many high schoolers hoping to get into college. charlotte spent part of her summer here at classroom matters learning the best strategies to get a 1,600 on the s.a.t.s. >> there's a lot of people who don't have the money or resources to get that prep. >> reporter: that's the crux of the debate on whether that's an unfair obstacle for student who is don't test well. >> how are kids without that privilege supposed to compete. >> a pro bow know law firm out of southern california claims using s.a.t. and a.c.t. scores to help decide who gets into college discriminates on students on bases of race and wealth. they filed this lawsuit today against the university of california calling the system's use of the test scores unkons substitutional. >> i understand why it feels helps run the tutoring center, >> reporter: even though tatiana she says her son is opting out of taking the exams. >> we're not going the to add that stress to our lives. >> reporter: a spokesperson for the university of california says we are disappointed that plaintiffs have file aid lawsuit when the university of california has already devoted substantial resources to studying this complex issue. and those resources include creating a special tax portion in charge of investigating the role that the test scores play in the admissions process and the task force is expected to release their findings later next year. >> thank you melissa. two people arrested for home invasion robberies are facing charges tonight including kidnapping, grand theft, and carjacking. officers booked them last week. invs. gators think they're part of the group that broke into a home and tied up the people before robbing them. police also arrested two other people but they have yet been charged. no sign of life on white island in new zealand after a volcano erupted sunday night our time filling the sky with fiery ash. six people are dead, eight still missing. among those missing is kathy huang. the san francisco woman was in new zealand, but did she leave before the volcano erupted. her family desperate to find out why she's on the missing list. sonja shin spoke to huang's family. >> reporter: yes, jessica, kathy huang's family have been trying to reach her all day. >> it's unknown. what do you do? you know? as parents? >> i suppose she should be safe, nothing happened to her, i hope so. >> reporter: kathy's father told us she left the day after thanksgiving on a trip to new zealand and australia. he doesn't understand why she's on the list of the missing because he heard from her that she left new zealand before the volcano erupted. he hasn't heard from her since. >> after the volcano, i'm worried about her. >> reporter: kathy is a nutritionist in san francisco. neighbors describe her as quiet. she's listed as missing. >> my son is dead eight years ago, so i know the feeling. i've been there. yeah. so, i'm sorry for them. >> i'm just a bundle of nerves. i'm absolutely just a bundle of nerves. just what do you do? you know, you try to keep the positive thought because, you know, miracles do happen. >> reporter: kathy's sister shelly has also been trying to reach the red cross to make contact with her sister. reporting live in san francisco, sonja shin, nbc bay area news. taking you outside for a look at the golden gate bridge. the roads are dry but rain is on the way. jeff raniere has a look at when we can expect the change if the weather r. we're not expecting a huge storm like before, jeff? >> it definitely is not compared to the past couple of storm systems we've had. just enough to get the roadways wet. it's starting to break apart a little bit as we get a stop here on the radar. the overall view, the bark is really worse than the bite so to speak with this one. we are seeing moderate to heavy returns but what is touching the ground is a lot lighter. nonetheless, be prepared for wet roadways across the north bay. we're tracking to the north and east. picking up in st. helena by 6:38 tonight. off to the south we're beginning tty showers into san francisco. that will make it to the east bay and a slight chance down here for the south bay. we're going to be tracking more of this and we'll have details and what's ahead for tomorrow and the days ahead coming up in 15 minutes. >> thank you jeff. there's a good way to get the updates on the forecast. jeff is always tweeting out the conditions. just follow him. his handle is @jeffraniere. >> after the forced power outages in november, california voters want pg&e, want a makeover. a new poll shows people are divided over what should be done. 37% want to get rid of investors and have the state or cities and counties take over pg&e. 25% want to restructure the company and split up the gas and electric divisions or sell it all to another utility. only 12% say the current structure should stay in place. 28% are undecided. 12 unlicensed contractors faced a judge today after being accused of illegally bidding on a job. the contractors showed up after the 2017 fire storm. the home they targeted wasn't directly impacted by the fires. however, undercover fraud investigators got bids from those contractors from everything from landscaping, painting, even remodeling. the lowest bid came in at $3,000. the highest bid at o-20 grand. you should know any bid on work above $500 is illegal for unlicensed contractor to do. it's a common problem across the bay area. now it's happening in sonoma county. the county wants to move hundreds of homeless people out of a park in santa rosa. that camp is taking over the park and a court order is preventing the countity from moving the homeless people out. mark joins us with the homeless battle. mark. >> reporter: you can see here just a small part of the homeless encampment that has taken over the trail park here in santa rosa. the item on how to deal with this is up for the county's agenda tomorrow -- i'm sorry, a week from today. meanwhile, this camp keeps growing. >> for more than half a mile, tents and tarp shelters line the bike path of the park. a sign at the enentrance warns people to avoid going in. matt cook lives in the neighborhood. >> i've never seen anything like this. >> reporter: ben peterson lost his bike this morning, said someone in the camp stole it. >> i tried to grab it and they said nope, this is my bike. >> reporter: this park trail is county property and a resident the camp filed a lawsuit in court and got an injunction preventing the county from removing people unless the county can provide another place for them. >> it's unfortunate, the situation. >> reporter: jason has been living on the streets since he lost his business sales job and then his house. >> as soon as you're not paying, you know, you're out on the streets. >> reporter: people like amy have been bringing food and clothing and hauling out trash. >> it just takes time and belief and i believe in people. >> reporter: the head of the county department that oversees the homeless says the other location mandated by the court order ought to be a proper shelter which is what we are hearing from the people here. >> absolutely, yeah. absolutely. >> reporter: any kind of shelter? >> yes, yes, absolutely. >> look at i. it's crazy. i don't like living like this. >> reporter: back live now, the head of the county's homeless program, the so-called czar and homeless advocate dos agree on one very big point. they both say that the people in this park should be put immediately into a shelter rather than first programs and then shelter. so, that is a hurdle. that's what will be proposed one week from today at the board of supervisors. reporting from santa rosa, mark matthews. >> we see the rain coming down if as well. another step to help the housing crisis, a new property tax on multimillion dollar buildings is heading to the ballot in san jose. mayor sam la car doe rallying with advocates before the meeting. the tax is intended to raise taxes. it would only apply to buildings worth more than $2 million. one resident where homes top $2 million isn't buying it. >> i don't agree that it should only be on -- based on a certain valuation of the home. i think if we would taxed, it should be taxed equally across all homeowners. >> it'll go before voters in the march election. okay. cold hard cash for guns. that's what you can get this weekend if you're willing to turn in your weapons. the gun buy back comes after two high profile shootings in south santa clara county this summer. but one law enforcement agency will be noticeably absent from the buy back. damian trujillo is live. who's skipping it and do we know why? >> reporter: jessica, the sheriff's office will not be here and we're still not sure why that is. they've held their own gun buy back events in the past but for some reason they are skipping this weekend's partnership. christmas hill park is peaceful today. a memorial still adorns the enentrance. but this was the scene in late july at the garlic festival. [ sound of gunfire ] a mass shooter killed three people and injured more than a dozen others. >> the gilroy community has come together. it is starting to heal. >> reporter: just a month before, another active shooter just ten miles away at the morgan hill ford dealership. so, today the d.a. and local police agencies came together to announce their efforts to take guns off the streets by offering cash for any gun. >> far too often we see those unwanted firearms ending up in the hands of convicted felons, used in robberies. >> reporter: one police agency that was noticeably absent from the announcement was the sheriff's office which patrols a large portion of south county. we're told the agency was invited. it's unclear why deputies declined. >> you would have to ask that question of the sheriff's department. >> reporter: no one in the sheriff's office was available today to explain. the department has held its own gun buy backs in the past. >> if it saves one life, it's worth it. >> reporter: gilroy and morgan hill will be there on saturday, two communities that will forever share a common bond. and the event begins at 9:00 a.m. at the citicorp ration yard here in downtown number of people riding trains to the airport. two dozen dogs will soon be reunited with their owners. these dogs were in that van in fremont that was stolen yesterday. however several of those dogs are still missing, believed to sb have been sold. jodi hernandez joins us with the new developments. jodi. >> reporter: raj, i'll tell you two dog owners have already picked up their pups. another one, we're told, is on his way driving here from washington as we speak. i'll tell you it has been an emotional couple of days for those dog owners. you're looking at some of the stolen dogs who are being cared for at the oakland animal shelter after surviving a terrifying ordeal yesterday. police recovered the dogs in oakland aboard a transport van that was stolen from a fremont hotel parking lot. now animal control is working to reunite the pups with their owners. >> my hope for these dogs is their safety and welfare and they -- if they're owned, they get back to their rightful owner. if they're headed to a rescue, that they get their safely. >> reporter: this rescue dog named ava was on her way to their new family in washington. they've been worried sick. >> she hasn't had an easy life and the idea for us was to give a dog that doesn't have a perfect medical record and is not going to be a candidate for a breeder to just have a healthy and happy life. >> reporter: but while police recovered 24 dogs, at least two others are still missing, believed sold to people on the street. three month old papa was supposed to have been delivered to his family in washington today. he even has a christmas stocking waiting for him. >> these animals become extensions of your family. i just hope he makes his way back to us. that way we can have a nice christmas. >> reporter: this puppy named fable has a family waiting for her too. tonight, fremont police say they may have a lead. they say this woman posted a photo of a pup that looked like fable on social media. they are hoping to talk to her about where she got it. and we just got a bit of good news. fable's owner says she's in touch with that woman who made the social media post and the woman says she intended to surrender the little dog. she says she had no idea the dog was stolen. i'm jodi hernandez, nbc bay area t news. the community is rallying around a family of a doughnut shop that shut down. they were in business nearly 30 years. the owner said the shop couldn't afford the soaring rent in the area anymore. members set up a gofundme to support the family as they transition out of their business. so far they've raised $3,500. >> there's a chance we could have chucks back. >> we'll see. it's a tough situation to be in for so many people. >> it is. jeff raniere, we saw mark matthews. it'somainfall right now and light rainfall down toward san francisco. as the storm system moves in tonight, this is nowhere nearly as strong as the wet weather we have dealt with over the past couple of weeks. as you can see on our radars right now we do have that system starting to push into the bay area. all of the radars are over doing this just a little bit but none the less light to moderate rainfall moving northeast into st. helena by 6:46 tonight. 101 corridor, wet here points off to the north. american canyon, rain fall by 6:59 tonight. we've also started to see showers developing in san francisco and that'll keep going here as we head through the next 30 to about 35 minutes. so, where do we go from here? i think we keep the best bets of some wet weather this evening into 11:30 into marin, napa, and sonoma counties. as you move through your morning commute it's going to be the hit and miss kind of rainfall for us. everybody's going to get the chance for us here from the north bay to the south bay. cloud cover stays put. it's similar by tomorrow afternoon and evening. might need the umbrella for a little bit and the windshield wipers, nothing major but hit and miss rainfall. temperatures on the cooler side. right on down to the south bay. you know the good thing about all this rainfall lately, we have also stacked up on the sierra snow which is important to keep us out of a drought. look at these numbers. if you missed them, we are now to an average of 116% of normal statewide. i'll show you which cities are ranging from 600 to over 1,000% of normal with had it comes today. house speaker nancy pelosi announcing a rare agreement with the white house over trade. the new trade agreement replaces the 25-year-old nafta accord with canada and mexico. it's now nicknamed generic medicines. >> tom steyers making a couple stops in the bay area this week. he will hold town halls beginning tomorrow afternoon in walnut creek. the event will be at the event center. on thursday he'll be in napa to speak with voters at the college. a deadly shoot out in new jersey today was so violent police had to reassure residents it wasn't a terrorist attack. three were civilians, two were shooting suspects. police say it started as a homicide investigation in jersey city. when the officer approached, the two suspects shot and killed him. they fled to a nearby kosher market where they waged in an explosive gun battle. a witness says it must have shocked police. >> it's pretty powerful. they were shooting. i don't think they were even expecting what they ran into. >> the officer who was killed was a married father of five, three other officers were wounded. new at 6:00 tonight, thousands of students at uc santa cruz may not get their grades this quarter. their teaching assistants are holding them hostage demanding a pay raise. marianne favro takes a closer look at the demands and how the university is responding. >> reporter: more than 300 uc santa cruz students voiced their support for striking graduate students today, many of them are teaching assistants who say they simply can't afford to live in the bay area on just $2,000 a month. >> graduate students can't take living in poverty anymore. most of us pay more than half our income on rent. >> the grad students union didn't authorize the strike but the more than 400 grad students involved say they will not submit grades until they get a cost of living increase. >> my grades won't be posted because i'm going to need to choose my next classes and some of my classes if we don't get our grades in, then we are able to enroll in our next class. >> the grad students want a 70% pay increase. that's an additional $1,400 a month. they say they want administrators to meet with them this afternoon but they did not show. the university is looking at solutions and issued this statement saying we are disappointed to see graduate students go on an illegal strike that may adversely impact our undergraduate students. the way to come to a solution is to address this by having open discussions, not through an illegal strike. the teaching assistants say they will release grades for students requesting them for financial aid and other hardship. this is finals week, so the grad students won't be teaching but say they will continue to proctor exams. in santa cruz, marianne favro, nbc bay area news. a high school soccer coach is accused of molesting some of his young player. ricardo gutierrez was arrested yesterday. he's accused of annoying and molesting three girls all 15 or 16 years old. he was a walk on varsity soccer coach at san jose gunderson high school. better check your refrigerator. the cdc is sounding the alarm on a new e. coli outbreak. this is chopped salad kits from salinas valley. at least 24 people in the u.s. and canada have gotten sick because of this. two bay area cities are teaming up to conserve water, palo alto and mountain view approved the joint water. it focuses on recycling water. it includes a water recycling center and water purification center. >> it will help us achieve our goals to really increase water means in santa clara county. >> it also reduces waste dumped into the bay. san francisco international getting another non-stop flight to austin, texas. the new flight takes off in april of 2020. american expects major tech companies like (. a follow up on the deadly crash in the east bay over the weekend. a third victim has been identified. 31-year-old of oakland. the chp says they were driving on highway 24 on orinda early saturday morning when the car veered off the road and crashed into a tree. all three died at the scene. an apology following a deadly dog attack. a 14-year-old boy was walking his dog when a pit bull attacked and killed it. after the attack, animal control put the pit bull down. the pit bull had attacked another dog before but was no longer classified as a dangerous dog since it hadn't attacked in three years. today the owner of that pit bul. he also reached out to us saying he's working with that family to hospital mayngerous dogs areis have put patients information at risk. they announced an employee improperly disposed of patient information. that employee threw used meal tickets in the trash instead of shredding them as required. patients who stayed at the between june 8th and november 4th could be impacted. the hospital says there's no evidence that any of that personal information has been misused. an east bay city is trying to ban smoking in public. the concord city council is meeting tonight to ban smoking in and around apartment buildings and parks. no spoking inside or outside. it includes a ban on smoking ecigarettes and vapes. the city will have designated areas for smokers. caught redde by a doorbell. you're looking at several items stolen in the east bay. doorbell cameras showed two people stealing packages. yesterday officers started looking for them and they found a treasure trove of packages that pair stole. the only free bird watching festival in the u.s. was just cancelled. the annual flyway festival will not be held next year. every february for the last 24 years you could watch birds migrate into the area. the city closed the preserve after fires ripped through in october. >> trying to save a preserve which is 44% of the open space, at the same time we're trying to put a big multi-thousand person festival on to celebrate the wild life that we're not going to be able to go see. >> still no word at this point if the festival will find a new stepped in and helped out. >> let's talk about christina. i'll show you her home. this is before the tubbs fire in 2017. and that is the after math. after the home burned down, christina says she immediately suspended all her utilities including at&t bundle. however, she said she recently discovered she was once again paying for all of those services and have been since early last year even though her home isn't rebuilt yet. she asked at&t to credit the month she was billed for the service she couldn't use. it offered just a small fraction so she called us. >> through your help, i was first off some of the impressive numbers and the data we have crunched tonight. look at this up into the north bay. this is the december rain and how we stack up against the averages. you can see in santa rosa we've had over 7 inches just this month alone. napa close to 3 1/2. mill valley nearly 3 inches putting us 600 to nearly 700% of normal for the month. so, we have seen our fill. down here through the south bay also a remarkable story mountai normal. again, 1,063% of normal. a lot fall, los gatos over 4 inches, and san jose over 1 inch. we've seen a little bit of break between the storm systems and that's good. the storm system moving in tonight is not extremely strong so i'll i think we'll avoid flooding issues. it's more nuisance rain. those roadways are going to be wet. already we've seen right around .1 of an inch in heeldsburg. not a big storm system but roadways are wet. let's put a track on this. you can see on doppler radar, rain fall moving to the north and east into napa by 7:13 tonight. also off to the south, showers developing into san francisco. that'll pick it up i as you continue through 7:07 tonight. as we continue through the next several hours i think we'll have a chance of getting showers into san jose and it's going to be the scattered situation as the storm moves across tonight. you can see it right here in the future cast. i think it's going to be a similar story for tomorrow morning at 8:00. also into tomorrow evening. so, keep the umbrella close. we won't need the sunglasses and you'll definitely need the jacket as we h about .25 to .33
