community. it is not just poor air quality, i'm also tracking near record high temperatures into the labor day weekend. one bay area school district is scrambling to come up with new lesson plans after parents complain of racist and homophobic material in the curriculum. >> it's especially concerning if we've been using it in the school district for six years without a concern raised. alejo reportedly reaches a settlement in one of the deadly shootings that has the police under the microscope.>> the bay area's largest county may be on the verge of getting the green light to reopen the economy just a little more. tonight county leaders are saying not so fast. maria medina is live in san jose to explain why the county will keep some businesses closed.>> reporter: you may be wondering why the state is saying okay but the county is saying no. typically counties enforce the most restrictive orders and in this case, it is ceren to send to cara honey. >> marissa is not only a teacher today bringing the total to 295. they also confirmed 157 new coronavirus cases today. the bad air is already here and an approaching way will make matters worse. paul heggen joining us with a look at what we have to deal with. >> the bad air quality certainly is not going to go anywhere. any improvement is very gradual day by day basis. tomorrow the trouble spots will be in the north bay, especially downwind of the woodward fire. also we have to worry about the central bay, san francisco and oakland with slightly less bad air quality but at no point will we see any green dots on this map as we head into the labor day weekend. and, the heat will be building. this is your hour by hour labor day forecast, look at those temperatures for inland portions of the bay area. the average high will be 103. that means the range temperatures will be between 98 and 108. around the bay and near the coast it will be not as hot but that's where a lot of folks don't have air-conditioning so he advisories are already in effect there. we will take a look at the whole labor day weekend forecast in just a few minutes. the question tonight, are we going to lose power again? the state has already issued an alert and warned about potential rolling blackouts during the heat wave. the alert is in effect from saturday until monday between 3 pm and 9 pm.>> a 5% increase of generation. >> and homophobic. what is even more baffling is that curriculum has been around for years. >> reporter: the district told me tonight once it started getting these emails, there was no choice but to remove the program from the distance learning curriculum. >> i have a lot of anxieties, a lot of frustration. >> cat is one of many parents have raised concerns with the alameda unified school district after hearing about racist and homophobic lessons being taught over a program. >> were you offended at all? >> when i was asked about what was a traditional family and we saw pictures of two white parents. >> racist, all over going on, especially for the kids, if they learned that, it is not good for them. >> this is a program that has been used for years within the district. >> i'm especially concerned if we've been using it in six years without a concern raised. >> it was a way for kids to make a credit to pass classes. the board of education vice president says this is a wake- up call to make some changes in the district. >> we have a curriculum that really comes from and ethnocentric base. we are really starting to change the way we adopt curriculum so that we adopt curriculum that is more culturally responsive. >> the district told me that the company may make the changes overnight to fix issues still, the district says they cut ties with the company hopes to provide information on a new program next week. federal agents have reportedly shot and killed a suspect in it deadly protest shooting. this weekend a caravan of trump supporters arrived in portland and converted a group of protesters demanding racial justice. members of the caravan fired paintball guns into the crowd setting off a series of clashes. that night a 39-year-old who reportedly belonged to a far right group based in portland was shot and killed. the suspect was among the group opposing the caravan. justice department officials say agents shot and killed him while attempting to arrest him in washington state today. the city of alejo has reportedly reached a settlement with the family of a black man fatally shot by police after initially being pulled over for not having a light on his bicycle. this is body camera footage from february 2018. right before officer ryan mcmahon shot and killed foster. that shooting outraged many but the da said mcmahon was justified in using deadly force. according to the mercury news the city settled for $5.7 million. now a year after foster was shot officer mcmahon was involved in another fatal shooting. willie mccoy in the taco bell drive-through last month. we learned that the vallejo police chief recommended that mcmahon be fired. still ahead, college students stuck paying rent on apartments they will never live in. we studying at home but there landlords won't allow them to break their lease. we found out that the owners of several large apartment buildings are getting money from the government while charging students all across the country. meanwhile the company that operates element student living received a paycheck protection program loan to offset its financial losses due to covid- 19. ppp data shows elements owner received anywhere from 350,000 to $1 million. the owners of academy 65, another student living space received between two and $5 million. at the grad in san jose the owners received between one and $2 million in ppp loans. >> we are scared and we are afraid of what is to come. how will this affect us long- term. >> palat lives at the grad and is considering dropping out of school at san jose state to get a full-time job to pay for her apartment that she is not going to live in. >> am i going to have to be a part-time student now to make up the money that i'm going to have to pay?>> student at the grantor also organizing, their petition garnered nearly 1500 signatures so far. most students are still at home with their parents but some have chosen to move into these apartments because they can't break their lease and some have already complained that the move-in here is not going well. students have complained to management that they don't feel safe at the grad during the ongoing health crisis. one wrote to management that during moving there was zero social distancing and packed elevators. >> right now we don't feel like we are cared for, we don't feel like they put our health in any sort of importance. >> jess is being asked to sign this liability waiver saying she acknowledges that it is possible she may become sick and that she agrees to hold the creeping in, doing its usual thing. low to mid 60s, temperatures will drop a whole lot more the rest of the night. the fog will make its way into the valleys inland in the bay area like it has the past several nights and then it retreats. basically to where it has the past couple of days, right along the coast, but i don't think you will see much clearing along the coast. one more great day and then you get a little more sunshine by the weekend. tamara's dog walking forecast, this is a bailey from pleasanton. if you have some high-energhe i beginning saturday and it will continue through the rest of the holiday weekend very temperatures tomorrow morning starting in the mid to upper 50s to around 60 degrees. near normal temperatures for the rest of the day. slightly below average around the water. upper 60s and low 70s around the bay, low 80s around san jose. close to 90 degrees for the hotspots, and that's not that hot this time of the year. certainly not close to where we are going to be this weekend. the heat advisory kicks in on saturday for spots along the water heard this is where temperatures will not be that hot, topping out in the 80s around the bay and 70s on the coast. but that is dangerously warm for a lot of areas where a lot of people don't have air conditioning. the excessive heat will be inland where temperatures will reach well into the 90s on saturday. and then high temperatures sunday between 100 and 110 degrees, that puts us in record territory for the second day of the labor day weekend. likely to get close to record highs in san jose and santa rosa. temperatures slowly back off as we head into next week but be ready to sweat this weekend. and we will stay hot at least through tuesday and back off a little as we head through wednesday and
