rod. we decided to go to a uc hastings law professor to try to cut through the politics and find out exactly what the federal law says. political finger pointing continued today over juan francisco sanchez. sheriff mirkarimi blasted officials saying they were to blame for not issuing a warrant. >> reporter: i.c.e. handed the sheriff's department on drug charges with a detainer. the sheriff says there's no legal obligation and they that did hold lopez sanchez to make sure there were no prior charges. >> they could have held him and deported him. >> reporter: an i.c.e. spokeswoman says deportation orders like the one for lopez sanchez have no legal sanction. and reflects a misunderstanding. there's no federal document or no federal court with the authority to issue one. uc hastings professor says immigration is fairly under federal jurisdiction in reviewing arizona's more stringent law has not ruled on it. >> the supreme court has not ruled on sanctuary city. it leaves it up to the location of the locality which way it chooses to go in terms of the level of cooperation with the feds. >> reporter: ed lee criticized the sheriff saying quote communicating with federal law enforcement agencies in these cases is simply common sense and in the best interest of public safety. the sheriff said that mayor ed lee supported this sanctuary city ordinance and accuses him of playing politics by playing the law under the bus. >> this thing is going to keep ongoing with all this finger pointing. thank you so much jana. san francisco police confirmed the gun found at the bay was the one used to kill katherine steinle. officers recovered the gun after steinle was shot in the back. the áf the gun was reported stolen from the vehicle of an agent with the bureau of land case and the debate it's parked. including more video from today's conference with the san francisco sheriff. in another high profile case involving san francisco sanctuary policy. a judge in san francisco sentenced a second defendant to 10 years in prison in the shooting death of three san francisco family members. prosecutors say 34-year-old willford rays was in the car when edwin ramos shot and killed a woman. last may, after a riot the body of 24-year-old nicholas rodriguez was found in his cell. he was from oakland and serving an eight year sentence for robbery. prison officials say his cell mate skre -- jesus perez is the suspect. the riot lasted for 15 hours before prison guards regained control. at first the prison thought rodriguez had escaped. while searching the area, guards found a weapon but prison officials would not describe it. >> later that night, they found the body of inmate nicholas rodriguez. since then, this incident has been investigated as a homicide. rodriguez' body had been cut nearly in half and many of his organs are still missing. the autopsy showed his also had alcohol in his system. the facts of his death became public in an autopsy report obtained by the associate press under a public records request. today san jose police are investigating a deadly accident involving an out of control pickup truck it crashed through a wall and right into the back of a san jose house killing one man riding in the truck. azenith smith talked to the terrified family members who were inside of the home at the time of this morning's crash. >> reporter: sky fox 2 was over head when this white chevy truck crashed into a house in san jose. the badly smashed up truck took out the home's sliding glass door leaving shattered glass and debris everywhere. chris lee own it is home, his wife and children were inside at the time. >> at the time it happened they didn't know what was going on. they thought it was an earthquake. until they found out it was more severe than they thought. >> reporter: the driver somehow lost control. the car knocking out a large cement wall and large trees before landing in the backyard. >> it just happened so fast. i just came put words together. >> reporter: evan mora was outside talking to his dad when he heard a loud boom and rushed to help. >> the car was on fire. the car was all damaged. banged up. i just couldn't tell what car it was anymore. there were two people in there, the other person was yelling for help. >> reporter: two people are trapped inside the house. moore and his friend grabbed shoveled to try to pry the door open. a man in his 50s died. it took the two 30 minutes to get the driver out. he was taken to near by trauma center. >> the speed they were going at was way too fast for the area and the conditions. and you know speed is probably going to be the main factor here but that's yet to be determined. >> reporter: the crash all unfolding in front of evergreen valley high school. >> as you see we're actually in a school zone. so we're very fortunate that summer school wasn't in and there were more people on the street that could have been injured. >> reporter: authorities were out here for hours and shut down a portion of ruby avenue. it's unclear if the driver was under the influence, that's under investigation. santa clara's largest school union has turned down a tentative agreement. part of the unit voted no. that resulted in the entire agreement being reject. no word when the union members will strike. sciu represents 9,000 county employees including 911 dispatchers and jail workers. a blood drive that calls attention to what some say are discriminatory regulations was held today in san jose and san francisco. the national gay blood drive is part of the -- supporters say ending the ban would save lives. the goal is to drive home the point that the ban is creating a waist. the confederate battle flag has flown on south carolina property for more than half a century. that tradition ended with a short by dignified ceremony. they handed it to the curator of a museum. >> i think what it's creates is a window of opportunity to attack other things that are confederate related. >> reporter: until recently calling for the confederate flag's removal was considered political suicide. but all that changed beginning with the killings of nine church members. the shooter had posed for photos with the flag. the tide turned when a republican related today the first president of the confederacy delivered this tearful speech. >> i am a descendent of jefferson davis, okay, but that does not matter. it's not about jenny horn. it's about the people of south carolina who have demanded that this symbol of hate come off of the state house grounds. >> reporter: many south carolinians take proud that the massacre was found not by riots but shows of unity. calls that were answered right here at the state house grounds. back ups that could affect your commute. new at 10:00, oakland's garbage problems are once again making news. a protest this evening at city hall brought a group of restaurant owners together. they say they're angry over come posting and trash fees that went into effect july 1st. one owner said her composting bill went up $300 a year and it's cheaper to throw away the compost instead of recycling. >> much of the difficulty comes from new rules requiring waste manage -pl to offer come postservice to any oakland business that asks for it and that the city is working to find solutions to the increased charges. engineers are having a tough time getting rid of a algae bloom. the problem brought environmental experts back out again for the second time this week. >> reporter: environmental experts were back out for the second time this week to spray. >> it's actually bacteria. so we just want to make sure that's not around. >> reporter: the toxic blue- green algae was discovered in mid- -- >> they had us treat in very specific areas where they saw it starting to come back. and so what we did today was go to those areas and hit them and make sure it doesn't become a full bloom again. >> reporter: the combination of dry weather and the closed off lake has kept people away. the junior life guard program was still operating but only a fraction of the campers that originally signed up have been showing up. and those here have been confined to land. the blue-green algae did appear last week and authorities believe the drought and warm temperatures may be the cause. >> we need to get our confidence level up and we need o work with alameda county -- we need to work with alameda county health to make sure we don't have these toxins in the lake. >> reporter: if all goes well lake tamiscal could possibly be reopened by next weekend. in oakland, rob roth, ktvu fox 2 news. a grass fire is now fully contained in vallejo and fire officials are trying to determine how it started. the fire broke out near lake herman road off columbia parkway. calfire says it burned about 40 acres of grass on a hillside not far from homes. firefighters from vallejo, benetia and cordelia tackled it from the ground. and then declared contained by 5:00 p.m. after a pretty gloomy start today things really picked up around here. in terms of weather the clouds cleared. this afternoon temperatures got into the mid-70s in the warm spots. nice outside right now. nice winds out in san francisco. the bay bridge here east bay hills hills out that way. look for fog to show then we talk about sunday because there's a shot at more typical daytime highs as we get into the next week and the five day. a sacramento judge blocked state regulators from punishing farmers who ignored rationing orders during the drought. the ruling calls for an irrigation district. the judge ruled the state waters resources control board ordered water cut backs without a hearing. new tracks were reopened and trains were back on schedule. the director of the fbi says the system failed and charleston church gunman suspect dylann roof should not have been able to buy a gun. the 21-year-old is charged with the murders of nine people at an historic african american church. fbi director jeff combey blamed incomplete and inaccurate paper work. when roof first tried to buy a gun, the fbi check failed to discover he had been charged of possessing drugs. nasdaq gained 75 and the s & p was up 25. analysts credited news from greece and that news was that greece' parliament approved the government's latest austerity proposal. they're the bases of negotiation as the country seeks a third bail out. the measures will be felt by all greeks with higher taxes, pension cuts. ticker tape parade down the new york canyon of heros today. it was the first for a woman's sports team. >> an antwon lewis reports, if fans have their say, it won't be the last. >> reporter: the celebrations began at 11 11 11:00. a ticker tape parade for the first ever all woman's team. >> it's the first for a nonnew york team. i think they should keep doing them. >> who on the float do you want to see the most and did you see them? >> probably morgan. yeah i saw her. >> reporter: in a ceremony after the parade the mayor summed up the nation's pride beforehanding the keys to the city. >> said the film was terrible. babano says he owns the film but without lynch's permission a film about lynch's life story cannot be released. >> so it's like that. you expect to walk in whenever he feels like it. >> reporter: fans at lynch's charity said they would be interesting in watching a film. >> i'm sure we're going to find it on the internet some where. >> why is that? >> because we want to see about him growing up as a kid here in oakland. >> reporter: i spoke with lynch's pr person at the charity event and they all told me lynch will not answer questions about the movie. babano said the film had a $100,000 budget. >> so who is out the money? it was $100,000 but you talked to mario, the film maker and he said he's just out his time. the money has actually gone where? >> from investors. i guess marshawn lynch paid the investor it is $100,000. it's more about the time and effort that was put into this film along with the hundreds of people local people that were hired to act in it that are disappointed that the film will likely not be shown. >> and marshawn went to mario and said make this film and then said, it's not going to happen. >> he holds out some hope. he says it's not likely. it was interesting, mario was asked to do the film by marshawn the night after we did the interview. >> he's such an interesting guy. it would be interesting to see. so many people follow him with his rise in the nfl and success. a 17-year-old boy was dead after being shot at santa cruz county. sheriff deputies responded to a 911 call thursday night. officials say they asked the teen to surrender but he refused and instead pointed a rifle at one of the deputies. this is a picture of the rifle the teen was allegedly holding when he was shot in the chest and the hand by two deputies. he later died at a hospital. thieves in the south bay have hit restaurants for the second time in one week. in the latest weekend break-in they managed to leave evidence on the ground. they were caught on surveillance video. >> reporter: $2,500 for the conviction of these guys who burglarized the san jose restaurant twice this week. >> they came back last night with a couple of buddies, crow bars and a lot of tools and somehow were able to get the safe that was bolted to the ground. unbolt it and took off with the entire safe and contents of it. >> reporter: surveillance cameras caught it audiotape. the men checking that the coast was clear and then rolling off quickly out the door. >> they made more in 10 minutes than they would have made in a month working. >> reporter: the owner of mojo says his isn't the only business being targeted and something needs to change. he believes in increased police presence in willow glen would help. >> these guys aren't i'm left with nothing. >> reporter: they pled to rolling back odometers and theft but will serve time in home confinement and no jail. putting them behind bars may have made it tougher to collect money for the customers who said they were ripped off. >> it's felony convictions he's going to be on probation. he's lost his business. >> do they regret making these deals. >> i think what they regret is the effect it's had on other people. i don't think they ever intended to injure or harm someone. >> at their dealingship, cars remain but the guevaras lost their license to sell them. least that. low 90s. look at santa rosa 79. kind of cool, mild there was drizzle out there today. here's our live camera shot looking back at the bay area. there's the satellite loop. the low pressure that's been the culprit of all our cool weather, showery weather and stormy weather. kind of been sitting here for a few days and got caught up in the flow. you see it starting to go out. that rotation is going to go out into the great basin. it's probably going to be responsible for some significantly severe weather as we go into the next two or three days. so even though it's kind of benign for us. it gets out there it's going to explode and run into some warm gulf air and dry air from the north. could be a real problem. so we'll watch it but we get into a drier pattern obviously. temperatures outside right now are in the 60s. the microclimates tomorrow. you're talking about now 70 in oakland for a daytime high. 74 out toward lafayette. these numbers are not where they should be right. because out by clayton i would expect upper 70s and low 80s. this time of, this time of night. or this time of year but it's not happening. so brentwood 80 degrees for a daytime high. should be 93 something like that. here's what we have. we have a system to the north that will have an impact on us. watch. so this guy goes right. so normally the high would build in and we would get hot. 90s. but this next low comes down. doesn't bring us showers. but it gets close. nudges in. pushing the fog inland and sets us up with kind of a cool mild pattern. air quality is good. but forget the 90s. not happening with that guy there. that's how that is going to go. that's how a lot of next week is going to go is that cooler than average number. 82 in vacaville for a forecast high. the five day forecast then as you peak at it. temperatures these are the top tier numbers so you would expect top numbers here easy. that's as low as it gets. 85, 86 on tuesday of next week. the story is more
