New federal charges related to the january 6th attack. This was an unprecedented assault on the seat of american democracy. Plus the fire so intense that it cracked windows across the street. We are hearing from neighbors and what they say about fire danger. This has caused grave concern for neighbors, and rightfully so. National night out taking on new meaning in oakland as neighbors band together to address solutions to crime. And this team took off on a joy ride in her neighbors tesla. This is cbs news bay area with juliette goodrich. Good evening, and we start with big news. The man accused of killing cash up founder bob lee will stand trial. We are getting our first reaction to the case from a woman who knew the victim well. Bob lees exwife and the mother of his children. Our lauren toms was there and she spoke outside the courtroom and rebutted key claims from the defense. What a day in court yeah, juliette. The result of this hearing is that nima momeni is going to trial, but today we learned new twists in the relationship between the two, and from lees exwife who says she is shielding her family from the more gruesome details. Outside the courtroom, the exwife speaking out for the First Time Since the killing. Her voice cracking with emotion as she showed her support for the prosecutions case. They are doing the best they can and i dont think there is anything sloppy about this. He stabbed him. The fact that he stabbed him multiple times is disgusting. Reporter prosecutors made their case during a twoday hearing with Video Surveillance and expert witnesses who testified that dna evidence from nima momeni was found on the handle of the knife used in the fatal stabbing, while lees dna was found on the blade. Lee says she has no reason to believe that they were friends prior to her exhusbands death. I dont think they were friends. I never heard him mentioned. Reporter but the defense painted a different picture and argued that his decision to act in an area with cameras paired with a friendly history with lee do not amount to premeditated murder. We chose manslaughter because it is the lesser crime and we believe that i told the judge, i said listen. If anything, they have proven manslaughter because they do not have malice and all the other things that the government reporter one key witness we have not heard yet is nima momenis sister who allegedly had a relationship with lee. She has allegedly refused to cooperate. Prosecutors believe this could be used to show motive. Why give them a deposition of witnesses when we do not have to . Lauren joining me in studio now. So it is clear that his sister will have a large part in the case. There is information they want. Reporter yeah, absolutely. We have not heard yet from momenis sister, but one defense lawyer said that we can expect to hear from her once the case goes to trial. Throughout this case we have been learning new details that do suggest that she played a pivotal role in the events that transpired in the Early Morning hours of april 4th earlier this year, so once we do hear from her when this case goes to trial, she will definitely have information to shed on this case. Lauren, thank you so much we are also following another developing story with former President Trump being indicted by a federal grand jury, this time stemming from his efforts to challenge the result of the 2020 election and the investigation into the january 6th attack on the capital. It is adding more legal troubles for trump as he makes another bid for the white house. According to the indictment, the president faces four charges, conspiracy to defraud the united states, conspiracy to obstruct an official proceeding, an attempt to obstruct an official proceeding, and also conspiracy against rights. Prosecutors said trump knowingly spreadad lies about the election i in order toto destabililize the country anand spread mistrust about the outcome. It also alleges that trump and his coconspirators tried to pressure than Vice President mike pence to reject the electoral results as counted on january 6, leading to the storming of the capital. Jack smith called the siege and unprecedented assault on democracy. It is described in the indictment. It was fueled by lies. Lies by the defendant targeted at obstructing a bedrock function of the u. S. Government and the process of collecting, counting and certifying the results of the president ial election. Trump responded on social media by calling jack smith on deranged and asked why they waited so long. Joining me to break this all down as the history and communication professor at cal state east bay. Thank you so much for joining us. Lets get the first things first, your reaction when you heard the latest news that trump had been indicted . I think the first thing that stood out to me was that jack smith chose to use the word exploited. That is that he said that trump exploited the events of january 6th, which is much different from what we have been talking about, where since trumps impeachment he has been accused of inciting the events of january 6th. So i think that this is a reframing of how we have understood these events. So what does that language mean then, necessarily, in terms of the charges . We are in such a hyperpolarized time that i think unfortunately the language will not matter too much. I think trump opponents will already think he is guilty and supporters will already think he is innocent. Trump operates in a very unique space in american politics were whenever he is indicted or accused of doing something criminal, his supporters rally around him stronger and stronger. He has done a great job of making his supporters feel like an extension of them, where if he is indicted, they are indicted. He is basically clear the republican primary field and a poll has him neck and neck with joe biden. So this has hardly been politically devastating for the former president. Case in point to his reaction launching more of his campaign. Where does this stand, then . He can obviously run and be president from behind bars, correct . Yes, there is historical president. Eugene debs ran for president when he was in jail. It does appear that trump is in another unique situation where he is trying to run out the clock and hoping he can be elected to the presidency in time to pardon himself before seeing a prison cell if he is indeed found guilty. This is the second time in two months that jack smith has brought charges against trump. He is set to go to trial in may over his handling of documents. In march, manhattans d. A. Indicted trump on state charges of falsifying business records, and he may soon face charges out of georgia with a grand jury looking at his attempts to replace state electors with people loyal to him. There will certainly be much more coverage on former President Trumps indictment on the cbs evening news with Norah Odonnell coming up at 6 30 right after this newscast. In other news, scaffolding collapsing around a building in San Franciscos hayes valley as flames blasted into the sky. This is what the building looks like now. It is a shell of walls and bent and sagging scaffolding. This happened at the corner of octavia and oak streets. Anne makovec says it is a site that neighbors have been concerned about for a while now. Reporter all six lanes had to be closed well crews worked on getting the scaffolding down. Eight people were displaced. It took firefighters two hours to get this under control. While that was going on, people in the area grabbed their phones and these were some of the videos that were posted. Keep in mind that this is around 6 00 in the morning, so people were just getting up for the day or were jolted awake by the loud popping. Fire officials said the heat was so intense that it actually melted the seats on their fire trucks and broke windows in the buildings across the street. They say the fire grew so big because the building was still under construction without a roof or walls to contain the flames. We do not have the suppression system we would normally see in a building and we do not have heat protection from closed doors or heat protection from drywall, just to name a few. It also allows and facilitates a rapid and widespread of the fire. Reporter people who live in the area said they do not think this is the first fire in this neighborhood. They recently sent a letter to the mayor and city officials asking for help. We are really trying hard to keep everyone safe and trying hard to make hayes valley a good place the people want to come to, then this. Why wont our city officials do something about this . I dont understand. If they dont have the resources, then they need to call in resources from the state, national guard, red cross, whatever it takes to triage these issues. It is going to take a long time to clean up this area, so at least for now try to find alternate routes, jules. All right, anne, thank you. The woman accused of rushing onto the bay bridge naked and firing shots is now facing enough charges to put her in prison for 30 years. 32yearold sequoia pled not guilty to gun related charges. Prosecutors said she was driving recklessly before stopping her car and stopping the afternoon commute. Fortunately nobody was shot. To the north bay now, where a 13yeaols joyride in her parents tesla ended in a crash. This happened on king and howard streets just after 4 30 this morning. Police telling us that the teen lost control when she hit a dip in the road. She and her friends made it out with just minor injuries. Federal prosecutors say that suspects in a milliondollar jewelry heist led police right to them. Part of the hall was a rolex with a gps tracking device. That is how they were able to track one suspect to san mateo following the march heist. Four others are also charged, but prosecutors believe that a dozen may have been involved. Still involved, a 75yearold woman exchanges gunfire with home intruders. This is one of many recent crimes that has National Night out taking on a new meaning in oakland. The annual event is a chance for police to build positive relationships with the community. In oakland it is taking on more significance with so many neighbors on edge about recent crime. We have reported on shootings, carjackings , and now we are learning that a 75yearold woman in the Oakland Hills opened fire on two intruders in her home who then fired back. Katie nielsen is that one of the National Night out events where crime and what to do about it are top of mind. Reporter here at full Gospel Church people showed up for the National Night out event, where organizers say they are trying to bring the Community Together over concern that violence is at an alltime high. This was the site of a terrifying Home Invasion robbery where an elderly woman was home when men shot their way in and fired almost 20 rounds at the homeowner, who amazingly was not hurt. She is still in jeopardy, being an elderly woman trying to protect herself. Reporter the homeowner said that he does not want to show his face on camera. He does not want to be the next target. This neighborhood used to be quiet and the only thing you had to worry about were skunks and raccoons and possum in your yard. Reporter he says he feels that the neighborhood is no longer safe. If something happens, i dont have time to wait for the police, because nine times out of 10 you are put on hold for five or 10 minutes. Reporter according to the Police Officers union, there are 712 positions for officers, which means fewer officers available to respond to 911 calls. Many do not feel that the level of Police Officers that we have is at a level that we would want. Reporter Police Union President Barry Donelan says this is why events like National Night out are so critical, to get officers and Community Members talking. People are afraid and nervous. To have an event like this now shows that we can come together without violence and mayhem and without being afraid. Reporter the church has been a Gathering Place for decades. Church leaders wanted to involve children in the area by an backpack giveaway. It is their way of getting the next generation engaged and motivated to make positive changes in the community. There is an old african proverb that says that if the community does not embrace their children, when the children grow up they will burden the community, so it is important that we show love now so that they know that they have a family and a community and that their community does care about them. Reporter the event goes on until 7 00 tonight with a number of city and county leaders expected to attend. People in oakland have a chance to weigh in on the next police chief. The Police Commission will host in person forums starting this saturday at the golden gate and cesar Chavez Branch libraries. Other events are planned for next wednesday and saturday. Earlier this year, chief Laronne Armstrong was suspended and fired by sheng thao. A Consulting Firm was hired to help find a new chief. They will recommend four candidates for the mayor to choose from. Paul heggen here, and we are talking about a nice, cool breeze right now. It feels more like june or even may compared with the first day of august, but we have some changes in store. Enjoy the cool weather well it is here. The onshore breeze is going to keep cooler conditions with us as we pass through the middle of the week. Tomorrow and thursday will still bring below average temperatures to the entire bay area, but the heat dome will flex its muscles a little bit and build closer to us. Temperatures start to warm up on friday, they pick saturday and sunday, but we are back to near normal temperatures by next week. The warmer temperatures are being pushed further back over the Desert Southwest with above average temperatures likely to continue for the foreseeable future. The eight to 14 day outlook takes us through august and it does not look like we will see largescale change. The worst of the heat is still avoiding us. Every once in a while it builds closer, so we will keep an eye out for the potential of that later this month. Temperatures are mostly in the green, which is good. We may see more air quality measurements tomorrow with smoke drifting down the coast from the flat fire burning in southern oregon, but the worst we will see as moderate air quality along the coast. Most of this will be elevated in the atmosphere instead of ground level. Most of the cloud cover is out over oakland and the fog is aggressive this evening. Temperatures are in the upper 50s and low 60s. Even the warmest spot in concord is just one degree above 80. Not very warm for the last day of august. High temperatures tomorrow are only around 80 degrees in concord, which is unusual for this time of year. There will be patches of mist and drizzle to begin the day on wednesday. While the fog does not last too long inland, it will be more stubborn along the bay and the coast. I would not anticipate much sunshine at all for coastal parts of the bay area tomorrow and thursday and even likely into friday as temperatures inland start to heat up. Temperatures tomorrow do not warm up a whole lot. We have a longdistance dog walking forecast and we have hans hear from loretto, tennessee. We will stick with San Francisco since we are a bay area station. Temperatures only reaching up into the 60s for much better dog walking weather than they would normally see in tennessee this time of year. Temperatures tomorrow are going to be slightly below average with even the warmest spots in the delta and far inland only reaching the low 80s. A lot of 70s inland with 60s around the bay and right around 60 degree high temperatures along the coast. Temperatures will warm up over
