The judge ordering deputies to remove the suspected killer after he became incoherent and started yelling another prosecutor. Kpix 5s da lin is live outside the courthouse. Da, legal experts say the outbursts may not be a bad thing for the suspect. Why is that . Reporter ken, thats because the suspects defense attorney wants to show the jury the suspect is mentally unstable and unfit to stand trial. Now if the jurors buy that and believe hes insane, then this case is basically over. Not guilty by reason of insanity. Day two of john lee cowells testimony lasted only 15 minutes. He was agitated, belligerent, and combative toward the prosecutor. The judge ordered deputies to remove him from the courtroom. He kept saying last time you said im not found guilty, so what do you want me to say now . Last time you say im not guilty, and he just started like getting really hyper and hyper and hyper. Reporter the outburst happened as the prosecutor was showing Surveillance Video of the attack on a bart platform in oakland that killed nia wilson in 2018. Wilsons family and friends say he was tton a performance, almost worthy of an oscar nomination. We hope the jury sees what it is too. Its a show, its an act. Hes very smart. Hes using big words. I believe hes been coached. Its just an act to me. Hes showing signs of manipulation. Reporter nia wilsons sister survived the stabbing. Cowell says he attacked them because theyre aliens that hurt his grandmother. He has a diagnosed history of Mental Illness including schizophrenia and pleads not guilty by reason of insanity. The prosecutors are trying to move he knew what he was doing and was mentally confident when he killed nia wilson. Im here to get justice for my sister, myself, and my other little sister as well. Reporter the prosecutor is trying to convince the jury that the suspect is a drug addict and not mentally unstable, and thats the approach that hes taking. Now cowell will not be taking the witness stand after todays outburst. The defense attorney intentionally put cowell on the stand so she can show the jurors his mental state. Shes a 77yearold widow and immigrant from the philippines. They say wells fargo has a pattern of foreclosures. Were here because wells fargo wrongfully foreclosed on my clients home. They sold her an 800,000 home at a public auction for only 51,000. They left her with nothing. She reportedly made every mortgage payment on time until 2018 when she fell on hard times. At the time foreclosure wiped out over 17,000 in home equity. We reached out to wells fargo for a statement and havent heard back. Part of the San Francisco tenderloin neighborhood got a deep cleaning today. Crews picked up trash, power washed, and cleaned up graffiti. Every thursday morning 15 to 20 crew members will focus on a specific neighborhood. Outreach officers will talk to members of the community, and the goal is partnering with them to help maintain their spaces. At the time program runs through june, and then the city will evaluate how well its working. And new at 6 00, is the smart train working . Thats at the very heart of the biggest measure on the ballot in the north bay come march 3rd. Wilson walker has more on what measure i would mean for voters and more importantly what a no vote would mean for smart. You know, i think its important to recognize were just getting started. Weve only be carrying passengers for a little over 2 years. Sujuror. Ng growth and reporter after plenty of growing pains, smart is mostly working and they say measure i will keep the momentum rolling. Its a simple renewal for the quarter cent sales tax that residentses in marin and sonoma are already paying. I think they should go on a diet. Reporter rich has a ph. D in urban transportation and doesnt think smart helps traffic or the environment, and he opposes measure i. Measure i gave smart a blank check. Were talking at 1. 2 billion, and what are we getting out of it . Reporter for smart, i is largely about accounting for expected bond revenue that never materialized during the recession. They say a 30 year extension of the sales tax will let them restructure their debt while securing more state and federal funding. So this measure and renewal at no additional cost to the taxpayer makes them more competitive. Every Public Transit system in the world has some sort of revenue stream. Theres never an understanding that after 20 years this was going to end. This is how we pay for the system. I and other people have calculated it takes about 100 of public subsidy for each round trip. Reporter so measure i will have a lot to do with your perception of smart. I asked rich what happens if theyre successful in stopping the tax. Thatll give us more time to reevaluate the performance. Reporter and if you lose . The board will be faced with really difficult decisions. We aitrips, and then go back out to the voters after having made those cuts. Reporter think of bart, an essential but aging system, and now were all paying for it and living with the overdue upgrades that bart needs, so many of our transportation problems fit that paradigm, but smart is brand new and possibly facing some long term challenges of its own. Its sort of a different speed of question we normally run into. Sure, and a big part of the story is the spending, the campaign spending, and specifically from one family . Reporter yes, the money spent against measure i is coming largely from one family, in fact one person in one family. More than a million dollars. This is, as you might expect, creating controversy here. We asked the yes campaign for a comment on that, they have talked to us. The woman behind the spending has not, but well talk more about this on cbsn bay area tonight at 8 00. Well get into the spending. Interesting. All right, wilson, thank you. Still ahead on kpix 5 and cbsn bay area, a bay area zoo going plastic free. The example its trying to set for zoos worldwide. Obama at a time when washington is divided in old ideological battles he shows us what can be achieved when we bring people together to seek pragmatic solutions. Don ford has more on this exhibit and how its designed to change human behavior. Reporter these 3 new animals will be at oakland zoo for the summer, but if you look closely, theyre not what you think they are. They are sculptures of a river otter, a mako shark, and a penguin. The artist has sculptures all over, even the smithsonian. Theyre made of garbage. Reporter really . Theyre all made of garbage and all garbage picked up off of beaches. Reporter all kinds of debris, some from as far away as japan. This is all part of her lifes work drawing attention to global plastic pollution. This is all kicking off a campaign called imagine a future without plastic. We gave up plastic straws, cups, lids, but now were giving up the plastic Water Bottles and those types of things that will always stay in the environment. Reporter the zoo says theyre negotiating with their suppliers to eliminate all plastics, announcing that for the First Time Ever dasani water is now in aluminum cans. Folks are naturally drawn to the cup sculptures. Kids touch the items. Even young kids get an understanding of the plastic problem. People have been picking it up, including artists, and they made it into those sculptures. Reporter what do you think of that . Its very interesting. Reporter the Waste Management recycling company recology is also working with the zoo. Were getting a firsthand account of what one of barts new unarmed ambassadors experiences on the job. Latifah davis has spent 3 days patrolling trains on afternoons and nights. I have a radio if i need to contact them, and theres also officers on that same beat when were patrolling. And the latest map from the Drought Monitor brings bad news for california. Nearly half the state is either abnormally dry or at a moderate drought level. The abnormally dry level is most of the Sierra Nevada range and the central valley, sacramento area, and most of the bay area. Darren peck has more on whether theres any hope of any kind of rain in the forecast. I think its a timely story now, liz, because that tells us the position that we find ourselves in now and looking forward the next week and a half, looks dry. Really going towards the end of february, theres not much hope here. What we saw today was kind of interesting. Thats a good batch of the low clouds, the marine layer that builds in along the coast. Can happen at any point in the year, but it typically happens in the summer. It was really right along the coastline and bay this morning. Tomorrow we wake up again with the low clouds that cover much of the bay area. And that will, it certainly adds a mood, but it will keep the temperatures pretty much similar to today. Speaking of which, low to mid50s out there, and the comparison, look how much colder we are than yesterday because of this change. Anywhere from 4 to 14 degrees cooler than yesterday thanks to the on shore flow. The low clouds getting pulled back on shore again tomorrow morning. Expected the gray sky for your morning commute tomorrow. But then by tomorrow afternoon, it will be different were. Were going to start to pick up a little more offshore flow to clear out the low clouds, and not nearly as many around tomorrow to show you. Overnight lows in the mid40s, very much on the mark for where we should be, and highs tomorrow, this is the number were going for, the middle number. We wont be far off the mark at all. Morgan hill 67, Mountain View 63, east bay very similar numbers. Pittsburgh going to 63, we see a few upper 50s as you get closer to the opening of the gate. Still showing us some of the cool marine air lingering there, but for most other locations we dont feel that. Well be in the upper 60s in the far north bay. Up into lake and mendecino county. Theres the sevenday. No rain as we discussed. In fact it will be pl sunsfor next week and the temperatures sit at average for much of the next 7 days. Back over to you. That is baseball weather. Putting term limits on congress, about washington insiders went crazy. They said term limits are bad, that theyll break government. What a joke congress is working fine for politicians and corporations, but its not doing anything for real people on climate, health care or gun safety. The only way we get new ideas is electing new people, including a president willing to shakeup washington. Im tom steyer and i approve this message. The Houston Astros face the media for the first time they were found guilty of using video to steal signs during the 2017 season when they won the world series. Reporter do you use the word cheating . Was this cheating . We broke the rules, and you can phrase that any way you want. This didnt impact the game. Um, we had a good team. We won the world series, and well leave it at that. Not exactly the remorse many were hoping to see. Todays press conference was more like the organization apologizing for getting caught, not for cheating the game. Im not going to talk about details today. I dont want to get into too many specifics. Im not going to talk about my teammates. You want answers. I want the truth you cant handle the truth. The choices we made were bad. Every member of that team has to take respondents responsibility. I wish i had said more, and i didnt, and im sorry. Reporter how do you prepare for what youll face on the road . We win. So enter dusty baker, perhaps the perfectbaseball man to manage this years astros team and get past this controversy. You know, washington was better, and these guys are better than that. Im a fortunate man to be here. I feel terrible for the organization, and i hope all this will subside and people will get back to work. Now the mood is a bit lighter in scottsdale. Johnny qato made quite an impression, and it had nothing to do with his arm. I noticed his beard was glistening, so i asked him about the beard oil he uses, but nothing especially notable.
