Starting off the week at the jersey shore i just need to know if the funnel cake stores open just a couple of details yes, exactly. The boardwalk fries, the lemonade im going to gain 20 pounds and come right back. But we are having a wonderful time here. Iconic announcer this is an nbc news special report. Heres kate snow. Good morning. We have breaking news from the Supreme Court. It is a landmark decision for the lgbtq community. The justices ruling that it is illegal for workers to be dismissed from a job based on Sexual Orientation and gender identity. Nbc justice correspondent Pete Williams joins us with all the details. Pete, what can you tell us . Well, this is a stunner, frankly, coming from this conservative Supreme Court that no longer has Anthony Kennedy among the justices, the man who wrote all of the gay rights decisions before. But today, the Supreme Court has ruled that title 7 of the Civil Rights Act of 1964, which makes it illegal for employers to fire employees on the basis of sex, also covers Sexual Orientation. Now, the lower courts had been divided on this, and the Trump Administration sided against this ruling, saying, no, that when Congress Passed the Civil Rights Act in 1964, nobody was thinking about Sexual Orientation. It was simply discrimination against men or women. But today, the Supreme Court said, no, thats not the case. Sexual orientation is considered part of that 1964 Civil Rights Act. Now, this is a victory for an atlanta man, gerald bostauk, who worked for the county and was fired after his employer found out he was on a gay mens softball team. He sued and the court said sorry, you cant sue under the Civil Rights Act, it doesnt cover Sexual Orientation. And the Supreme Court today said thats wrong. Its an issue that divided the lower courts. On the same day this was argued, the Supreme Court heard a separate case on whether its also illegal under this same civil rights law to fire someone for transgender status. We dont have that decision. The Supreme Court, as you know, in this time of the pandemic is not actually in the courtroom. All this is happening virtually. And frankly, all we have so far of the decision is the very first page. But im told now that its starting to line up. And the vote is 63 with neil gorsuch, one of the trump appointees, joining the chief justice, john roberts, and the courts four more liberal members, to form this 63 majority. So, this is a huge thing. And i would just say one other thing about this, kate. Gay Rights Groups considered this even more important than the fight for marriage equality, because while not every gay person in america gets married, most gay adults want or need a job. And as of just a few minutes ago, it was possible to get married on sunday and legally fired on monday, but no more. Kate . And pete, you mentioned neil gorsuch. You had told us when we were preparing for this possibility today that he argued in the argument, you know, indicating that he might accept this argument, that these rights are covered by that statute. Yeah, he said that, actually, more in the transgender argument, but he seemed to be among the conservatives the one that was distantly possible to maybe be peeled away to join the majority, and thats what hes done here. Well have to see what the logic is as this this thing is i guess there are so many people on the Supreme Court website that the pages are loading very slowly, but at least we know what the bottom line is, kate. Well, why dont we let you read that, pete . And ill jump over to nbcs Peter Alexander at the white house, who is with us as well. Peter, this is a landmark ruling. Any reaction yet from the white house . Reporter no, kate. Actually, we just reached out to the white house moments ago. We havent heard from them yet. The president s been tweeting on other topics over the course of this day. This has not been top of mind from him. But you know, lgbtq activists and allies have said there really has been this whiplash between the Obama Administration and the Trump Administration in terms of their policies on issues related to the gay community, so this will certainly be hailed as a victory in those communities. What the white houses position on this will be will be interesting. We wait to hear from the president on this topic, as hear from him a little bit later. We know there has been a lot of focus on some of the other issues that the courts been reviewing as well, including issues as they relate to the president s taxes and the issue of daca. On this one, though, certainly, were still waiting to hear from the president how he tries to frame this, even though his administration has been pushing to try to roll back a lot of the Obama Administrations efforts to provide new opportunities and rights to members of the gay community. Kate . And let me go back to Pete Williams. Pete, have you had a chance to read any of this yet . And does this now apply nationwide . Yes. The answer is it does apply nationwide. Now, some states, a small number of states, had their own laws that made it illegal for employers to fire people on the basis of Sexual Orientation, but now, this is the guarantee that applies nationwide. So, the majority opinion was written by neil gorsuch. So, clearly, the chief justice assigned him the opinion, which gives it extra punch. And let me just read a couple of lines from what he says. He says, sometimes, small gestures can have unexpected consequences. Major initiatives practically guarantee them. In our time, few pieces of federal legislation rank in significance with the Civil Rights Act of 1964. He talks about title 7, outlawing discrimination on the basis of race, color, religion, sex, or national origin. And he says, today we must decide whether an employer can fire someone simply for being homosexual or transgender. The answer is clear an employer who fires an individual for being homosexual or transgender. So, now we know what the second case is going to say. Fires that person for traits or actions it would not have questioned in members of a different sex. Sex plays a necessary and undisguisable role in the decision, exactly what title 7 forbids. So, now we know, even though we havent gotten the second decision yet, we know what its going to say, that title 7 not only makes it illegal to fire someone on the basis of Sexual Orientation, but also on the basis of transgender status. Now, this is a case that came from michigan. Amy stevens, who worked for a funeral home, told her employer that she was going through a sexual reassignment and would start coming to work dressed as a woman. She was fired, and she sued, and she won in the lower courts. And now it appears, from what Justice Gorsuch is saying in this opinion, it now appears that hes going to side with her. She died of a kidney ailment just a couple of weeks ago, so she will not live to see this victory, kate. So, in other words, this is not just affecting one community, pete, this is affecting two broad communities. Were now talking about Sexual Orientation and gender identity being protected by that statute. Yeah. And you know, this is the gender identity movement, this is really a nascent movement here. Its just getting started. This is the first Supreme Court ruling ever on this question of transgender rights. There was one that came up here a couple of years ago of a student from a virginia school, but it ended up not being decided. The Supreme Court has never decided a transgender until today, and its an opinion written, it would appear, by Justice Gorsuch, although we dont know we havent gotten the second case yet. We should be getting it here in a few seconds. Well see if he wrote it as well. But he turns out to be the key vote on that issue as well. And do we know, pete you mentioned states that already have their own state statutes, and this will now broaden that to other states. What happens in states where theres been resistance to this idea . What happens in states that have opposed transgender rights, for example . Well, its now illegal to fire somebody on the basis of transgender status. And of course, these laws are administered by the equal Employment Opportunities commission. What usually happens here is if someone is fired and they believe that they were fired for being transgender, then they sue. And you know, depending on where you lived, up until today, you might or might not win, if you lived in a state that had that coverage or if you lived in a state that was in the federal circuit where the courts had said, you cant do that. Now its true nationwide. There will be so much reaction to this today. Im sure its i cant check my email right now, pete, but im sure its already pouring in from lgbtq groups, advocacy groups. This is something they have, as you mentioned, been fighting for, perhaps even more important and significant than samesex marriage was. Advocacy groups had said all along throughout this case, a gay person can get legally married on sunday and get fired on monday. That was their point when this case was being considered. And pardon me for looking away from you, but im awaiting we all are staring at the courts website for the next decision to come up. Theyre supposed to come every ten minutes, but it still hasnt been posted. But i cant emphasize enough what a stunner this is that you know, if Anthony Kennedy had still been on the court, then perhaps we would have expected this decision, but hes gone, replaced by a justice whos much more conservative, brett kavanaugh. Of course, Antonin Scalia died of a heart problem, and he was replaced by neil gorsuch. So, you know, can you imagine Antonin Scalia writing this decision . I dont know about that, but here comes neil gorsuch. Now, i will say this those people who were, what they call textualist, who believe that you decide cases based on what the law says, did put their hopes in neil gorsuch. Because while it is true, indisputably both sides here agreed that when congress was debating the Civil Rights Act in 1964, nobody on that, in the congress, was thinking about transgender status or Sexual Orientation. Thats a for sure. Okay do you think it reflects in some ways im told now i just realized now that its the two decisions are combined together. So, now we know that, for sure, it is 63 on both cases. But the hope was that neil gorsuch would say, it doesnt matter what was in the mind of congress. All we care about is the words of the text of the statute. And thats why there was some hope that he might provide the controlling vote, and he has. Right. Not just the controlling vote, but actually written the opinion, you said. Yes. Well, and, not just the controlling vote, but given them you know, 54 would have won. 63 is a much bigger victory. Right, right. Does that speak to you you cover the court. Youve covered the court for years, pete. Does that speak to where we are as a culture right now . You know, can we read into this, that perhaps, culturally and societally, we are more in favor of lgbtq rights . Well, you know, i think, certainly, that was true for gay rights, because the Supreme Court has gradually gotten to that point where with, first of all, saying, you know, if a state passes a law singling out gays, it cant do that. And then finally, the decision on samesex marriage, which was huge. But the transgender thing has moved much more slowly through the courts. Its really a much newer issue. And frankly, its been fought mostly over the issue of bathroom access. Remember, thats what tied North Carolina in knots, and they finally decided to go in a different direction. So you know, this is a question that has not been chewed over a lot in the lower courts, and that is why its somewhat surprising that the Supreme Court has sort of leaped ahead of all that. So, i think the simple answer to your question is yes. And as someone whos covered the community and covered transgender rights, i can tell you that bathroom issue is something advocacy groups have really not wanted the focus to be on. They would much rather we be talking about these broader issues, as far as lgbtq rights. Yeah, and pete, ill let you go go ahead. It came up during the argument as well. The justices seemed to want to talk about it, but obviously, they got to the bottom line. Just to recap, a 63 decision out of the Supreme Court today. A landmark ruling banning discrimination in the workplace against anyone who is gay, anyone who is transgender. Asbury park wanted people to eat inside as well, but when Governor Phil Murphy sued the city, they changed their mind. Im going out of business and if we lose the local businesses, we lose asbury park. Reporter theyre desperate to open by summer when business is best. Right now, new jersey has the second highest number of covid cases in the country. Over 166,000 and more than 12,500 deaths. The most densely populated state right next to the most densely populated city new york. When coronavirus took hold here, it spread like wildfire. On march 4th, the first case was reported by march 19th, the state was shut down. On april 30th, 458 people lost their lives. The most in a single day were in the fight of our lives and remain in the fight of our lives. Reporter the hospitals were overwhelmed. Holy name medical center, the number of icu beds skyrocketed more than five fold. Getting tested wasnt easy there were excruciating lines. People even told to get there the night before halfway through april, 95 of the longterm care facilities had at least one case of covid as deaths mounted, so did the economic toll. Between midmarch and early june, over 1. 2 Million People filed unemployment claims. Many Restaurant Owners couldnt keep paying salaries while they were shut down its been totally crippling its awful reporter now as summer begins and the curve flattens, glimmers of hope for a state with true grit being tested like never before so there were religious Services Held over the weekend in places of worship they had to follow those indoor gathering rules. 50 or 25 capacity depending which is the lower number. I mean, listen you mentioned this we were the second hardest hit state in america over 12,600 fatalities the virus indoors is far more lethal than when its outdoors we have to be very careful about opening things up that are inside, lack of ventilation, close proximity. Well get there. No question well get there. Were just not ready yet look. I dont know if people can hear, we have a heckler whos yelling about this very thing. I mean, this rage that people feel about businesses not being opened fast enough, its real. Why arent you moving more quickly . You know, a lot of Business Owners say its kind of arbitrary. Why can i walk to home depot with a hundred people but i cant go have a meal yeah. This guy deserves to say what he wants to say, but honestly overwhelmingly the majority of folks get it we make the decisions. Theyre not arbitrary. Theyre based on facts and data. Weve driven down the positivity rate, the rate at which the virus spreads are way down probably leading the nation right now. Weve just got to keep it down inside is a lot harder than outside. But with this weather, this is as good as it gets were opening back up and it feels great. Have you thought about picking up the pace of reopening . I think were comfortable where we are i dont think we can responsibly go faster. Well get there to Indoor Dining casinos which are a huge part of the economy in our state in atlantic city, well get there but weve got to do it responsibly. Weve seen the protests that have gone on you attended one protest you changed the rule so outdoor gatherings of more than a hundred people could go on some Business Owners see a double standard. Listen, outside versus inside i cant say it enough. The other thing about protesting, we understand the right to protest but wear a mask and stay six feet apart if you can. And get tested all of which is essential. The governor in new york said yesterday he would consider shutting it down again because he received in the state 25,000 complaints about businesses and individuals not sticking to the rules, not doing the social distancing we saw those crowded scenes in new york if it comes to that in this state, are you willing to go backwards there . You have to leave that on the table as a consideration i hope to god we dont have to we now test more than any other state in america were building up our Contract Tracing and isolation plans. I hope if we see this thing god forbid come back around, we can drive it back into the ground. How worried are you about a surge either from the protests or other gatherings . We saw memorial day. In the sun belt, many states are seeing that surge now. Im less worried about the outdoor stuff. Im far more worried when we get inside my gut tells me and im practicing without a license that this will come back, but god willing it will come back in spurts that we can with testing and Contact Tracing surround it and push it back down. What an interesting time we live in. Were facing a pandemic and also this moment of great reckoning and upheaval with regard to Racial Injustice in this country. You attended a protest with your family theres a movement afoot to defund the police. Do you support defunding the police we attended two protests and it was extraordinary one Community Overwhelmingly of color and one overwhelmingly white. Eve. This is a mosaic with lots of pieces in it. We have to build up. Weve been investing since day one in the state since we heres what i believe. And well continue to do that. We need to obviously continue to deepen the relationship between Law Enforcement and our communities. We made a lot of progress. God knows as a state and as a country we still have a long way to go. To put a fine point on it, when the slogan is defund the police, is that something you can support . I dont think its a black and white question ive always thought what are your priorities . Whats your budget say, not just your words but where are you putting your money we believe in lifting communities up and deepening engagement between Law Enforcement and our communities. Well continue to stand for that you had dinner with the president friday night in bedminster here in new jersey. You said you dont hold your punches with him whatd you talk about . We talked a lot about coronavirus and our economic recovery we talked a lot about infrastructure the president approved a huge project for this state in this region the socalled portal north bridge which has been sitting there waiting to get replaced since 1910, believe it or not. And hes put his name on that. Thats a huge step 15,000 jobs in new jersey. Lets get started with your news at 8 00 the deadly Police Shooting of Rayshard Brooks in atlanta this weekend adding to the outrage that erupted three weeks ago with the killing of george floyd. Blayne alexander joins us now from atlanta where she spoke with brooks widow good morning reporter hoda, good morning. This morning we are expected to see protesters take to the stat these images are capital. Were already seeing a steady ss behind us. Were learning more information about brooks final moments. All of it played out on six different angles of video. We want to warn you some of these images are disturbing. On the streets of atlanta this morning, renewed calls for justice bearing a new name. Rayshard brooks. The 27yearold shot and killed friday by an atlanta Police Officer. Overnight the medical examiner announcing brooks died from two gunshot wounds to the back. The death ruled a homicide. The charred remains of this wendys set ablaze amid protests marked the spot where he spent his final moments. Officers responded to a call that brooks, asleep in his car, was blocking the drivethrough. Body camera footage shows a mostly calm interaction. Brooks taking a sobriety test which investigators say he failed. But 43 minutes into the recording, as an officer tries to arrest him, chaos. Stop fighting youre going to get tased reporter this eyewitness video shows the struggle. Investigators say brooks grabbed an officers taser. Here you see him running away from police and appearing to point the taser at them. An officer responds with fatal gunfire. Hoda spoke with the brooks attorney earlier this morning. They could have easily waited and caught him later or let him be blocked in by the officer that was responding. It was just unnecessary. Reporter brooks wife Tomika Miller still cannot face that moment. So you still havent watched that video . Nope. Im already in enough pain right now. So to see anything of my husband being shot down or i couldnt see that. I cant stomach that right now. Reporter within hours of the shooting, the citys police chief resigned. The officer who opened fire terminated. A second placed on administrative duty. But city leaders say thats not enough. Everyone knows that pulling a gun is one thing and then shooting. That just hit me, that disturbed me. And i couldnt understand why that happened. So thats why we need to review every single procedure, every single policy. Nothing can heal the hurt, the pain. Nothings going to bring him back. Again it keeps going on and on. Im not the only one going through it. Reporter right now there are at least three separate investigations going on. To find out exactly what happened on friday night including one by the areas District Attorney who says that he could announce his decision on charges as early as this week. Savannah . All right. Blayne, thank you. Here in new jersey, one of the Supreme Court ruled it is illegal to fire a worker because they are gay, lesbian, or transgender. Pete william joins us. This is a stunning decision from newly conservative Supreme Court by vote of 63. The court said existing federal law makes it illegal for employers to fire them because theyre gay, lesbian, transgender. They said it is illegal on the Civil Rights Act. Today, the court said while Sexual Orientation was not on the minds of anyone in congress when the law passed, it is the words of the law that count. Firing on the basis of sex orientation is a form of discrimination. Gay Rights Groups consider this an issue. Every lbgt needs a job. That same law makes it illegal to fire employees because theyre transgender. What makes the decisions more surprising is they were written by Donald Trumps first Supreme Court appointee, neil gorsuch, joined by john roberts and other liberal members. 21 states had laws banning discrimination based on these factors, now it is the law of the land. Weve been doing a lot of charity fund raising in the next couple weeks, were going to be doing a live stream show to benefit jersey shore musicians. Trying to do what we can, stay as positive as we can. What does it mean to look around and see people are here, life is coming back to the boardwalk. Its an amazing boardwalk ive been here for 17 years. And the redevelopment of it is its the reason i came here to watch our city grow and well grow again what are the challenges now, anthony . You have its a Lemonade Stand. You have fries, you have lemonade you employee a lot of young kids who maybe has their first summer job. Now when you have this reality of coronavirus, how has that changed how you operate in the business youre running . Its changed a lot. This is just the health care component, the covid we have 50 to 60 teenagers who work for us, this is their first Work Experience its important i take that responsibility seriously i have to make sure not only the kitchen is safe with knives and fryers, but that register.
