Kate steinle who was shot and killed by Jose Ines Garcia zarate in july of 2015 along pier 14 in San Francisco. The jury is left to decide whether this killing was intentional or accidental. The charges being considered are murder and involuntary manslaughter. The prosecution claims zbar tay intentionally carried out this shooting, pointing the gun at steinle and deliberately pulling the trigger. It was a stolen gun from a car of a u. S. Bureau of Land Management ranger that the defense says zarate found stashed under a seat at the pier. And that the shooting was accidental and the bullet ricochetted off the pier before striking her back. This case has been politicized due to the fact that zarate is an undocumented immigrant with a criminal history who has been deported several times. When you couple that with the San Francisco stwaert status, this case has come under the National Spotlight for good reason. Hamilton and clears out in other areas still seeing clouds from the moisture overnight, but we are expecting to see an additional system. Lets talk about that timeline. As we head towards tuesday, we have another system, but this is pretty farther north, Seattle Portland area and it could bring light rain possibly for the north bay on tuesday. But the bigger concern is going to be an additional cold front thats going to sweep in on saturday and thats going to once again pick up the breezy to windy conditions with a much cooler sunday ahead. Still pretty long ways out, but looks light were going to get another shot of rain here. Over the next seven days, we dry out wednesday through thursday. As we get into thursday and friday with the arrival of that storm system, we can expect some pretty cold mourns mornings. Expect frosty mornings thursday and friday and saturday and sunday, the showers will once come in in the inland spots. In the 60s for the remainder of the work week. We go undercover to find out the dangerous bacteria and other things that could make you sick. Popular makeup stores. A california woman is suing a the dirty truth about popular makeup stores. A california woman is suing a big cosmetics chain, claiming one of the samples she used there made her sick. You know what were talking about, right . I actually do because i go to the makeup store. At the makeup car, stores handle samples that testers and Television Anchors of both sexes can use to make sure youre getting the shade you like before you buy it. Turns out the samples can be loaded with nasty germs and make you sick. Here is nbcs jeff rossen. Reporter watch this woman putting on lipstick like shes in her own bathroom. But thats not her lipstick, its a makeup sample in the store. And other women use it, too. In fact, we watch woman after woman trying on samples, testing everything from mascara to eye shadow to concealer on their faces. Were blurring them. No need to embarrass. It may seem harmless, but one woman is now suing sephora, claiming she got the herpes virus. Is that actually possible . Oh, its absolutely possibly. You can catch the herpes object from lipstick. That virus can survive on the surface of a lipstick tube for up to a week. A week . A week. Reporter she said its not justment herpes either, makeup samples can make you sick any number of ways. But is it really happening . To find out, my producer lindsey is undercover at some of the most Popular Stores taking samples of those makeup testers. First up, the target of that new lawsuit, sephora. Shes using sterile swabs to gatherer samples from all kinds of makeup. Lets try this one. Reporter sealing them up. All right. Off to the lab. Reporter and sending them to a certified Microbiology Lab where these lab techs get to work, testing for different kinds of viruses and bacteria. And the results are in. At sephora, four out of eight samples containing harmful bacteria including e. Coli what is that . Oco l they come out with our feesies. So you could literally be applying and smearing someone elses fecal matter directly on to your lips. That is so gross. Reporter but the shocking results, two of the samples at sephora coming back positive for staph, which could cause very serious infections, boils and legions. Especially if you have an open cut on your skin or lips or it gets in your eyes. Is it happening at other stores, too . Here is the macys sample. Reporter at alta one sample coming back positive for e. Coli another for klebsiela and staph. That means that all three stores we tested, we got hits for dangerous bacteria. We reached out to the companies, macys declined to comment but the others did. Sephora telling us the health and safety of our clients is our foremost priority and their testers are regularly sanitized, replaced and replenished. Also saying they follow best practices in our stores and offer many other ways for clients to test products. Ulta saying the health and safety of our guests is a top priority. We encourage and support sanitary trial by offering items like cleansers and disposable makeup applicator. What are people supposed to do. How do you avoid this . Well, if youre itching to try, at least use the makeup on the top of your hand as opposed to using it close to your eyes or lips. Those areas are much more vulnerable to infection. Right . Jeff rossen reporting and ruining your lunch. By the way, if you dont want to test these samples all at the store, experts say you can buy the product, try them at home. If you dont like it, many stores will let you return them for a full refund. I know sephora and i think ulta do that. Rite aid, thats how they try to differentiate themselves. Good to know. Back in a moment. All right. Breaking news now that weve been covering for about a half an hour. San francisco fire still working with pg e on that situation there. It is near the corner of mission rather, Mission Street and st. Marys avenue. This would be the Outer Mission above 280 and the san jose exit there. It was reported first as a gas leak and then it turned into what sounded like an explosion. Pg es investigating there, but we do want to tell you you should avoid the area if you can. There are no injuries reported but they do need to get a lot of personnel in there to fix that line. We also saw a backhoe digging there. Hard to tell whether its part of the problem or the solution. It looks like they had drawn something on the ground and digging something up. We will be continuing to monitor that. Of course youve got the kate steinle murder case and the verdict there. We will be monitoring that as well throughout the day. Things shaped out quite nicely for us. They worked in our favor. Weve got a lot of sunshine. Temperatures will remain comfortable in the 60s.
