Physical distancing must be maintained Hand Sanitizer should be made available and face coverings are required even though Open Houses or possibly its certainly not business as usual there. Making a plan might feel like homework, but it will help you and your family stay safe during an emergency. Welcome back, everyone. Tonight, americas high court saying it will take up a Mississippi Abortion Case that bans all abortions after the 15 week apart pregnancy with few Exceptions Washington Correspondent Alexandra Limon reports that conservatives are hoping the case will help. Overturn the Landmark Abortion Rights Case Roe Versus wade. The Supreme Court will hear this case in its next term which begins in october. In recent years. Conservative states have been passing more restrictive Abortion Laws knowing they would be challenged and hoping it would lead to overturning us Abortion Laws mississippis Abortion Law is one of the most restrictive in the country. Banning all abortions after 15 weeks except in cases of severe fetal abnormality or when the Mothers Life is in danger and the law does not provide exceptions for Rape Or Incest over the last 4 years. A critical rights like the right to Health Care. The right to choose have been under. Weathering an extreme attack, including Project County and state laws. So far lower court decisions blocked Mississippis Law because Roe V wade established women have a constitutional right to an abortion until about 6 months into a pregnancy. But that could change with the Supreme Courts. Now 6 to 3 conservative majority were hopeful as many conservative scholars are that this is the precise a vehicle to overturn Route Sarah partial perry with the conservative Heritage Foundation says states have the right to regulate abortions. This is an opportunity to secure their State Opportunity to protect and the pro life parameters. But some say restricting access to safe and legal abortions hurts women because even when outlawed statistics show that roughly the same number of women have abortions except with more dangerous methods and settings. And the president and the Vice President are devoted to ensuring that every american has access to Health Care, including reproductive Health Care. White House Press Secretary Jen Psaki said that regardless of the outcome of this Supreme Court case. The biden administration is committed to getting congress to pass along to permanently, protect womens right to an Abortion Reporting in washington. Alexandra limon. And for more on this case and what it could mean for both sides in the abortion battle. Were talking to someone with lots of experience on both sides of the courtroom. Someone who also teaches law. Were joined live by. You see Hastings Law Professor rory little tonight to talk more about this case. Professor little, thanks so much for spending time with us here on kron 4 news at 8 oclock. My pleasure to be here. Thanks for having me on. So the first question we have to ask, how do you see this potentially playing out. We have a majority conservative. High 6 to 3. Do you what impact this could have. I think people are right to be concerned about this case when i dont think its going to be the vehicle to overrule Roe Versus wade. Instead, the court seems to be acting very cautiously. They waited 8 months to decide whether to take this case. And then when they took this case, they took only one of the 3 questions mississippi had put in front of them. So theyre acting cautiously in a sense. Roe versus wade might die the death of a 1000 cuts little case by little case by little case and theyre not little bit. They wont overrule it entirely. They just cut back on it so far that it becomes. Not nearly as protective of the womans right to choose as it has been. Yeah. Its going ask you, professor, bottom line, what will happen if the justices do rule in favor of the ban. Youre saying it does not necessarily kill Roe Versus wade. Well, they dont have to overrule Roe Versus wade to decide in either direction. In this case, they can simply say and by the way, leading case these days is really chacey, which is a 1996 decision, which in a sense, a plan Roe Versus wade. But they dont have to overrule those cases to decide either either direction in this case. And i think they will be caught you will certainly see a few justices saying lets just over will the whole thing, but im not sure theyve got 5 to do that. Justice kavanaugh seems to be the middle of the court these days and he is turning out to be a pretty cautious but conservative justice. What is you mention the fact there are 3 questions that or 3 issues that this particular law. Really the justices on what was it about this specific one that they decide to take up on this. Well, here the lower courts ruled that were at least the mississippi says they ruled that all tree pre viability. Restrictions on abortion are not constitutional. So the Question And Answer is can you have any restrictions on abortion, tree viability. This 15 i shun week limited mississippi said is viewed as pre viability. The question is i mean, all unconstitutional. I think the court is likely to say, well, theyre not and maybe send it back to mississippi and the other 19 states that are. Because in this case and say reconsider your laws in line with what we are saying today. We knew 5 justices at least a majority. But were not going to say it can never be done. Were also not going to say always is okay. Its going to be a mixed bag of course, putting this on tea leaves is a little early. This will be argued until next october at the earliest. I wont be decided until probably after so 2022. Professor just quickly, so much has changed, but are there clues from the past but suggest how this will play, how they will rule. Well, we certainly know that there are not just conservative justices, not conservative catholic justices the catholic church is steadfastly against abortion justices kavanaugh justice barrett. Some people view them as illegitimate justices. Well, theyre still on the court. They have a lifetime appointment. Justice thomas and justice alito. I think it made it clear they would just overrule Roe Versus wade just courses. Were not quite sure yet what hes going to say. But these are justices who are not in favor of a constitutional right to get an abortion. Without any restrictions. All right. Professor or a little as always, thank you again for your time.
