rescue crews jumping into action. we're live on the scene. the news starts now. thank you for joining us. i'm vicky nguyen in for jessica augeri. >> we begin with scary moments in the water. a rare attack a man was swimming in the bay when he was bit by a sea lion. he frantically tried to distract the animal but bit on the arm. plenty of people on boats and on shore were watching in horror. nbc sam brock joins us in san francisco with all the details. sam? >> reporter: raj, vicehicl vick what happening and rescued the man. the man was swimming by himself and if the bystanders hadn't been there, the outcome would have been different. >> for san francisco people that love a swim in the bay, a chilling development sunday. >> i saw a sailboat with a wounded swimmer and they screamed at me to not go out there and the wounded swimmer had deep puncture wounds in the upper arm and blood was running down and a coast guard vessel. >> reporter: nearby sailors called the coast guard after a sea lion charged a 56-year-old man near the coast. >> if the boat wasn't there, who knows what would happen. they rented the boat for the day and on their way waback. >> reporter: the sailors delivered the man to marine police for care when they applied a tourniquet to the wound. some swimmers said they had their own run ins. >> i looked at him or she like this and the sea lion looked back at me and charged me and of course, i swam across the top of the water like you wouldn't believe. >> it's happened a few times for the past few days and one guy said he was swimming and got bumped five times by the sea lion. >> reporter: after the attack, members of local swim clubs were right back at it taking notice but still practicing their favorite aquatic past time. we did not actually get an explanation as to what might have caused this aggressive behavior on behalf of the sea lion. some speculated maybe mating season. it is not. the victim was transported to sf general and we and other stories. his twitter handle at sam nbc bay area. the man charged in the deadly ghost ship fire was ordered to stand trial after two weeks of testimony an alameda county judge says there is sufficient evidence derrithese men are to blame. the ruling is a relief for those who lost a loved one in the fire. >> they are very pleased that the defendants have been held over. >> reporter: that's the reaction of at least some family members of the ghost ship fire victims after a judge ruled there is indeed enough evidence for a trial. after hearing nearly two weeks of testimony from more than a dozen witnesses, the judge says there is strong evidence both max harris and derrick almena played a role in the management of a death trap and are legally responsible for the 36 lives lost. >> first step for them in getting the accountability and justice. >> reporter: but the men's attorney say they are confident they will prove their clients aren't at fault. the real culprit, the landlord and city of lock land. >> this was a malfunction on the part of the city of oakland. the landlord allowed this to happen. >> this was not a death trap. it was ordinarily. it was clean. it was whole some. >> reporter: the prosecutor read the names of each of the 36 victims bringing tears to many in the audience. >> i take 36 breaths every day in prayer and i take a continuous amount firefighter all of us. >> reporter: defense attorneys expect the trial to take place in the next six to eight months. in oakland, jodi hernandez, nbc bay area news. >> also, a scene at the warrior's game tonight. a moment of silence for san francisco mayor ed leie. mayor lee was insurance tenttru bring the team back and paved the way for the construction of the chase center. the arena is under construction and will be open in 2019. mayor lee died on tuesday. tomorrow thousands of people are expected in san francisco's city hall to honor him. the 65-year-old died unexpectedly. this is the scene tonight on the steps of city hall. steady stream of people dropping off flowers, cards, and candles. here with the details for this weekend, beginning tomorrow a public viewing will be held from 8:00 in the morning until 7:00 p.m. mayor lee will lie in repose. on sunday, a celebration of his life is scheduled for 3:00 p.m. also at city hall. a celebration a dramatic turn today in the case against the man accused of killing a beloved south bay woman known as ms. flo. you may remember the case prosecutors say the men beat and killed ms. flo during a home invasion last year. today a grand jury indictment puts the case on a fast track. robert handa broke the story on twitter. he joins us live now from the main jail with today's new developments, good evening, robert. >> reporter: good evening, vickey. this grand jury indictment handed down will lead to more severe charges against the men held in custody here and also lead to a much faster trial. it also means one young man arrested as an accessory will join the other two in facing a felony murder charge. the three accused men have already been making court appearances but now the district attorney's office will charge johnny brown junior, zackery quinn, and willie king with felony murder, robbery and elder abuse on the basis of the grand jury indictment and skip the usual preliminary exam. the victim known as ms. flo was beaten during a home invasion robbery and suspected brown and quinn attacked and robbed her, left, and returned and attacked her again. but the grand jury also indicted king for felony murder. prior to today, king then 19 years old was only charged as an accessory to the robbery. >> i can't discuss what happened with the grand jury, but mr. king did live across the street from ms. flo, and his role in what took place that day was more than simply an accomplice. >> reporter: king was arrested today and will be charged friday. king was arraigned but quinn refused to be transported from jail and in court the judge said quinn must show up in court friday or be forcibly extracted from his cell monday. whether it was a factor or not, brown and quinn face special circumstances of causing great death and bodily harm during a robbery. >> if the circumstances are true with brown or quinn, they will be sentenced to life in prison without the possibility of parole. willie king since he's not charged with a special circumstance, however, he's charged with felony murder would be charged from 25 years to life in prison. >> reporter: three other people, two girlfriends and brown's mother also face charges for allegedly assisting in harboring the suspects. live in san jose, robert handa, nbc. >> thank you. we have tragic news from the fires in southern california. firefighter had died. a somber scene in ventura county this afternoon as fire crews and law enforcement led that procession. 32-year-old corey iverson from san diego was killed while fighting the thomas fire, that's the one in ventura county. iverson had been with cal fire since 2009. he leaves behind a wife and a 2-year-old daughter. his wife is also pregnant with a second daughter. >> our thoughts and prayers are with corey's family and all of his friends and co-workers throughout the department and the fire service. while we continue to process this tragic loss, we must keep our focus on the fire. >> very difficult for everyone involved. thousands of firefighters remain on the front lines. that thomas fire in ventura county is 35% contained. one of the hottest concerts in the bay area is back and it is happening right now. the red hot chili peppers are one of the big attractions of band together two. the concert for the north bay. the concert kicked off about an hour ago at the bill gram civic auditorium. among the crowd are survivors of the fires. >> i think it's so magical and amazing and i just love that they are doing that because they are like one of my favorite bands and it happened to be them playing here and i love it. >> organizers were able to raise more than $17 million last month and tonight, the sold out event raised another $5 million. well, a brief scare at sfo, the bomb squad checking out a suspicious package. sky ranger was overhead earlier today. police did evacuate everyone in the post office cargo facility. airport officials say they screened a piece of mail that came in on an international flight after something didn't look right. the bomb squad came out but they deemed the package safe. flights and passenger terminals were not impacted during this into an argument with a parking spot but he's answering questions after a picture was made and accusations online that he did it himself to raise money. >> all them facebook posts you see, i didn't do. i have people very upset with me. >> reporter: steven wilson stands by the story he told fairfield police monday night. he told them someone put this racist remark across the passenger side of his suv from front to back. >> it said negro but didn't say negro -- it said negro go home. >> reporter: wilson said the racist gra fffiti ended with go home. in one picture the slur ends with go. then a newer one actually does end with go home. it says "n" word go. how do you have two pictures unless somebody did it twice? >> no, this is what happened. that night, that's all it said was go. >> reporter: wilson says while visiting a friend in richmond, he was tagged again and someone finished the sentence by adding the word home. same person? >> no, not the same person. it was different paint. >> reporter: we can't compare the paint now because wilson's suv was buffed clean. >> people are saying he did it to himself and got this go fund me page to get money together. >> no. >> reporter: wilson says this is his only go fund me site, one two weeks ago to raise money for colon cancer surgery but a second go fund me asking for money to clean up the suv was organized by a neighbor without his approval. >> i didn't ask for none of this. >> reporter: fairfield police are looking at accusations but for now, they are still investigating this as a hate crime. we're live, our way in that weather forecast including some gusty winds building back in as we head throughout the next 36 hours. i want to start off with tonight. the two new warnings when it comes to weather. the first one is a wind advisory from 10:00 p.m. friday until 10:00 a.m. sunday from the northeast and south bay, as winds could gust up to 50 miles per hour and also for the hills above 1,000 feet in the northeast and south bay. we have a fire weather watch issued. this will get upgraded to a red flag fire warning into tomorrow. we'll detail more on these winds coming up but i'll get you into tomorrow's forecast. we begin with chilly 30s and 40s and clear sky. by the afternoon, on your friday forecast, less in the way of sunshine. partly sunny and a little cooler, as well. this will bring us to 62 in santa rosa and 58 oakland, 64 san jose and you have low 60s from palo alto into san francisco. in terms of that wind, most of tomorrow it's going to be relatively calm but once we hit 10:00 p.m. on friday, i think the wind gusts will ramp up out of the north 15 to 20 miles per hour. primarily in the hills above 1,000 feet. by 5:00 a.m. on saturday, it becomes gusty here. 20 to 40 mile per hour gusts possible and check this out, all the way into saturday afternoon we'll likely see winds 20 to about 50 miles per hour. so saturday at this point, looks like the windiest day ahead. we'll see less in the way of wind once we hit sunday's forecast. gusts 5 to 15. not too bad for that raiders game here on nbc bay area. dry weather monday, tuesday and wednesday and possibly a slight chance of a shower next thursday as winter begins. we'll have much longer looks of the seven-day forecast and a closer look at the wind and how gusty it could get in the micro climate in 20 minutes. new trial. the request is over the sole conviction in the case on gun possession charges. here is nbc bay area's christie smi smith. >> reporter: outside the courtroom, gonzalez chief attorney explained why he believes the new order after the conviction after a brief conviction. >> our whole defense is we picked up an object and didn't know what it was. that goads riges right to this. >> reporter: he was acquitted of murder and manslaughter in the shooting death of kate steinle but found guilty being a felony in possession of a gun. gonzalez believes the judge didn't properly instruct the jury about the charge. >> i think to properly instruct the jury in state court or federal court will find mr. garcia not guilty. >> reporter: federal prosecutors filed their own charges in a case that drew national attention, criticism from president trump and sparked fierce debate about undocumented immigrants in sanctuary cities like san francisco. >> the defense can get rid of that conviction that helps him very much in the federal case. >> reporter: markuates uatyate professor and while the defense procedure is roue tutine, there could be more at steak. >> no conviction on any crime whatsoever is hard for the public to take. >> reporter: prosecutors said they needed time to go over the motion. >> there will be motions filed at the end of the trial and we'll review and respond in court. >> reporter: both sides are due back in court in january. in san francisco, christie smith, nbc bay area news. a 15-hour stand off in the south bay ends with a wanted felon back in jail. police swarm the neighborhood near the golf course yesterday and finally took the suspect into custody just before 4:00 a.m. the swat team backed the bear cat vehicle in the home and used tear gas and officers fired bean bags and used k-9s for help. he jumped fences and hid before he was cornered. >> did eventually try to come out through different parts of the house and elected to come out the front of the house where he was taken into custody by police. >> without a fight. >> he definitely resisted arrest. >> some neighbors were forced out of their homes. the man was wanted on a felony warrant for burglary and possible connections to other crimes rc crimes. a vicious attack in a dorm room in san francisco state. investigators don't know what started it. it happened on tuesday afternoon. university police heard a student scream for help from inside of his dorm room. officers then forced themselves in. they found an 18-year-old man choking another student. he also had cuts to his body. students say they are surprised because they feel the dorms are usually safe. >> when you walk in, you have to show your key to show that you live here and i'm wondering did they hold up a pair of keys and the person didn't look at them or how did they get in? >> it's not clear if the attacker is a fellow student. the university says the student had surgery and is recovering. as for the suspect, the attacker is in jail. it is a plan to bring more accountability at the santa clara county jail. the board of supervisors made a move to create an oversight committee to keep an eye on what is happening after several jail guards found themselves on the wrong side of the law. damian trujillo reports from the county government center. >> the trouble at the jails have been well-documented and sheriff lowery smith received most of the blame. supervisors are saying things are about to change. the problems inside the county jail have been stacking up. there was a murder conviction of three jail guards and the arrest of several others for unrelated crimes. not to mention, a couple of inmate escapes. >> we've had 623 recommendations for reform. that tells us we had work to do and doing the work now. >> reporter: today a board of supervisors committee voted to appoint an inspector general of the sheriff's office and that person will report directly to the board of supervisors. >> the difference is that it will have oversight in a number of areas. >> reporter: the idea is to appoint a civilian oversight committee to add muscle to jail reform that critics say are badly needed. >> i think it's important there be a community oversight committee. the only way you build trust in the community, maintain trust and keep the community as a partner is by having the community directly involved and engaged. >> the sheriff was not at the meeting but several deputies were on hand also there was john, the man who used to run the jails and now wants the sheriffs' job. >> we reached out to sheriff laurie smith today but her staff said there was no availability for comment. damian trujillo, nbc b brks krb news. tonight president trump's tax plan hangs on by a thread. senator marco rubio says unless republicans increase the child tax credit, he cannot support this package. republicans can only afford to lose two votes and departing gop senator is expected to vote no. a couple other senators are on the fence and senator john mccain has been hospitalized this week for cancer treatment. republicans are racing the clock to pass the overhaul before alabama's democratic senator doug jones is sworn in early next year. a house speaker paul ryan denies reports that he might be leaving congress if and when the tax overall passes. po politico are speculating he could leave at the end of the term or in weeks. his relationship with president trump has been strained and he's broken with the president on several issues, most recently the president's support of alabama senate candidate roy moore. the magic kingdom is getting larger and president trump approv approves. disney is buying the fox movie and television studios with cable and international tv businesses. the price tag more than $52 billion. the sale does not include fox news. the white house says president trump supports the deal and today called fox owner rupert murdoch to congratulate that i really wanted came out of that seas season but. >> but when she did, very little has been the same sense. even in front of no one, everyone is now watching. it can make her nervous, which karen admits has been a weakness of hers in the past. >> like the week before, i feel all this nervous energy and sometimes i don't know how to cope with that and it's frustrating and sometimes like i feel like i'm so ready for this competition but at once, i step on the ice and i don't know how to skate anymore. i'm so nervous. i'm so tense. >> while karen will work to overcome that obstacle, edmonds is facing a different one, injury. the san jose 19-year-old already has ever has one olympics under her skate. the 2014 games in sochi russia but that experience only left her wanting more. >> definitely. in sochi, even after the long program, it had been like three hours after the event, it was sitting back in my room in the apartment complex like looking through the photos of the olympic brand-new issued fire weather watch and i really want anyone who lives in the hills above 1,000 feet to listen to this pretty seriously because we could see gusts up to 50 miles per hour. it will drastically lower the humidity and increase the fire threat here in the hills above 1,000 feet for the northeast and also for the south bay. so if any fire was to start, it could spread very fast. we'll detail more exactly how gusty it could get for the micro climate. i'll take you to tomorrow morning's forecast. not that much in the way of wind. a little breezy here. overall a cold start down to 38 for the south bay and peninsula at 40 and chilly 36 for the try valley. north bay down to 33. that's the number one coldest spot and a jacket in san francisco at 45. we start chilly and by the afternoon fortomorr tomorrow, t change is not quite as warm. clouds increase for a partly sunny day. you probably won't need sunglasses for the afternoon and looks good in the temperatures. 64 san jose, 6 262. most of the day tomorrow is going to be five to ten miles per hour. once we hit saturday morning, we're going to see things pick up because this cold front is going to dive off towards the south helping to pick up winds throughout the state. specifically for us, saturday morning you can see things will be anywhere from 10 to 22 miles per hour. winds coming out of the north and east. here is the problem we're going to get into. not only gusty very early saturday morning but right through 10:00 a.m. and even gusty winds staying with us through 1 1:00 p.m. on saturday. saturday looks like it will be a windy day from the morning right into those evening hours. then eventually once he hit sunday's forecast, less in the way of wind and that will be good news to get us out of the fire danger. dry monday, tuesday, and wednesday and then once we hit thursday next week, a slight chance of a shower. doesn't look like a big storm system at this point as winter will arrive at 8:28 in the morning. temperatures in san francisco in the upper 50s to also low 60s. for the inland valleys, we'll see 60s as we head throughout the next seven days. again, the biggest thing we're rescue crews jumping into action. we're live on the scene. the news starts now. thank you for joining us. i'm vicky nguyen in for jessica augeri. >> we begin with scary moments in the water. a rare attack a man was swimming in the bay when he was bit by a sea lion. he frantically tried to distract the animal but bit on the arm. plenty of people on boats and on shore were watching in horror. nbc sam brock joins us in san francisco with all the details. sam? >> reporter: raj, vicehicl vick what happening and rescued the man. the man was swimming by himself and if the bystanders hadn't been there, the outcome would have been different. >> for san francisco people that love a swim in the bay, a chilling development sunday. >> i saw a sailboat with a wounded swimmer and they screamed at me to not go out there and the wounded swimmer had deep puncture wounds in the upper arm and blood was running down and a coast guard vessel. >> reporter: nearby sailors called the coast guard after a sea lion charged a 56-year-old man near the coast. >> if the boat wasn't there, who knows what would happen. they rented the boat for the day and on their way waback. >> reporter: the sailors delivered the man to marine police for care when they applied a tourniquet to the wound. some swimmers said they had their own run ins. >> i looked at him or she like this and the sea lion looked back at me and charged me and of course, i swam across the top of the water like you wouldn't believe. >> it's happened a few times for the past few days and one guy said he was swimming and got bumped five times by the sea lion. >> reporter: after the attack, members of local swim clubs were right back at it taking notice but still practicing their favorite aquatic past time. we did not actually get an explanation as to what might have caused this aggressive behavior on behalf of the sea lion. some speculated maybe mating season. it is not. the victim was transported to sf general and we and other stories. his twitter handle at sam nbc bay area. the man charged in the deadly ghost ship fire was ordered to stand trial after two weeks of testimony an alameda county judge says there is sufficient evidence derrithese men are to blame. the ruling is a relief for those who lost a loved one in the fire. >> they are very pleased that the defendants have been held over. >> reporter: that's the reaction of at least some family members of the ghost ship fire victims after a judge ruled there is indeed enough evidence for a trial. after hearing nearly two weeks of testimony from more than a dozen witnesses, the judge says there is strong evidence both max harris and derrick almena played a role in the management of a death trap and are legally responsible for the 36 lives lost. >> first step for them in getting the accountability and justice. >> reporter: but the men's attorney say they are confident they will prove their clients aren't at fault. the real culprit, the landlord and city of lock land. >> this was a malfunction on the part of the city of oakland. the landlord allowed this to happen. >> this was not a death trap. it was ordinarily. it was clean. it was whole some. >> reporter: the prosecutor read the names of each of the 36 victims bringing tears to many in the audience. >> i take 36 breaths every day in prayer and i take a continuous amount firefighter all of us. >> reporter: defense attorneys expect the trial to take place in the next six to eight months. in oakland, jodi hernandez, nbc bay area news. >> also, a scene at the warrior's game tonight. a moment of silence for san francisco mayor ed leie. mayor lee was insurance tenttru bring the team back and paved the way for the construction of the chase center. the arena is under construction and will be open in 2019. mayor lee died on tuesday. tomorrow thousands of people are expected in san francisco's city hall to honor him. the 65-year-old died unexpectedly. this is the scene tonight on the steps of city hall. steady stream of people dropping off flowers, cards, and candles. here with the details for this weekend, beginning tomorrow a public viewing will be held from 8:00 in the morning until 7:00 p.m. mayor lee will lie in repose. on sunday, a celebration of his life is scheduled for 3:00 p.m. also at city hall. a celebration a dramatic turn today in the case against the man accused of killing a beloved south bay woman known as ms. flo. you may remember the case prosecutors say the men beat and killed ms. flo during a home invasion last year. today a grand jury indictment puts the case on a fast track. robert handa broke the story on twitter. he joins us live now from the main jail with today's new developments, good evening, robert. >> reporter: good evening, vickey. this grand jury indictment handed down will lead to more severe charges against the men held in custody here and also lead to a much faster trial. it also means one young man arrested as an accessory will join the other two in facing a felony murder charge. the three accused men have already been making court appearances but now the district attorney's office will charge johnny brown junior, zackery quinn, and willie king with felony murder, robbery and elder abuse on the basis of the grand jury indictment and skip the usual preliminary exam. the victim known as ms. flo was beaten during a home invasion robbery and suspected brown and quinn attacked and robbed her, left, and returned and attacked her again. but the grand jury also indicted king for felony murder. prior to today, king then 19 years old was only charged as an accessory to the robbery. >> i can't discuss what happened with the grand jury, but mr. king did live across the street from ms. flo, and his role in what took place that day was more than simply an accomplice. >> reporter: king was arrested today and will be charged friday. king was arraigned but quinn refused to be transported from jail and in court the judge said quinn must show up in court friday or be forcibly extracted from his cell monday. whether it was a factor or not, brown and quinn face special circumstances of causing great death and bodily harm during a robbery. >> if the circumstances are true with brown or quinn, they will be sentenced to life in prison without the possibility of parole. willie king since he's not charged with a special circumstance, however, he's charged with felony murder would be charged from 25 years to life in prison. >> reporter: three other people, two girlfriends and brown's mother also face charges for allegedly assisting in harboring the suspects. live in san jose, robert handa, nbc. >> thank you. we have tragic news from the fires in southern california. firefighter had died. a somber scene in ventura county this afternoon as fire crews and law enforcement led that procession. 32-year-old corey iverson from san diego was killed while fighting the thomas fire, that's the one in ventura county. iverson had been with cal fire since 2009. he leaves behind a wife and a 2-year-old daughter. his wife is also pregnant with a second daughter. >> our thoughts and prayers are with corey's family and all of his friends and co-workers throughout the department and the fire service. while we continue to process this tragic loss, we must keep our focus on the fire. >> very difficult for everyone involved. thousands of firefighters remain on the front lines. that thomas fire in ventura county is 35% contained. one of the hottest concerts in the bay area is back and it is happening right now. the red hot chili peppers are one of the big attractions of band together two. the concert for the north bay. the concert kicked off about an hour ago at the bill gram civic auditorium. among the crowd are survivors of the fires. >> i think it's so magical and amazing and i just love that they are doing that because they are like one of my favorite bands and it happened to be them playing here and i love it. >> organizers were able to raise more than $17 million last month and tonight, the sold out event raised another $5 million. well, a brief scare at sfo, the bomb squad checking out a suspicious package. sky ranger was overhead earlier today. police did evacuate everyone in the post office cargo facility. airport officials say they screened a piece of mail that came in on an international flight after something didn't look right. the bomb squad came out but they deemed the package safe. flights and passenger terminals were not impacted during this investigation. >> i didn't ask for none of this, for none of this. >> defending himself in the court of public opinion. a bay area man that says he's the victim of a hate crime but some are calling his story into question. tom jensen is live where the man's suv was allegedly tacked with racist graffiti. why the public backlash? >> reporter: vickey, he said it happened monday night after he got into an argument with a parking spot but he's answering questions after a picture was made and accusations online that he did it himself to raise money. >> all them facebook posts you see, i didn't do. i have people very upset with me. >> reporter: steven wilson stands by the story he told fairfield police monday night. he told them someone put this racist remark across the passenger side of his suv from front to back. >> it said negro but didn't say negro -- it said negro go home. >> reporter: wilson said the racist gra fffiti ended with go home. in one picture the slur ends with go. then a newer one actually does end with go home. it says "n" word go. how do you have two pictures unless somebody did it twice? >> no, this is what happened. that night, that's all it said was go. >> reporter: wilson says while visiting a friend in richmond, he was tagged again and someone finished the sentence by adding the word home. same person? >> no, not the same person. it was different paint. >> reporter: we can't compare the paint now because wilson's suv was buffed clean. >> people are saying he did it to himself and got this go fund me page to get money together. >> no. >> reporter: wilson says this is his only go fund me site, one two weeks ago to raise money for colon cancer surgery but a second go fund me asking for money to clean up the suv was organized by a neighbor without his approval. >> i didn't ask for none of this. >> reporter: fairfield police are looking at accusations but for now, they are still investigating this as a hate crime. we're live, our way in that weather forecast including some gusty winds building back in as we head throughout the next 36 hours. i want to start off with tonight. the two new warnings when it comes to weather. the first one is a wind advisory from 10:00 p.m. friday until 10:00 a.m. sunday from the northeast and south bay, as winds could gust up to 50 miles per hour and also for the hills above 1,000 feet in the northeast and south bay. we have a fire weather watch issued. this will get upgraded to a red flag fire warning into tomorrow. we'll detail more on these winds coming up but i'll get you into tomorrow's forecast. we begin with chilly 30s and 40s and clear sky. by the afternoon, on your friday forecast, less in the way of sunshine. partly sunny and a little cooler, as well. this will bring us to 62 in santa rosa and 58 oakland, 64 san jose and you have low 60s from palo alto into san francisco. in terms of that wind, most of tomorrow it's going to be relatively calm but once we hit 10:00 p.m. on friday, i think the wind gusts will ramp up out of the north 15 to 20 miles per hour. primarily in the hills above 1,000 feet. by 5:00 a.m. on saturday, it becomes gusty here. 20 to 40 mile per hour gusts possible and check this out, all the way into saturday afternoon we'll likely see winds 20 to about 50 miles per hour. so saturday at this point, looks like the windiest day ahead. we'll see less in the way of wind once we hit sunday's forecast. gusts 5 to 15. not too bad for that raiders game here on nbc bay area. dry weather monday, tuesday and wednesday and possibly a slight chance of a shower next thursday as winter begins. we'll have much longer looks of the seven-day forecast and a closer look at the wind and how gusty it could get in the micro climate in 20 minutes. new trial. the request is over the sole conviction in the case on gun possession charges. here is nbc bay area's christie smi smith. >> reporter: outside the courtroom, gonzalez chief attorney explained why he believes the new order after the conviction after a brief conviction. >> our whole defense is we picked up an object and didn't know what it was. that goads riges right to this. >> reporter: he was acquitted of murder and manslaughter in the shooting death of kate steinle but found guilty being a felony in possession of a gun. gonzalez believes the judge didn't properly instruct the jury about the charge. >> i think to properly instruct the jury in state court or federal court will find mr. garcia not guilty. >> reporter: federal prosecutors filed their own charges in a case that drew national attention, criticism from president trump and sparked fierce debate about undocumented immigrants in sanctuary cities like san francisco. >> the defense can get rid of that conviction that helps him very much in the federal case. >> reporter: markuates uatyate professor and while the defense procedure is roue tutine, there could be more at steak. >> no conviction on any crime whatsoever is hard for the public to take. >> reporter: prosecutors said they needed time to go over the motion. >> there will be motions filed at the end of the trial and we'll review and respond in court. >> reporter: both sides are due back in court in january. in san francisco, christie smith, nbc bay area news. a 15-hour stand off in the south bay ends with a wanted felon back in jail. police swarm the neighborhood near the golf course yesterday and finally took the suspect into custody just before 4:00 a.m. the swat team backed the bear cat vehicle in the home and used tear gas and officers fired bean bags and used k-9s for help. he jumped fences and hid before he was cornered. >> did eventually try to come out through different parts of the house and elected to come out the front of the house where he was taken into custody by police. >> without a fight. >> he definitely resisted arrest. >> some neighbors were forced out of their homes. the man was wanted on a felony warrant for burglary and possible connections to other crimes rc crimes. a vicious attack in a dorm room in san francisco state. investigators don't know what started it. it happened on tuesday afternoon. university police heard a student scream for help from inside of his dorm room. officers then forced themselves in. they found an 18-year-old man choking another student. he also had cuts to his body. students say they are surprised because they feel the dorms are usually safe. >> when you walk in, you have to show your key to show that you live here and i'm wondering did they hold up a pair of keys and the person didn't look at them or how did they get in? >> it's not clear if the attacker is a fellow student. the university says the student had surgery and is recovering. as for the suspect, the attacker is in jail. it is a plan to bring more accountability at the santa clara county jail. the board of supervisors made a move to create an oversight committee to keep an eye on what is happening after several jail guards found themselves on the wrong side of the law. damian trujillo reports from the county government center. >> the trouble at the jails have been well-documented and sheriff lowery smith received most of the blame. supervisors are saying things are about to change. the problems inside the county jail have been stacking up. there was a murder than two months away in south korea but there is a place and date much closer that the figure skating world is focused on. that includes a talented trio from the bay area hoping to be added to the list of bay area champions. it is a early wednesday afternoon in november and karen skates alone. no coaches, no choreographers, no trainer. not even a single sec dpeck ta . karen has only her music and herself to push her through the practice, that and the knowledge of what will happen in this very building the first week of january. >> when i took the ice today, it was headlights. i was feeling nervous but excited. it hit me in a few months i'll hit the ice and feel the nervous energy knowing it's the olympic year. >> reporter: san jose is home to the 2018 united states figure skating championships. the competition that will go a long way to see who represents the u.s. in pyongyang. this competition she won last year, surprising much of the ice skating world. including herself. >> it was definitely a big shocker for me because going into the competition, i really didn't put much expectation on myself and i was already having a little rough season and just nothing that, nothing that i really wanted came out of that seas season but. >> but when she did, very little has been the same sense. even in front of no one, everyone is now watching. it can make her nervous, which karen admits has been a weakness of hers in the past. >> like the week before, i feel all this nervous energy and sometimes i don't know how to cope with that and it's frustrating and sometimes like i feel like i'm so ready for this competition but at once, i step on the ice and i don't know how to skate anymore. i'm so nervous. i'm so tense. >> while karen will work to overcome that obstacle, edmonds is facing a different one, injury. the san jose 19-year-old already has ever has one olympics under her skate. the 2014 games in sochi russia but that experience only left her wanting more. >> definitely. in sochi, even after the long program, it had been like three hours after the event, it was sitting back in my room in the apartment complex like looking through the photos of the olympic rings in the background of me skating and i was like amazed and i totally wanted to do it all over again. >> i got to participate in the games in 2014. >> a foot injury kept her off the ice for much of the past year. she pofocused her energies instd on her freshman at santa clara university. >> i feel like it was almost a blessing in disguise it happened because even though i was working really hard the first two weeks after sochi, i didn't feel as motivated as i did until i came back from the injury because at that point, it was like i got to actually see what i was missing. >> all that time off the ice, though, have many wondering if polina will be in top form for the nationals. they call her a question mark. she disagrees. >> i think i'm an exclamation point. >> vincent joe would like to put an exclamation point on the season, as well. he came in second at last year's national. his first ever senior competition. but with big results, have come even bigger expectations. >> i'm stepping into this new, this new spotlight i have this one year to step up to all the expectations and meet them and try to make the olympic team and beco compared with the people tt have been here twice as long as i've been alive. >> so, after years of dreaming, and untold hours of practicing, all three bay area skaters look to san jose hoping it will be the spot where they make one giant leap toward their ultimate goal. >> we're stepping into uncharted territory with only one chance to make it right. >> so far this figure skating season, neither karen, polina or vincent turned in performances that meet their expectation but it takes just one great performance in san jose in jar january to punch their ticket. >> isn't that cool? they will all be here performing and if they do frost on the roof. >> tomorrow morning possibly more. the focus is gusty winds building in the forecast through the next 36 hours that will increase the fire danger. we'll start off with tonight. a brand-new issued fire weather watch and i really want anyone who lives in the hills above 1,000 feet to listen to this pretty seriously because we could see gusts up to 50 miles per hour. it will drastically lower the humidity and increase the fire threat here in the hills above 1,000 feet for the northeast and also for the south bay. so if any fire was to start, it could spread very fast. we'll detail more exactly how gusty it could get for the micro climate. i'll take you to tomorrow morning's forecast. not that much in the way of wind. a little breezy here. overall a cold start down to 38 for the south bay and peninsula at 40 and chilly 36 for the try valley. north bay down to 33. that's the number one coldest spot and a jacket in san francisco at 45. we start chilly and by the afternoon fortomorr tomorrow, t change is not quite as warm. clouds increase for a partly sunny day. you probably won't need sunglasses for the afternoon and looks good in the temperatures. 64 san jose, 6 262. most of the day tomorrow is going to be five to ten miles per hour. once we hit saturday morning, we're going to see things pick up because this cold front is going to dive off towards the south helping to pick up winds throughout the state. specifically for us, saturday morning you can see things will be anywhere from 10 to 22 miles per hour. winds coming out of the north and east. here is the problem we're going to get into. not only gusty very early saturday morning but right through 10:00 a.m. and even gusty winds staying with us through 1 1:00 p.m. on saturday. saturday looks like it will be a windy day from the morning right into those evening hours. then eventually once he hit sunday's forecast, less in the way of wind and that will be good news to get us out of the fire danger. dry monday, tuesday, and wednesday and then once we hit thursday next week, a slight chance of a shower. doesn't look like a big storm system at this point as winter will arrive at 8:28 in the morning. temperatures in san francisco in the upper 50s to also low 60s. for the inland valleys, we'll see 60s as we head throughout the next seven days. again, the biggest thing we're focussing on is wind where gusts could hit 50 miles or more. >> an important warning for people to be aware of this weekend. >> for sure. >> thank you so much. >> thanks, jeff. up next, droready for
