his. he has been swallowed in a wave of controversy in recent weeks pl allegations of sexual misconduct with underage teenage girls from decades ago when he was in his 30s. democrat doug jones faces the uphill battle. alabama has been red for decades. voters say they are sick of the spotlight and the allegations. >> it makes alabama look like, you know, like it always does. and it's just -- it's just not right. i'm fed up with the whole political mess. i'm tired of it. i'm sick of it. i'll be glad when food is over. >> statewide turn out has been brisk. the race so extremely tight like we said, moore with 50% of the votes. and doug jones with 49%. experts say a winner won't be named until late tonight. we will be following in special election closely. i'm going to be keeping track of the numbers and have another update in 30 minutes. raj. >> thank you. we'll track the results here with us. janelle also. and coming up in 25 minutes our political analyst larry gerston will be in studio with us to share his thoughts. now to top local story. the bay area woke up to stunning and heart breaking news today. the sudden death of san francisco mayor ed lee. san francisco's 43rd mayor died shortly after 1:00 a.m. this is him being taken to the funeral home. the sky ranger captured firefighters and motorists pausing to salute the mayor. he was shopping near his home in glenn park when he suddenly collapsed. mayor lee was rushed to sf general wrp doctors tried for hours to save his life. a small memorial popped up there in honor of the mayor. we have team coverage remembering the life and legacy of the mayor wells what's next for san francisco. we begin with sam brock joining us live at city hall. sam. >> reporter: jessica, good evening, in the words of lieutenant governor gavin newsome earlier shock is not the right way to characterize this. no one new of any health issues. he seemed vibrant and energetic and jovial, understanding this is the background there, they tell me they are shaken to their core over this. they described the imprint he left on san francisco. a heart broken city hall. with all the harmings of an immeasurable loss, honoring the life of 65-year-old mayor ed lee. >> nobody saw this coming. this is truly an absolutely shock that i think is going to take a while for everyone to recover from. >> were you aware he had any sort of health issues. >> i was not. but i do -- i never saw anybody work harder. i never saw anybody work harder >> the hard work and lengthy list of results highlighted much of acting mayor london breed's remarks underneath the rotunda. >> san francisco was enduring the recession and rising unemployment and growing worry. but the mayor was undeterred. >> lee championed prominent tax breaks to lure twitter and other tech companies to the area reenergizing the job market. he led with housing creation and oversaw the rehabilitated affordable homes. then the public service prior to office. >> we all remember him as a civil rights attorney who fought for tenants fighting rent increases. and a civil rights advocate. and it's a very difficult time for many of us. >> reporter: lee kept up his lifelong effort to help those in need with stints on the human rights commission, the department of public works and city administrator before entering public office. the common thread. >> opponents may have disgrd with him on policy. but everyone agree that is our mayor was a good man with a good heart. >> reporter: also, of historic significance here mayor lee was the first asian-american, the first chinese-american to serve as mayor. former supervisor david schuh told me there was little representation of the asian-americans before his arrival. but he is proud to pass the -- to cast his ballot for mayor lee as mayor. and that his legacy will get quote live forever. reporting live, sam brock. >> yes, politics aside san francisco lost an important public servant today. mayor lee did not speak the spotlight or even the title of mayor. he was humble. he was smart and passionate. he became acting mayor of san francisco in 2012 when gavin newsome was elected as the lieutenant governor. today, a heart broken newsome shared thoughts with us about his friend. >> he was a mentor. he was an adviser. he was a supporter, a incredible father, great husband. i saw so many things he did that, you know, were never -- in the news or never in print. decent, honorable person. >> well said by the lieutenant governor. he adds that ed lee was the type of manna lived his eulogy and not resume. he was without ego. mayor lee had challenges in the city and region this diverse there are a lot of issues he leaves behind. the question now, who takes over? all in the hand of the board of supervisors. mark maungtss is at the office and he was a unique politician almost anti-politician. this is a critical time for san francisco. what happens next? >> reporter: well, it is, raj. and you mentioned it when you talked about gavin newsome. we have seen this before when ed lee took over the office from gavin newsome because gavin went to the lieutenant governor office. ed lee was not elected by the voters to be the mayor. he was appointed by six votes. well more than that. from the board of supervisors. and the board could do it again. today board of supervisors president london breed is acting mayor. >> and i ask for your patience and i ask for your support. >> but without the support of her fellow supervisors breed to be replaced soon. >> if the board of supervisors collects six votes from the membership and you can't vote for yourself. they can select any person of frist who is of legal voting age to serve as mayor through june 2018. >> that's how lee got the job. >> now a few weeks later i stand before you as your mayor. [ applause ] >> reporter: before his appointment there was extraordinary pressure on the board of supervisors. today that pressure is building again. though none of the supervisors are ready to acknowledge it. >> right now, all i can think about is mayor lee's family what they are going through. politics will come. i get that. we will deal with that. >> city attorney dennis haira told me the board doesn't have to vote to appoint the interim mayor. >> for that entire period of time should they choose not to take any action mayor breed will be the acting mayor and the president of the board of supervisors. >> and whether it is in the coming weeks or six months from now, the future of city hall politics will likely hinge on who ever is selected. >> they put together the most important policy document in the city, our $10 billion budget we creates funding priorities. they set the tone for san francisco and provide leadership. who is in that role is important to the continued success of our society. >> now within the past hour former secretary of state hillary clinton had this absenting on twitter saying mayor lee's death is a terrible loss for the people of san francisco. he was a good friend and vocal advocate for the city he served and loved. my thoughts with his family. senator diane feinstein also played a major part of the san francisco mayoral history. she says he was an excellent mayor of great but sometimes challenging city. his quiet style was effective and allowed him to solve problems as they occurred. the last time a san francisco mayor died in office, feinstein was pressed into service. she was appointed deputy mayor back in 1978 when the mayor george mosconi and supervisor with were assassin eighted. that was a water shed moment in feinstein's career. many are talking about lee's legacy. the mayor recently talked about how he one day hoped to be remembered. the mayor's very last sit-down interview was with the nbc bay area report bigad shaban. during that interview the mayor talked about the ongoing series on illegal evictions in the midst of the housing crisis. the mayor who grew up in public housing revealed to us the kind of legacy he had hoped to leave behind. >> we have not built enough housing to accommodate. we haven't made it affordable enough. >> san francisco hasn't been able to do it in the past, why should anyone trust san francisco will meet the goals in the future. >> in the past we have failed because there wasn't a sincere effort. when i sent a goal of 30,000. i meant 30,000 units at 2020. this was a dpoel prison without parole. before the judge sentenced antolin garcia torres. sierra's parents said their painful peace to the man who murdered their daughter. and the lamars have waited so long to finally have their say, marianne. >> reporter: you're right, jessica. this has been a long and painful journey for the family. i first interviewed marlene lamar back in march of 2012 after sierra disappeared. now more than five and a half years later she finally got the opportunity to ask garcia torres to tell her where her daughter. >> the only thing we can hope for is that prison will be a hell for him, and that what he has done will eat away at his brain like a cancer while i rots in prison. >> that's the message sierra lamar's father delivered directly to his daughter's killer in court today. sierra's mother made an emotional plea directly to the killer >> asking him to come forward where sierra is to give us the real closure that we deserve as a family. >> after hearing from sierra's parents and her aunt and uncle, a judge sentenced garcia torres to life in prison without the possibility of parole. garcia torres was convicted of kidnapping sierra from morgan hill and then killing her. today many of the volunteers who spent countless hours searching for sierra embraced each other after learning garcia torres will die in prison. >> the gutless punk who raped and murdered sierra lamar and held her family hostage six year has been served today. >> but for the family there is no closure. >> every day is difficult for me. i think about her all the time. and what's been taken from me as a mother. >> reporter: well, the judge also ordered garcia torres to register as a sex offender. and now the defense team says they plan to appeal his conviction. reporting live in san jose, marianne favro, nabz bay area news. flames engufld homes in the oakland hills in the overnight hours. and it rekindled painful memories of the 1991 fire storm. the fire broke out before midnight immediately engulfing two homes under construction. the fire gutted two homes and scorched eight others in the neighborhood. forcing many people to quickly evacuate. >> no shoes, no shirt nothing. it was scarey. i don't know how my house is still there. it was wild. >> it used while wildfire season was a couple months a year now almost all year-round. >> part of the breaking news coverage in the overnight hours. it turned a retaining wall and a portion of the road is closed because of the damage. so far firefighters don't know what started this blaze. it's back to work for thousand of oakland city workers. the strike suspended today. employees were back on the job after walking off last tuesday over contract negotiations. an agreement hasn't been reached yet. however the union and city have met with the mediator. will this help the housing crisis? and will there be affordable housing? a major decision in the silicon valley. the city of mountain view is about to vote on a megaplan hading almost 10,000 new homes. the plan is backed by tech giants like google looking to expand in mountain view. anser hassan is there in the city with the city is set to vote within the hour. anser. >> reporter: good evening, raj. city council is meeting. you can see the group gathering in support of the measure. to give you some perspective, a large housing development is usually about 1,000 homes. this will be almost 10,000 new units, 2,000 earmarked as affordable housing. now if passed many bay area groups hope this could be a blueprint in addressing the bay area housing crisis. build it and they will come. >> it's a precise plan and it's a land use policy change that is unlike almost anything that's ever been done before. >> reporter: in 2015, the city of mountain view began to re-examine its land use policy in the north bay shore neighborhood. bay area is home to tech's global giants like google. but there was no mandate for actual housing. tonight's vote would change that. >> it will more than -- it will about 30% more housing in mountain view. >> tonight's roet is critical. tonight's vote that shows even the small to mid-size cities know that they have a responsibility and a role in helping our region address our collective housing crisis. >> carl is with the silicon valley leadership group. their report found between 2010 and 2015 the region created about 367,000 jobs. but only added about 57,000 new homes. he says california's tax laws actually penalize cities for adding homes. so mountain view's vote could be a milestone in how cities address the housing crisis. a broad coalition of private and community groups, even the school district advised on the plan. they hope it becomes a blueprint for other bay area cities. >> it's going to really be critical in offering more affordable housing choice. for the people that work not just in silicon valley but for the bay area. >> reporter: in mounen view, anser hassan, nbc bay area news. >> that's a big vote we'll bring it when it comes in during the newscasts or the twitter feed. let's bring in jeff. and we talked about the wildfire season going on all year long. we're so dry you can't dispute that at this point. >> i know. we really want the rainfall in here. there is a chance before christmas -- not a major storm system but as jessica just mentioned we are bone dry. let's look at where the drought is right now, the worst. you can see down across southern california where they continue to battle all of the wildfires at the current moment. it remains under moderate drought l.a. basin a abnormally dry for the san francisco and central valley. for the bay area we remain out of the drought but definitely have to start picking up something before we start to see -- well, these dryer than average conditions pushing back into the bay area. now, in terms of our forecasts for tomorrow morning it's dry. also cold. down to 38 here for the south bay. peninsula 40 and the tri-valley at 34. possibly frost. down to 32 in north bay and san francisco at 44. bottom line tomorrow morning you need the jacket like the past couple days. throughout the afternoon as we head throughout your wednesday forecast temperatures, well, pretty comfortable. 64 in antioch. 65 in san jose. 68 in morgan hill. 64 in san francisco and 66 in napa. no hunl differences traveling throughout the bay area. a quick look at forecast shows droi over the next seven days. next change would be wind coming in saturday. 10 to 25-mile-per-hour out of the north. that's good enough to help to clear out the air quality. but it keeps the fire danger up. we'll let you know more about the shower chances for the bay area at 6:48 tonight. >> thank you very much, jeff. firing back, president trump lashes out at an call for congress to look into sexual misconduct claims against the president. that prompted president trump to lash out today and his target was new york senator can kirsten gillibrand. one at least six senators calling for his resignation. the president tweeted that gillibrand begged him for campaign contributions and quote would do anything for them. words that were taken by many as being sexually suggestive. >> it was a sexist smear attempting to silence my voice. and i will not be silenced on this issue. >> grotesque. it took my breath away and it represents the conduct of a person who is ill equipped to be president of the united states. >> the white house maintains there was no sexual innuendo and the tweet simply addressed the current campaign system. minority leader nancy pelosi called the tweet disgusting. democratic senator elizabeth warren accused the president of bullying senator gillibrand. up next, results coming in alabama's special election process p will an janelle wang who has updated numbers. >> since i saw you at the top of the hour. roy moore pulse ahead slightly pu. but the race is too close to call. now with 35% of the precincts reporting. roy moore with 52% and doug jones 47. both wachgt closely from the viewing headquarters. live pictures from montgomery alabama and in birmingham alabama, a crowd there hoping to change a deeply red state blue. both candidates cast ballots earlier today. moore continues to have a lot of support, including from president trump, despite growing allegations of sexual misconduct with teenage girls. democrat doug bes jones knows he has an uphill battle but has significant support, including from former president obama. still a tight race to close to call right now. if roy moores wins he could face another battle, a congressional ethics investigation, gop senators will also reportedly meet tomorrow to discuss what happens next. raj. jessica. >> thank you, janelle. the high-profile race in alabama has defied the pundit it's. few experts were willing to speculate. we can see it's close. >> larry gerston, it's almost like election night but talking about a race in alabama. and a lot of people have been talking about it around the country. what are we looking for? we talked about the allegations at length. what are we looking for in terms of early results how do we determine who wins. >> that's a great question. because the 34% whatever you have right now where is it coming from. what votes are yet to comp. it's easier to count the votes in the rural counties because there are fewer. we know that moore does better in the rural counties. the big counties in terms of population, the birmingham, huntsville stuff like that. the votes take longer. doug jones people are hoping they'll have a wig enough lead in this is those counties to offset the many rural counties where moore does better. >> how much into play will come the push by the democratic party to get new voters in as we've seen with the minority groups especially african-americans. >> it's not just the africa rn americans. if you use the roy moore platform we're talking about muslims, homosexuals, a groups that are anything but white christian. >> all of these groups are likely to feel threatened much more after tonight than they did before tonight. because now we have a real ally in the senate. a trump ally. you have to expect a real kerfufle in the senate among republicans. when you heard judge moore talking today he wasn't talking about beating the democrats. he was talking about the republican leadership that's who he wants to replace. you can see right now particularly if he wins the big fight for the heart and soul of the republican party. that's what we want to watch between now and 2018. >> are you going to be surprised larry if he wins? because traditionally he should win despite the allegations. will you be surprised if he does not win tonight. >> yes i'll be surprised if he doesn't win. a couple of reasons why. we know that judge moore underperforms but wins nonetheless. he won by 4% in the last statewide race. the other thing we must remember this is a special election. they are unique creatures. very few people come out and historically poor people, people of color don't come out in special elections as much as in other elections. you give that benefit to judge moore and extraordinarily republican state. the big surprise would be if doug jones wins. he has carried himself well considering the huge margin that donald trump won by just a year ago. but he has an uphill battle. >> we certainly will be watching for sure. thank you larry. >> and he got new numbers from nbc news. roy moore reading 53% to 46%. as larry mentioned the bigger votes of the area sky ranger. the mayor is remembered as a fierce advocate for several issues, technology, homelessness and guy rights. nbc bay area laura malport joins from us the safeway where mayor lee collapsed last night. laura. >> reporter: jessica, this safeway is apparently where the mayor did a lot of his late night grocery shopping. and people here tell me he will be missed. look here, you will see flowers and balloons and a handwritten note. people tell me the mayor was a kind man who always had the city's best interests at heart. mixed emotion along the streets of san francisco where residents woke to the news of the mayor's sudden passing. >> he was very passionate about the environmental work and very passionate about so many other causes. >> he devoted his life to the city and civil rights and social justice. and it was a shock. >> as the city mourns lee's death residents and public agencies find ways to remember him. as noon today, public transportation agencies around the bay marked his passing by stopping all cars, buses and light rails for a moment of silence. outside lee's home in glenn park flowers and cards of condolences. >> he was kind. the people i know who interacted with him were very happy with how down to earth he was. >> reporter: mayor lee left a lasting visible mark in san francisco, dramatically changing the sky line with the addition of the city's tallest sky scraper, the salesforce tower. he fought for the homeless and affordable housing. most importantly many saw him as a champion of human rights. the nation's largest lgbtq organization says in part mayor lee was a tireless advocate for lgbtq equality who worked to make san francisco a stronger more vibrant and inclusive community. a committed environmentalist lee was in chicago last week fighting against climate change. reporting live in san francisco, laura malport, nbc bay area news. a congresswoman nancy pelosi spoke about mayor lee from washington, d.c. any had been political allies and friends for decades. she explained how she found out the news. >> practically in the middle of the night a call came that our dear mayor was shopping in the safeway, 10:30 at night for groceries, had a heart attack, was rushed to the hospital and died a couple hours later. a terrible loss to our city. this is a man who has never had an unkind word to say about anyone. and nobody had an unkind word to say about him. >> leader pelosi went on to call him, quote, a true gentleman. >> mayor lee leaves behind his wife and two daughters. unfortunately family is no stranger to sudden tragedy. back in 2013 at the local high school graduation mayor lee talked about us losing his own father. >> for me, i lost my father when i was a sophomore in high school. so i knew that my days ahead were not going to be very easy. in fact, i made up my mind as a graduate of public high school that i was pretty much going to go it alone, even though my father had reared me as a cook and my mom was a seamstress all of her years. but she had five other kids to take care of. and i did not want to be a burden. >> london breed is now acting san francisco mayor. >> we're talking about london borrowed. she was until this morning a san francisco supervisorfare from district five and served as the board president. that's from the inner sunset to the haight. she went to galileo high school and uc davis. she grew up with her grandmother in western housing. she will be the first african-american woman to lead san francisco. this is the second time someone was thrust unexpectedly into the mayor's office after the mayor's death. the first we mentioned in the nauiokaitis george mosconi who was assassin eighted in the 70s. feinstein was the first female mayor to follow. she went issues and sports. we got to know mayor lee pretty well through the years. not only a genuine leader but instrumental in the landscape of bay area sports. he was easy to spot in the giants and warrior championship parades. today those franchises paying respects on twitter. the warriors tweeting we are stunned and saddened by the mayor's sudden death. the lasting impact he leaves on the city of frist is a timeless tribute to his incredible leadership and vision. the giants tweeting, deeply saddened to learn of the sudden passing of the mayor. he was a true san franciscan who devoted his life to serving our city and supporting those in need. he was the giants number one fan. giants president ceo larry bay area speaking about his friend. >> i'm remembering him as somebody full of warmth and a good honest decent human being. and that sometimes those people you know don't always fall into politics. he was really a caring, high-integrity decent human being. >> he was instrumental for the giants and also very instrumental in getting the warriors' new arena over in san francisco. the 49ers tweeting a statement today from the york family. it said in part the citizens of san francisco and the bay area lost a wonderful man and a tremendous leader. the city of san francisco is marking the first night of hannukkah an hour ago. the city lit the first candle on the union square menorrah. the san francisco has lighting ceremonies on all seven nights. it's an annual tradition happening almost a half century. and there is no fear of rain with the lighting ceremony down at the union square. >> the festival of lights is upon us. >> normally this time of year we could get rain in here. and also a storm. but it's clear across most of california at least right now in terms of any kind of storm activity. and that's why i want to start off with a look at the rainfall season to date. we talked about this in the 5:00 show and how much we were behind for december. and you can see so far since october the 1st we have picked up rainfall. over six inches in soont race and inch and a half in san jose. but when you compare to where we should be we have a deficit of 1 inches to 2.62 for the rainfall season which begins october 1st. as of to date we are running about 45% of average in san jose. 66% of average in oakland and 73% ample in santa rosa. it's doable to catch up i think and to be at average or better. we're putting a lot of weight on january and february's rainfall hopes. we talk more about the rainfall chances here just before christmas coming up in about a minute and 30. i want to bring you into the tomorrow morning forecast. just know you need the jacket again. you may be doing scraping on the windshield into parts of the south bay with temperatures down to
