we come on the air, millions along the east coast are on alert for severe weather. it comes as americans gear up for the holiday week and one of the busiest travel times of the year. the tsa predicting it will break its all-time daily record in the coming days. friday was already the fourth busiest day in the agency's history. the threat tonight impacting more than 61 million americans from north carolina to maine. severe thunderstorms, flooding, and tornadoes all possible fueled by hot and humid conditions. out on the west, days of heavy rain leading to flash flooding in the albuquerque area. our weather team is standing by with the forecast. and abc's faith abubey leads us off. >> reporter: tonight, amid record-breaking holiday travel, more than 61 million americans under severe thunderstorm watches from north carolina to maine. the system already bringing heavy rains and damaging winds to the midwest. these lightning strikes in garnett, kansas causing a transformer to explode. torrential rains leading to dangerous flooding in downtown albuquerque overnight, prompting water rescues. a city bus among the stranded vehicles. >> last night was very, very extreme when it comes to weather. the convention center was about six inches away from major, extremely expensive flood damage. >> reporter: officials say several buildings were damaged, including city hall and the police department headquarters. the severe weather threatening to disrupt that record travel taking place around the july 4th holiday. >> it was really busy in phoenix. we did have to get there early. >> reporter: aaa estimating more than 70 million americans will travel over the holiday period, an 8% increase over 2019, expected to be the busiest 4th of july on record. some passengers at atlanta's hartsfield-jackson airport, the nation's busiest, telling us that weather has upended their travel plans. >> unfortunately, our layover got canceled because of the weather in new jersey. >> my flight has been canceled due to the weather there, they say. i'm a little frustrated not knowing where i'm gonna go if i don't have a flight until tomorrow. >> so many questions there. faith joins us from the atlanta airport. the fourth of july a few days away and the holiday travel expected to set records. >> reporter: that's right, rachel. the tsa expects this holiday travel period to peak next sunday, july 7th, anticipating it will screen more than 3 million passengers in one single day across the nation. which will be the agency's busiest day ever. rachel. >> rachel: faith, thank you. all that travel could be upended by heat and storms. let's get to danny beck strm. time out this threat for us. >> reporter: this line of strong to severe thunderstorms sweeps across the northeast tonight, bringing drenching downpours, damaging wind gusts and prolific lightning to millions. severe thunderstorm watches from north carolina to maine until this front pushes off shore. while the northeast is stormy, the south is steamy. settling into a stretch of scorching heat through the fourth of july. triple digit heat indices for houston, tulsa, new orleans. beryl the big story, the earliest hurricane on record, and unprecedented to see a storm this strong this early in the season. beryl barreling toward the windward islands. this is just the second named storm of the season. with water temps closer to september, it's no surprise we're off to a quick start. >> rachel: storms in the northeast, the heat in the south, thank you. we turn to the news just coming in. the department of justice is set to off boeing a plea deal, allowing it to plead guilty and avoid a trial over allegations it misled the faa during its evaluation of the boeing 737 max. it was involved in two fatal crashes in 2018 and 2019. families of the 346 victims have been pushing the doj to take boeing to trial and impose hefty fines. attorneys reptding those families say they oppose the deal. both boeing and the doj have declined to comment to abc news. >> rachel: next, the new york attorney general is launching an investigation into a police shooting of 13-year-old boy. body camera video of the incident was released over night. hundreds taepded a individualt for that eighth grader. officers said they believed the boy had a handgun, but it turned out to be a bb gun. details tonight from morgan norwood. >> reporter: tonight, for the first time, we're seeing police body camera footage of the moment an officer in upstate new york shoots and kills 13-year-old nyah mway. in the video you see utica police stopping the 8th grader and another teen, who they said matched the description of robbery suspects. >> can i just pat you down and make sure you got no weapons on you? >> reporter: as an officer moves in, nyah runs away. >> gun! got a gun! man's got a gun! >> reporter: the teen appearing to point at officers what authorities say they believed was a gun, circled in red in edited freeze frames released by the utica police department. police catch up, pulling nyah to the ground. >> drop it! drop it! >> reporter: an officer, identified tonight as six-year veteran patrick husnay, shooting nyah once in the chest, during what the police chief described as a struggle. >> it was just one shot, it was me. >> reporter: tonight, authorities also releasing this photo of what they say turned out to be a pellet gun. a replica of a glock 17 gen 5 with a detachable magazine. not an actual gun. mway's mother sobbing at the press conference saturday. >> i don't think any officer goes on the job hoping to shoot or intentionally try to shoot anybody. they're looking to be able to come over at the end of their shift like anybody else. >> say his name. nyen mway. >> reporter: overnight, hundreds gathering to remember nyah, a refugee born in myanmar and a member of the karen ethnic minority. >> he shouldn't be here crying and mourning for his little brother. this country is supposed to be a country of freedom. a country of peace. what's going on? >> reporter: rachel, police say this wasn't a random stop. instead, part of a police investigation. the chief also saying they've arrested teens for carrying replica guns, calling it a disturbing trend. rachel. >> rachel: morgan, thank you. sfwloo now to the race for the white house and more fallout from the first presidential debate. president biden spending the weekend at camp david. his campaign trying to turn the page, saying it has raised more than $33 million since thursday. but questions about the president's age and mental fitness are not going away. here's abc's white house correspondent, maryalice parks. >> reporter: tonight, president biden with his family at camp david, as democrats try to chart a path forward, following his dismal and worrying debate performance. >> there are very honest and serious and rigorous conversations taking place. >> reporter: jamie raskin saying there's a world where biden is not the party's nominee, but biden himself would have to choose to step aside. >> whether he's the candidate or someone else is the candidate, he's going to be the keynote speaker at our convention. he will be the figure we rally around to move forward and beat the forces of authoritarianism and reaction in the country. >> reporter: but other biden allies offering a more full-throated defense. >> the stakes of the race couldn't be higher and the only democrat who has ever beaten donald trump is joe biden. he is our candidate for november and he has the best shot to beat him. >> reporter: the biden campaign arguing if the president were to drop out, it would lead to weeks of chaos on the convention floor. republicans already tying up senators for re-election to biden's debate performance. trump and his close confidante predicting trump will win in a landslide. tomorrow, he begins serving a four-month prison sentence for defying a congressional subpoena to discuss his role in the january 6th attack. >> will you appeal right now, message to all of trump supporters, to respect the results -- >> are you going to -- is this your question? have you asked -- have you asked a democrat this question? yes or no? the answer is no. have you asked a democrat that question? >> i haven't seen democrats storm the capitol. >> rachel: and maryalice joins us live from washington. the supreme court rejected steve bannon's appeal to delay his prisonp sentence and all eyes back on the high court with the justices expected to issue that major decision on donald trump's presidential immunity case. >> the supreme court is also set to decide on trump's claim he should have absolute immunity from criminal prosecution for all of his actions while he was president. this is one of the most major, mow consequential cases of this term. it's going to have huge implications not only for trump, but also for the future of the office of the presidency. rachel. >> rachel: most consequential ruling coming at the end of the term. thank you. now fierce battles in northern gaza, cease-fire talks stall once again, and new fears of a wider conflict in the middle east. israeli officials considering whether they can reach an agreement with hezbollah. matt gutman is following the developments from tel aviv. >> reporter: tonight, with an israeli raid into a hamas stronghold in northern gaza entering it's fourth day, troops in close quarters combat, going room to room. about 60,000 palestinians near gaza city forced to flee. roads gridlocked with trucks and donkey carts piled high with household goods. so many suffering serial displacement. muhammad among them, saying this is the fourth time we have been displaced. they tell us it's safe but it turns out it isn't." israel had first cleared the area six months ago but hamas has regrouped and stiffened it's resistance. famine, headed off by a blitz of aid this spring, but again gaza now on the brink. hospitals saying they are just 36 hours from shutting down due to a lack of fuel. that floating u.s. built pier, dismantled for the fourth time due to rough seas, and now the pentagon says it might not be reinstalled until the u.n. distributes the nearly 19 million pounds of backlogged aid on the beach. the u.n. was supposed to distribute it, but halted distributions citing lawlessness in gaza. and with ceasefire talks stalling between israel and hamas, protests erupting in jerusalem and tel aviv where tens of thousands clogged the city center demanding a deal for the return of 120 hostages, in gaza, living and dead. they've been lighting fires here in tel aviv and in jerusalem to give you a sense of the desperation and the urgency of these protestors. these people have been marching for three hours now demanding a hostage deal. but a senior hamas official saying this weekend there has been no progress made on ceasefire talks. and as tensions intensify with israel and hezbollah. israel's defense minister sharing this image with troops on the northern border saying, we're approaching a decision making point on whether they can reach an agreement or opt for a military offensive against hezbollah. israeli officials telling me today both hezbollah and israel have agreed to broad parameters of a u.s. brokered deal that would stave off a war but hezbollah has made it clear it cannot sign that deal until there's that ceasefire in gaza, but that could be months away so those officials are saying at this point a potentially devastating wider regional war is more likely than not. rachel. >> rachel: matt gutman reporting from israel, thank you. tonight, u.s. defense officials confirm that several american military bases across europe are operating under a heightened state of alert. the level was raised this weekend to the second highest state of alert. according to the army, it happens when intelligence indicates some form of terrorist action is likely. the newspaper stars and stripes reports the directive includes large bases in germany and aveeno air base in italy. >> early results in the first round of france's legislative election show the far right national party with a strong lead. final results are expected after next week's second round of voting. president emmanuel macron called the vote after his party suffered a crippling defeat in recent european elections to the far right nationalists led by marine le pen. the vote could impact european financial markets and also western support for
