Shes very highly respected, i can say that. Reporter barrett is favorite of religious conservatives for her strong antiabortion rights views. And if confirmed would move the court to the right for a generation. In 2016, she said she doesnt think roe v. Wade will be entirely overturned but access to abortion would be restricted. I dont think the core case, the roes core holding that women have a right to abortion, i dont think that would change. I not the question of whether people with get lateterm aborti abortions, how many restrictions on clinics, i think that would change. Reporter President Trump first considered barrett when filling Anthony Kennedys seat after he retired in 2018. He nominated judge Brett Kavanaugh instead. Reporter well, i mean, she was highly regarded federal Appeals Court judge, a former law professor at the at notre dame where she was considered a brilliant academic. And her writings really reflect that she sees the law a lot like her old boss, justice antonin scalia. She worked for him as a law clerk. All of these things kind of suggest to republicans that this nomination would be a home run. And democrats feel just the opposite. One of other names heard before was judge barbara lagoa, some thought trump might go forry that since florida is a battleground state. Are we seeing differences in idealogy between the two . Not really. As ben said, judge barrett had long been the presumptive frontrunner because the president met with her and went with Brett Kavanaugh. I think one of the things that worked in her favor was that. As he said, she had already been voted. Because the vetted. Bows the white house wants to move so quickly, the fact that she went through the brutal hearing for the civilth Circuit Court of appeals, the chicagobased court, worked in her favor. They saw she had gone through the fire and stood strong. Shes been an academic, so shes well versed in the issues in the hearings. Time office her side. There was a huge push for gentlemanjudge lagoa not only because of politics, but people believe police shes also a staunch conservative. What about the timeline for confirmation . Reporter its going to be something. Theres going to be two days to keep in mind. 38 and 99. 38 days until the election, 99 days until this session of congress concludes. Can they do . Yeah i mean,hevote say. Er ihe past where theyve done it quickly, congress has, getting a nominee. Justice ginsburg herself really around 50 days from the time of nomination to confirmation. Justice oconnor, under 40 days. In modern times, those nominations take a lot longer. It is allout war when youve got a Supreme Court confirmation in these days. And so recently its taken more like 2. 5 to 3 months, and obviously thats a lot longer than the time frame that theyve got. They say they have the votes. So if republicans hold together, its going to be very difficult for democrats to do anything about it. Jan, the list of justices who have acted differently on the bench once theyve gotten there versus what a president or others expected of them is very long. Can you talk about that a little bit . Reporter yes. It usually is for republican nominees, jeff. Its usual usually you dont see someone that the democrats nominee night and they start voting conservative. For republicans and conservatives, this has been a long source of frustration. You have a republican president nominating a justice whos going to be a staunch conservative. They get to washington and next thing you know they start getting influenced and start drifting to the left. Youve seen that over and over again, whether it was Justice David souter, justice kennedy, even sandra day oconnor. The promise of a conservative Supreme Court has always fallen short for conservatives. But now they believe that this may finally be the time if just j barrett is confirmed to the Supreme Court where they would have a solid majority, six conservative nominees which potentially could get you to a majority even if one of them decided, like justice chief justice, john roberts did, to go over and vote with liberals in controversial cases. The president has to find a way to puncture into the former Vice President s lead out in by trying to stoke doubts about him. For biden, its trying to keep the focus on the covid pandemic, the president s leadership of it or lack thereof in his belief, and try to not do any harm to the lead that he maintains in paddleground states battleground states. Bidens done about 11 debates over the last year or so. The president hasnt debated anybody since the tweb psy2016. Hes been practicing and biden getting ready with aides. The president sai onits b talke lot this transition is already under way. Can you talk about that a little bit . Reporter yeah, thats an important thing to keep in mind. Theres federal law that requires the Trump Administration and the Biden Campaign to begin working on a potential transition. The biden team is already in place. Theyre mostly working virtually, but there is office space in washington if they need to use it. The Trump Administration is also getting ready, preparing agencies for the possibility of having to work with a Biden Transition Team after the election. The fbi already starting to review paperwork per people who would be involved in that process. The law was put in place during the obama administration, and all indications are so far that things are going smoothly.
