>> we'll have conditions on that. >> reporter: he's staunchly anti-abortion rights and has supported the day a nationwide abortion ban. he is not in favor of protections for same-sex marriage. he voted against reauthorizing the violence against women's act, and against the bipartisan infrastructure bill. and he voted against the bipartisan chips act aimed at boosting production of semiconductors here in america. in the early morning hours, after the attack on the capitol on january 6th, johnson still voting against certifying biden's victory. that earned him respect from former president donald trump who, today, outside of court, took credit for johnson's win. >> this time yesterday nobody was thinking of mike, and then we put out the word and now he's the speaker of house. >> reporter: overnight, when he secured the nomination i tried to ask if he stood by his position, his vote not to certify the election. mr. johnson, do you sport efforts to overturn the 2020 election, do you stand by that vote? johnson's fellow republicans booing and shouting. it remains a legitimate question for any new speaker. after more than 60 judges, many of them appointed by trump reviewed challenges to the election, but repeatedly declared there was no widespread fraud that would have changed the outcome. so i asked him again today about election integrity and whether he would acknowledge that trump loss. do you acknowledge that trump lost the election? >> i think we'll be unified today. >> reporter: he didn't answer the question. today democrats saying it's clear why johnson succeeded where others have failed. >> this has been about one thing -- this has been about who can appease donald trump. >> reporter: david, one of the first orders of business for the house to consider is the president's request for additional funding to both israel and ukraine. a growing number of republicans say they only want funding for israel and not ukraine. tonight, speaker johnson not committing to putting that package on the floor for a vote. david. >> david: rachel, thank you. the other major news tonight involves israel's war with hamas. tonight we've learned that israel holding off its ground invasion of gaza for now. amid pressure from the u.s. what we're learning about the delay and what this could mean for the hostages still being held by hamas. in the meantime, israel's air assault pounding gaza, the healthcare system collapsing. our team inside gaza tonight, where a third of all gaza hospitals are closed. just eight trucks of aid getting through the border from egypt. before the war at least 400 trucks would travel through a day with aid. what about the hundreds of american citizens still inside gaza? abc's matt gutman tonight from tel aviv. >> reporter: tonight, israel, amid significant pressure from the u.s., deciding to hold off on that ground invasion for now, urgently pushing to free more hostages as israel's aerial bombardment rocked gaza for the 19th consecutive day. gaza's healthcare system collapsing. 12 of the 35 hospitals no longer functioning. officials claiming more facilities are only hours away from running out of fuel for generators. medicine also in short supply. reports of surgeries being performed with no anesthesia. doctors like mohammed ghandil unable to keep up with the crush of patients. >> the hospital door is open, but the health care is not provided. if the fuel is zero, simply the doctors and the nurses will go home and the hospital will turn to a big morgue. >> reporter: and the wounded keep coming. our team on the ground in gaza, filming medics rushing the injured, including babies, to the emergency room. al jazeera's gaza bureau chief wael al dahdouh here sobbing over the bodies of his wife, daughter and son, all killed in a strike in central gaza where israel has told civilians to flee. today, for the fourth day in a row, a convoy of aid making it into gaza. but just eight trucks. before the war, more than 400 trucks arrived daily. is israel still prohibiting fuel from coming in? and how long will that last? >> hamas has over a million liters of fuel in their stockpiles in gaza. they're actually not far away from rafah, their tanks full fuel, all they need to do is give it to the hospitals. >> reporter: the hamas-run health ministry claiming 1,400 palestinians were killed in the past 48 hours alone. the deadliest days of this war for the palestinians. president biden has repeatedly talked about the civilian toll, but today he questioned the hamas' numbers and reiterated america's support of israel. >> israel has the right and i would add responsibility to respond to the slaughter of their people. and we will ensure israel has what it needs to defend itself against these terrorists. that's a guarantee. >> reporter: and tonight, over 220 hostages, including americans, still in the hands of hamas. biden today, saying he did not demand a delay in israel's ground invasion, but signaled it was heavily encouraged to slow it down to save the lives of those hostages, adding their safety should be a priority. >> what i have indicated to him, is that if that's possible to get these folks out safely, that's what he should do. it's their decision, but i did not demand it. >> reporter: and tonight, as the situation worsens inside gaza, it's not just the concern for the hostages, or the innocent civilians caught in the middle, there are still up to 600 american citizens trapped in gaza. >> david: that's another key part of this story. we can't forget about the hundreds of american citizens still inside gaza waiting to get out. matt, there was another alarming image that made news around the world. the leaders of multiple militant terrorist groups meeting in lebanon? >> reporter: this is the image that sparked that concern regionally, the leaders of the iran-backed proxy hezbollah, hamas, palestinian islamic jihad, meeting in lebanon, a portrait of the ayatollah hanging in the room. after recent attacks on u.s. bases, president biden now warning the ayatollah not to target u.s. troops saying that the u.s. will respond. >> david: matt gutman in tel aviv. here in new york city, the dramatic scene involving former president trump in a new york courtroom. the former president was suddenly called to the witness stand by the judge who questioned trump and then admonished him. fining him $10,000. 45 minutes later, he suddenly left the courtroom not long after that judge's warning. aaron katersky outside the courthouse tonight. >> reporter: donald trump has spent this trial sitting alongside his lawyers, his arms folded, a stern look on his face, but today the judge abruptly summoned the former president to the witness stand. where he was sworn in and slapped with a fine and a warning, all because of the judge had heard about what trump had said in the hallway just minutes earlier. >> this judge is a very partisan judge with a person who's very partisan sitting alongside of him. >> reporter: the judge wanted to know who sits alongside him the person who trump attacked as very partisan was his haw allergic, trump had targeted the clerk before, and had been warned not to do it again. in fact the judge previously imposed a limited gag order preventing trump from disparaging court personnel. trump insisted he wasn't referring to the clerk but to the state's star witness, his former fixer michael cohen who had been testifying. the judge didn't believe him. i find the witness is not credible, the judge said, i find the witness was referring to my law clerk. it's the second time that trump violated the gag order, the judge fined trump $10,000 and warned, don't do it again, or it'll be worse. the trial resumed with cohen back on the stand. he testifying that trump directed him to fiddle with his financial statements. to inflate trump's net worth to whatever number mr. trump told us to. under cross-examination trump's lawyers pressing cohen about why he told congress in 2019 he couldn't recall trump directly ask him to artificially inflate his assets. trump calling the moment a win. >> he was caught lying. like nobody's ever lied. it was better than a perry mason moment. and that should be the end of the case. >> reporter: the two men hadn't seen each other in five years, in court they sat feet apart. cohen telling us he looked trump right in the eye. when you looked him in the eye, michael, what did you see? >> i saw a defeated man, i saw somebody who knows that it's the end of the trump organization. >> david: it was quite a day there. aaron, you were in the courtroom, that unexpected move the judge calling the former president to the witness stand. less than an hour later, trump suddenly getting up and leaving the courtroom in the middle of the proceedings, you saw this all? >> reporter: he stormed right out, david, it came after his lawyers had asked the judge to throw out the whole case. because michael cohen had given some contradictory testimony. the judge refused saying there's plenty of other evidence to keep the case alive. but trump marched right out. catching everyone in the courtroom, including his secret service detail, by surprise. the judge had issued that fine to trump and warned him about his rhetoric. the judge saying, david, doesn't want to see anybody get killed here. >> aaron, thank you. >> david: we turn now to hurricane otis and to what meteorologists were warning was the nightmare scenario. growing from a category 1 hurricane to a cat 5 hurricane in just hours, and then making a direct hit on tourist resorts in acapulco. the storm rapidly intensifying in those final hours before landfall. with 165-mile-an-hour winds slamming ashore in the middle of the night, guests huddling in hotel ballrooms. rooms drenched and ripped apart. at this hour, otis is now dissipating. we're tracking the system. here in the u.s., two systems. one bringing flood alerts and the other bringing snow across multiple states. senior meteorologist rob marciano is tracking it all for us tonight. hey, rob. >> reporter: i'm worried about the images and reports that will come out of mexico tomorrow. this storm absolutely exploding that close to shore. that sort of rapid intensification is what hurricane forecasters fear the most. they didn't have any help from the models, look at this chart. all lines at the bottom, none of those forecast models expected to get to cat 1 strength. they went to cat 5 strength. climate change likely playing a role. some of that moisture is getting up into dallas, already seeing rainfall there. kansas, wettest day in over a year. winter storm warnings across the northern tier. maps in motion, show another pulse of that tropical moisture getting into dallas, texas, tomorrow, up into the midwest and the great lakes by tomorrow night. heavy snow in helena, montana. could bring a foot to bismarck as we head to tend of october. still obviously in hurricane season. >> tracking multiple headlines for us. rob, thanks. we turn now to the urgent man hunt near worchester, massachusetts. an air force veteran wanted in the deadly shooting of his wife with their four children at home. tonight police have returned to the woods where his car was found. here's abc's erielle reshef. >> reporter: tonight, the intense manhunt for aaron pennington, now wanted for the murder of his wife in massachusetts, considered armed and dangerous. >> we're still treating this like he is alive and would be somewhere in the woods. >> reporter: the air force veteran on the run since sunday morning after the couple's four children reportedly went to a neighbor's home scared because they could not find their father and their mother was in her bedroom crying. first responders discovering 30-year-old breanne with a gunshot wound to the face, pronouncing her dead. police say three shell casings were found in the living room but no sign of a weapon. pennington's white bmw found in a wooded area monday night, just minutes from his home. an arrest warrant stating investigators found a note on pennington's cell phone. dated the night before the murder, reading, be quiet if she wakes up, just say you're getting nasal spray. get on side of bed. very close proximity to head. residents initially urged to shelter in place as a precaution. police out in force. that order now lifted, but authorities still warning the public to be vigilant. court records show that aaron pennington suffered from mental health issues and had threatened suicide. >> david: when we come back here, two planes colliding on the runway. and tonight the fda now looking into a drink at panera after a family says their daughter died. in a moment. h the ucard - one simple member card that opens doors where it matters for you. what if we need to see a doctor away from home?
