information. you can follow him directly at r handa nbc. a chaotic scene with a deadly ending. big questions about the use of tazers after a man died during a confrontation with oakland police at this scene process. jodi hernandez joins us live from oakland where the man's family and a high approval attorney are demanding answers. >> reporter: that's right wp civil rights attorney john burris says the man's family is devastatesed. he has agreed to help them get answers while the oakland police department and the district attorney's office conduct investigations. >> he tried to run from the cops. so they have to do something. >> this man describes what he saw after a traffic collision outside his workplace on oakland's foothill boulevard. he says the driver who caused the crash took off running then got combative with police officers who tried to put him in a patrol car. >> screaming and saying no i don't want to go inside help me help me. >> we need a medical crew. >> the officers ened up using a tazer on the man who later died at the hospital. >> all i know is that a person is dead and that a tazer was used. the question to me is was a tazer used properly, and did it contribute to his death? >> the man's family has contact the civil rights attorney john burris who wants to get to the bottom of what happened. >> the guy is alive and working every day and get a call and he is at the hospital and he is dead. that's traumatic. >> the oakland police department wouldn't talk on camera. but any say it's being investigated by both the homicide unit and internal affairs. folks at the center for human rights say police officers are simply too quick to use tazers on people who really need crisis intervention teams. >> we just don't know enough about how tazers interact with every human being to not record them as lethal instruments. >> reporter: the oakland police department points out that while a tazer involved, the cause of death has not yet been debates. among questions and concerns how often are tazers used what's the likelihood of things turning deadly. let's bring in bigad shaban. >> we looked at the data for the entire country and found out dying from being tazed is actually pretty rare. we discovered tazers used in the field about 250,000 times per year. leading to roughly 62 deaths, according to the bureau of justice statistics. that's one death for every 4,000 times a tazer is used. statistically a person is more likely to get struck by lightning. here in california, 140 people were injured last year after being tazed by law enforcement. >> we also did some digging into what agencies actually use them. we found out that sheriffs departments in 8 of the bay area 9 counties arm deputies with tazers. and while they aren't part of the arsenal at santa clara county sheriff sh office the agency tell us it's in the process of coming one a pilot program to potentially use them in the future. >> good information thank you. a roof-top mounted derick. they are called out to the building where the crane was already being dismantled. we're told during the process the crane slumped and came to rest on the ornamental metal outside the building. the build something not damaged. no one injured. cal osh an say they determined the roof mounted unit was stable. meaning while it may look scarey there is no danger that it would fall or further collapse. they did not see a need to investigate but will stay in contact with the operator as the rest derick is dismantled as scheduled. they say before that happens an the officers would be required to release personnel files. >> a nfl star held at gunpoint by las vegas police. we have new video fueling the debate of what happened. this was big news several weeks ago. las vegas police releasing more body cam footage today. showing seattle seahawks star michael bennett minutes before and after he was handcuffed at gunpoint. bennett has hired a high approval bay area attorney and claims he was only detain because he is black and the police used excessive force. police say the video refutes the claim. investigators say officers had reason to detain him based on the way he was running from the scene. >> months after coyote creek flooded in san jose official cleanup efforts are about to begin near the rock prings neighborhood. crews evacuated hundreds from the area when the floods happened. now the water district board is gathering volunteers to clear junk from the creek. the debris could cause blockage and more flooding. trees add to the problem but the scene of huge problems earlier this it is the tallest dam in the country, the oroville dam was the scene of hunl problems earlier this year. the spillway collapsed forcing 200,000 people to evacuate. >> now we have uncovered more problems. the entire dam could fail which could impact our water supply. senior investigative reporter steven stock has been on this case six months. steven what do you ever. well raj this independent forensic report released says the state of california failed to use modern engineering standards to address issues with the spillway you just saw that failed. but our six-month investigation uncovered warning after warning that the dam itself needs serious attention and repair. problems that two former state insiders tell us are being kicked down the road and not being fully addressed. all summer and into the fall work on oroville as collapsed spillway has forged on at a furious pace, as california's department of water resources races the clock to repair the mile long spillway before the next rainy season. but it's what's not getting all the attention that concerns several engineers we spoke with. >> they don't know what to do. >> state water project engineer don colson retired 20 years ago after working on many facilities including oroville dam and the spillway. >> i think it has failed. it just hasn't collapsed. >> we examine two decades worth of federal and state inspection reports, engineering studies, consultant letters and mos nearly 10,000 documents in all. they repeatedly identify safety issues which concern several engineers we spoke with. issues such as a 15-foot long crack in the gate eight at the control structure that appears to be growing. sprulg or deterioration of concrete in other areas. cracking tendon or trun onroads that help move the gates which control the flow of water through the dam. and failure to come one a long-term plan acceptable to inspectors which would morin the amount and flow of water that naturally goes through the earth and dam. if that water comes out at the wrong place and at the wrong speed it could wash the dam away. >> my driving force is out of concern for the public. >> in recently retired high-level dwr did administrator who asked to be called mark worked as a field engineer on the water project. >> they're not addressing issues that have been raised, pointed out, documented in previous division safety dam inspection reports. >> mark joined another retired dwr engineer tony who worked on state projects including oroville dam. both wanted to shir knowledge from the inside about how dwr runs manages and maintains dams. >> any have a tendency to reduce -- tri and reduce bt maintenance costs by trying to do thing themselves and not getting adequate technical help. >> they askeds to conceal identities because both fear pensions could be taken away for speaking out publicly. >> here you have a catastrophic failure that's not going to allow it to operate the way it's supposed to. >> we're pretty confident that the dam is safe. >> joel serve as deputy director on the state water project. he was there helping calling the shots when oroville dam spillway began to fail. >> we lose that and it's uncontrolled. we knew that was a problem not only for public southeast but the environment itself and the dam structures. >>s in his first extensive interview since that spillway failure wak in february. >> is the rest of the dam safe? >> yes, i think from -- today's assessment, inspections, we've had structural engineers looking at those cracks. today yes obviously we need to keep monitoring. we need to improve our maintenance program. >> critics such as the engineers who used to work at dwr say the issues must be addressed now issues like that crack which this report shows in red paint and says is growing in length. >> cracks like that could really weaken the structure to the point where it could lead to a failure. >> well, i think that's probably a miscommunication on that's been growing. i had conversations with our dam safety engineers. and it has not grown. >> the cracks in the tendons or trunion rod that support the control gates worry engineer more. initial tests show 28 rods have cracks 1/32 of an ifrm or bigger six of the cracks are larger than 1/16 of an inches. that indicates more comprehensive tests are called for. >> back 15 years ago we we were looking at it these were cracking and failing. if this gate fails you're not going to be able to control the releases out of oroville. >> when i show you that what does that say to you as an engineer. >> it tells me we got a problem. and it tells me that we're lucky that it hasn't manifested itself to a great problem and a crisis. >> but what draws the largest critical questions from the half dozen engineers we spoke to was this. dwr has failed to develop a quote for long-term monitoring of water that naturally leaks through the earth and dam. what's known as the friatic surface. inspectors raise thd concern repeatedly in report after report offer over the last five years. it was listed on the most recent inspection report as the top issue to address. the reason, to keep the dam safe experts say dwr must know with certainty how much water is coming out of the dam and where. because if water flows out of the dam face instead of tam's toe erosion can occur and the entire dam could wash away. >> clearly federal monitors are concerned about in issue. >> we have a monitoring system today. obviously dsod and ferc want to improve that. >> but forgive me the fact they keep repeating and point going out mean it hasn't been addressed yet. what's taken so long to address the issues. >> that i can't answer. that's something i could get back to you oh on on why so long i don't have an answer for that. >> and despite several long email explanations from dwr after that interview, they never did get back to us on that question about why all this is taking so long. they also would not let us see or take pictures up close of that large crack at gate 8. they continue to insist the dam is safe even after they admitted to me they also never expected
