a woman on the san francisco waterfront this week. abc7 news has learned that this man 45-year-old francisco sanchez connessed to -- confessed to killing kate steinley. he has been deported a number of times. it is calling into question san francisco's immigration policies. here is vic lee. >> flowers mark the spot where katherine was fatally shot on wednesday evening. abc7 news learned divers from the police boat tanned a gun off the waters of the pier. tests are being done,t investigators believe it is the one used by francisco sanchez. he is now charged with the murder. sanchez is on probation in texas. he has a long wrap sheet. sources say he has been arrested not only in texas, but oregon and washington. he has also been deported to mexico five times. in fact ice had him in custody in march, but turned him over to the sheriff's office when they discovered he had an outstanding drug warrant here. the d.a.'s office dropped the case that dated back to the 1990s and the sheriff's office subsequently released sanchez. they requested notification prior to his release so they could take him into custody again. they say the detainer was not honored. the city supervisors two years ago approved policy that would prohibit local local law enforcement that would prohibit local detain neithers unless they were convicted of other crimes besides human trafficking in the past seven years and was in custody again on a similar offense. he carved out an even stricter policy which in almost all cases required ice to go to court. >> if a judicial order was to be reviewed we would order the warrant. there were none in this case. >> ice said all they wanted was the courtesey of being told that sanchez was going to be released. vic lee abc7 news. across the board we are many people who came out to pier 14 were getting pictures of the bay bridge and most had no idea why there was a collection of flowers in the middle of the pier. that collection of flowers marks where katherine was killed on wednesday. her parents tell us they are happy so many people have come to pay their respects. this collection of flowers for katherine has been slowly growing. the memorial has made a big impression on her parent. >> it has helped liz and i and it is a positive thing and a horrific situation. it has really helped. >> he is still trying to process what happened and the fact that she is gone. >> i have a little solace i was with her and i have the overwhelming grief of a father the moment she was shot. >> her parents called her kate, a young woman with a playful personality and often at the center of her group of friends. she never ventured far from her connection of family. >> when she would leave here to go home she would text and say i am home okay. for a 32-year-old that's just the way our family is. >> they are not ready to forgive the suspect, francisco, sanchez but they don't want to blame anyone after learning he was not turned over to immigration agents by the sheriff's department even after being deported five times. they just don't want a similar swages to happen again. >> hopefully maybe a legacy for kate that because of this it won't the cockpit and you are safe. >> being computerized doesn't mean it is easy to set up. there are 10,000 fireworks that need to be carefully unpacked loaded to the right tubes and then loaded to go
