capturing the attention of the public and police today, tuesday, july 7th, 2015 2015. and good morning. welcome to "today" on a tuesday morning. savannah having holiday time this weekend. we're joined by hauta. that guy with the helium balloons, that was a $10 lawn chair. >> what was he thinking? i know he's trying to promote his cleaning products, but hello. >> more on that story in a little while. we want to start on a tuesday morning with breaking news out of washington state. a deadly ice cave collapses at a national park. it's really popular with hikers. jacob, is at one of the hospitals where the injured are being treated. what can you tell us? >> good morning, the three most critically injured patients are treated here, all crushed by ice. that area now closed indefinitely as the rescue effort has now turned into a recovery. this morning, one person is dead and five others are injured after a section of the popular big four ice caves in washington suddenly collapsed monday. >> being advised of a possible partial collapse of the ice caves. eight to nine subjects, possible injuries, some subjects unconscious. >> more than 100 rescuers raced to the remote area about 70 miles northeast of seattle. >> essentially a frozen avalanche, it's incredibly dangerous. >> three of the injured hikers who all sushered from crushing type injuries were airlifted to seattle. a fourth victim, a juvenile, not seriously injured was transported to a nearby hospital by ground. it was the second day in a row part of the ice caves collapsed. one woman was reporting when a portion of the same cave gave way near a group of hikers. officials warn the public in may to stay away from the unstable and dangerous caves. warmer than normal temperatures were melting the ice and snow months ahead of schedule. sadly, this cave-in was deadly, with one person still buried inside. county officials say it is closed until further notice. and they assess the area and as they recover that deceased individual. it is tedious work. the rescue emergency officials also have to make sure that they're savefe as well. matt and hoda. >> and now to explosive new revelation tied to the bill cosby sex scandal in newly released court documents from a 2005 deposition, the comedian admits obtaining sedatives to use on women he wanted to have sex with. national correspondent kate snow is here with more. >> good morning. cosby's lawyers have fought to keep these from being seeing saying they would embarrass him and they were sealed for about a decade. after a request from the associated press, a judge from philadelphia said because cosby so often got on a, quote, soap box about moral issues, he no longer has the right to keep all these records private. bill cosby in his own words admitting he obtained seven prescriptions for quaaludes in the 1970s and gave them to other people. in documents from a 2000 fave case, cosby was sued from a woman who accused him of drugging and sexually assaulting her. before it was settled out of court and dismissed, cosby sat through a wo-day deposition. was it in your mind you were going to use the quaaludes for young women you wanted to have sex with? the plaintiff's lawyer asked, cosby replied, yes. he avoided questions about who he gave the drugs to and when or whether he ever coerced or forced women to take drugs. did you ever give any of those young women the quaaludes without their knowledge, he was asked? cosby's attorney jumped in, do not answer that question. cosby described one encounter in las vegas. she meets me backstage, i give her quaaludes, we then have sex. >> i wouldn't necessarily call this the proverbial smoking gun, but it is kwauberation for the fact that he used drugs when attempting to have sex with women. so it does in a sense take the moral high ground from his position. >> for barb bowman, who was one of 13 jane does in the case, it's vindication. >> it was a big breath, big sigh of relief, of hope. and looking forward to this next part of this journey because i think this is really just the beginning. >> in the documents frk the accuser's attorney is complaining to a judge that cosby's lawyer was turning the deposition into a carnival, a claim the judge later rejected. the plaintiff's attorney also at one point said to cosby, i think you're making light of a very serious situation. cosby replied, that very well may be. we reached out to attorneys and representatives of cosby and did not hear back. he has never been charged with a crime with sexual and drug allegations. a couple other things to come out in the court documents. cosby offered to pay for the education of the 2005 accuser if she got a 3.0 gpa or better, and also confirmation of something we reported last fall, that cosby agreed to give an exclusive interview to the national enquirer years ago if they agreed not to print a story about one of his other accusers. >> revelations in the case. >> thank you very much. let's turn to melber, cohost of the cycle. good morning to you. sealed for ten years, this document, this deposition. now released and revealed. why now? >> basically, revealed because the associated press sued for it. typically, if you have something sealed in this kind of settle settlement or suit, it is gone. we don't see it. the judge finding because he was a public person making sort of a morality crusade, this was fair game. >> let's talk about the key exchange. when asked by the plaintiff's attorney, when you got the quaaludes, was it in your mind you were going to use these quaaludes for young women that you wanted to have sex with. cosby replies, yes. so all the allegations that have come forward by women against bill cosby over the last many years now one day, one word, yes, how does it change things legally for them? >> legally, this what they call an admission against interest. here is bill cosby saying that part of the fact pattern that has been in dispute and alleged is in fact true. he did acquire these kind of drugs for this kind of reason. that's an ingredient in some of the crimes alleged against him. >> the other exchange, when asked by the same lawyer, did you ever give any of those young women the quaaludes without nar knowledge, and cosby's lawyer jumps in with, do not answer that question. would that have been an admission of rape? >> it could be because it would go to the idea he was incapac incapacitateing people to have intercourse. depending on the state, that alone can constitute raim. >> if you're a prosecutor in a jurisdiction where a woman has brought an accusation against cosby, based on what you heard this morning and read this morning, do you have cause to bring criminal charges against cosby? >> most of the criminal prosecutors who looked at this, including in pennsylvania, said they didn't feel they have the evidence beyond a reasonable doubt. pennsylvania and new jersey still have a shot clock ticking, the time has not run out to continue to look at the criminal charges. >> the criminal side in terms of civil suits against bill cosby, does this open the door to more of those? >> absolutely. the civil standard which we all know is lower and this kind of document asian coming from his own mouth and cosby's lawyers aren't disputing the accuracy, opens up, i think, a much stronger civil case. >> ari, great to have you here. now moving to politics and donald trump doubling down on his controversial comments about immigration as the republican presidential candidate's empire takes another blow. nbc national correspondent peter alexander has the later on this. good morning. >> good morning to you. donald trump is now dismissing the latest company that cut ties with him. that's espn, after espn announced it's going to move an upcoming celebrity golf event away from one of trump's courses. not a big deal, that's what trump said, as he spoke out again on this issue. now driving a wedge into the republican party. at a charity golf event monday night, donald trump teed off again on illegal immigration. >> we're talking about crime. you saw what happened the other day with the young lady in san francisco. a disgrace. >> trump has seized on the random shooting death of 32-year-old kate steinle. killed while walking along the embark adaro with her father last week. the alleged attacker, a districted felon who federal officials said had been deported to mexico five times. in a jailhouse interview, francisco sanchez said he didn't remember what happened but didn't dispute police say he did it. trump insists it was merely one of thousands of similar incidents throughout the united states. later he added, infectious disease is pouring across the border. >> they're bringing crime. they're rapists. and some, i assume, are good people. >> in that statement, trump argued his controversial comments about undocumented immigrants are being deliberately distorted. trump has quickly divided the republican party desperate to win back latino voters. just 27% supported mitt romney's campaign, down from 40% for george bush in 2004. >> i'm willing to debate here in new hampshire any time on the issue of immigration. >> late monday, trump also insists someone else besides him retweeted a message about rival jeb bush that said bush has to like the mexican illegals because of his wife. bush's wife is mexican-american. >> thank you, donald. >> thank you. >> the billionaire's whose comments have catapulted him to second place in republican polls says he isn't backing down. >> the polls are a testament. now they say i'm going higher. i think the country is fed up. >> still defiant this morning, the "washington post" reports many of the workers building trump's newest luxury hotel right here under crux in washington, d.c. by a contractor, say they're undocumented workers who crossed the u.s.-mexico border illegally in search of a new life. trump's spokeswoman told the paper trump's companies and its contractors follow all applicable law. >> wow, this story keeps unfolding. peter alexander, thanks so much. in the meantime, another high-profile gop candidate, governor chris christie of new jersey, could be forced to resign because of his white house run. according to reports, democratic lawmakers in new jersey are planning to introduce legislation that would require christie to step down. they say he's been out of the state too much this year. the bill, by the way, would also apply to any future governors. >> now to the raging debate over the confederate flag. lawmakers in south carolina are one step closer to removing it from state capital grounds. today, the state senate is expected to give final approval of the bill after a 37-3 vote in favor of removing the flag. it would then move to the house and could be on governor nikki haley's desk by the end of the week. she has led the charge to remove the flag in the wake of last month's shooting at an historic black church in charleston. >> let's turn to natalie with the latest on a closely watched meeting involving the united states. >> the iran nuclear talks and once again, the talks are breaking through their second deadline in a week. andrea mitchell is in vienna with the latest. andrea, good morning. >> good morning, natalie. the iran tacklks have now been extended for a third time, now until friday. a u.s. official says they want to focus on the quality of the deal, not the challenges. it is a giant game with iran. the u.s. does not want to look too eager for a deal. and iran has been upping the ante. they have renewed their call to lift a u.n. embaurgo on conventional nonnuclear weapons that are preventing iran from buying or selling weapons including ballistic missiles. the u.s. thinks this would further inflame the wars in syria and iraq, and russia and china who could make money, want to lift the embargo. while this is going on, the republicans back home are having a field day attacking the talks. republican presidential candidate ted cruz now calling on hillary clinton who started the talks in the first place, and on john kerry, to cancel the talks. saying he wants kerry to return home and stop negotiating with what cruz is calling that vicious enemy, iran. back to you. >> all right, andrea mitchell, we'll be watching what happens in the next 24 hours or so. the second csx train in as many weeks has derailed in tennessee. this time, at least four cars came off the tracks. this happened near nashville. 3 of the cars were carrying packaging beads. a fourth car was carrying steel. no hazardous materials were spilled. fortunately, no one was injured. last week, another csx car carrying toxic chemicals caught fire and prompted thousands to evacuate. >> a southwest plane bound for san francisco had to turn around and make an emergency landing in phoenix on monday night after the plane blew atire on the plane landing gear. it landed safely and no one was injured. pars were then moved to a new plane. >> fames movie producer jerry weintraub has died. he produced "nashville" "karate kid" and "ocean's 11." he promoted tours for elvis presley and frank sinotary. he died of cartiac arrest. he was 77 years old. >> as we showed you earlier, a man in calgary, canada, takes to the skies using only helium balloons and a cheap lawn chair. now he's in trouble with police. take a look. daniel using the $10 chair and 101 helium balloons. he said he was trying to draw attention to his cleaning product company. probably got a lot of attention he did not want. he said he intended to parachute himself into the calgary stampede, the city's famous rodeo. what would go wrong there? the weather did not cooperate for him. he said he was looking down through the clouds at 747s and that it felt like 30 below up there, but instead he landed in an industrial field. police have charged him with one count of mischief causing danger to life. so many things that could go wrong. >> i kept thinking of the movie "up" that looked so awesome until you see the reaction. not great. >> aren't many mornings you get to use the word nitwit, but today. look at the flooding we saw in las vegas. at one point yesterday, a foot and a half of water over the road. ten rescues from flood vehicles. the world series of poker had to be delayed because water rushed into the ballroom where the tables were set up. we have flash flood watches this afternoon. we have a line of stronger storms from chicago to st. louis down into texas where we also have flash flood watches and warnings in effect. we are still looking for more and more rain. it trains over the same areas and across central oklahoma with up to 7 inches of rain in the next 48 hours. (beep) hey... o.k. they'll do. wake up to the mountain grown aroma of folgers. ♪ the best part of wakin' up ♪ so, where do you want to start? i think this is a pretty good place. ♪ is folgers in your cup ♪ good morning. i'm meteorologist kari hall. temperatures are now in the mid 60s. we do still have a lot of low clouds all across the bay. north bay now at 55 degrees. nice and cool. as we head into the afternoon expect highs to top out in the 70s and 80s for most of the bay. am san francisco, though reaching 69 degrees, east bay 71 degrees, we get some sunshine this afternoon and it will be breezy, mice and comfortable and more of this weather this week. and that's your latest forecast. >> all right, dylan, thank you very much. let's turn to a troubling case in florida making national headlines. a quarterback at florida state university dismissed by the school overnight after video surfaced of him punching a woman at a bar. of we should warn you, this is disturbing. nbc's gabe gutierrez has more. >> reporter: this morning, florida state university quarterback de'andre johnson is off the team and facing a charge of misdemeanor battery. it stems from an incident on june 24th at a tallahassee bar. in this newly released surveillance video, johnson is seen arguing with a woman. she then raises a fist. he grabs her arm. she tries to hit him. but he punches her in the face. >> he is very regretful he did not turn around and walk away immediately. >> reporter: according to court documents, the victim suffered bruising under her left eye, swelling to the left cheek and upper lip, and a small cut near the bridge of her nose. johnson's attorney says while his client is embarrassed and apologetic apologetic the woman had yelled racial epithets at him. >> there is a witness that says -- heard this. and that did not invoke mr. johnson to do anything. he had then tried to deescalate the situation. it wasn't until she struck him twice before he reacted. >> reporter: the woman declined to comment to nbc news. it's the latest in a string of football scandals. ray rice was booted from the baltimore ravens last year when video surfaced of him punching his fiancee in an elevator. johnson is also not the first fsu quarterback under scrutiny off the field. jameis winston, now a top draft pick was accused of rape in 2012. he said the sex was consensual and was never charged. he has since filed a counterclaim against his accuser. as for johnson, his attorney says the 19-year-old is now volunteering at a domestic violence shelter. >> the question we have to ask ourselves, do we want to teach our young adults that when they make a mistake, that's it your life is over or do we want to teach them that if you make a mistake and you learn from it that perhaps you might be given a second chance. >> reporter: for "today," gabe gutierrez, nbc news. >> not a good situation. >> that video. >> watching everybody in the bar just sit there. >> yeah. >> they were just frozen and didn't know what to make because you're right, there wasn't much reaction. coming up is nascar now too fast and too dangerous? >> i'm feeling pretty good this morning, actually. for what we went through as a heck of a crash, and the safety equipment did its job and i'm here today. >> were you simply in the wrong place at the wrong time or did you sense that something bad was about to go down? >> well we were sitting in a pretty good spot. i was riding right behind jeff gordon and pushing all we could to the finish. the white flag had already come out and thought we were in a pretty good spot to get a good finish which we did. we came across the line in seventh, so i was proud of the finish but didn't want to be crossing the line in the air, by no means. >> yeah you got banged around which is bad enough at those speeds. by the way, how fast were you going at that time? >> i haven't really quite found out the exact speed, but i've heard 190, somewhere around there, 198. >> so you get banged around at that speed, it's bad enough. but then the car goes airborne. can you even begin to describe what that feels like in the pit of your stomach? >> yeah no it's not the greatest feeling in the. when world. when the first impact happened you tuck instantly and grab the wheel as hard as you can. when the car flips over you know it's getting ready to be a rough ride. you hold on with all you've got, and when it hit the fence, i didn't really know where i was. i was still kind of holding on talking myself through the wreck. and after we landed back on the ground i was thinking it was almost over. and the worst part of the crash was actually the very end when the two cars slid into me. but it was pretty cool to see all the pics. felt like the wreck happened and when it was over i thought i was done wrecking and there was somebody at my car. >> so you've seen the video, and is it weird to know you're the guy in that car? >> yeah i've looked at the video, and all the pictures. it's definitely wild to look at. i want to thank everybody that built my car. i want to thank nascar for all the stuff they have done to make our sport safe. i mean you see a wreck like that and you shouldn't be talking to a person as early as you guys are talking to me today. i feel like it's pretty cool that i'm just a little sore. i feel great, and i'm ready to race this weekend. >> you bring up nascar and there's a lot of criticism, austin, as you know about this racing restricter plate racing. let me read some comments that have come out, referring to this in the last couple days. in referring to this driver ryan newman said quote, nascar got what they wanted. that's the end of it. cars getting airborne unsafe drivers, same old stuff. they just don't listen. jeff gordon who you mentioned earlier, said quote, i'm glad i only have one restricter plate race left. and brandt james writing for "usa today" wrote this. quote, simply and most importantly, this -- there a question for nascar as a sanctioning body and a sport. is this acceptable. so let me ask you. is it too fast too dangerous, does nascar have to change? >> well, you know i want to first off say i love my sport in nascar. you know i get to do what i love on the weekends and race. and what they have done to make our cars safer after bad wrecks have happened i think, you'll learn more from my wreck. they have the car now, and they'll be looking at it and see what happened the right way. i think, you know for this type of racing we probably could bring the speed down a little bit and get the same style of racing that we want to see out there for the fans. obviously, we don't want cars getting in the air. so we'll work hard to do that and i think nascar has the people around them to make the right call. >> but restricter plate racing keeps cars bunched tightly together at high speeds. is that something that can continue? >> you know i think we like to see the tight racing the pack type of racing it's cool for the fans to watch. it's fun for our drivers to be a part of it, i think. i think the hardest part though you don't need the speed where we catch air. so it's pretty tough decisions to make. we signed up for this as drivers when we sign in to what we're wanting to do. it's a part of our racing. we go to talladega and daytona twice a year. >> when are you back in the car, austin? he wanted to sleep with. a judge has released documents from a 2005 case. cosby was being sued by a woman who had accused him of drugging and assaulting her. that case was settled out of court. cosby acknowledged under oath he once obtained prescriptions for quaaludes with the intention of giving them to young women and having sex. he confirmed doing that with one woman in the 1970s. more than a dozen women have accused cosby of sexual misconduct. some involving drugs. he has never been criminally charged and has denied the allegations. at least one hiker was killed and five others injured at a popular tourist attraction in washington state. officials say there was a partial collapse monday at the big four mountain ice caves of northeast seattle. signs warn people to take away because warm weather has made the ice caves unstable. there was a similar collapse a day earlier, but nobody was injured in that accident. a grandfather and baby granddaughter barely escaped serious injury after a frightening accident in sydney australia. he let go of the child's stroller while talking to her mother at a train station. the stroller then rolled off the platform and as you see right on to the tracks. the baby suffered some cuts and bruises, but the grandfather climbed down and moved her off the tracks right before a freight train came through. he was able thankfully to scramble to safety as well. scary moments there. some bad news this morning for all of you who plan to swing by starbucks on your way to work or school. beginning today, the coffee giant is increasing prices on some of its drinks ranging from 5 cents to 20 cents. a small and large brewed coffee will each go up by 10 cents in most areas of the country. the change comes as other coffee sellers, though are lowering their prices. starbucks blames rising rent and labor prices for their hike. a set of all-girl quintuplets is finally together at home this morning in houston. we have been following their story right natalie, thank you so much. now to the alarming results of a new study in health care. are you at risk -- at a higher risk of dying from serious illness or injury if you check into a hospital on the weekend? it's something called the weekend effect. and the research shows the answer in several countries, including the u.s., is yes. the new study looked 3 million admissions between 2009 and 2012 from 28 metropolitan teaching hospitals in the u.s. england, the netherlands and australia. the research focused on deaths occurring in hospitals within 30 days of an emergency admission or planned elective surgery, and found that the risk of dying was higher on weekend hospital visits in three out of four countries. the risk was 13% higher in five u.s. hospitals. 8% higher in 11 hospitals in england. and 20% higher in six dutch hospitals. and here with more is nbc medical contributor, dr. natalie azar. those numbers are shocking but it should go without saying if you have an emergency and it happens to be a weekend, you go. >> of course of course. and, you know i want to say this. this finding has been observed over multiple studies over multiple years. there is probably not one single explanation. if you come in with a arrested yack arith mea that requires an intervention the hospital just might not be staffed as well as it is during the week. but obviously, if you have an emergency, you're going in. >> let's talk about some other things. we're going to move down here. the july effect. this is a time where new doctors, interns and things like that are in training. you should be aware of that. >> correct, hoda. and as opposed to the weekend effect which we have established is true, the july effect is a little more controversial. some studies suggest it really does exist, some studies suggest it doesn't. but the whole basis of this is that the academic year for medical trainees starts on july 1st. that means that every year, june 30th to july 1st, there is a whole switchover of, you know, doctors who are taking care of you. they're getting used to new electronic medical records, they're inexperienced. i should say, there is a lot of supervision that still happens. so you may not want to schedule something elective on july 1st give it a couple weeks. again, a little controversial. >> there are teaching hospitals out there. and one of the key questions to ask is who is actually doing the operating, because sometimes the less experienced people may be in the operating room as well. >> 100%. and this -- if you are admitted and getting a procedure done in what's called a university academic teaching hospital you have to assume there will be residents who are taking care of you, as well as the attending physician. this is very relevant when it comes to surgery. i have to say, though there have been many studies that have looked into the safety comparing these kinds of two hospital systems, and it actually looks like in some cases that you know hospitals that have residents actually perform better than the hospitals that don't. a lot of surgeons obviously are there, and there's constant supervision. but it's just something to keep in mind. >> and quickly, you should always have an advocate whether it's elective surgery, emergency surgery, someone who can ask the right question. >> absolutely. you want to have a family member or friend somebody to prep questions, take notes. you're in a stressful situation when you're in the hospital. you may not be you know taking everything in. you want to have somebody there who is an advocate. >> i had that. my sister with me if she didn't take notes, i don't know what would have happened. and lastly quickly, have an emergency plan. >> absolutely. things can go wrong, doesn't matter what age you are. when you are admitted into the hospital you have have an advanced directive. don't ask what sarah jessica parker says she will never discuss in public. and the three simple changes you >> i'm competitive with both of those, probably better at jenga. it's less brain -- >> so at a party, that's your go-to game? >> my nephew and i were just playing jenga for hours in st. louis. >> that sounds like fun at a party. >> oh yeah! >> scrabble. >> there are ways to -- i'm sure there are college kids who make jenga -- >> we used to in college. >> oh, yeah. >> the more drinks you have, the better the jenga gets. >> there are parents preparing to send off their freshmen soon and just heard that. >> "hollywood game night" is so much fun. we're going to play a game jin has dialed up for us. she's a ringer. >> very competitive. so are we. it could get ugly. >> we're going to talk to jane in just a minute. let's talk about this bill cosby news. newly released court documents quoting cosby in a 2005 deposition admitting he obtained sedatives to give to women he wanted to sleep with. cosby said he, quote, obtained seven prescriptions for quaaludes that was in the 1970s and gave them to other people as well. cosby's lawyers have fought to keep these documents from being seen by anyone. they were sealed for about a decade. this deposition as i said, was in '05. but finally released after of a request by the associated press. cosby was being sued in the case by a woman who accused him of drugging and sexually assaulting her. before it was settled out of court and dismissed, cosby sat through a two-day deposition where these admissions were made. the plaintiff's lawyers asked in one instance, when you've got the quaaludes, was it in your mind you were going to use the quaaludes for young women that you wanted to have sex with. cosby replied yes. the lawyer also asked did you ever give any of those young women the quaaludes without their knowledge. cosby's attorney at that point jumps in and says, do not answer that question. nbc news reached out to attorneys and reps of bill cosby didn't hear back. cosby has never been charged with any crime in connection with sexual or drug allegations. he and his representatives continue to deny. i was watching tv last night and some women were on television saying these were alleged victims who have been speaking for years, and trying to have their voices heard. and they heard -- >> discredited for years. >> they heard the information in that deposition and they said that story rings true to me. >> i don't understand how the legal system works here, that if someone makes that kind of admission in a deposition, how is that sealed? [ laughter ] >> here, baby, you can make this, you'll make our sauce in the blender no cooking. first thing's first. here's a tip. when making a pesto put the liquid on the bottom first so it emulsifies ease. >> i so this is water. >> little bit of lemon juice. >> basically this is my creamy alfredo sauce, a.k.a. no cream. >> it's kind of pestoey, right? >> but i'm using cashews as the thickener. see how thick that is? put that in there. put the spinach garlic, lemon zest. the zest is superaromatic and tasty. if you don't want to use cashews swap them out for almonds. if you don't want to use spinach and you want to get healthier you can add kale or arugula. do this, always make sure to put a lid on top. >> can i ask about nuts? you can use any kind of nuts or do these -- >> >> uh-oh. there we go, all right. >> so grind that up. and then that makes this creamy slishs delicious sauce right here. now make our pasta. so now you take a peeler, not a mandolin otherwise you'll like -- right? >> i cut my finger off. >> so go just like so. just make little. >> -- do you have a tip for that is this? >> yeah use a peerl.
