The governor is hoping to change all that by allowing people to request Court Ordered treatment for people with the most severe Mental Illnesses. When people get their meds, when people get support, we know we can turn peoples lives around. This is eminently solvable. Sentences go is one of the first seven counties in the state, and the only one in the bay area so far, to open care courts. While there has been a lot of talk about this controversy, there are still a lot of questions about the details of exactly how this will play out. Jose martinez met with some people behind care courts to explain how they will work. You might think it is a Traditional Court setting, where people will be facing the judge, but you would be wrong. They are actually going to be here, in this room, where it is less intimidating, having a conversation with many professionals, including the judge. Reporter judge Michael Barrett is one of the first judges dealing with these cases in San Francisco, we met with him at the superior court on polk street, where he will preside over all care act court matters. One major change is that a lot of different people can file a petition under this new law. It used to be that the decision whether to file a petition to bring somebody into court to address their Mental Health concerns was in the province of the criminal system , the district attorney, and the civil system , a conservator, or the department of Public Health. Reporter that means family members , a roommate, or anyone who has witnessed an individual experiencing Mental Health issues, can request a judges intervention. If they meet the qualifications, the court will oversee the development of a care plan, and that is when the department of Public Health comes into the process. We will be responsible for consulting on cases, so if anyone has questions, we can consult whether somebody is appropriate for care court. But also, when petition get filed with the court, the department of Public Health will be responsible for investigating those petitions, providing reports back to the court. Reporter dr. Angelica almeda tells me that the department is ready to take those on. According to the department, San Francisco has added over 350 new Mental Health and Substance UseDisorder Treatment beds to the 2200 existing beds, and another 50 are in the pipeline. People will have access to an array of services that could include residential treatment, medication management, case management. Crisis services. Reporter for up to 12 months with the possibility to extend another 12 months , and the court will provide consistent oversight, but it is important to note they cannot require treatment. Because this is a civil court, not a criminal court, and it is also voluntary, we cannot force services. We are really focusing on relationship holding between the judge and the participant or the potential participant, in order to make them feel comfortable. We are not going to have the judge wear a robe or sit on the bench. Instead, we are going to be at level, sitting around a table, having a conversation. Reporter if a patient refuses treatment, the last resort could be conservatorship , but josh beckett says he is hopeful this will help folks out before that happens. It is a voluntary program to try to engage people who have serious Mental Illness, in particular schizophrenia, or psychotic disorders. So that they can access the appropriate treatment and hopefully get better. Reporter of course, the real impact of this program will be seen out here, on the streets. Last year, we spoke to anita wills, whose son lasted a Mental Illness as an adult. She said he began roaming the streets and ended up in jail, accused of attacking people with a knife. He had some success with treatment programs, but because they are strictly voluntary, he leaves when his schizophrenia takes over. She thinks care courts could be an important first step. That feels good, that somebody cares, that the state is having a conversation about it. Will it work . I dont know. But what we have now is not working. Now, there has been strong pushback from critics who say it is a violation of civil rights. The state Agency Disability rights california has long opposed fourth treatment, saying it lessens the likelihood that people will seek voluntary treatment down the road.
