because they were afraid of being stranded there. witteker lives in this neighborhood in the middle of two major road repair projects. santa clara county started new construction on black road close four-door 8:30 a.m. to 5:30 p.m. next westbound caltrans will begin stabilizing skyline boulevard on monday that road will be closed all next week from 6:00 a.m. to 6:00 p.m. 37 but skyline and black road are the only ways in and out of the area ever the skyline collapsed during the winter storm. the construction schedules leave 171 home owners stranded or blocked out during the days. >> i could get a phone call from school saying the your kid is sick and i can't go get them np. >> many home owners called and complained to both attentions but nothing has been resolved. >> doesn't make sense seeing it. >> reporter: but under new new guidelines introduced by the santa clara county the way police deal with it is supposed to change. in most cases the charge no longer comes with a trip to the jail. instead just a citation. >> i can't control what other policies and other entities do. i can only control my department. >> today the police chief says he is not ready to get onboard. he is advising officers to arrest suspects if they see the need breaking from the county's new jail guidelines. those guidelines call for law enforcement to issue a citation instead of a jail booking for most crimes that have a bail amount of $15,000 or less. that includes some thefts, exposure and prostitution cases. the chief says crooks aren't getting off easy in his city. >> i want the residents and the officers and also the individuals that might be out there thinking we're going to be easier on crime that that is not the case in the city of san jose and that these officers will go out. they will enforce the law. >> reporter: the county made the change to keep jail cells from filling up with the low level and mentally ill suspects. they also say a jail supervisor has the final call on who can be booked. and who can't. the san jose police department has modified the duty manual to officially reflect the county's new guidelines. but the chief says he will continue relying on the opinion of officers not a number set i by the county. >> we are here to keep the city safe. >> in san jose, damian trujillo, nbc bay area news. >> county offers are closed today we weren't able to get reaction to what the chief said. we have new details in an ongoing police sexual abuse scandal in the east bay. today a legal restrictry for former officer ryan walterhouse. he was face ago misdemeanor charge in case the celeste gaap. the teenager we reported on her extensively who claims she had sex with dozens of police officers from various police department in exchange for protection and information. the d.a. office says it can't find her to testify. so it's dropped the charges. walterhouse's attorney says his client hopes to resume his contrary in law enforcement. the cleanup continues in north bay fire zone. the epa has been working on this almost two weeks now. they've collected items from more than 5,000 properties. and say they're almost 75% finished. which includes everything from paint can'ts cleaners rk oil batteries even pesticides wins the epa finishes work state and federal agencies can come in and remove ash and debris. and that's when the true rebuilding process can begin. well millions raced to music the north bay fire relief concert a big success for victims and first responders. the show itself raised $17 million. in total $23 million raised. expensive it is to rent here in the airway. we compared the cost of a two bedroom apartment across the bay. on average people spend more than $3 a month in san francisco for two bedroom. more than $2,500 a month in san francisco and you can see the numbers there in oakland not far behind. the survey from apartment lists.com says a quarter of bay area renters spend at least half of their income on rent. now next week san jose city leaders will vote on whether to amend the rental ordinance to allow for more rent controlled units. where do we go to get a price break how about sol oh many .right before the holidays. two of the families say they've been unable to find anywhere else they can afford to rent. >> i see a lot of people going through this. they're getting pushed out. and everybody is one paycheck away from being homeless for the holiday angles bay area housing experts say situations like this are becoming all too common as the bay area deals with an unprecedented housing crisis. where tenants have little power. >> we are sort of in the midst of an unprecedented level of housing inafford ability. they're at the mercy of people who will do the wrong thing in many instances. they have no alternatives. >> we tried to reach the property owner and the property manager. their attorney was unavailable for comment. meanwhile, their tenants have no idea where
