The school has launched nearly 1500 students since 2009 and report from california has found that the district has had a lot of staff turn over in recent years. More on the new battle in this mornings original report. Reporter week after week, trains carrying coal from utah unload cargo at the terminal in richmond. Trucks full of Petroleum Coke and oil industry byproduct drive in from the nearby phillips 66 refinery. The coal and pet coke are transferred to ships headed for asia where theyre burned as fuels. Its a driving business that richmond residents say is happening at the expense of their health. Obviously i dont like it. Reporter dalia and her mom were among the thousands that fought to stop coal shipments through their town. Train cars travel through residential and neighborhoods in richmond. I get that it is bad for the environment and not just the whole pollution of the town thing but it is basically the pollution of the world. Reporter push back from residents resulted in a new City Ordinance that phases out storage and handling of coal and pet coke over three years. Kpix5 has learned that the terminal along with the coal company that ex ports coal and phillips 66 which ex ports pet coke have gone to court looking to over turn the ordinance. They claim among other things that it violates constitutional right to free commerce. The fossil industry decided they didnt like the ban and challenged it in court. Now all of us are in court defending the ban. Reporter executive director of San Francisco bay keeper that along with sierra club is supporting richmond in its legal battle. Bay keepers patrol boat has been monitoring from the water for years to be sure the coal dust isnt polluting the bay. The coal industry is trying to get more than 11 million tons of coal out of bay area ports and what theyre trying to do is basically make the bay area coal country. Reporter data from u. S. Census bureau which tracks trade says coal ex ports through the terminal sky rocketed from 120,000 metric tons in 2016 to 738,000 in 2019, a 615 increase. From the air, you can see why richmond residents are at risk. Train tracks run next to neighborhoods that have been designated by Environmental Protection agency as disadvantaged because of the many sources of air pollution they are exposed to. That includes two freeways and a chevron oil refinery. This is an absolutely huge deal. Reporter a pediatrician in richmond that also pushed for coal ban is now speaking out to defend it. We know that the particulate matter that is released into the air went from coal dust, from Petroleum Coke dust is toxic and making people sick. Many young patients attend school a half mile from the terminal. The insides of their classrooms are covered in coal dust by the end of the day. The cars are covered. If thats whats inside their classrooms and on their cars, its in their lungs. Its just the reality of it. Reporter a spokesperson for the terminal told us they cannot comment because of the lawsuit. Our cameras were not welcome outside the facility in richmond. The richmond mayor had plenty to see. Its costing a lot of money. Reporter it now wont cover the cost of defending it. Theyre a Million Dollar a year organization. But once the ordinance was passed, they basically cut the city loose and said you are on your own. Reporter he says he was ready to settle before the ordinance passed and is ready again. If levin was willing to agree to cease this operation say in seven years, it might take seven years to work through the lawsuit. Reporter lauren and her daughter hope the owners of the terminal and Utah Coal Company will back off and leave the ordinance standing. Things are getting a little bit busy out of livermore. 680 in both directions is checking in problem free if you are commuting through there. A new crash before stephens drive. Road work along 101 has been cleared so traffic is moving nicely in both directions through marin.
