it's in dupont, washington, between tacoma and olympia. it's a new service that just started today that runs from seattle to portland. look at that, just a tangled mess. still so many emergency personnel on the scene. even hours after this all started. about 7:45, the train went off the tracks and fell partially on to interstate 5. again, six related deaths just confirmed. investigators say the death toll is sadly expected to rise. there are dozens of others hurt and hospitalized, but police say there are multiple fatalities on the train. no drivers who were on the highway have died but there were multiple injuries reported. our seattle affiliate just talked with a woman on the phone who witnessed it all and then tried to help. >> i seen it come around the curve. as it went around the curve, it jump and hit two cars that i saw. >> do you have any idea -- >> it was awful. i see bodies on the ground. i don't know if they're from the train, but there were three to five bodies on the ground. people injured with gashes in their knees. head wounds. i'm a cna so i had some gloves in the car and some bandages. and i just did what i could to help. >> we can also tell you this, amtrak says there were more than 80 people on board that entire train. let's bridge in nbc bay area's kris sanchez she's live in san jose. she's actually spent the last couple of hours investigators how rail workers here in the bay area are continuously trying to keep our tracks safe. what did you find out, kris? >> reporter: hi there, laura. we knew it is going to be a very long time before there is a definitive reason for that train crash in washington state, but with so many bay area commuters on trains and rails, we had to ask is there something like that that could happen here? we did hear back from some of our agencies. we know that the train was on tracks part of a new route, as you mentioned. the train was traveling about 70 miles an hour. a passenger told msnbc a little earlier this morning that the train started to wobble before then it careened down a ditch. but we also know that under federal law, that line and all other commuter lines like it would have to have positive train control. according to the federal railroad administration, positive train control can automatically control the train's speed and force a stop if a train operator fails to take appropriate action for the conditions at hand. ptc is intended to prevent train-to-train collisions, and also the movement of a train through the main line switch that's going in the wrong direction. now back in 2015, cal train was to complete its ptc installation on schedule and it is now working on the electrification through high-speed rail service through the peninsula. that high speed will require that kind of ptc technology. b.a.r.t. was pressured to implement positive train control after two workers were killed while working on a rail line when a train went through unannounced. we are going to continue to dig into the local records to see if there is something can be gleaned, but i did get communication from muni and their spokesman says they use automatic train control, particularly in the subway, through the subway tunnels, but that at this point it is just a little too early to take anything away from what happened in washington and apply it to what we could do very sad story. officials are investigating the death of a 4-year-old boy from redwood city who died near lake tahoe. he was found in a hot tub in state line, nevada. authorities say it appears to be an accident. the child has not been identified. developing now, the power is back at atlanta's airport, the world's busiest airport impacting can be felt really around the globe. when it went out on saturday for ten hours, it cancelled more than nous flights. the airport is starting to recover but the problems are not completely over. and there you have it there. that was the moment the lights turned back on yesterday, but that fallout from the power outage at hartsfield-jackson is being felt widely across the country. more than 300 flights cancelled today, on top of 1,100 flights cancelled sunday. being trapped by that loss of power on under sunday and the trains being stuck there. others were really stuck looking for help. >> there was no one at b, there was no one as c, and only when we got to c and people were coming down from tsa was there someone guiding them to the gate. >> and atlanta officials blaming a fire deep in the airport's sprawl tunnelled system. now casualty az you can imagine, bay area airports and passengers are experiencing those problems. let's go to nbc bay area pete suratos. he's at sfo. you were talking about this earlier this morning, that impacted a lot of people. a lot of people in line behind you. >> reporter: yeah, good morning to you, marcus. well, you know, this morning at least we were saying there were about half a dozen flights cancelled at the three major bay area airports, sfo, san jose international and oakland airport. the biggest issue we saw here at sfo where they had five cancellations. at delta airlines getting folks on to the planes. as airlines are trying to figure out this situation, you have passengers trying to come up with a backup plan. it's an airport holiday greeting no passenger wants to hear. >> seeing the cancellation, i'm a bit shocked but i'm hoping to be positive to get on another flight this afternoon. >> reporter: cindy is one of the many frontier passengers dealing with a cancelled flight to atlanta. passengers were handled with this piece of white paper with information on how to book another flight. >> i've got my neighbor taking care of my cats. i've got business to do. i'm -- >> reporter: daelt airlines passengers are running into the same problems with some having success booking another flight. >> we're going to land maybe ten hours from what our original, you know, touchdown was. >> reporter: but passengers like maggie apparently took notice. her 8:00 flight to atlanta was not cancelled, so in the spirit of the holiday season, she gave up her seat to those waiting for hours. >> i felt very compelled to do it. >> reporter: the resolution may not be so easy for others who are hoping for some good will with time running out. >> my grandchildren are all there so this is a trip i take every year. and every day counts. >> reporter: now, we know that frontier airlines and delta airlines are giving passenger vouchers when it comes to that next flight. weather heading our way. kari? >> a lot of sunshine today. that will continue throughout the afternoon. the rain does not get here until late tomorrow night. we're enjoying our last few hours of all of this sunshine. taking a live look outside in san jose at christmas in the park. temperatures still very cool. now in the mid-50s. if you're getting ready to head out on your lunch break in oakland, it's going to be in the upper 50s and eventually hitting about 60 degrees with mostly sunny skies. temperatures all around the bay area, low to mid-60s. then we talk about that rain and when it arrives. we're already seeing it across the pacific northwest. that will be dipping to the south. a look at the timeline and how much rain we are going to see coming up in the full microclimate forecast. >> thanks so much, kari. new at 11:00, a prominent circuit court judge calling it quits amid sexual misconduct allegations. judge alex kosinski worked with san francisco's ninth circuit court of appeals. last week the "washington post" reported on misconduct allegations by at least 15 women dating back decades. saying a prolonged battle would be bad for the court. he apologies, saying he speaks candidly but never intended to make anyone feel uncomfortable. >> an arsonist may have struck again in the south bay. about 20 suspicious fires that were set along highway 680. the latest fire was spotted early sunday morning near the southbound 680 onramp off of capital expressway. the fire appears to have started in a shopping cart next to a homeless encampment. then spread to surrounding vegetation. chp says that fire is likely connected to the recent suspicious string of fires. new this midday, we finally know how this crash started. that video taken along east 14th street in san leandro about 1:30 in the morning. the car crash flood a nearby bridal shop near ban kroft avenue. in the last 15 minutes or so, the chase started after a carjacking in oakland. also new, two suspects were taken into custody. no one was hurt. new this morning, a story we brought you this morning on "today in the bay." people in one livermore neighborhood are pushing alameda county to fix the congestion. tesla road has become a popular shortcut. some people try to circumvent the gridlock on 580 and the alt mont. a nearly 37% increase in traffic over the past year. we spoke with one man who said the traffic is bumper-to-bumper about 7:00 in the morning. what used to take him ten minutes now takes him 40 minutes. >> i could be in the city and commute out here just as fast. so, you know, it's just ridiculous when you spend three hours a day going to a town that is only five miles a day. >> we asked county leaders who tell us they're considering adding speed tables, which are father was diagnosed with. >> reporter: tweeting that my father is doing well and we're all looking forward to spend christmas together in arizona. thad cochran has also been absent lately, but expected to be back on work when the senate votes on taxes later this week. that plus last minute support from bob corker and marco rubio, the senate will have just enough votes to get its tax bill over the goal line after the house votes tomorrow. >> we are on the 1 yard line and intind to punch it in on tuesday. >> reporter: the $1.5 trillion gop plan would double the standard deduction and cut corporate rates, with critics arguing the bill mostly benefits the rich. >> what we are seeing here is a real massive attack on the middle class. everybody in every tax bracket will see a tax cut. so picking out one piece in 1,000-page bill and saying, well, this is going to benefit somebody takes the whole bill out of context. >> well, if you're still in need of health insurance, there is still time to get covered. the deadline to sign up for covered california has been extended to this friday, december 22nd. that's if you want to have health insurance starting january 1st. the final deadline to get coverage is next year, january 31st. now in the last few days, thousands of californians have signed up. in fact, signup this year is outpacing last year. recent close calls at sfo have reportedly prompted one lawmaker to launch new legislation. mercury news reports east bay congressman is proposing legislation to promptly preserve cockpit voice recorders. it comes in the wake of two recent incidents involving air canada planes. in one case, the plane almost landed on a crowded taxiway. in another case pilots didn't hear them telling them to go around. the ntsb says those proposed rule changes are not necessary. christmas shopping just became a lot easier for someone in the bay area, actually. they're suddenly $40 million richer after hitting the big state lottery's bottom of the screen showing rain in the forecast starting late tomorrow night but mostly wednesday morning. our high temperatures up to 64 degrees in milpitas and up to 63 in concord. oakland, 63 degrees. vallejo, 65 degrees. 62 in san mateo and redwood city and 63 degrees in the marina district. north bay also looking at some mid-60s today and a light easterly wind. if you're going out this evening to the menorah lighting in union scare, at 5:00, we'll be 60 degrees. these are the kinds of cold mornings we've had but start to see some clouds moving in as this storm system finally has a chance to dip to the south as high pressure has moved away from the bay area. that's what's kept it so dry. we haven't had rain here since december 2nd if you can believe that. as we go hour by hour, it's looking all clear good and then we take it into tomorrow. start to see some clouds moving in. by 1:00 in the morning, that rain starts to make it in to san francisco. and also into the east bay, south bay, that rain is in and out before sunrise and before you get to head out the door for that morning commute. it's going to be clearing but also cooler and very windy. during those overnight hours when we see that quick-moving system moving in, most of us are looking at about 0.05, maybe 0.10 at the most. it looks good for the sierra as well. as we look live in heavenly, we do have that snow moving in for wednesday and the possibility of getting "new york post" spots about 2 to 4 inches of snow. maybe a little bit hower in some of the higher elevations. we'll talk more about that and than usual. not only is there the food distribution, but they also are prepping for the toy distribution later on this week. this week, today and tomorrow folks are picking up their 50-pound boxes of food complete with the regular staples and also with a turkey or a ham. 3200 low-income families will get this box and it's something that sacred heart has committed to doing since 1964. on thursday and friday, this is the real action, parents will get to come into the toy room and pick out gifts for their little ones. the sweet thing here, the kids don't have to know where they came from. they can give the children their gifts according to their own family traditions. sacred heart, though, only has about half of the toys they need to fulfill that promise. so you might be wondering why do they promise toys they don't have yet? the folks here say that's because they know the community always rises to the occasion, even if it's a little close to the deadline. >> our same goal is last coming up, we continue to follow that breaking news out of washington. an amtrak leaves the tracks with dozens of people on board. we are learning at least six people are dead. the latest from the scene. breaking news coverage out of washington state. and welcome back. we continue that breaking news coverage out of washington state this morning. >> want to take you back live to the scene of a deadly train derailment. it happened in dupont, washington, between tacoma and olympia. take a look at what is left of the train, just kind of a tangled mess there. about 7:45 the train actually went off the track, falling partially on to an interstate, interstate 5 there. look at all the emergency personnel that rushed to the scene. six people died. no drivers who were on the highway died, but there were multiple injuries when that train just rolled off the track. listen to a whom who lives near the track describe the chaos. she said she could have been on that train. >> i just woke up and heard a bunch of sirens and noise. it was very, very scary. i'm so glad i was off work today. but just looking at this whole mess right around christmas just breaks my heart. >> amtrak says there were over 80 people on board the entire train. president trump is reacting to this story on twitter. first, he sent a tweet saying that the derailment highlights the need for infrastructure spending. there was some mild backlash at the tone. about ten minutes later, he tweeted this, thoughts and prayers are with those involved. we'll continue to follow this breaking story and bring you the latest as soon as it comes in. back here at home in the bay area, san francisco's city hall is open for business. it was closed to politics over the weekend. nearly thousands of people, dignitaries and everyday citizens lined up to honor mayor ed lee. >> as you probably know, he died last week at the age of 65. governor brown among those who spoke during the ceremony said mayor lee had a love of life and a devotion to public service. a sentiment echoed over and over again. nbc bay area's sam brock has more. >> reporter: the memorial for mayor ed lee began right at 3:p.m., with the presentation of the colors. punctuatual like lee, who by all accounts also had a pretty interesting sense of humor. >> he told terrible jokes. he laughed because he was trying to build enthusiasm. for his jokes. >> most of the time, he told jokes that he could barrel get through because he was laughing so hard at them himself. >> reporter: humor at times can cushion great pain. both were evident in abundance this evening. the ceremony glided from stately impromptu speeches. >> you can deal with somebody you trust, you can't deal with somebody you don't struft. >> reporter: to soulful statements about lee's legacy. >> wake up every day and try to add a little value. not impugn their integrity and not take them down. try to help lift them up. >> reporter: lee's wife anna nodded along as california leaders -- the city's first asian american mayor. >> san francisco's history in prior centuries is marked by prejudice against the chinese community. >> in china, san francisco's first asian mayor, he was an icon. >> reporter: lee was iconic in smaller circles, too, for the city's most the neglected or vulnerable. it what's summoned legendary sport stars to extol the little things lee did every minute every day of his life. >> ed lee showed our children that public service can still be noble. >> reporter: and to that end, one of mayor lee's daughters tonight spoke about a weekend tradition of theirs. he would wake her up at 8:00 in the morning in high school every single weekend to go out and paint over graffiti and pick up trash on the streets. she said it was the absolute last thing she wanted to do in high school, but it showed herbert how to work alongside people and improve her community. sam brock, nbc bay area news. >> a great memory for her as well. thank you. san jose police still searching for a murder specific. joseph duran, the fourth suspect wanted in connection with a murder over the weekend. police also arrested three other suspects in connection with that same murder. it happened last december. police say an 18-year-old was shot to death at a gas station on south winchester. police have not yet released a motive for the murder. >> police are surging for suspects after an attack outside the hayward b.a.r.t. station. two people were hurt. this happened around 9:30 last night in the b.a.r.t. stakes parking lot. a man was stabbed and the woman was assaulted. all three of them got away. the female victim was treated and released. the e-ma -- sbrun owe police say the driver struck and killed a pedestrian on skyline boulevard. it's not clear when the crash happened, but officers found the victim about 7:00 in the morning yesterday. the victim's identity has not been released. tragedy in the north bay. a family trip took a deadly turn in sonoma county. a father and his 6-year-old son were swept away from shore at goat rock beach, a popular beach just west of jenner. three children were plague in shallow water when a strong undertoe pulled the boy deeper into water. the undertow was too strong. both the father and son drowned. >> we want to show you this video right here on your screen. if you look closely at that car driving up there on the top right of your screen. you can see people firing a flare gun. they shot it into a home. this happened in san ramon saturday night. police say the suspects aimed and fired at five homes. luckily none of those homes caught fire. police believe the suspect's car is an older model nissan send tra. back at the table. talks continues between oakland leaders and union leaders after the strike brought the city to a standstill. there is still some work left to be done. city agreed to give workersers a 6% raise over the mention couple of years. the new contract is expected to be approved by the city council this week. the fight against the historic wildfires in california continues. >> not before new evacuations in the destruction of multimillion dollar homes. nbc's steve patterson has the latest. >> reporter: this morning marks two weeks since the blaze broke out. more than 8,500 fire personnel now on the front lines. some working 24-hour shifts to stop the flames from spreading. the thomas fire scorching 270,000 acres is now larger than the size of new york city. destroying more than 1,000 properties. it's also killed two people, including 32-year-old firefighter corey iverson. thousands lining highways on sunday to pay their respects on his final journey home to is san diego. residents in areas being protected by fire crews have been showing their support, including oprah, who tweeted, god bless every firefighter and their families. meanwhile, places like downtown santa barbara have become ghost towns. the majority of the area still under evacuation orders and businesses are taking a big hit right before the holidays. >> all my friends are buying gift cards. because there haven't been places open to shop. >> reporter: firefighters may finally be getting the break they need with the forecast calling for calmer winds. >> westerly winds will bring in higher relative humidity so it improves fire conditions there through wednesday. >> reporter: as residents face week three of relentless smoke, ash and flames, they're hopeful ablue skies are on the horizon. >> red flag warnings, which had been in place since the fire started, were lifted overnight. that fire is now 45% contained but there is more wind in the forecast this week. coming up, more rain in the forecast as well. kari's got a peek at it for us. >> that rain starts to like a routine holiday delivery, but watch this video closely. a u.p.s. delivery person walks up to a house with a package in hand, looks over his shoulder apparently to make sure no one's watching and then allegedly slips a package into his pants. the item, a pair of head phones for honda purchased by davidalitimdavid altman purchased for his girlfriend. he posted the video on facebook at first i didn't believe it. i told my girlfriend, come look at this. >> his girlfriend is the daughter of an nbc news producer. in a statement to nbc news, u.p.s. says the individual caught on camera is probably a seasonal worker and the company is cooperating with local law enforcement to apprehend the individual. so-called porch pirates are nothing new. they've become more common with the surge in online shopping. nearly one in five americans is the victim of package theft and that number increases during the holidays. the medium price of a stolen package, $250. the holiday shopping season is the busiest time of year for u.p.s., the postal service and fedex. in an attempt to fight porch pirates, the palm beach schiff's department honored an u.p.s. driver who spotted a thief in action and called the police. the suspect admitted he stole the packages because he had no gifts to gives for christmas as well as an addiction to drugs. what happens when the suspect works for the company making the delivery? >> it makes me mad every time i watch it. >> reporter: david altman says he insfauled a camera on his front door because he had a package stolen two years ago ago. >> i was stunned. it's like a grinch stealing christmas scenario. >> jo ling kent reporting there. the guard against package theft, consumer experts recommend you do a few things. redirect those packages to a secure location. an amazon lock or a fedex office or to your office instead of your home. if you do go to your home, well, use a smart gadget for your phone like a video doorbell. as the olympic games quickly approach, there are worries that the impact global warming is having on athletes' preparation. snow is coming later. some say the hunt for offseason training spots is increasingly a scramble. nbc bay area's your moment for the winter games, which start in february. definitely cold temperatures there, here not as cold. >> not as cold. we've been watching the sierra. we know we haven't had a lot of snow this winter. just a little bit. we're going to get a little more as we go through the week and also a little bit of some rain here. as we get a live look outside in emeryville, all clear skies, and that's the problem the whole month of december. we haven't had any measurable rain since december 2nd. as we take a look from san bruno mountain over san francisco, a lot more sunshine and cool temperatures to start out this morning. we are now up to 51 degrees in santa rosa, and napa 56 degrees, 53 in oakland and 59 degrees in morgan hill. we're heading into the upper 350s for the south bay. in east san jose and los gatos, 65 degrees will be the high. for the bottom of the screen, come over and look at it, we will have some rain midweek but that's about it. 63 degrees will be the high today in concord and livermore. for the peninsula, 63 degrees in palo alto. the embarcadero at 64 degrees and the north bay at 64 in napa and sonoma. a light wind and as we take a look at the activity happening right now in downtown san jose with christmas in the park, starting to see a few more people heading out there, maybe on their lunch break. if you're going later on this afternoon, it's going to be in the mid-60s. by 3:00, that's the warmest time. it does cool off fairly quickly as we go into evening so make sure you bring a jacket. we're looking at our next storm system set to move in here late tomorrow evening. stillwell to the north of us moving apart parts of oregon and washington state. the winds picking up. rain starts to move into the north bay i'd say around 11:00 or once again. we'll feel a drop in those temperatures and it's going to be really chilly after we get about 0.05 of an inch of rain and most spots getting about 0.10 of an inch of rain. hopefully we can squeeze a little i bit more moisture out of this system but right now it looks pretty light. the winds picking up from the north at about 10 to 20 miles per hour. maybe a little bit higher along the coastline. very breezy winds. cooler temperatures for the first day of winter. that's on thursday. heading into the weekend, it stays chilly with upper 50s for the weekend and morning temperatures, that's going to be the big story in spots where we haven't had freezing temperatures like san jose. well, we could have a freeze heading into the end of the week and also the weekend. so those are the things i'll be watching. also going into next week, it's looking pretty dry. so no rain for the day of christmas and we're looking at least some light snow in the sierra over the next several days. >> sadly be a multi volume set. the story would begin with the birth of their daughter ella, coming into the world months premature, weighing barely 1 pound. while at the very same time, gin was being distinguished with cancer. >> yes, stage four lung cancer. >> reporter: the very good news is that daughter and mother are both still with us, though jin's cancer has spread to her brain and she is by no means out of the woods. it's the kind of experience that teaches you to appreciate every day, particularly the one kids love best. >> yeah, every christmas is -- we're celebrating. >> reporter: which is what makes this gesture so very bright. >> the santa with the reindeer. >> reporter: a team of volunteers from the bonnie j. lung cancer association descended on jin's house one day this week, stringing lights, inflating santa and his reindeer, getting ready to surprise ella when she gets home from preschool. over the years, the foundation has raised tens of millions of dollars for cancer research and patient services. so by comparison, this may seem small. >> thank you so much. >> reporter: but it's not. >> if we can hang lights and plug in an inflatable reindeer and santa to make somebody happy, that's what counts. >> reporter: andrea parks knows this because bonnie was her mom and she lived through her diagnosis and stretreatment 14 s ago. the gift she says is for the entire family, but jin and andy say this is for ella. she has not been a bystander to her mother's illness, they say. she is a one girl, 5-year-old support team. >> she knows when we need a hug and
