walnut creek interchange, the metering lights are on. one crash up there on the north bay. highway 12 at 29th. should be off to the shoulder. early commuters are still doing fine. >> thank you very much. 6:00 right now. new this morning, a new legal battle is brewing over u.s. immigration agents quickly releasing families after they cross the border. in many cases families say they were not given enough time to make travel arrangements, san diego county which is near the mexican boarder is now suing the trump administration trying to stop the pennsylvania as that leg-- to stop the practice. this comes as mr. trump is threatening to close it off. however, republicans are urging him to drop the plan. today in theway tracie potts joins us live to explain why the president's allies are urging him to back off. good morning, tracy. >> reporter: good morning, everyone, you see the president tomorrow in southern california inspecting that new border fencing, back here, some of his allies are concerned not about immigration but about trade. the millions of dollars going back and forth across the border every day, what happens to jobs tied to that trade if the president shuts it down? at the southern border with mexico, migrants are racing against the clock, rushing into the u.s. in full view of officers, to request asylum before president trump closes the border. >> it's very much overwhelming the system. >> reporter: at legal ports of entry, there the a 12-hour backup, for delivery trucks, after border agents were sent off to deal with immigration. at stake, in these trucks, goods worth $1.7 billion a day. >> closing down the border would have potentially catastrophic economic impact on our country. >> reporter: that's mitch mcconnell, one of the president's closest allies on the other side of this fence with other republicans concerned if the border shuts down, the economy may take a hit. >> we ought to take into consideration the consideration which closing the border would do. >> reporter: president trump sees both sides. >> sure it will have a negative impact on the country. when you close the border also, you will stop a lost of the drug coming in. >> reporter: he said to california to view new border fencing. homeland secretary kirstjen neilsen joins him to yuma, arizona today, one of the busiest sites for migrants entering the u.s. when it comes to trade and the concern about the impact on those american jobs, the white house economic adviser larry kudlow says they're considering shutting down the border but keeping those truck lanes opened for commerce. >> all right, always something happening on capitol hill. in fact, let's talk about another big issue brewing there, getting ahold of president trump's taxes. >> reporter: well, now democrats have made the formal request to the irs. >> that should go up to the treasury secretary. he says he's already been talking with the legal team about this, expecting that it would come that they'll follow the law and review it, if he says yes, then the committee will vote and decide if those tax returns go public. if he denies their request, they will have to find some other legal way to get them. so far the committee has requested the ways and means committee has requested six years of both personal and business returns. >> all right. we'll see what happens next. tracie potts, live from washington. thank you. a violent attack this caught on camera, an elderly man carjacked right in his own driveway in san jose. "today in the bay" chris sanchez, you told us the man is okay. what are police doing at this point? what do they know? >> reporter: well, they're looking into the case f. they have a suspect. they have not told us who that is yet f. they've made an arrest. we don't know that either. we will be pressing for details. we know that suspect was caught on kabul ra and when the victim told the suspect that the cameras were rolling, the suspect said he didn't care. now, in that under surveillance video you see 72-year-old hector estrada struggling against that other man in his driveway not far from pleasant high school. the younger man punches estrada several times in the face and body, estrada says he flashed a gun before he took off. this is the is from a under surveillance camera he installed a week ago. >> i told him he was on camera. he says, i don't care. my other pair of glass, he broke. i think it was the frame of the glasses that did all the cutting. >> there all happened in broad daylight. it was 9:45 in the morning. mr. estrada was unloading groceries from his car. the 72-year-old will be okay. his scar totaled. officers found it with no driver in sight. i will show you crime statistics for january and february this year. these are the latest numbers available. there are more than 1,000 vehicles stolen, which is a 30% drop compared to the year before. it's a 12% increase year over year, excuse me. there were 207 robberies, a number lower than the year before so again we will be pressing for more details here. in san jose, chris sanchez. today in the bay. >> hopefully housing. the aclu is throwing its support filed by a silicon executive, that says sfo customs agents threatened him and mistreated him after he returned from overseas. this passenger says agents tried to intimidate him. he refused to unlock his computer and iphone. they say agents flagged him for an interview moving through customs and asked to him show his flight iten rear itinerarii. he refused and that's when he says the situation got tense. >> he started getting very angry and saying no, you have no right to see inside my phone. >> the idea that if someone is going to search your person or your longings, they have to have reasonable suspicion to base the search on. as you know, your telephone and your computer contains your digital life. >> the aclu says the incident raises constitutional questions about unreasonable search and seizure. a customs spokesperson refused to comment on this specific case, did say, in general, keeping america safe depends on being able to for the most part, we're seeing mostly cloudy skies, but a few spots getting in on some light rain, especially along the coast. we seen some mist and drizzle across the golden gate bridge. as we go into the day, our system moves in, the next one arrives tomorrow, starting early in the morning, we could see that rain picking up by late morning. we time it out going hour by hour, spotty-like showers, overall, a mostly cloudy day. you want to make sure you are prepared for just about anything and then going into tomorrow, once again, early in the morning, we start to see more rain, by noon, we have a pretty good coverage of that rain, so we are have to see if the giants will postpone or delay that game for tomorrow, our rainfall totals, not look really significant here for parts of the north bay, a half inch of rain in some spots. a tenth to a quarter inch of rain elsewhere. if you pla on the go to the sierra this weekend, a new winter weather advisory in effect. light snow in the fast today or tomorrow. we are looking at an additional five or six inches. look, we still have 240 inches of snow at the base. once again, light snow coming down for the next couple of days south bay, up to the dunbar bridge. an easy drive. i didn't see anything the last time i checked. the reports or the camera, but i did hear about it from one source, so i'll continue to track that. over there. over here, we're looking at the upper east shore freeway. we talked about that crash as you come down the hercules xichlt a few reported as a major accidents. they are concerned. you have "today in the bay" is live with what may be new answers to some very important questions. i remember covering this, it was so strange when we heard about this crash, pete. >> reporter: yeah, very strange, lawyer remarks that's why they are holding a coroner's inquest. it started yesterday and goes into today. the purpose is to bring closure to that tragic incident that took place about a year ago today. i want to show you the picture of that family. you see the two mothers with the six adopted children. the mothers, you see them in that picture. it was jennifer who was behind the wheel of that suv in march in 2018 when that crash took place. right now, investigators are trying to determine if this was done on purpose or if thmplsz an accident. a pathologist did speak in front in ukiah in the inquest mentioning jennifer hart the driver had a blood col level of .10, that is above the california legal limit. sarah hart, her wife, she was in the passenger's seat. she had a toxic level of antihistamine in her body. the pathologist said three of the kids did as well. now, chp said there were no tire or skid marks at the scene, calling that unusual. referring to past incidents that are tim similar. now, there will be more finding presented and it will be up to the jurors to make a final decision. >> interesting case there thanks so much, pete tragic for those kids. just out of east contra costa county, three people recovering from an overnight crash near downtown brentwood. they tell us they were responding to shots fired in the downtown area when they stumbled upon the crash scene. a gun was found, police say the driver was drunk south of there. police still searching for the person bo broke into a home in broad daylight, detectives say someone donald trump u jumped onto the roof of the home about 1:00 yesterday afternoon and smashed through an upstairs window. the suspect took off. police do not believe that crime was random. >> new overnight, investigators are talking for the first time about the cause of last month's ethiopian airlines crash, they say everything about the plane and protocol was normal until the pilotsco you would no longer maintain little warmer on sunday and even though we'll still have some clouds around, we'll reach up to 75 degrees for the inland valleys on sunday, the bay up to 68 degrees, the coastal area, 63 degrees. and a lot of celebrations going on around the bay area, including the cambodian new year in oakland. we'll see still looks like a slight chance of rain during the morning, the sun will peak out, the temperatures reaching around 60 degrees. if are you heading out of town, going to lake shasta, expect it to be rainy this weekend there. highs reaching 53 tomorrow and 50 degrees on saturday. we will have them all throughout the day tomorrow. highs reaching 59. warming up on saturday and sunday looks like the pick of the weekend. 70 degrees and some peaks of sunshine in monterey, raining off and times" and "washington post" are reporting bill barr's summary of the mueller report is not as accurate as it should be. the actual report was far more troubling than mr. barr indicated. there is a bat until congress to see the whole report. the marketable thing on this is for two years, the mueller team never leaked until now. it looks like it's a weird week for healthcare. we will talk about
