motive or any tight he might have had to terrorist organizations like isis. another big story we're following right now. an hour ago, the verdict in the colorado shooting trial was red. james holmes was found guilty of first-degree murder for the shooting deaths of 12 people in a movie theater at a denver suburb nearly three years ago. james holmes stood in the courtroom silently as the verdict was announced. there are an additional 165 other charges. but the murder charges are key. they could lead to the death penalty. the same jury will decide the sentence. james holmes' defense attorney argued he was insane at the time of the shooting and unable to tell right from wrong. the jury rejected that claim. republican presidential candidate jeb bush made a visit to san francisco today. he visited a starbucks there and answered questions from reporters on a variety of topics. we're joined live from san francisco. what did you talk about today? >>reporter: we talked about a bunch of different topics. he came here. florida -- former florida governor jeb bush arrived here by uber. he walked in and for the offices of this business which is a company that connects people with contractors that can do jobs for them. after looking around, he did a town hall style discussion with staff as workers asked him questions on different topics like gay people in the workplace and pay for women and education. the workers there really appreciated him stopping here. this was not the companies idea. two weeks ago, they were called by the campaign and were asked if they would host the event. they said yes. and that gave them a chance to make the case. >> more businesses are being closed and then are being formed. people are working part-time rather than full-time. this is a time when we have to change how we go about it. i believe i have the leadership skills to make this transformation. i don't have an anger. i'm not motivated by anger. there are a lot of candidates that seem to be -- they are good at preying on people's angst and i have joy in my heart. i have believed that we are in the group -- in the verge of greatness again. >> jeb bush also mentioned his father, former president, who fell and broke a bone in his neck, is stable. >> i have a question. the issue in san francisco -- the sanctuary issue, did that come up? >> he kind of passover that when he was talking with the folks here. afterwards, he did talk to media. that issue came out. he said he felt that san francisco should be cooperating with federal officials with ice. otherwise, san francisco -- >> and another topic. equal -- it will pay for women and gay rights. did that come up? >> they did. workers here specifically asked about those issues. in both cases, he said that, yes, equal rights for gay people -- they should not be discriminated against in the workplace. and that women should be paid equally. but he felt that, it is either up to the states or there are laws in the books that should take care of those issues. >> live in san francisco covering the visit from jeb bush. thank you. we want to talk about a recent forecast. there could be much-needed rain coming to the drought stricken state. we're getting closer every week. and getting little update. still looking pretty strong. >> the story here is, temperatures are going about 3 degrees celsius above average. this time of year does not really impact us at all. if you go into the winter months, if that warm water gets sucked up with the winter, that makes it into the jetstream. >> as the days get shorter, the jetstream is brought down. that is november, december and el nino is still down here. the jetstream grabs that moisture it is like putting the storm on steroids or something. >> that is the one water. >> that is a warm water. this is the progression of months. this is the images. >> this is january, 2015. >> it is warmer. and that is getting hotter. and then looked at june. pretty solid signature right there. what does this mean? typically, el nino typically -- you won't see many hurricanes. but we are seeing a lot of this year. some experts think the hurricanes are a result of the warmer water. typically el nino will increase the wind down here. what is happening is the wind is not necessarily there but the warm water is. this is hurricane dolores. it will work its way in and factor into the forecast. this is what el nino want to do -- which is take the moisture from the tropics and send it north. when the jetstream drops down, it is game on. >> you don't know when that will be, right? >> in november, -- we assume it will be around there. >> so the story here is, -- these are not el nino occurrences here. but if this is moist and there is a lot of thunderstorm activity and it gets sucked in, it is game on. notice for the arrows are. i am pointing here. this is south. what i am getting at is -- we will come in a little bit closer here -- el nino has the potential to bring significant rain. mainly south of the bay area. so you can almost guarantee ridiculous amounts of rain here. but we are on this gray zone. >> we will either be super wet or just average? >> nothing really lined up to what we're talking about right now. what makes this year different compared to last year? >> this el nino is -- there were big el nino years. those were anomalies -- for this range. it is really about how much above average the surface temperature is. if it is a half degree above average, it is a weak el nino. we're coming up to about three or 3.7 degrees celsius above average. most of the scientists are saying that it will phase and with winter. so your question is, will we get there with the jetstream? yes. if we get to new -- november and december, and the el nino is present, we will. if it is too far out to the south, it will in endangered the point conception. >> we want that thing north of us. >> we will get some rain. >> they don't have the capacity to hold that like we do. >> will you be a crazy snow year? el nino means really what storms. >> so this el nino could be kind of a historical one in that, if it stays at that high level above average and reaches into the winter, it is game on for heavy rain. for at least the southern california. the question is, how far north will it go? >> we will check in with you in a little anthony, host of wall street week. it is on every sunday on our sister station. thanks for being here with us. >> thanks for having me. >> we have politics. >> since the financial crisis, we have seen way more governmental intervention in the market. not just the federal reserve. the bank of japan and the european central bank. so what governments have been doing around the world -- is intervening in markets. as an example, in china, since the latest stock market crash, they have manipulated things into the market to prop the markets up. we have not quite gotten that far here with our federal government. i do think politics matters because the next president will have to deal with tax reform, immigration reform. and will have to deal with the current regulatory rubric that all of of the corporations have to deal with. and we are overburdened with regulations. even the democrats believe that. i do believe the next president will be having those challenges. >> let's talk about investors, when they looked toward the next president. let's start with the gop. you have a jeb bush as one of the front runners. you have donald trump. donald trump is leading in the polls and in the favorability liking. that is out. what do investors think when they looked toward republican candidates? >> i think people like us who are super focused on the presidential campaign are probably worried about those things. but i would say that the average voter is not going to focus on the selection until one or two months prior to the election. when you see these guys jockeying right now, it is really a money thing for them. they have to raise enough money to get their messages out there. so mr. trump does not need the money. he certainly has a great ad for pr. i do think that donald trump will not be the republican nominee. if i had a guess, it would be one of three people. either jeb bush, marco rubio or governor scott walker from wisconsin. so one of those three guys on the republican side -- will be more reform oriented would be scott walker. i do think the post time is ending. i don't think it will be clinton or bush at this time. >> on the other side, democrats, hillary clinton -- you don't think so? >> no. i think she will get the nomination. >> and when? >> i don't think she will win -- what i think now is a reality check by the american electorate that they will need more reformat -- more structural reform to deal with entitlement. more reform as it relates to income and corporate taxes. my guess is that after eight years of the democratic administration, the republicans will have an opportunity here. the last time a democrat won after eight years -- was james buchanan in 1856. i am betting history here -- making the prediction that the republicans will likely win the presidency this time. >> finally, as we wrap this up, if i have a 401k and i am paying attention about things happening in this country and others, what should i be paying close attention too? should i be concerned? >> i would tell you that despite the noise in the marketplace, the greek country has the gdt of the city of dallas. i would not be overly concerned. i would keep myself on a long-term 10 up to 20 year investment. if you are younger, i would focus more on stocks and bonds. because that will be your ticket to the promised lands over a long period of some fog is back. temperatures are definitely warm. >> did you notice that today? >> i was inside. >> did you notice that it was a little warmer say? >> i did. at walnut creek. >> temperatures got up into the mid-and low 90s. fire danger came out because of the increased temperatures and lower humidity. as we move into the next couple of days, it will cool off. there is a live camera shot. beautiful downtown san jose. look at the air quality. i think that is mission peak. you can see pretty clearly from downtown san jose, that is a great indication of the air quality. there is that live camera shot of the fog coming in over the hills. we have fog out there. a lot going on in the pacific. i mentioned earlier, the hurricane delors as a category two. if that works its way north, it is going to feed into southern california and bring some significant rainfall there in the next three or four days. we will be tracking that. it could bring a thundershower to the southern district. the fog off the coast here. a little break. let's come in a little bit closer. a little break pacific. soggy across 19. moving up to the marina district, you have fog. you see the fog working its way across the bay. the hottest day of the week, -- tomorrow should be a degree or two cooler. we will still see some low 90s out there. just a degree or two cooler. a little bit more of a seabreeze tomorrow. eighty-four at walnut creek. mild and warm weather. i socket of this last night. you have low-pressure waiting to drop down as we go through the next couple of days. that will cool things a little bit. but they are not backing out. it was really cool last week. this week, the highs have moved up a little bit. inland temperatures, let's take a look. dolores is a category two right now. this is the pathway. category one as we go into tomorrow. saturday it turns into a tropical storm. sunday, it it turns into just a tropical depression. look where it is. the flow here -- that is the point of conception right here -- the flow want to take a lot of this moisture and go like this. it is going to be south of the district most likely. if it occurs, we will get some big-time rain in southern california. it is a big deal. we will be tracking that. these are the forecast highs. ninety-one in pittsburgh. ninety-two in brentwood. and think about -- santa clara valley, here. >> and under way. a police officer on routine patrol spotted a mazda suv around 2:30 a.m. this morning. he found a man inside the car who had been shot. the man was taken to the hospital where he died. investigators say they don't know what prompted the shooting. no arrests have been made. state and water officials have issued their first assist order. the state and water board order the west side irrigation district to stop pumping water. the board says that the inspectors -- there was no right to access the water. the district can appeal. it is found to be in violation, it faces a fine of up to $10,000 a day. uber is being ordered to pay more than $7 million in fines and could lose its operating license in california. this is for not giving the state public utilities commission information it ask for. the state says uber was last two years ago to turn over information about wheelchair accessible vehicles. uber says it has already provided substantial amounts of data and is sharing more information -- and sharing more could jeopardize the privacy of riders and drivers. uber plans to appeal. the audi won nba championship. bringing home two trophies. we will tell you about not one, but the two honors received last night. one of the things everybody is talking about on social media. and people still texting and driving. coming up up, we are taking time to examine this great rides. california has been cracking down on drivers using their cell phone behind the wheel. despite new laws and even the financial penalties, more and more people are talking and texting while driving. we're taking four minutes at 4:00 to examine this trend and ask the questions, what possibly can be done? >> joining us now is a chp officer daniel hill. is a big problem. many of us are guilty of it. >> let's get right to the numbers. the survey of office and traffic found that 39% increase in the percentage of drivers seeing you mean -- using their cell phones while driving. >> 39%. >> if we break it down further, that is 9.2% of drivers this year spotted using their phones while driving come here to 6.6% last year. this is the highest level -- if we go back to 2012, that was 10.8%. what is going on? >> you have to realize that as we integrate these cell phones into our lives -- everybody has a smart phone. everybody wants to stay in touch and communicate. people are driven by social media. they want to make sure everyone is up-to-date with everything. picking up that cell phone behind the wheel -- people don't realize that driving is a really complex task. it is easy in our heads. because it does not take much as far as concentration for the drive. but what you don't realize is that every millisecond things are changing all around you. when your focus is off of the wheel and off of what is in front of you, you don't know what will happen. >> in april, it was a distracted driving awareness month. we did a story with chp. you guys put me behind the wheel of a car. i had a phone and it started texting. i want to show the viewers a quick clip of what i experienced. >> round two, same scenario with a twist. this officer put in a surprise. tossing in a cone that i never saw. >> you did not even see the call. >> i did not even see the calm. >> the next round, another flying cone. >> that time, i did see the call and -- collin -- the cone. >> that could have been a child. instead of an orange cone. >> . >> one of the reasons i want to show that again is because here we are three months later and i ask myself this -- how have i then sent experiencing that? i will be honest. i have picked up the phone. i have also thought about that story and i have not texted. it is easy to get into the routine again. here i am hitting cones unfortunately, it takes an instance -- like a ticket or an accident -- for people to change. >> it is sad that we have to get to the point where there has to be a penalty or somebody injured or killed before we realize how serious this is. that is why we are trying to advocate the and -- the educational portion of this. it is about realizing that every second you have a cell phone in your hand, it takes your attention away from the road. that is somebody's child or your child. it is somebody's son, child, mother or father. it does not make sense for us to do this. we have the campaign of -- it can wait. it is all over the place. at&t is really scary about -- serious about this as well. everyone needs to step up and realize that it has to wait. it is not just that it can't wait. it has to wait. we can't pick up the cell phone anymore. if you do, you might run over somebody. you might crash your car. it is nothing in comparison to if you killed someone. >> and about personal accountability -- each individual driver saying they will no longer do it -- we show the stories of people who die. and teenagers who die because they posted something on facebook while they were driving. so it sounds like personal accountability. with more laws help? was more legislation help? >> it is not going to help per se. it will really change the mindset of the public. we know there are penalties out there. everybody knows they should not do it. it is so easy to do it in our heads. what really needs to change is the paradigm shift. we need to stop moving so quickly in our culture. we need to realize that we can wait a second before we answer the text message. or pull over to the shoulder if we need to use the map. we have to think about it -- in that we have to slow down and convince each other that it is not that important. >> remember officer, when nobody put on their seatbelts. when i was growing up. and the fines and that going up more. the thing was drunk driving. the fines and penalties are more. don't you agree that lawmakers -- like if it was a $1000 fine to text, it would help? >> the first offenses about $160 at minimum. >> is that including the core cost? >> that does go up. >> so a couple hundred dollars. >> maybe it should be more high. >> we have to hold lawmakers accountable and try to pass them. >> for a dui, we have seen a reduction in that for the most part because the fines and penalties are so stiff. you lose your license. you get a $10,000 fine. and your insurance increases. the problem is that, people are -- it is a small fine. it is an infraction. people can pay it and move on. it does not at a point to your record. it has to be a combination of things. you are right. if we have a stiffer penalty and increased enforcement, that will change half of it. the other half has to be the education part. the highway patrol is serious about getting in front of this and saying, this is dangerous. you should not do it. these are the reasons why. showing a voters in san francisco will get to decide -- proponents a home shares are unregulated and makes scarce housing even harder to find in san francisco. others say the measure will hurt tourism and the economy. joining us to discuss this is gail carson, the man behind it, with sure better sf. thank you for being here. >> i want to get to the board of supervisors meeting and what happened there. we will talk about the amendment. they passed the amendment on the short term home and room rental. the nine-day cap front posted rentals as well as the office of short term rental administration enforcement that was created. your thoughts on what happened inside the chambers tuesday. >> the 90 day cap on hosted rentals was already in place. the problem is, it is 365 days if you are there. and 90 days if you are not. how should the city determine whether or not a host is sleeping in their own bed at night? the short term rental administration office was created by the mayor. really, the amendment the the board passed on tuesday -- >> there was a more strict one that did not go. so they will live a more lenient one. >> there were two more strict proposals. one was a 120 day limit across the board. the other was a 60 day limit with some requirements. >> so as you gathered 16,000 signatures, you get something on the november ballot -- talk about what it is. >> it is intended to curb the runaway use of residential units as tourist accommodations. airbnb is the biggest player in san francisco with about half the market. it has between five and 6000 listings every month. and 60% of those hour entire unit. they are not home sharing. they are not people renting extra rooms. they are entire units that are available every night of the year. there are 60 other websites that offer residential residence to tourists. between them, there are another 4000 units. it is having an impact on the availability and affordability of housing. it is a having a dramatic impact on neighborhoods. >> i saw the senator -- and the former mayor of san francisco saying -- they are not talking about the ballot measure but the amendment -- but saying that the law will destroy the integrity of zoning dropped in for this go allowing commercial and hotel use in residential areas throughout the city. >> the airbnb law that the board has passed -- that they rezone every residential neighborhood in the city to allow unlimited hotel use. >> so the supervisors -- we went out to city hall today to ask their take on the ballot measure. this is what they had to say. >> from my perspective, it is exactly the wrong approach for this measure. the problem with the ballot is that if it is approved, if you need to change in the wording or a -- anything, you have to go back to the voters of san francisco to change legislation. we, as the government, are learning and adapting to had a regulate these companies and an effective manner. we will have to you use this time and time again. if you look at what we did with the board of supervisors, we amended legislation that we passed nine months ago. >> i consider him a friend but we happen to disagree on this issue. i don't think anything the board has done so far will bring in the illegal conversion of the residence -- residential units or the hotel rooms. the ballot measure does that. the ballot measure says, if you are going to do short-term rentals in your home or extra room, fine, no problem. go ahead and do that. for a limited number of days. but you have to be registered. you have to be licensed. and if you are not, the hosting platform cannot list your unit. we have only had 700 people register in san francisco. there are 6000 units on airbnb alone. if airbnb is going to list on listed units on registered -- unregistered units, they should be sanctioned for that. imagine if uber had unlicensed drivers with unregistered vehicles on the uber platform. it would be fined a lot more than that. >> not much time before the election. will you be out on the streets and knocking on doors? >> yes. and the mass media. >> thanks for coming in. >> thanks for having me. we will send it back over to bill nino, i am fascinated by it. but i am also a little worried. should we be concerned? >> i would not be worried about that. >> with the flooding? >> it is probably not one storm. it is a series of storms. it is more of a climatic shifts a little bit. i would not be worried. but what most people worry about is, the heavy rain -- and getting some mudslides. >> it is all stuff we will have a warning with. not like an earthquake. >> you are fine. >> outside, there is the fog. you can see that around san francisco. it is around tomorrow. there is another live shot. here is a satellite image. you can see dolores is here. this one is falling apart. it is a very active pacific, i have to say. some experts are planning to this being the el nino center. usually el nino does not contribute to hurricanes. but some are suspecting with the warmer water here, it is creating more tropical action. and you see dolores -- watch this moisture -- it wants to stream into this area. all of this rain has been going though the desert southwest into el paso and into kentucky the other day. we're seeing a lot of effects that some experts are saying that could be el nino related. but the shark attacks, not el nino related. just so you know. it does not mean one big storm. it is a climatic shifts. we will talk more about that. here is the fog right now. you can see that. there is 19 avenue. my kids go to school right over here. >> yes. >> the fog is in that shot. it is across and moving into san francisco. plenty of fog and low clouds around tomorrow morning. the current temperatures are where they were yesterday. tomorrow, the highs will be around here. tomorrow will be slightly cooler. but not much cooler. and more significant cooling as we get toward the bay area saturday and sunday. more clouds. so this pattern -- there are no fires. there might be one. we do not see one. we have not done a fire in the news all week, which is a good sign. this pattern is relatively mild for this time of year. i have been around in july and august a lot. and it is fire city. you can get fires with temperatures like that here. those are 100. the warmest areas will be in the '90s. even upper 90s. let's get to the five day. it will be a nice-looking day tomorrow. slightly cooler for the bay area. >> i went to the only high school in the bay area where we have long a look in today's money business. >> how do you land that really cool job? apple, twitter, instagram, facebook, thousands of resumes from around the world. how do you stands out in the crowd? we will look for some of the answers to that. i think what is really need is that you talked directly to the people at these companies. google, twitter, the ones you are doing the hiring. the ones we want to get to if we're looking for a job. there are three things that you really should consider. number one, who do you know? so it is not just, send your resume work get a referral. >> if you get a referral from an employee, that automatically puts you in a special category. and fax, employers are not super forthcoming about this. but about 30 up to 50% -- are employees referred by people who work here. >> that makes sense. number two, you have your parents -- -- at the appearance of your resume. >> i think the lesson is to go in and be prepared. be brief. address the questions. be professional. as far as a resume goes, same thing -- i had one recruiter that the -- it is not that i saw your resume and hated it -- the point is to follow-up. >> don't just give up. don't just assume, i had a great resume. and had a great interview. follow-up. >> my mom would say, the squeaky wheel gets the grease. you don't have anything to lose. if i could give one encouraging words to a job seeker, i would say to put yourself out there. it is not about you. the recruiter being busy -- it is not that you are not capable. >> so they don't get annoyed. if you call or e-mail. >> if they want passionate, engaged and committed people, then they are probably willing to forgive some of the qualifications for the other competencies. >> before we go -- i know you said it is a two a straight. just because it sounds cool to work at google, twitter or instagram -- it might not be the best fit for you. so as a job seeker, look at what is a good fit for you. >> yes. it is almost like dating. like i like you so much -- and you don't like me but i keep pushing. like i will go out with you even if i don't like you. if it is not good for you and i know you will not be a good fit because of your emotional stuff or you are not a team player, i'm doing you a favor. >> it might not be the right corporate environment for you. maybe not what you are looking for as far as flexibility or the size of the company. >> there is a difference between desperation and -- you really want to get in front of the right person. >> you have really great advice and more tips on president. president obama today brought his calls for reforms to the criminal justice system to a prison in oklahoma. the first sitting president to visit a federal lock up. the visit to el reno federal correctional institution was part of the push for reduced sentences to non-violent offenders. he wants to make it easier to turn their lives around. president obama met with six inmates. he described them as young people who made mistakes who aren't that different from many he and other americans have made. [ indiscernible ] >> second chances, the resources that would allow them to survive. >> president obama was clear on making a distinction between non-violent drug offenders and violent criminals. >> the visit comes days affhe granted -- after he granted clemency to some offenders. he said their punishments didn't fit the crime. frank and julie now. >> thank you. tonight the search for a motive after a shooting at two military centers in chattanooga, tennessee. four marines were killed and we are learning about the gunman who is also dead. >> ktvu fox 2 news at 5:00 p.m. starts now. >> tonight law enforcement officers surrounded and swarmed the home of the gunman. sheer what we know right -- here is what we know right now. he is 24 years old, born in kuwait. there were two targets. the first was this morning at favorable reserve center the second was at naval operation support center where four marines were killed. ken pritchett is in the news room. what have you found out? >> the fbi identified the gunman as muhammad youssef abdulazeez. this is a photo of muhammad youssef abdulazeez who was born in kuwait and it is not clear if he is a kuwaiti or u.s. citizen. some reports say she a naturalized u.s. citizen. the shooting took place in chattanooga, tennessee. the glass door shows multiple rounds fired in what one witness described as a rapid release of gunfire. he then drove to naval operation support center where the four marines were shot and killed before the suspect was shot and killed. chattanooga police were in pursuit of the suspect. the fbi says it is investigating the motive. the u.s. attorney's office is classifying it as terrorism. >> this is a sad day for the united states. these service members serve their country with pride and they have been the victims of these shootings. >> reporter: the suspect lived in the town of hickson which is across the tennessee river from chattanooga. investigators swarmed his home in the search for what was behind the shooting spree. president obama was speaking for the american people and offering families of the four marines the nation's deepest condolences. >> it is a heart breaking circumstance for these individuals who have served our country to be killed in this passion. >> reporter: in addition to the four marines killed a recruiter and a chattanooga police officer were wounded. that police officer was shot in the ankle. >> are all indications right now that the suspect here acted on his own or is there indication other people were
