emergency! another protest, kaiser mental health workers across the bay area and state launching a 5-day strike today. they are protesting understaffing, crushing case loads, and patient appointments that often aren't available for months, they say. kaiser officials say they're urging members of the nuhw to end the strike and review the proposal they've created. this is the 6th strike the union has called in 12 months time. and an amber alert canceled after the child was found. the boyfriend of the mother allegedly stabbed her and kidnapped the child. they were found at a gas station in cambria. cell phone video shows the moment deputies arrived at the gas station and took him into custody. people recognized his car, saw the child inside, and then physically restrained him until police arrived. >> my heart was just pounding. it was unbelievable. >> he hit the window twice trying to break to get in, and finally a guy bear hugged him from behind and then i took the rock away. >> the statewide amber alert was sent out after police were called to a home in san jose. witnesses say they heard a woman screaming and found her with serious stab wounds. the child's mother remains at a hospital in critical but stable condition. at the time father will most likely face a list of charges including attempted murder. bay area homeless advocates claiming victory tonight. that's after the supreme court let stand a lower court ruling that allows homeless people to sleep on public sidewalks or in city parks if there is no other shelter available. kpix 5's len ramirez is in san jose with reaction from the city. >> reporter: well the san jose housing department says it agrees with the court's decision that criminalizing homelessness and poverty is not a solution, but that perspective may be put to the test as more and more people appear to be moving into the parks and sidewalks of san jose. tents and piles of homeless people supplies are now sprinkled around st. james park as homeless people appear to be moving in to stay. at the same time the san jose police have stepped up patrols and appear to be questioning people sitting on benches. the city has been trying to clear out the park for years, but under a supreme court decision, there might not be much the city can do if homeless people decide to stay. >> it's a small victory. >> reporter: pastor scott wages ministers to the homeless in san jose and say it is court made the right decision to let stand a lower court ruling that allows homeless to stay in parks or sidewalks if there's no other shelter to stay. >> i think not allowing them to stay anywhere, literally having nowhere to go, it's unethical. >> reporter: the 9th u.s. circuit court of appeals ruled that prosecuting people for sleeping in parks or on sidewalk social security a violation of their 8th amendment rights. >> get their houses tore up, stuff tore down. >> reporter: several large encampments were recently swept near the union-pacific train tracks, but they only move a few feet away. >> from one spot to another spot. it makes it hard on them. >> the sweeps are a total waste of time. i've seen this now for 6 years since the jungle closed. they've not gotten into housing. >> reporter: late this afternoon, san jose's housing department put out a statement that says quote, the solution to homelessness is more housing that is affordable to low and moderate income households. in san jose, len ramirez, kpix 35. a new report out says some bay area corporations paid no federal income tax in 2018. they're among 91 fortune 500 companies that paid nothing, and that list included netflix, levi, chevron, and sales force. the left leaning think tank studied the first year that the republican tax cuts was in effect, and overall the report says the loss in federal revenue adds up to nearly $74 billion. at the same time the federal deficit has grown to nearly a trillion dollars this year. cliff erosion keeps threatening ocean front homes in the north bay, and retaining walls don't always help. kpix 5's don ford shows us the ongoing problem. >> reporter: it's one of those magnificent million dollar views. the problem is, the view keeps getting closer and closer to the house. there used to be a road between the house and cliff, but the cliff is eroding away, falling slowly into the pacific. the homeowner has approved permits from marin county to build a retaining wall, but the coastal commission said no. the coastal commission didn't get back to me. but long time resident and volunteer fire captain peter smith says. >> a couple years ago a few houses went down. >> reporter: this is not the first house to be threatened. >> it's constantly happening. where we're standing used to be a road. you build a house by the ocean, mother nature is going to get you. >> reporter: to prove his point, fire captain smith took me on a little tour. >> so that house was right here. and this whole area here is just oozing down constantly. >> reporter: example after example, lot after lot. he said the cliffs are all moving. >> this concrete down here. >> reporter: here he says is a retaining wall that was 40 feet up the hill. the wall and the house behind it all came down only 4 years ago. >> but i don't think there's a way to stop it. >> reporter: but this house still hasn't gone down yet, and the owner is still trying to save it. he has about 50 feet to go. don ford, kpix 5. still ahead on kpix 5 and cbsn bay area. >> reporter: i'm juliette goodrich in pleasant hill. they call these in-law units, and soon the bay area could see a backyard housing boom. >> >. no more space around the chase center? think again. the proposals for more development in the mission bay neighborhood. >> your favorite platform. they used to call them granny unit, but they could be the answer to the state's housing crunch. the governor has approved them. now 2 east bay communities want to fast track them. kpix 5's juliette goodrich is in pleasant hill where they're talking about it right now. >> reporter: that's right, the pleasant hill city council will be talking about it, and they're calling it an urgency ordinance to get the language moving to streamline the process and make it easier for people and it's already working. they call them granny units or in-law units. you name it, and now coming to a backyard near you, you may see more of them popping up. now that pleasant hills city council will be expediting the permit process. this is an example of a backyard cottage or in-law unit. the homeowners could actually rent it out down the road, and the ordinance, this emergency ordinance gives units like this the green light to go ahead and build cheaper and with less red tape. appealing to many homeowners like linda turner who has lived in pleasant hill for 40 years and has space to build but held off due to the time consumer permit process. >> i definitely have room for it in the back, so it's just which side we'd go down, extend the driveway or whatever. >> reporter: streamlining the permit and approval process will help create more affordable housing. >> the idea is it will generate housing supply. it's not going to fix the housing crisis, but it will make affordable options available to people in a number of different settings. it could be a garage that's converted to a housing unit. >> reporter: turner can understand why some might say not in my backyard. she says they need some rules and regulations. >> i like it as long as they're not going to build two story places and keeps the general, you know, look of the neighborhood the same. >> reporter: so tonight the city council will discuss this emergency ordinance, and tomorrow night in walnut creek they will be doing the same thing. also another note to this, the property owner does not have to live on the premises in this new ordinance as they do now. and this is a live egret here in front of the city hall that the producers were asking about. just wantedded to give you a side note as well. back to you. >> appreciate that, beautiful. let's take a live look at the chase center in san francisco tonight where even more development may be coming to mission bay. first the warriors proposed a 129 hotel and 21 residential units and alexander real estate has proposed a mixed use life sciences building. the city and board of supervisors still needs to approve these plans. now current plans include a 250 room marriott hotel under construction that opens in the fall of 2020 and a new school that's going to be open by 2025. load up your clipper card. your bart rides are about to become more expensive. the fares jump over 5 percent on january 1st. example, a short trip in 19th trip in oakland to the downtown berkeley station will only go up about a dime, but a longer trip from montgomery street to antioch will cost you about 40 cents cents more. the agency says the extra cash will go toward building new bart cars. the recent rain shapes up our lakes for boating, camping, fishing, and water sports come summer. there are 144 major recreational lakes in the state, and water levels are now at 114 percent of normal. a look now at sierra tahoe earlier today. sunny and fresh powder from the weekend. darren peck says dry weather is not here to stay, right? >> not going to had a chance to get outside on monday because the numbers don't tell the whole story. the numbers tell you that we made it to a very average day for the daytime highs, but after the week of weather we've been having, i think today was anything but average. you had a chance to get out and enjoy the sunshine. these numbers although typical for mid-december might have felt a bit warm out in the afternoon getting direct sun on you. we have 2 more storms out in the pacific. the first one out here lining up, not that far. and the next for saturday. let's come in for a closer look at this first one. bring them both on shore. the first one comes in right there. you see the time stamp that says wednesday morning? and that's really the way i think about this. it's going to be wednesday morning's commute to work that we'll pick up another enough. it will slow down your drive for the first half of wednesday. now the next storm arrives saturday into sunday, and that's it lined up right into the coast as we get into, right in between the 2. saturday and sunday. the general take away is rain both days. probably the second half of saturday into sunday. let's look at the one for wednesday's commute since we have clearer information. tuesday night, 10:00, already off the coast. but you can see the brighter colors here. the pops of yellows and oranges. as we get into the wednesday morning time frame, that says 5:00 a.m., and right over the heart of the bay area, there's enough rain we have to deal with it for the drive into work on wednesday morning's commute. 8:00 a.m., still here. watch what happens as we get into the afternoon. moves into the sierra. and we could have a few left over showers for the second half of wednesday. rainfall totals from the first system, those are good enough that that's a moderate storm for us. decent, not a deluge, but it's enough to get the streets wet. morning lows tomorrow, a little better than today. we start a gradual warm up now. if you thought it was cold this morning, the temperatures will improve gradually over the next 3 days. the daytime highs don't change. upper 50s for daytime highs, around average. except
