The nfls deflategate scandal appears headsed to federal court after tom bradys fourgame suspension was upheld by the nfl commissioner, Roger Goodell. The ruling also containing a bombshell, that brady had his cell phone destroyed just before he met with investigators. Nbc National CorrespondentPeter Alexander has the latest on this. Good morning. Good morning to you. Tom brady posting his response on Facebook Page early this morning writing im very disappointed by the nfls decision. I did nothing wrong and no one in the Patriots Organization did either. Right now at Gillette Stadium at new england, bob kraft, the owner of the patriots is addressing the media responding to that 20page decision that its not the crime, its the coverup. Was never biggest quarterback playing defense this morning. Tom brady teeing off on the leagues decision to uphold his fourgame suspension over deflategate, calling it deeply disappointing. In his report tuesday, Roger Goodell said that brady had the cell phone and sim card he used throughout the scandal destroyed. Ordering his personal assistant to do so on or about march 6th, 2015, the very day brady was interviewed by independent investigators. The report says that kept some 10,000 Text Messages away from those investigators. The league instead receiving a letter saying that electronic data could no longer be recovered. Goodell wrote, rather than failing to cooperate, mr. Brady made a deliberate effort to conceal relevant evidence and undermine the investigation. Bratddys camp insists tom was completely transparent and patriots blasted the suspension as unprecedented. The Players Union said the league based on the suspension on the smoke screen of irrelevant Text Messages and plan to appeal in federal court on bradys behalf. Brady has maintained his innocence publicly at news conferences. Is tom brady a cheater . I dont believe so. In high profile interviews. All of the facts will come out after the super bowl and how will those facts come out . That will be news to me as well. Reporter the new revelation could be a lasting tarnish on his golden boy reputation. I think what happened today has given the people already inclined to be against tom brady to presume he is guilty. They have more ammunition to argue hes guilty. The people on the other side of that coin, they dont know what to say. Some of tom bradys rivals are piling on. Former ravens wide receiver smith tweeting, you cant say cheaters never win. Brady reported early to patriots training camp. Next stop likely to be in federal court. The league preemptively filed a suit to confirm bradys suspension. Yes, they did. Bob costas, the host of nbcs football night in america joins us. Youre a lifelong football fan. You wake up this morning, are you feeling better or worse about the integrity of the game . I think it depends emotionally on where youre waking up. Im talking about you. I think they turned a misdemeanor into a federal case, both figuratively and literally. Theres no question consciousness of guilt both in his interview with me super bowl week and press conference, destroying the cell phone, if it walks like a duck and quacks like a duck, but guilty of what . To me this seems more like watering down the infield or Playing Field to slow down a speedier opponent or pine tar on a bat. Its not awful but it became awful because of the way the league overreacted and brady himself didnt say what he could have said. I think if you read that 19page report and i know you have, to me i felt like this isnt about deflating footballs anymore, this is about a coverup. This is about someone who didnt cooperate and someone who destroyed evidence. Its always the coverup rather than the crime. Ive been thinking from the beginning, why didnt he just say, look, the equipment people knew i wanted the footballs at the lowest per missible end of inflation. If accidentally or purposely they went beyond that, i take responsibility for it because ive communicated my preference but didnt order them to do that. The league gave him an out on Text Messages and emails, they said your lawyer can go through these communications and hand over to us the ones that are pertinent. Yes. The notion that he was doing what would be understandable, trying to protect private information, that doesnt apply here. Now whats the next step . Its going to federal court, that we know. If he applies for an injunction, fine, that means the case goes ford and he gets to play the first four games. If he loses, he could face suspension in the middle of the season. The legal experts that ive read and listened to weighing in on this have said, generally speaking, a court wont grant an injunction unless they believe you have a good case and good chance to win it after its reheard. Hes going to have to make that case and what it hinges on isnt whether the evidence would stand up in a criminal court. Its whether under article 46 of the agreement between the players and the league, they have the right to do this. Whether it was the right decision is a separate thing from whether or not he has the right to impose the penalty and hear the appeal. All about process, not going to go to permit. Fourgame suspension, a lot of people are arguing and comparing that to greg hardy of the Dallas Cowboys involved in a heinous episode of domestic violence. He got four games. Are they comparable . Not remotely but the league can say he sat out all but one game of last year. Arbitrator reduced it to four, thats not our judgment. This goes to the integrity of the game. They say its consistent with fourgame penalties for using performance enhanceing drugs on the first offense. Stay in new york because well need ut over the next couple of months. Ill go to the cot in the back room. Starts at 7 00 unfortunately. Unfortunate. Turning to natalie for the other top headlines.
