There a plain clothes officer confirmed they found a shotgun in the backyard of one of those homes, possibly the same weapon used last night here. San jose police are still out here. You can see them behind me. Theyre at the school for protection. They have temporarily suspended Outdoor Research and asked the teachers to keep their doors close for the time being. This is the second time a man has entered campus in the middle of the night and fired a gun. This is what it sounded like around 3 50 this morning. Those were two of the five shotgun blasts recorded by a neighbors surveillance camera. You can see in this video was the man what shooting at. He blew out a Security Camera outside the School Library and fired upon the building itself. A woman who lives across the street was awakened by the gunshots. She was actually on the phone with 911 as he continued firing. At one point she says he turned and pointed his shotgun in her direction, compelling her to hit the deck for her own safety. She and her husband did try to chase the gunman. A gutsy move considering neither of them were armed. Why did you chase after this man . I just wanted to give a description. I just wanted to i want it to stop. Im tired of this. These are my daughter goes here. This is just not fair for the kids. Its not fair. [ inaudible question ] two weeks ago. You never think of what happened here, you know, and you hear all about the sandy hook things. They did a barricade drill here a couple of months ago with the kids, but, you know, obviously as a parent its concerning. This is a very, very highly rated school. Reporter for over 90 minutes this morning, San Jose Police set up a perimeter in the neighborhood surrounding the school. Were here in the willow glen neighborhood of sanz. Officers werent able to find the men. Described described as 510, stocky bill. Police are looking to see if other cams got a good look at him. They think he possibly may have run through the yards. There are a lot of Home Security cams. The school difficustrict they be this is the same man who shot at one of their portable classrooms two weeks ago. Back here in the bay area, more than two years after her murder, today the teenager accused of killing 8yearold Maddie Middleton was arraigned in santa cruz. He will be charged as an adult. Nbc bay areas maryan favro was in the court. Reporter Adrian Gonzalez did not enter a plea this morning because his Attorney Says he plans to appeal a judges decision to try his client as an adult. Adrian gonzalez, who is now 18, stood in court this morning while his public defender announced he plans to appeal a judges decision to try gonzalez as an adult. I believe the decision to send my client to adult court is not supported by the totality of the evidence, which clearly shows, in my opinion, that the minor, now the defendant, is compliant, motivated and amenable to treatment. Im not surprised a bit. Thats the way our legal system in this country works. It goes round and round and round, but i think there is enough evidence that justice will occur. Reporter gonzalez is accused of raping and killing 8yearold Maddie Middleton in july of 2015. In a confession to police, gonzalez said he lured her to his apartment by offering her ice cream. If convicted, he faces life in prison. For the family of Maddie Middleton this now means even more delays. Gonzalez wont be back in court until february 20th. In santa cruz, maryan favro, nbc bay area news. New at 11 00, the San Leandro Police Department Says an officer has resigned. Hes accused of having sex with a 17yearold that was part of the departments Explorer Program. The officers name is marco becerra. Social services alerted the department and the police began investigating back in october. Becerra resigned about two weeks later. He faces three felony charges because the victim is a minor. The Explorer Program is for young people interested in Law Enforcement careers. Police say they are indefinitely suspending that program. Jurors still havent come up with a verdict in the state kate steinle murder case. Today is their fourth day of deliberations. Kates shooting and death created a firestorm of controversy over undocumented immigrants and sanctuary cities. Pete suratos is at the courthouse following it for us in San Francisco. Good morning, pete. Reporter yeah, good morning to you, laura. As you mentioned, more of the same here at the hall of justice in San Francisco. Still no verdict from the jurors in the kate steinle murder trial. The trial taking place for more than a month. Were expecting to come to an end shortly. And possibly that verdict being handed down today but we still dont know for sure. We have some new video of the past few days here regarding the jury deliberations. You see the prosecution and defense teams walking the hallways here at the hall of justice. And if you remember yesterday, jurors had questions for the judge, but we werent able at least were werent privy to those questions because it was a closed session. When it comes to the verdict, the jurors have to determine whether Jose Ines Garcia zarate intentionally or accidentally killed steinle back in july of 2015. Now, prosecutors initially charged him with seconddegree murder but the judge agreed with the prosecution to have the jury also consider firstdegree murder or Involuntary Manslaughter when it comes to that verdict. This case weve been following for the past two years, steinle was shot and killed bizarre tay in 2015 along pier 14 in San Francisco. And the prosecution claims that zarate intentionally carried out this shooting, pointing the gun at steinle and deliberately pulling the trigger. A stolen gun i might add found at the pier traced back to a u. S. Bureau of Land Management ranger. The defense claiming that the shooting was accidental and the bullet that killed steinle ricochetted off the pier before striking her in the back. If found guilty of seconddegree murder, Garcia Zarate could face anywhere from 15 years to life in prison. Our crews here are in the hall of justice. Stay tuned to nbcbayarea. The examiner got ahold of documents revealing the areas have been narrowed down. The paper says options include spots in hayes valley, inner richmond, sunset, marina valley, north beach and south of market. Sources tell the examiner that one or two will be part of the Pilot Program and if its skel, it could go citywide. Buzzfeed reportedly that they were displaying inappropriate phrases. Last night, they issued a statement to usa today. It says in part, quote, we worked to quickly remove it as soon as we were made aware. We are investigating this matter to determine what was behind the appearance of auto completion. Google tells usa today it has removed 270 accounts that made predatory comments on videos featuring minors. It turned off comments for 625,000 videos that were targeted by child predators.
