just moved to san francisco too. a southern california state senator plans to introduce a bill on notifications to i.c.e. the measure by republican jeff stone will require law enforcement it to notify i.c.e. of any convicted felons in custody who are also undocumented immigrants. it would also allow a 48 hour hold to decide if they want to pick up the individual. if i.c.e. declines, the person could be released. new developments for the ransom case originally declared a hoax by police. four months later, it turned out it did happen. tonight, they are vindicated. one suspect is in jail and others are still on the loose. how a dropped cell phone helped investigators connect the dots. julie this 50 page complaint reads like a movie script. the suspect admits to an elaborate movie scheme. 38-year-old matthew mueller is the man in custody, in connection with huskins' abduction. a three man team, invading the couple's home, tieing them up, and drugging them, before taking huskins for ransom. >> we were not able to substantiate any of the things they were saying. >> reporter: they declared it a hoax, especially when huskins turned up unharmed. >> what i would classify as a wild goose chase. >> reporter: they might still be saying that, but for a home invasion. the couple fought the suspect off and he ran. >> he left a trail behind that we followed. >> reporter: mueller left his cell phone behind, and dublin police tracked him to lake tahoe. >> once you put all the pieces of the puzzle together, it came out pretty good. it all added up to him. >> it's not a hoax. it's what happens to two human beings. >> reporter: they had no connection to the suspect, other than living on muir island, that's where he boasts of running a car theft ring in an abandoned warehouse. mueller is an educated lawyer, who sent angry letters telling police to believe the letter. not to discredit them. >> we're going to look at his mental history, and his mental illness and see if and how that impacted his life in the last several years. >> we firmly believe there are other people involved. we want to see these people off the street too. >> reporter: their attorneys say they stayed together through the scrutiny and shame. >> what i want for vallejo police to do is to do their job. >> reporter: vallejo cops they say rushed to judgment, and missed basic questions. >> what is the motive? why would mr. quinn purportedly try to ask for a ransom for himself, which makes no sense whatsoever. >> reporter: quinn and huskins were silent throughout. they don't want to jeopardize the case against mueller. asked about selling their story, they say no, the two physical therapists just want to restore their reputation and get on with their lives. >> so no word at all about they say they are looking for other individuals as to how many individuals, or what kind of people they're looking for? >> it appears there were two other individuals in the house that night. we haven't been given anity tails about them as of yet. but there was evidence found in connection with the dublin case that led them it to vallejo. such things as some goggles that denise huskins was forced to wear. >> still a lot to unfold here in this case. debora, thanks very much. the search is over now for the father of a missing baby in shasta county. the county sheriff's department confirmed that matthew graham was shot and killed this morning during a carjacking and police chase that ended in dunsmuir. police think she is now dead. last friday night, someone found a pacifier similar to baby embers on the side of the freeway about 10 miles from the family home. matthew graham disappeared the next day. authorities say he stole a semi automatic gun from his mother after hearing the search for his daughter had turned up a possible lead. >> i do not believe that baby ember graham is alive. if the baby had been left out in the elements, it's been approximately two weeks, and the baby would have been without food or water, with temperatures in excess of 100 degrees. >> a husband and wife from shasta lake told police they were carjacked by matthew graham at gunpoint at their home. police chased it to dunsmuir where the suspect was shot and killed. the sheriff's department says it will release more information on this case tomorrow. in oakland, two people are in custody tonight after leading police on a brief chase. officers spotted a stolen car at the intersection of fleming avenue and raw street. when they tried to pull the car over, they say the driver took off. the officers followed, and the suspects eventually got out of the car and ran. both men were taken into custody near 66th avenue and leona creek. a class action lawsuit against major league baseball saying the league doesn't do enough to protect fans. the fan is a mother who says she fears from the safety of her family from foul balls and fragments of broken bats. the lawsuit comes after an incident last month when a fan was hit in the head by a bat at fenway park. in a statement, an mlb spokesman told the times fan safety is the league's foremost goal. that statement reads in part, fan safety is our foremost goal for all who choose to visit our ballparks. major league baseball is in the process of reevaluating all issues pertaining to fan safety, comfort, and expectations. new at 10:00, a big announcement in the south bay today where the president of san jose state university announced he is leaving to take a position as a an adviser to a global leader. ktvu's maureen naylor live with the role he is pursuing. frank, san jose is looking for a new leader after the president announced he was quitting. after four years on the job to now become an adviser to the president of afghanistan. on campus this evening, the winds of change are blowing. students received this email from president mohammed kayumi announcing he is leaving to become an adviser for the afghanistan president. a native of afghanistan, he said in a statement since 2002, i have often been asked to lend my intellectual expertise to many of the significant educational and infrastructure challenges. the president has asked for my immediate assistance, and leadership in numerous infrastructureinitiatives. >> his contributions in afghanistan will be tremendous, this is exactly the kind of talent that afghanistan needs. >> saying after decades of turmoil, the country is in need of stability, and says he has made history as an afghan american. >> no afghan has ever been president of an american university. so that in itself is quite an accomplishment. >> reporter: but the leader has encountered criticism during his time at san jose state, including how he and the administration handled a 2013 hat crime, involving an african american student. >> our decision making failed. i failed that student. >> reporter: san jose's mayor says he got a call from kayumi. >> he has been working very collaboratively with many of our leaders talking about how we can create a pipeline, for example of talented young leaders in the city. >> reporter: today, the head of the system praised him for 29 years in the csu system. adding we are also thrilled he has been given this unique opportunity to contribute to infrastructure projects that will improve the quality of life and prosperity of the people of lanes tonight. they're making changes amid concerns about safety. ktvu's heather holmes is live now in the city with the adjustments being made right now. >> reporter: caltrans crews arrived here just a short time ago. they are closing lanes to do some restriping work. officials tell me after this roadway opened for the first time last night, it became clear that improvements were needed. out with the old. in with the new. it was the first full day of the new version of doyle drive. the $1.1 billion presidio parkway. the main route to and from the golden gate bridge, and drivers are adjusting. >> i missed my exit, because the signage is in the wrong spot, and the other three people in my office did the same thing. >> reporter: also adjusting, project managers after the lead architect noticed a potential safety problem for those heading into san francisco. >> there's an adjustment in lanes that you've got to make too suddenly, because you've been sailing along on relatively gentle curves and suddenly there's this little wobble that comes in. >> reporter: concerned drivers speeding might be caught offguard by the lane alignment. >> which perhaps wasn't reviewed as well as it should have been. >> reporter: it caught sydney by surprise. >> it's not ideal, but i'm sure they'll work the kinks out. >> reporter: that's what caltrans officials say they're doing. >> there's still a lot of work that needs to be done. >> reporter: stressing the striping is temporary. >> going to be in the final configuration. a smooth transition. >> reporter: caltran says if drivers obey the 35 mile-per- hour speed limit, they shouldn't have a problem. after all, it offers a brands new driving spears. >> i think it's going to be a great thing, once i get the hang of it. >> reporter: once everyone gets the hang of it. officials urging drivers to take it slow. this roadway has a new look, a new feel. they also caution drivers to the to be distracted by the great views of the bay. >> the views are incredible. also heather, caltrains, are they saying when everything is expected to be complete? any timetable for the finished product? >> reporter: you heard him mention the retaining walls. also landscaping. all of that is expected to take about a year. drivers should treat this like a construction zone. that there are going to be changes or adjustments again until all of that work is complete in about a year. >> remember that 35 mile-per- hour speed limit. frightening moments for bank employees and customers in felton, when an armed robber forced them inside a vault. these are pictures of the suspect. they were posted on the facebook page for the santa cruz county sheriff's department. authorities say four employees and two customers were inside liberty bank on highway 9 around 1:30 when a man came in and demanded cash. the robber took the money, and ordered six people to get into the vault. he then took off behind the bank toward graham hill road, and felton covered bridge county park. as of right now, he is still at large. police in san francisco are asking for the public's help tonight in finding a missing man who is considered at risk. the 78-year-old was last seen late last night. his family is concerned because he didn't have his required medication with him. he only speaks cantonese, and likes to frequent the city's chinatown area. he is described as asian, about 5'7", and weighs about 140 pounds with brown eyes. a huge festival is bringing children from all over the world to the east bay this week. hundreds of children are here for an international youth choir festival. new at 10:00, amber lee with tonight's kickoff at the scottish wright temple in oakland. >> reporter: dressed in cultural attire, each floral group carries the flag of their country. a display of pride, and camaraderie with other young singers. a series of concerts and competition. during rehearsal, the group from austria displayed its ability to perform the unexpected. a song from bali about the monkey king. a departure from traditional choir movements. >> it feels amazing, because you are so in the piece of music. >> reporter: the austrian team won second place. >> more relaxing in school. we can not think about school when we sink. >> reporter: there are more than 650 young singers here from eight countries, and also of them are being hosted by the families of the local students. >> you really get to know everyone. i really like getting to know the different choirs. >> reporter: the piedmont east bay children's choir is hosting the event. the festival is held once every three years. it brings together students ages 8 to 18 from countries, including finland, china, and canada. each showing off their strength whether it be in classical, gospel, or contemporary music. >> i'm using all my body, so it's kind of like working out, but with voice. >> reporter: learning about other cultures and sharing their own through music. >> bridges are made from different countries that hopefully have some impact on the future of the world. >> reporter: that hopefully will last a lifetime. in oakland, amber lee, ktvu, fox 2 news. tracking some fog trying to move in through the city. there it is, back for the first time in a couple of days anyway. there's been patchy fog, but now it's coming back with a little more push. bay bridge, san francisco, fog, some stars. a beautiful night out there. the fog along the coast is going to fill in tonight. we're going to see a little more of that. there's a few high clouds overhead, and they're just moving through. temperatures are going to warm a little bit. like today, they warmed a few degrees over yesterday. tomorrow, they'll warm another couple degrees. so we might see mid-80s. by wednesday, we'll see temperatures even warmer than that. so there's the outline. a little bit of fog along the coast. come in closer, and we'll take a look at the current temperatures. lots of 60s. it's not a big push. look at san francisco at the airport. 67degrees right now. you know the fog is there, we're not seeing this massive influx of the fog. still up 70s around fairfield and up into the sacramento area. tomorrow, starting off kind of warm. patchy fog in the morning. burning off quick, and temperatures tomorrow, i don't know. out in clayton, martinez, you're in the mid-80s. down south towards morgan hill. upper 80s. might see a 90 tomorrow. warmer tomorrow, then more warming as we head into the next couple of days. that will certainly increase the fire danger. so tomorrow is nudist camp in los gatos today. they could face up to three years in jail if convicted. >> reporter: at a time when california is entering its fourth year of record breaking drought, prosecutors say they want to use the case against nudist camp lippen lodge as an example. >> i think the message is for anybody. if we're in a severe drought, if you need water you need to take the appropriate steps to obtain that. >> reporter: the owners did not enter a plea. they're charged with felony conspiracy, and trespass, accused of diverting water for three months last year from nearby henry's creek. it's owned by the mid-peninsula regional open space district. >> this is at multiple times trespass to divert water. they were told not to take water from henry's creek. >> reporter: prosecutors say the couple removed water lines, and have pictures of workers installing pipes for private use. the alleged theft hurting wildlife and the public since the water ends up in the nearly empty reservoir. >> henry's creek went dry as it crossed into the lupen lodge property. >> reporter: the couple declined to comment about have reportedly said they long use the creek to keep their water tank full, not to mention for topping off their skinny dipping poolment they admitted to diverting five gallons per minute, but they do not have an compact total of how much was taken. >> reporter: two employees are facing the same charges. as for the camp, it remains open, in fact, they're celebrating 80 years of body acceptance and freedom next month. in san jose. azenith smith, ktvu, fox 2 news. californians who stop watering their lawns now can't be fined for letting the grass turn brown. previously, he signed a bill that bars homeowner associations from doing the same thing. a show of support today for thousands of athletes competing in the special olympics. >> a big jump in gas prices. but only here in california. now one lawmaker says it's time for the state to take action. if you bought gas in the last few days, you've seen it, a sudden spike in prices. ktvu's ken pritchett is live in emeryville with more on the surge and two suggestions for some relief. >> reporter: gasoline for regular at this station is $3.59 a gallon. in the past week, we've seen price increases from 20 cents to more than 50 cents a gallon at various locations throughout california. down in los angeles, a gallon of regular will cost you more than $4 a gallon. the price of gas can spike and you'll get different reactions. >> i have not noticed, but i knew it always happens every summer. there's no surprise. >> reporter: but a double-digit jump in the price is something regular motorists cannot ignore. >> there's a fluctuation from $3.06, to $3.70, depending where you are in the bay area. >> reporter: irritating for some for state senator ted gains, it's a crisis for families. >> i sent a letter to the governor asking that he stop the requirement of a summer blend in our gasoline here in california. import gas from other states that we can provide some relief. >> reporter: california uses a special blend of gasoline in the summer months that is harder to produce, and often results in price increases. but with the uc energy institute of business says this is not a normal price increase like we've seen in the past. >> this is really an unprecedented price spike. i think it calls for more investigation into why we're not seeing the normal relief valve. >> reporter: the call by senator gains to suspend the summer blend would not please environmentalists concerned with air quality. drivers we talked to had mixed opinions. >> i think what's good for the environment is important, but i also think there needs to be a balance between what is fair for the citizens. >> i think whatever can be done right now to assist the consumer would be a benefit. >> i'd say, let's stay with what we have, if it's protecting our environment. >> reporter: to give you an idea just how much, and how fast gas prices have gone up here in california, the average price for a gallon of gas in california last thursday was $3.43. it has gone up nearly 29 cents since last thursday. it is unclear when the prices here in california will go back down to a place more in line with the rest of the country. in emeryville, ken pritchett, ktvu, fox 2 news. new york city today agreed to pay $5.9 million to the family of eric garner. he's the man who died after a police officer put him in a choke-hold. garner's death became the focus of national outrage after a video surfaced of police choking him as they tried to arrest him outside a convenience store. they suspected him of illegally selling cigarettes. garner had asthma, and repeatedly told officers he couldn't breathe. details of another settlement which had medical personnel respond to the scene have not been made public. ashton carter told the pentagon today to get ready for transgendered personnel. carter ordered a group to spend 6 months to study the implications. he also said all decisions to dismiss citizens with gender dysphoria would be handled by an under secretary of defense. there are 15,000 transgender troops currently serving in the military. the boy scouts of america today announced gays would be allowed to serve as scout leaders. they have adopted a resolution that amends the policy. it allows charter organizations to select adult leaders without regard to sexual orientation. the national executive board will meet to ratify the resolution on july 27. the special olympics torch run made its way through california today on the way to the world games in los angeles later this month. >> ktvu's ken wayne shows us how the athletes were met by an adoring crowd in petaluma. >> reporter: it was a welcome fit for champions. dozens of special olympics athletes were given a police escort, and passed through flag waving supporters. >> pretty fast. >> did you win? >> uh-huh. >> do you have some gold medals? >> yeah. >> reporter: they wound through sonoma, santa rosa, and finally petaluma. there is a special bond between the athletes and law enforcement. >> this is my 25th year in law enforcement, and this is probably the most rewarding thing i've ever done. >> reporter: the special olympics is now in its 43rd year. supporters say it's become the most successful fundraising campaign in american history. with half a billion dollars raised since it began in 1981. >> we've been connected for at least two decades involved in the torch run. the collaboration we have is very unique. >> reporter: as for the athletes, it's a chance for them to shine in activities they northerlialy wouldn't be able -- normally wouldn't be able to participate in. >> i participated in the national games in princeton, new jersey, and i became a national champion in running long jump. >> it's confidence building. it's focus. it's so much. it's not just about the sport, or the athletics part of it. it's about the whole body and with confidence, it's wonderful. >> from here, the athletes head to san rafael, and san francisco. and eventually, they'll end up in los angeles for the >> the judge is hearing the trial without a jury and the case could be precedent setting. wisconsin governor scott walker joined a corroded field today becoming the 15th candidate seeking the national attention in 2011 when he led a successful campaign against public sector unions. he promised to make his anti- union stance a centerpiece of his election strategy. the first debate for candidates is set for august 6. one of two brothers convicted for assaulting two men in a bathroom at levi stadium last year, will spend the next five years in state prison. this is cell phone video of that fight taken by a witness. it shows them attacking two other men. amador was sentenced to two felony counts of assault, likely to cause great bodily injury stemming from that fight last october 5. he pleaded guilty last month to the assault. dario's trial is set for august 31. a warm up in the works. the temperatures chief meteorologist bill martin is tracking in his complete bay area forecast. >> up first, fighting fires when drones show up. the growing danger in the air. cal fire says there have been four recent incidents where it's had to ground its planes and helicopters because of people flying drones. ktvu's john sasaki shows us the danger of drones when crews are battling a fast moving fire. >> reporter: along highway 4 in concord, five small fires broke out next to the roadway. >> could have been someone dragging a chain down the freeway, or brakes or exhaust. >> reporter: he says firefighters knocked down these firefighters quickly enough that air support was called off. but on big fires, there's nothing like help from above. >> invaluable to us. they can drop retardant, and that doesn't put out the fire, but it will hold it in check until our ground resources can get in there and actually control it. >> reporter: that's why drones flown by people who want to shoot fire video are becoming so problematic. this is drone video shot by a viewer that damaged five homes. a drone in the air can cause serious trouble for the airborne firefighters. >> there's a drone in there, and it causes a mid-air collision, it causes damage to the aircraft, which would cause it to be grounded, or worse, it can cause mid-air collision and cause that air tanker to actually crash. >> reporter: so on big fires, the faa will order a temporary flight restriction, keeping other aircraft out of the area, and any pilot that strays too close will be ordered out. >> so drones of course, no communication there. that means we have to shut down our aerial fire fighting efforts. >> they are flying a drone. that means the fire is going to get bigger. there's a bigger threat to life and property. threat to our fire pilots, which is not good. >> reporter: using my own drone, cal fire is so serious about this issue, this week, they're shooting a public service announcement to remind everyone during a wildfire, you should leave your drone on the ground. there has been an outpour in support of the victims of that fire in san jose that john mentioned in that report. rego rangel's family lost their home and a lot of soccer gear and also trophies that belonged to a team that played in the soccer league. a gofundme account has also been set up. tracking your temperatures from today. they're a little bit warmer than yesterday, and they'll continue to warm a big warming trend as we go toward the middle of the week. winds are breezy, but not unusual. sfo was gusting earlier to 35. now they're 28. so the plan here is for this low pressure center to get nudged a little bit to the north by this guy. it's just subtle stuff. this is a weak high. a weak low. that's why we're going to see temperatures tomorrow just slightly warmer, as we head into your bay area wednesday, slightly warmer still, and thursday, slightly warmer still. here is the fog forecast for the morning. pretty good push. i think we'll see it around the bay. it burns off quickly as you see here. and here come the reds. as we get to a more typical pattern for this time of the year. it's been unusual. that low sitting offshore. remember all the thunder showers last week, and before that around lake tahoe, sprinkles around here. the drizzle. the pattern has gone back to a more typical pattern. with that in mind, 89 in clear lake. wednesday's numbers will be, these are tuesday's in antioch. thursday, maybe 95. 79 in sunnyvale tomorrow. stinson beach has had insane weather the last few days considering the time of year we're dealing with. patchy drizzle tomorrow morning. temperatures want to peak on thursday, might see mid-90s. there's the five-day forecast with the bay area in crew. i think the story will be towards the middle of the week, the fire danger cincinnati, that's todd frazier. they call him the todd-father. get this, he was down by seven home runs with 1:30 left. he came on strong and won it right there. 15-14. the local fans loving that. probably going to be the highlight of the year for cincinnati red fans. he actually credits the crowd with helping pump him up to win it. >> hearing the crowd roar, call my name, adrenalin. those last workout in. sonny gray on hand for the a's. the giants have madison bumgarner, buster. on the infield, joe panik, and brandon crawford giving the giants one of the best double play combos in all of
