We still dont know whether the officer has informed investigators he saw a gun pointing at him or what exactly triggered his gunshots. I spoke with mr. Tindalls brother yesterday am of the he said he believes yesterday. He said he believes the Police Officer just didnt give his brother enough time to put his hands up. The officer, he did say it, but he gave them no time to even comply to what he was saying. Raise your hands [ gunfire ] reporter you feel the officer shot very quickly. He certainly shot quickly. That part is still not clear and its not quite clear on the video either. You see two men fighting. You heard the chief say a gun was present, but was it pointed at the officer . Did he perceive danger . Did he need to inflict deadly force in the officers mind because he believed the safety of others was threatened . Thats still not clear. The video was released well before b. A. R. T. Police planned on releasing it. Whats the story behind that . Reporter right. As we reported last night, the video was shown to Family Members last month. Oakland police were conducting the investigation, showed this video of the b. A. R. T. Police shooting to Family Members. It turns out a Family Member had shot video with his cell phone of that presentation to the family. So that video leaked out last night. We only saw a snippet of what weve shown you today. The b. A. R. T. Police Department Apparently felt very strongly that more context was needed, more video needed to be released and so in this instance they decided to release it to the public, but no indication that the policy here at b. A. R. T. Is going to change. It does not seem in the near future anyway that they will make this a habit, to release this kind of video this quickly after the incident. Understood. His Home Security camera sent him an alert and he spotted a prowler at his home in martinez on valley road. Kpix5 reporter Juliette Goodrich joins us now. The most disconcerting part was his wife and kids were asleep inside that home. Reporter yeah. Pretty helpless feeling. So hes got surveillance cameras set up around his home and when he got the alert, he checked up on his phone and saw this image, but imagine this. Hes in germany and as you said, his wife and kids are inside. Steven marist is used to his surveillance cameras capturing wildlife around his martinez home, but this was a first. He was looking in to see if anybody was around, if anybody was awake. Just the hall light was on. Reporter the only problem, steven was on a business trip in germany. He immediately called the Martinez Police. So i called them up and right away theyre like yeah, well have an officer out there immediately and i was on the phone with her live giving a description of the person i saw in the video. Steven put this video out on social media and he learned this intruder has been spotted on other surveillance cameras in the area. Fortunately steven is very connected to his community. He is head of his neighborhood watch. So he was able to contact Martinez Police immediately from germany and get them out here. The security concern surrounding guns in big groups of people have literally come to cinemarks doorstep. The theaters new policy prohibits oversized bags and backpacks inside. I agree. Reporter the policy says, in an effort to enhance the safety and security of our guests and employees, any bags or packages measuring larger than 12 by 12 by 6 inches will not be permitted into the theater with the exception of medical equipment bags and diaper bags. So in an effort to avoid Movie Theater shootings like the one that happened in aurora, colorado, in 2012, theyll either have to leave those bags in the car, have them searched or go home. But you cant forget about what else fits inside these oversized bags, candy and snacks that are significantly cheaper to buy outside the Movie Theater than to buy inside. I dont know. I think thats kind of stupid. Reporter why . Because people dont always want to eat whats in the Movie Theater and they try to charge a lot of money for it. Reporter industry insiders say theaters make almost half their revenue from the concession stand by charging up to 85 more than regular retail, but most movie patrons say thats just the price theyll have to pay for safety. Obviously they have their ulterior motive, of course, but still other things can be brought in in those bags. This evening new numbers show the amount of rapes reported in san jose are on the rise. In the past 10 years reported rapes are up 263 . Kpix5s kiet do on what could be behind those numbers. It sparked an intense manhunt for the suspect wanted for robbing and sexually assaulting a teacher in a classroom at a local middle school in san jose. He was eventually arrested a few days later, but if it seems like san jose has had more than its fair share of Sexual Assault cases lately, youre right. San jose inside has crunched the numbers of reported rapes for cities all across the south bay spanning the past 10 years and san jose is undergoing a trend like no other. Reported rapes are up 263 since 2007. Here at the ywca the Rape Crisis Center hotline gets 4,000 calls a year, a number thats steadily increased over the past decade. Ceo Dennis Crosby said it may be more victims are reporting the crimes saying the me too movement has helped victims come out of the shadows. We must insure as a community we recognize and uphold a survivors right to be supported and be believed. Reporter another factor may be the change in the fbis definition of Forcible Rape which used to be the carnal knowledge of a female forcibly and against her will, but in 2013 that changed to penetration no matter how slight without consent of the victim. The fbi says the old definition excluded 40 of victims. San jose police declined an on camera interview, but chief garcia told san jose inside it may just be more victims are choosing to come forward saying, we cant do this on our own. Its been a year since flood waters from the coyote creek spilled into san jose neighborhoods and forced thousands to evacuate and caused 100 million in damage. Today theres these barriers stretching hundreds of feet along coyote creek and the Water District hopes these barriers prevent disastrous flooding. This was the scene one year ago. San jose neighborhoods were sub emergencied in several feet of water. Fire submerged in several feet of water. Firefighters tried calling residents to escape. Today the streets are dry, but fixing the problems are far from over. None of us want a repeat of what happened last year. We went to washington d. C. In the spring to convene urgent need for large scale flood Risk Reduction projects here. Reporter the Santa Clara Valley Water District installed 3foot barriers to block storm water from the creek from spilling into the neighborhood and the district said its working with the army corps of engineers to develop a long term plan. Well be able to provide Technical Resources through the Water District as they pursue a study to evaluate what options can be done to address the coyote creek. So well work with the Water District to scope out specific areas that we can do on their behalf. They would fund us and then we would provide that service back to the Water District. Reporter still many residents say the damage is done. 150 flood victims are suing the city, county and Water District. The lawsuit says officials failed to prevent and warn residents of the flooding.
