One airline is working to stop the spread with Rapid Testing. And banning gas cars. California announces it will go right there. Officer down . We had two officers shot tonight. And its very serious. Its a very dangerous condition. Two officers shot during protests after a grand jurys decision to not charge officers in the shooting death of Breonna Taylor. Do not sully her memory by engaging in violence. Totally inappropriate for that to happen. President trump praising kentuckys attorney general for his handling of the Breonna Taylor case. Really brilliant Kentucky Attorney general is doing a fantastic job. I think hes a star. Lawmakers heard testimony on the latest Pandemic Response efforts. Preliminary results appear to show that most americans have not been infected with the virus and are still vulnerable to serious illness and death. Ruth Bader Ginsburg arrived at the Supreme Court for a final time. It was said that shed want to be an opera virtuoso but became a rock star instead. The team doctor accidentally punctured his lung. All that, during a sweet moment, a friend trying to take pictures and video. And all that matters. I wasnt able to vote because i was a felon. Thank god they changed this law. I want to hear mike tyson say the words participating in a democracy. Im sure youve already seen that grand jury in kentucky has not returned any indictment or charges against the police who shot Breonna Taylor. Its a tough day. I think we have to rage. We have to rage in love, but we have to stand up for the values of our humanity. And our life matters more than matters. Its divine. And i dont think that this is something that we can ever let become normal. Welcome to cbs this morning. Very well said. A lot of people still reeling over the decision yesterday. Thats where we begin. A lot of anger over the grand jurys decision in the Breonna Taylor case. Two officers were shot last night during the protests. That is not okay. Two officers involved in taylors death were not charged. Now the shootings marred what had been a largely peaceful demonstration of outrage in a city where a state of emergency had been declared in advance. Other protests across the country remained peaceful with thousands marching for change late into the night. All of this renews the call for accountability and how police deal with black americans. Our National Correspondent Jericka Duncan is in louisville. Jericka, lets start with that shooting last night which threatens to undermine that message. What do we know . Yeah, good morning. Well, right now we know that those two officers who were shot at were transported to a local hospital and are expected to be okay, treated for what appear to be nonlifethreatening injuries. But all of this comes at a time when a city is still grapple with the death of Breonna Taylor and now the words from the state attorney general here that the officers who killed her were justified. Officer down. Right there. Officer down. Reporter it was a frantic scene around 8 30 last night after two Louisville Police officers were shot. Interim police chief r Robert Schroeder says a suspect is in custody. One is alert and stable. The other officer is undergoing surgery and stable. Breonna taylor reporter although protests started peacefully, some people set trash cans on fire. Around 100 people were arrested. The protests came after months of waiting for a decision in the killing of Breonna Taylor. Former louisville detective b t Brett Hankison was indicted but not related to breonnas death. The grand jury voted to return an indictment against detective hankison for three counts of wanton endangerment, for wantonly placing the three individuals in apartment 3 in danger. Reporter hankison was arrested and released on bail. The grand jury concluded he wildly fired ten shots and endangered the lives of a pregnant woman, a child and a man who were in an apartment next to taylors. Officers Jonathan Mattingly and Myles Cosgrove will not face state criminal charges. The use of force by mauthly and cosgrove was justified to protect themselves. This justification bars us from pursuing criminal charges in ms. Breonna taylors death. Reporter taylor was killed on march 13th as they executed a search warrant for drugs or money. Neither were found. Her boyfriend believes the police were intruders so he filed a single shot which hit mattingly in the thigh. Police returned fire. Six bullets hit taylor. Somebody kicked in the door and shot my girlfriend. Reporter walker has maintained police did not identify themselves before they used a battering ram on the door. Cameron said the officers did knock and announce. That information was corroborated by another witness. Reporter law professor Collin Miller has worked with taylors family. He believes the grand jury did not hear all of the evidence. And we have several witness accounts from neighboring apartments. The neighbors saying we never heard the police knock and announce. Reporter taylors family Attorney Ben Crump called the decision to not charge any officer in taylors death outrageous and offensive. It continues to disrespect the black women they have permeated in American Society since they first brought us here in 1619. Reporter the fbi is also conducting an investigation. One of the things theyll be looking at is whether or not police obtained this warrant using false information. And hankison is also under investigation by an fbiled task force into allegations of Sexual Assault unrelated to Breonna Taylors case. Jericka, thank you. Kenneth walker was charged with attempted murder of a Police Officer after the raid in march but those charges were later dropped. He is now suing the Louisville Metro Police claiming misconduct. Early this morning we asked his attorney, steven romines, about the jurys conclusion that the officers actions were justified because Authorities Say that walker was the one who fired the first shot at them. Well, in every other situation in kentucky, a justification of selfdefense is determined by a jury. And it should be in this case as well. When we start letting elected politicians determine who should be charged and who shouldnt, then we are going down a very dangerous road. It is the exact opposite of the way our criminal Justice System should work, and unfortunately, it happens oftentimes in Police Shooting cases. That the prosecutors say, well, the police were acting in selfdefense. The police do not have any higher right to selfdefense than any ordinary citizen does in kentucky. Now because steven, wasnt isnt your client saying he was acting in selfdefense . When you listen to his 911 call, he clearly didnt know they were Police Officers. Absolutely not. And that is why the case was dismissed against him was that he was acting reasonably acting in selfdefense. And hes in his own residence. So he has a presumption that hes acting in selfdefense. Weve got a dozen neighbors who were interviewed by police as well who said they never heard the Police Announce that they were police. Theres no question they were beating on the door. But they never announced as police. Attorney general cameron said, well, the two police said they announced. So were going to start taking the word of the targets of the investigation as exculpatory . They also said they had a witness who said that correct. Heard the Police Announce themselves. Yes, and that witness, that witness, gayle, was interviewed by the police three days after this happened initially. And he stated, i did not exact words. Did you hear them announce as police . He said, i never heard anyone announce as police. He was subsequently interviewed two more times over the next month by law enforcement. He eventually says, yeah, i yeah, i may have heard them announce they were police. In fact, i saw a uniformed Police Officer. Thats after the shooting had already occurred. There seems to be some confusion, too, about the ballistics in this case. What do you know about that . Well, i know the ballistics done by i know what the ballistics done by the Kentucky State Police show and that it was whether or not Kenneth Walker shot or hit sergeant mattingly, it was inconclusive. Ive got the documents. And the attorney general camerons got the document slrkss but i dont know why he wants to play these games about talking about small portions of the evidence and not releasing the entire file. Release the entire file and let people make their own decisions, which is the same thing of, indict them. Apply the presumption of innocence, apply the rule of reasonable doubt. Let them go to trial. And if they are acquitted like everybody else, fine. But do not by prosecutorial fiat say theyre innocent, exonerated and im going to decide they dont get prosecuted. Well, there are still the other thing about it, gayle, is the issue of selfdefense justification in kentucky law does not apply when you kill a third party. If they are acting in selfdefense on Kenneth Walker as they claim, they dont get to kill Breonna Taylor as well. All right. And thats the law. So him telliing us what the la is in kentucky, thats not the law. Steven, so many questions in this case. All of it very upsetting. What we do know, its also not okay to shoot at Police Officers in the streets. The violence has got to stop. Violence on top of violence on top of violence. It will get us nowhere. But i really thank you for taking the time this morning. Many, many questions remain. No problem. Turning to 2020. President trump is deepening the threat of a constitutional crisis after the november election. He has refused to promise that hell leave office peacefully if defeated. Ben tracy reports on the president s most direct challenge yet to the legitimacy of the vote. Will you commit to making sure theres a peaceful transferral of power after, the leks . Well have to see what happens. Ive been complaining very strongly about the ballots. And the ballots are a disaster. Reporter President Trump has not provided any evidence to support his ballot claims. He also suggested getting rid of mailin ballots. You want to get rid of the ballots and youll have a very well have a very peaceful there wont be a transfer. There will be a continuation. Reporter this isnt the first time the president has said he may not accept the results if he loses. Its a rigged election. Its the only way were going to lose. Reporter last night, former Vice President joe biden blasted the president. What country are we in . Look, he says the most irrational things. I dont know what to say about it. But it doesnt surprise me. Reporter President Trump is also once again at odds with his own health experts. Hours after fda commissioner stephen hahn tried to reassure the public that a vaccine wont be rushed science will guide our decisions. Fda will not permit any pressure from anyone to change that. Reporter President Trump, who has said a vaccine could be ready by election day, claimed the white house will have the final say. Were going to look at it. Were going to take a look at it and ultimately, the white house has to approve it. Competing in North Carolina wednesday, biden also criticized the president s recent claim that virtually nobody, except older americans, is dying of coronavirus. So you go home and your mom gone. Your dads gone. Hes a virtual nobody . Reporter the white house is denying reports that dr. Deborah birx, the coordinator of the White House Coronavirus task force has been sidelined in favor of the president s handpicked doctor, scott atlas. But dr. Birx and other members of the task force have clashed with atlas who has questioned the use of masks and called School Closures hysteria. Anthony . Ben, thank you. The white house is also taking aim at the cdcs newest guidance on the coronavirus as our lead National Correspondent David Begnaud reports. Its director warns a vast majority of people in this country remain at risk. Most americans have not been infected with the virus and are still vulnerable to the infection. Reporter thats the cdc director dr. Robert redfield. He urged americans on wednesday not to let their guard down. Announcing that preliminary findings from a new nationwide antibody study shows that about 90 of americans are still susceptible to the virus. Yeah, i think dr. Redfield misstated something there. Reporter that is the newest member of the White House Coronavirus task force, dr. Scott atlas. He challenged dr. Redfields report saying he was partially relying on old data. Dr. Jon lapook its a basic rule of Public Health. You need have one message. No mixed messages. And you want to hear that from people who spent their career figuring out, how do you explain complex Health Issues to the public. Reporter and then this moment on capitol hill yesterday. Dr. Anthony fauci clashed with senator rand paul over Public Health orders. And what role theyve played in keeping the virus at bay in new york city. They are looking at the guidelines that we have put together from the task force. Or theyve developed enough Community Immunity that theyre no longer having the pandemic because they have enough immunity in new york city to actually stop it . I challenge that, senator. Im afraid please, sir, i would like to be able to do this because this happens with senator randall a the time. You are not listening to what the director of the cdc said. In new york booits about 22 . If you believe 22 is herd immunity, i believe youre alone in that. Reporter not only is dr. Fauci right, but new york city is getting it right. The test Positivity Rate here in the city and even statewide is roughly 1 . But the citys not taking any chances. As are businesses. The famed new york opera, the metropolitan opera behind me, they announced yesterday theyll not reopen until september of next year. Its the first time, gayle, theyve skipped an entire season in 140 years. A lot of people making big changes. Very Interesting Exchange between rand paul and dr. Fauci. Both sides feel very strongly on their positions. Thank you, david. For a second day today, americans will pay their respects to justice ruth Bader Ginsburg lying in repose outside the Supreme Court. Thousands stood in line yesterday, a slow and somber procession against a backdrop of rapid activity over ginsburgs replacement. The president plans to announce his nominee, he says osaturday. As jan crawford reports, hes pushing the senate to act very fast. I think the system is going to go very quickly. Reporter President Trump, who on wednesday could not commit to a peaceful transition of power if he loses, said its better if a Supreme Court nominee is confirmed before the election. Just in case it would be more political than it should be, i think its very important to have a ninth justice. Reporter as the president weighs his options his week, the leading contender to replace Justice Ginsburg is judge amy coney barrett. Shes a favorite of the d. C. Republican establishment which is lined up to push her nomination. In 2016, following the death of justice antonin scalia, barrett told cbsn she did not think theres a clear rule for either side in the debate over repla replacing Supreme Court justices during an Election Year. It shouldnt be a surprise that the senate is willing to push a president s nominee through in an Election Year when they share the same political affiliation. Reporter on wednesday, Justice Ginsburg arrived at the Supreme Court for the last time. Inside the great hall, a private ceremony for the eight justices, her family and her friends. It has been said that ruth wanted to be an opera virtuoso but became a rock star instead. Reporter chief Justice John Roberts spoke with affection as he honored ginsburg. Among the words that best describe ruth tough, brave, a fighter. A winner. But also thoughtful, careful, compassionate, honest. Reporter outside, mourners, including senators, the clintons and Vice President mike pence paid their respects as well as thousands of americans lining up to say goodbye to a hero. Of course, she will l
