shootings in two days. 1 on center road, and the other near a motel 6 in sunnyvale. we have live reports on both inciden incidents. police say this involves a suspect in a high profile murder last week. >> reporter: that is correct, ama. police wanted a man for shooting and killing another man in an office building. police say he was preparing to kill again when pulling out a gun and he aimed it at police officers. officer-involved shootings go through a lengthy process. one sunday night, number seven for the year. >> we have dangerous felons like this one, and he didn't comply with officers' commands, and attempted to go for a gun. using it on the officers. >> reporter: police say the suspect was wanted for a homicide in an office building last week. police are not identifying the suspect or officers involved. however, it appears an innocent bystander came close to getting shot as well. the owner of the laundromat says a bullet passed between his legs. police confirm the suspect didn't fire his gun, the bullet could only have come from an officer's gun. >> the glass shattered on my legs and it was bleeding, so bad. >> . >> reporter: lee says he locked himself inside. >> i called 911 and tell them don't tell police because there are four people, innocent people, inside of the store. >> reporter: no one else was shot or killed but officers will confront when with a gun. we know the name of a man a sunnyvale police officer shot and killed. he is allen matthew baker iii. we're live with the latest on this. melanie? >> reporter: this is the suspect that is still at large. he's from fresno and has an outstanding warrant in connection with a homicide. tonight an 18 year veteran with the department of public safety is on paid administrative leave. it's standard procedure following an officer-involved shooting. >> i think officers were faced with a deadly force situation and responded to it. >> reporter: around 4:00 p.m. saturday, people responded to suspicious behavior in this motel 6. they say two of the three men took off, running. according to captain hunter, one dropped a high-capacity magazine, then pointed a gun at the officer. >> the officer and the suspect were facing each other at the time of the shooting. >> reporter: officers identified the suspect shot and killed as 23-year-old allen matthew baker iii from san diego. they say he had a no boil arrest warrant for robbery. motel 6 guest andrea laura says she was startled. >> i heard gunshots and i saw a lot of people here. >> reporter: captain hunter says it's unclear whether or not baker fired rounds. investigators say they found another loaded gun in his backpack. they believe the second suspect is this man, shawn lamont brown. he has an outstanding warrant for his arrest in connection with a july homicide. officers believe brown is no longer in sunnyvale. a third suspect was arrested on a domestic violence warrant out of san diego county. seismologists say this morning 4.0 earthquake happened just before 7:00 this morning before oakland below a high school in the rock ridge area. surveillance cameras caught pets, and people reacting to it. seismologists say the shaking was strong because it was shallow, about three and a half miles below the surface. >> we never know if an earthquake is a precursor. there is somewhat of a greater chance of a larger quake within a week or so. it's a probability now of maybe 5% in the next week. >> the hayward quality generates a powerful earthquake in the 7.0 range. enough to do a lot of damage. every 140 years or so. >> it's shaking. yeah. that is a pretty good earthquake, there. >> morning news meteorologist felt our shaking. he kept his cool, reported the earthquake and moved onto the weather while the newsroom gathered information. >> abc7 news viewers tweeted us. christine says she watched it hit while mike nico was doing his report. jesse said it sounded like an explosion. and this is the pleasant hill now. what a difference it made in our current temperature readings. this is a 24-hour temperature change, 17 degrees cooler in napa now than yesterday. 13 degrees cooler in san francisco, oakland and san carlos. across the bay area, inland areas cooled down a bit. but there were hot spots today. here is a look at high temperatures, numerous locations in triple digits. 104 in livermore, 102 in concord. and one record high, a tie, moffett field died for a record high at this date. i'll show you the accu-weather forecast in just a few minutes. >> we seem to get hottest weather as kids are going back to school. that is the case in the east bay. and triple digits. we're live in antioch high school where a team has been trying to stay cool. jonathan? >> reporter: absolutely. they're nearing the end of sweltering practice and will be resting for another tomorrow. the best players, the most-important player on the field is this guy, right here. known as the water horse. on days like this, this best feature of antioch high's football field is the plumbing for these water stations. it helps an athlete perform like a star. the biggest star is this big, shady tree. >> did that tree make new friends? >> it did and has old friends that tend to go there. >> reporter: under the tree it was 96 degrees. >> are you ready? >> all of the cool kids are doing this. there are record lines at the water fountain in what is proving to be a teachable moment. >> the message is that we want to them to play safely. we do teach them about heat stroke. >> reporter: and sometimes, to play indoors. the class is normally on the playground but in this heat, it's all about air conditioning. and the district has a back up plan for that, too. >> these are just plugged into the wall. >> reporter: the funny thing about air conditioning is that it tends to fail when you need it. >> when you're drawing outside air, it's 110 degrees from the roof. we pull from the roof. >> you know back when we're kids we didn't have air conditioning. >> reporter: in antioch, abc7 news. and despite our hot weather, crews expect to contain the jerusalem fire by later this evening. it's 90% contained. evacuations have been lifted for the area near clear lake. the nearby rocky fire is now fully contained. firefighters lost major tools when grounding 15 planes like this one. a fleet wide safety check comes after a pro peller failed while a plane was on the ground in southern california. tonight the i-team investigates how a long-time driver for the u.s. postal service can't work because a police officer got a number wrong on a ticket he gave. >> there is good information in this story for all drivers and dan noyes is here with the report. dan? >> reporter: that mistake started a chain reaction and the driver had a difficult time getting police, and court to help fix the problem. >> reporter: gail is looking for another driving job, but last month, when she tried to get new car insurance, she received shocking news. >> i was just like, i couldn't believe it. you know? i said i'd been driving for a year. they told me my license is suspended. >> reporter: gail recalled in january, 2014 she got a fix it ticket because her jeep had a head light out. she had it repaired and mailed in a $21 check. that was gail's mistake. she misread the amount. it should have been $25. but the officer written her home address on the ticket incorrectly. that five should have been an eight. so gail never received any notice from traffic court about the extra $4 she oweked or failing to appear for her court date. >> when you write down what date i failed to appear and wrote march 28th. well, i never heard that date before. >> reporter: that is because the officer made another mistake, writing january 22nd as the date to appear. the same day he gave her the ticket. an sfpd spokesman e mailed the i-team, this is unfortunate and we have reminded officers to pass along information about ensuring citations are properly filled out. thank you for bringing it to our attention. that doesn't help gail. her $25 fine turned into $497 with penalties. money she doesn't have. raising two daughters as a single mom. >> i'm struggling as of now. i don't have rent this month. i'm expecting an eviction notice. >> reporter: gail turned to the lawyers committee for civil rights for help. >> when there is a mistake made by the officer or the court system, who has the obligation to fix and address the problem? in miss catrell's case, the burden was on her. >> reporter: there was a report about traffic courts further inequality for people of low income. total uncollected court ordered debt now exceeds $10 billion in this state. the report concludes california should end the use of license suspensions as a collection tool for citation-realited debt arcs louing more people to work and pay debts. >> the fines are just continuing to mount against mis-catrell. she can't do her job. she can't work. it would be impossible for her to pay the fees and fines in this part of the process. >> it just trickled down. it's just a shame. you know? it's actually, you know, i need reading, writing and visiting the dentist on campus. this is no ordinary school, one of two in west contra costa offering free dental work for low income students. leanne melendez is at coronado elementary. >> reporter: a few new parents registering their children today didn't know about the free service s. >> doing free dental care eliminates the needs for the parents to take off work to take their children to the dentist. >> sometimes, we don't have time to go. >> we can see them right away. >> reporter: the school will offer a free clinic, officials say it will keep students from missing classes. >> one way to keep them from missing classes is to have it on site. >> reporter: the city of richmond was able to save it. >> school district was able to partner with the city council to find the extra funds to keep the school open. >> reporter: voters passed a $380 million bond measure to rebuild their schools, corn in aedo -- coronado was one of them. >> it's an amazing school. >> reporter: parents will see the new coronado as the heart of this neighborhood. caltrans is backing off a controversial plan to use herbicide on a wetlands project in mendocino county. the agency is building a freeway bypass and will will be required to do major environmental improvements. caltrans was planning to poison invasive black berries to speed up the work. county supervisors opposed the work. caltrans plans to remove the berries by hand or machine. earthquake safety technology is being tried out for the first time in the united states at a new hospital going up in san francisco. 120 of these steel plates are being installed throughout the future sutter health hospital on van ness. they're called wall dampeners. they have a gel-like substance inside that acts like a shock absorber. >> this is an example of how much the building sways. the new hospital opens in 2019. some heat to talk about, it cooled off a little bit, though. >> which is nice. when you're ready. >> yes. we are indeed. cooling off on the coast but inland was still hot. mainly sunny skies now, but the fog which was earlier confined to the coast is beginning to push out over the bay and patches will push inland later in the evening. here is the view from sutro camera. you can see fog bringing with it cooling affects. it's 66 degrees in san francisco. 70 in oakland. 84 in san jose. 62 at half moon bay. check out this view of the western sky and satellite off the bay waters. it's 82 degrees now in santa rosa. napa, 75. fairfield, 96. concor99. heat is slow to retreat. there is the golden gate. the fog hovering over it. forecast features we'll see a foggy night along the coast. back to average temperatures by wednesday for the bay area, and air quality is already improving. here is the view from our east bay hills camera. improvement is coming in along with the fog. today was a spare the air day. tomorrow will not be. good air quality across the bay area thursday and friday which is good news. here is the satellite image we had a large ridge of high pressure so that is helping out with a retreat of the heat. we'll see temperatures moderating over the next couple days. overnight, look for fog at the coast low temperatures upper 50s to low 60s. tomorrow, another sunny and warm but not hot day. look for highs in mid-80s. low 90s farther south in gilroy. upper 70s to mid-80s. 84 in redwood city. mid to upper 60s on the coast. a touch of fog. up in the north bay, mid-60s on the coast and inland valleys warming up to 86 in santa rosa. in the east bay, still, quite warm with the two tunnels are essential to move water from northern to central california. northern california farmers say the tunnels would destroy a vital water system. some state lawmakers want to raise taxes to provide more health care coverage to millions of californians. supporters say 9 million low income californians are covered, however, they cannot receive care. doctors are reportedly turning them away because reimbursement rates are too low. they want more funding. critics say another tax is not the answer but something that should be covered in the $115 billion budget. just ahead on abc7 as a former 49ers exec sif showed off the latest concept for a stadium concept the raiders and chargers hope to share in carson, in southern california. >> you ready forfootball? >> reporter: people nfl players who object to terms of the phone shall billion dollar concussion settlement filed appeals today. it challenged exclusion of future cases of cte, the brain decay some link to football concussions. negotiators say the science is still evolving. the national labor relations board ruled that northwestern university football players cannot form a union. the ruling overturns last year's decision the northwestern athlete could unionize. the decision would have paved the way for the nation's first union of college athletes. the board nixed the players athletes saying it would be unfair for them to be a union while players elsewhere are not. wildfires in the northwest require evacuations as flames consume homes and businesses. massive fires are raging out of control now. 50 structures have been turned to cash in central washington. in idaho, wildfires destroyed 42 homes. a good sign in eastern oregon, higher humidity and lighter winds allowing crews to slow the spread of the winds and the so called warm fire that started yesterday is burning 300 acres and 50% contained. >> we were hr drawn down on resources with other fires. >> officials say 7 million acres burned so far this year, more than the two previous years combined. a newly proposed state law would mean big fines for drone users. drones interfered with responses 13 times in california this year. lawmakers behind the legislation say it's getting out of hand. if approved would face $5,000 fines and authorities would have the right to shoot down those drones. we've learned who the two kids were who were killed tragically by a falling tree branch at yosemite last week. two high school friends out of orange county. justin lee and dragon kim. we don't know whose family they were with. a large branch fell on their tent. their high school in southern california is offering grief counselors to friends. a new report released on the deadly end to last year's bank robbery and hostage standoff claims 600 shots fired by police were excessive. the nonprofit police foundation found some officers only fired because other officers were shooting. the incident resulted in the death of a bystander. >> there have been no claims of responsibility for a bombing that killed 18 people in what is called times square of thailand. surveillance cameras captured the blast in a hindu shrine in the area. back force came up with 32 recommendations. we completed each and everyone of those. >> reporter: he has been consulting with afghanistan president for years. >> we met in afghanistan while worked at the college of engineering. both of us went to american university of beirut and were college roommates there. we've been friends for 47 years now. >> he's exceptional. an exceptional prince. >> reporter: he helped arrange an interview between the president there and me and we talked about programs funded by u.s. aid for national development. these images are from roots of peace. agricultural development is one of the key programs. also efforts on education, energy and information technology. he says afghanistan is strategically located and could connect countries with fiber optics,
