were a victim of a violent crime and faced public humiliation afterwards. >> reporter: they walked hand and hand to the press conference. they didn't speak and at one point denise huskins fought back tears but they feel vindicated. >> todayed is a terrific day for them. -- today is a terrific day for them. doesn't mean they didn't suffer the ordeal, this changes nothing about the humiliation, the violence. >> reporter: denise huskins was kidnapped march 23. she told police she and her boyfriend had been tied up. and the kidnappers dropped her off at her parent's home in southern california. vallejo police believed her story was fake. that was last we heard about the case till this morning. the fbi unsealed an affidavit for the rest of matthew muller. he is a former marine and lawyer. the fbi says he was involved in a home invasion robbery last month and he broke into the house and tied up the couple inside and got away before police arrived. investigators say matthew muller left his cell phone in the house. >> he left a trail behind that we followed. >> reporter: investigators tracked him down to his home. he says he was the one who broke down matthew muller's door to arrest him. >> he wasn't surprised. i think he knew we were coming. it was a matter of time. >> reporter: during a search after the arrest, investigators found evidence that he was connected to the vallejo kidnapping. one of the pieces of evidence were goggles that the affidavit says was used during the kidnapping of denise huskins and they still had blond hair, denise huskins' hair still attached to them. mese are not commenting -- police are not commenting on the case. back to you. >> interesting to see denise huskins at the press conference. pretty emotional press conference for her. >> reporter: we weren't expecting to see her there. we talked to the attorneys there, they said we will be speaking at 3:30 p.m. but they made no mention they would be there. so it came as a surprise. >> allie rasmus in vallejo, thank you. new at 6:00 p.m. we are hearing from the parents of kathryn steinle who was shot and killed at the beginning of the month. they spoke today with bill o'reilly. ktvu's claudine wong joins us now from the new room with what they talked about. >> reporter: kathryn steinle's parents came on to talk about their daughter and what they want to happen next. her father says what happened was evil but says goodness trumps evil. kathryn steinle was killed july 1 in san francisco. >> she was not only beautiful but a very soulful person. a lot of depth. a lot of spiritualality. that is helping to give us the strength that we have conjured up here. i feel her strength still with me. >> the man arrested for her shooting caused controversy over immigration policies policies and san francisco's sanctuary law. he started a petition that would impose a 5 year sentence on illegal immigrants who were deported and come back to the u.s. >> i support kate's law because it would be a legacy in her name and her death would not go unnoticed. we keep up with politics because we are citizens of the united states and we feel the federal state and city's, their laws here to protect us but we feel that this particular set of circumstances and the people involved, the different agencies let us down and we just -- we are tired of the finger pointing and want to see action and if kate's law saves one person it is all for good. >> reporter: much debate ahead over the law. they do want to be involved. so there is a sense of kate within the law. >> sad, sad story. thank you. it is believed the father of a missing baby was shot and killed today during a carjacking and police chase. matthew ryan graham was killed by sheriff's deputies at 7:45 a.m. this morning. his daughter disappeared july 2 from her home and now police fear she is dead. on friday night someone found a pacifier similar to the baby's on the side of a freeway 10 miles from the family home. matthew ryan graham disappeared the next day. authorities say he stole a gun from his mother after hearing the search for his daughter turned up a possible lead. >> i do not believe the baby is alive. if the baby was left out in the elements it has been two weeks, the baby would have been without food or water with temperatures in excess of 100 degrees. >> a husband and wife were carjacked by matthew ryan graham this morning. police traced the car and chased it where the suspect died. a custody battle is making headlines in san francisco. a divorced couple is not fighting over children but frozen embryos. ktvu's noelle walker is live outside the courthouse. this is not just a legal case but emotionally charged as well. >> reporter: it is. you have a woman whose attorney say the frozen embryos are her only shot at having a child and an ex-husband who doesn't want them and one expert says he has every right not to have kids. >> reporter: the man, a harvard grad, with his ex-wife. she is also a neuro scientists. they were definition of a power couple. now they are in a power struggle over their rights, battling it out in a san francisco courtroom. as they were getting married, lee was diagnosed with cancer. the couple decided to harvest and fertilize her eggs. freezing the embryos for future use. >> our client is 46-year-old. a cancer survivor and she is infertile. she has no other options to have a child. we are confident our client will win. >> reporter: her ex-husband filed a lawsuit. among his claims the frozen embryos are not property. the couple signed a consent and directive stating what to do with the frozen embryos in case of a divorce. one of the options is to destroy them. >> our client revoked the directions because she wants to use them. >> the case captured media attention for its outcome. but there are other similar cases. she is fighting her ex-fiance to destroy frozen embryos he wants to keep. he was involved in a similar case in tennessee. he says so far the courts sided with both parties having to agree what happens when they are taken out of the deep freeze. >> as long as someone is saying i want control of my dna, very difficult to say anybody has the right to do that. >> reporter: it will be up to the dutes -- courts to decide. . >> the doctor pointed out there are many ways to have a family. >> noelle walker, thank you. an oakland a's fan filed a lawsuit against major league baseball saying the league doesn't do enough to protect fans. the lawsuit was brought by a mother who fears for the safety of her family from foul balls balls and broken glass. it comes after an incident in which a fan was hit in the head with a broken bat in boston. the lawsuit sites a study suggesting 1,750 spectators are injured every year at major league baseball games. major league baseball spokesperson said fan safety is the league's goal. 1.1 million dollars in taxpayer money to provide long term protection for the anchor rods on the bay bridge. the lines were exposed to the water because a contractor failed to seal the tubes surrounding them. the money will pay to dry the rods. one lawmaker says it is another expense in a project that has gone over budget and no one has been held accountable for the mistakes. >> highest paid employees and yet we don't hold them accountable. the bay bridge is a disaster. every project is a disaster and yet the governor failed to hold them accountable. >> the panel will meet to discuss further steps regarding the rods. the total cost of the issue to $4.3 million. expansion plans for san francisco's garbage and recycling center not sitting well with the people who live nearby. ktvu's rob roth reports on the proposal and the complaints. >> reporter: san francisco's waste transfer station, the city's dump. handles 2,000 tons of garbage every day. neighbors say living there is no bed of roses. >> we can't keep our windows open. the smell is horrible. >> reporter: [ inaudible question ] >> it is like what just went by. >> i have flat tires, you know, because of the nails and whatever on the street. it is just lots and lots of traffic. >> reporter: a proposal by recallagy, they hope to ex-- recology, they hope to expand here along the san francisco boarder. a proposal that is still in the planning stages. neighbors worry it could mean more trucks, noise and headaches. >> the concern we have is their lack of empathy for the neighborhood. >> reporter: they haven't received complaints before. >> we are interested in hearing their concerns and running the most professional operation possible for the city, including our neighbors.
