no charges were filed in that case. now they're trying to determine if he was also linked to a crime in mountain view. nbc bay area's jodi hernandez joins us live in vallejo where this first crime in this kidnapping first started. jodi. >> reporter: jessica, the victims' attorney says today's developments are just what the victims have been waiting and hoping for. they say the couple has been on an emotional roller coaster over the past four months. tonight they say they're vindicated. >> today is a fabulous day for denise huskins, for aaron quinn, who have held their heads up high in the face of public shame and humiliation. >> reporter: that's how attorneys for the victims of a bizarre abduction police initially characterized as a hoax say their clients feel tonight. as the fbi announces they have arrested a suspect. 38-year-old matthew muller a harvard law school graduate from sacramento is in custody, accused of kidnapping vallejo physical therapist denise huskins and drugging and tying up huskins' boyfriend, aaron quinn, back in march. >> the conduct was so far outside the box, they had a hard time accepting it as being true. so at this point you know -- at this point, i think we're beyond being surprised. >> reporter: according to the affidavit, unsealed just today, the victims say they were awoke en in the middle of the night, drugged, bound with zip ties and forced to wear duct taped swim goggles. their captors said if they did not comply the other would be hurt first by electric shock and then cutting their face. huskins was held for two days before being released. her abductors sexually assaulted her. >> the problem for a woman who has gone through an ordeal like this to then not be believed is tragic. it's revictimizing ms. huskins. >> reporter: huskins and quinn held on to each other tightly. their attorneys say despite the ordeal, they're stronger than ever. the couples' attorney say they plan to continue towíi rebuild their lives and move forward.;u)rñ @r(t&háhp &hc t so far, vallejo police aren't saying anything. they have not provided a comment. reporting live in vallejo, jodi hernandez, nbc bay area news. >> it is a bizarre details all the evidence that investigators say they have collected in the case. a chp motorcycle officer is in the hospital this evening with moderate injuries. he crashed earlier today on 680 in danville. our nbc chopper was overhead. northbound lanes were shut down for about an hour during the investigation into this crash. it happened just north of el certifio boulevard. the chp says it's not clear whether an earlier collision happened just in front of the officer or whether he was clipped by a big rig. happening now, fire crews in southern california battling 150-acre wildfire. it's forced the evacuation of some dozen people from a campground near irvine lake in orange county. at least one home near the lake is also being threatened at this point. right now, the fire is 25% contained. a fire in south san jose leaves three homes scorched and 12 people homeless. it happened yesterday afternoon on snow drive in south san jose. firefighters had to battle a second fire a few feet away alongside highway 101. investigators are trying to determine how the fire started. nbc bay area's marianne favro joins us from san jose with the details and how victims are doing now. >> reporter: the victims are doingf certainly very happy to have escaped with their lives. you can see behind me this home is boarded up and you can even see a do not enter sign. this is one of three homes that burned yesterday. scorched by a wind-fanned fire. and now investigators are trying to determine the cause. flames ripped through three homes in south san jose leaving 12 people searching for a place to live. today rico visited the place he once called home and recalled the horrifying moments when he was face-to-face with flames. >> i called my wife called 911 and pulled water. i heard the explosion. and the flames come into my face, you know. >> reporter: rico his wife three kids and two dogs are all okay but he lost almost everything. he managed to salvage scorched cash from his wife's business but the soccer coach says more than $3,000 given to him to pay for team dues went up in smoke. along with some soccer equipment. the fire then jumped up the street to scorch this one. firefighters say winds also sent embers over the sound wall causing a small fire off highway 101 that forced one southbound lane to shut down for about an hour. today arson investigators combed the area looking for the point of origin. we talked with one investigator who asked us not to show his face. >> it's our belief based on the burn patterns and physical evidence the grassfire was secondary. >> reporter: rico says he's not focused on how the fire started that destroyed his home and nine years of coaching memories. he's too consumed with wondering where his family will live now. rico's soccer team today started a go fund me account called house fire recovery. it's to raise funds to replace the equipment that was burned here in his home but also to help rico's family get back on their feet. reporting live in san jose marianne favro, nbc bay area news. >> marianne thank you. critics pounced on san francisco's sanctuary city policy after the recent murder arrest of francisco sanchez. as it turns out, more than 250 cities and counties nationwide are following the same rules. that's according to a new immigration and customs enforcement report released just today. between january and august of last year more than 1,800 immigrants wanted for deportation were instead released and later rearrested. sanchez's arrest nearly two weeks ago after a fatal shooting in san francisco reignited the immigration debate. he had previously been deported five times. an international manhunt under way for the notorious drug lord, el chapo, who escaped from a maximum security prison in mexico. his real name is joaquin guzman. he escaped saturday night. he slipped through a small opening under a shower in his cell. and that eventually led him to a ventilated and reinforced tunnel. the mile-long path went underneath the prison wall to a half built house in a farm field. prison guards are now being questioned to see if they may have been involved. u.s. authorities are once again offering their assistance. it turns out this is the 58-year-old's second prison escape. tonight on "nbc nightly news," a closer look at the crimes that led el chapo to become one of the most wanted men in the world. lester holt at 5:30. we could have an agreement in a matter of hours. three diplomats familiar with the iran talks say an agreement is imminent. john kerry left the hotel in vienna where negotiations are being held. american and iranian negotiators spent today struggling to clear the final obstacles aimed at eliminating the threat of a nuclear armed iran. it's a sign of the times. first the pentagon ends the don't ask, don't tell policy allowing gays to serve openly in the military and now looking to lift the ban on transgender people. nash carter wants the ban to be lifted. the official announcement could come later this week. senior u.s. officials say all military branches will have six months to determine the details of how to integrate transgender troops. we have new video today of the manager and owner of the pot shop in east san jose raided last week. both appeared in court today. since may, we have been investigating their marijuana dispensary called san jose organics. our undercover cameras captured the business violating city rules, including selling to underage customers. santa clara county judge, javier alcaliforniaa set bail at 250 each. the manager is set to be released tonight. owner, ben lew, set to be released tomorrow morning. as of this morning, the shop is closed. a rise in gang crime means a new gang strategy in san jose including sending out the elite s.w.a.t. team on patrol. i'm damian due heo live at police headquarters. i'm scott budman. after a spike in gas prices we talked to the experts to find out what's next. we'll tell you about prices coming up. and good afternoon. i'm meteorologist jeff ranieri. a beautiful day across the bay area. and clouds beginning to return to san francisco. your fog forecast for tomorrow coming up. plus how hurricane dolores may impact traveling plans to mexico. true full gang enforcement and it's virtually all handsn new at 5:00 tonight, full gang enforcement and all hands on deck. the gang problems in san jose are escalating. that means a change in strategy for police. officers will now focus on four areas around the city known gang hot spots. in a story you'll see only on nbc bay area damian trujillo is live. what's the plan damian? >> reporter: five gang zones dhaer looking at. the first couple weeks in july have been especially troubling for police, and so now virtually every available extra unit will be out fighting gangs, including the s.w.a.t. team. welch park is where parents bring their children during the summer break. but it's also a park adjacent to one of the city's designated gang hot spots. >> because of the violence we have seen these last month and a half, something needed to be done. >> reporter: san jose police have identified five areas in the city known as gang zones. it's these areas that the department will focus most of its efforts in the foreseeable future, meaning even the elite s.w.a.t. team known as merge will jump in patrol cars to cruise the gang zones. >> some of the citizens in if some of these areas are in fear for their safety and kids' safety and quite rightfully so. >> claudia likes the strategy. anything she says to help keep her children safe. >> the idea is to saturate these areas we have identified high visibility for patrols, proactive patrols. >> reporter: the new strategy took effect over the weekend. and it will be a mobile strategy. so for instance if something spikes on another -- in another part of town they'll pick up the pieces and move their strategy to that part of town to make sure they attack those gang hot spots. live at police headquarters in san jose i'm danian trujillo nbc bay area. >> thank you. closure today in the brutal bathroom fight at levi stadium last year. a central california man who joined his brother in attacking two men was sentenced. he was sentenced to five years in prison. he was the main aggressor in beating up two men at the bathroom at levi's stadium during a 49ers game last october. rivero must serve 85% of his sentence before he's eligible for parole. his brother faces a separate trial. the roadway opened last night eight hours ahead of schedule. the roadway was overhauled for structural and safety reasons. a better view of the golden gate bridge is an added bonis. the morning commute went well and it's inaugural day, but bound to be some tweaking. >> they do have a 35 miles per hour sign and an s-curve or something. but it's so small relative to all the other -- i don't think anyone notices it. >> that tweaking begins tonight. project leaders will close one lane of the parkway overnight to make some improvements. we have done this cat and mouse game before. high demand low supply. gas prices are spiking, but what's to blame this time? business and tech reporter scott budman joins us in san jose alongside the pump. scott. >> reporter: well, raj, good times for local businesses mean a lot of people hitting the road for summer vacation. but refineries have not been able to keep up with the high demand for gas, which is why we saw the quick spike in gas prices. it's a bit ironic that as our economy gets strong enough to encourage more people to head out on vacation gas prices are spiking, making it tougher for people who have to work. >> i scraped this money together to get ten bucks of gas in my car. and i've got to go to work every day. and if i don't get paid every two weeks, how am i supposed to go to work? >> gasbuddy.com says a gallon of gas jumped by 28 cents in california over the last week. 12 cents in san jose alone. and we're not done yet. >> i would believe that we could see prices jump another 5 to maybe 15 some stations another 25 cents a gallon over the next week before this latest round of increases is priced in. >> reporter: it's a price hike that's being felt all over the bay area. >> it's definitely a pain in the rear end. >> reporter: making it tougher to get away even in the heat of vacation season. gasbuddy.com tells us by the end of the month, the gas spike should subside and we will probably see a dip in gas prices. coming up tonight at 6:00 the green we know. just like our weather seems to be changing. let's bring in meteorologist jeff ranieri. a really nice day today. >> beautiful from the north bay to the south bay. a storm system passing by off to the north. a little bit of sprinkle activity in oregon. but for us just meant high clouds on the increase and you can see that band of clouds now moving throughout the central bay. you'll see in our sky camera network how gorgeous it is now for the south bay, averaging 79 degrees and sunny skies. thick fog at the immediate coastline coastline. and 77 throughout palo alto and los al toes. and east bay, sunny skies and 81. san francisco, blue sky but high clouds fillingter across. and the biggest problem right here is winds out of the west at 29 miles per hour gusting into the 30s. that wind will stay with us tonight, also tomorrow morning. so you may face some airport delays, possibly at sfo, maybe even for oakland. let's get you into the morning forecast as we head throughout tuesday and the fog coming back. upper 50s and low 60s. and the best chance of drizzle would be right along the peninsula with 61 degrees. let's bring you to futurecast and you can see for tomorrow how thick that fog will be at the immediate coastline. we can't even rule out maybe a little bit of drizzle back here towards alameda county and right up towards the north bay again low clouds stay with us. by the afternoon hours, we get that sunshine coming back here to the interior valley throughout santa rosa napa arain da, walnut creek, san jose. but if you're headed to the immediate coastline, you've got the fog still lingering throughout half moon bay. don't expect a full-on sunny sky at the coast. our biggest change this week is all about high pressure. by wednesday, this brings the heat and it will produce 90s throughout the interior valleys, possibly some isolated 70s at the coastline. so tomorrow is really going to be the last i think real comfortable day here throughout the bay area. that will put san jose at 83 degrees and sunny skies towards los gatos. 82 in moregan hill. palo alto and sunny. san francisco, 69 in the financial district and 70 expected in the mission. going to be real nice there. for the north bay, east bay and also the tri valley a trifecta of sunshine for napa santa rosa also with low to mid 80s. and the tri valley 87 and danville. 85 in pleasanton. oakland, 74 for the high. as we push towards this upcoming weekend, what you will find is gradually temperatures will begin to head down. saturday in the south bay, 84 degrees. by sunday, 82. the tri valley will go from 90 down to 88. so all in all, hot wednesday, thursday and friday. and then eventually we'll get those numbers to be dropping for us. and thankfully nothing headed our way. if you are headed towards mexico watch out for hurricane dolores. winds coming in at 75 miles per hour. this will be moving just to the south of puerto vallarta and cabo san lucas by tuesday, wednesday and thursday possibly as a category 2, maybe a category 3 hurricane. looks like wednesday would be the worst if you're headed to cabo san lucas. rainfall totals could gust as high as 40 miles per hour. but the good news if you're headed to cabo san lucas by friday and saturday the storm system moves out and looks good for us. >> thanks for the warning, jeff. at this hour tomorrow night. they include requiring stricter building materials, like preservative treated wood and corrosion resistant steel. an inspection every five years. the collapse killed six people. inspectors found the beams had severe dry rot. san jose state's embattled president is stepping down. mohammed qayoumi will become chief adviser for infrastructure in technology to the afghanistan. since then he's faced criticism for his handling of a number of campus crises including the bullying of an african-american student living in dorms. san jose state has had seven presidents in the past 20 years. the interim president will be appointed while they look for a successor. mohammed qayoumi released a statement that read in part it's been a privilege to serve as president. my wife and i
