the cdc what they said about if you had covid, your level of protection now. that major system moving across the country tonight. snow, ice and severe storms from texas all the way east. whiteout conditions, wind chills plunging to 40 below zero in some places. rob marciano timing it out. breaking news coming in right now. a major blow from the supreme court for former president trump when it comes to white house records in the january 6th investigation. jon karl on what his means tonight. the major new headline coming in in the murder of that ucla grad student stabbed and killed, working alone at a furniture store. what we've learned. images coming in. the deadly military accident near camp lejeune. at least two marines killed. and we remember tonight an icon in the world of fashion who broke barriers. in his own words tonight, why it was he succeeded. good evening and it's great to have you with us here on a very busy wednesday night. we have breaking news involving former president trump, what the supreme court has now decided. also news coming in on covid. young children and vaccines. but we're going to begin tonight with president biden making news just before we came on the air tonight, speaking to the american people, taking quest questions for more than an hour and a half on the pandemic, on inflation, on voting rights, and what he now promises to do in his second year. this made immediate news and we'll get to it in a moment. above all, though, tackling covid, acknowledging the nation's frustration and fatigue. but pointing out that 2 million fully vaccinated americans when he took office, now 210 million americans fully vaccinated today. on the economy, the president pointing to 6 million jobs created, pointing to unemployment now at 3.9%. but also addressing inflation, saying americans are feeling this at the grocery store and at the gas station. he pointed to the global supply chain issues and he says they've made progress already on this. he also pointed to his build back better bill, with universal pre-k and child care, expanded health care, that he says will help ease is burden on the middle class. and for the first time, he acknowledged in his second year now coming of his presidency, that he's now willing to break that bill into pieces, into large chunks, if you will, to get significant parts of it passed. our senior white house correspondent mary bruce making news on that front by pressing the president, do you need to be more realistic on your agenda? mary leads us off. >> reporter: on the first anniversary of his inauguration, president biden defending his accomplishments, even as major parts of his agenda stall. >> can you think of any other presidents done as much in one year? name one for me. >> reporter: still the president acknowledges covid, inflation, and gridlock in washington have left americans frustrated. >> did you over promise to the american public? >> i didn't over promise. and, what i have probably outperformed what anybody thought would happen. the fact of the matter is that we're in a situation where we have made enormous progress, i did not anticipate that there'd be such a stalwart effort to make sure that the most important thing was that president biden didn't get anything done. think about this -- what are republicans for? what are they for? name me one thing they're for. >> reporter: i asked the president how he plans to jumpstart his agenda. your top two legislative priorities, your social spending package and voting rights legislation are stalled, blocked by your own party. do you need to be more realistic and scale down these priorities in order to get something passed? >> no, i don't think so. i'm not asking for castles in the sky. i'm asking for practical things the american people have been asking for for a long time. a long time. and i think we can get it done. >> reporter: you're not going to scale down any of these priorities, but so far, that strategy isn't working. you haven't been able to get some of these big ledgislative - >> oh, i got two big wins done. bigger than any president has ever gotten in the first year. >> reporter: but currently, mr. president, you're spending package, voting rights legislation, they're not going anywhere. so -- >> that's true. >> reporter: is there anything that you are confident you can get signed into law before the midterm elections? >> yes. i'm confident we can get pieces -- big chunks of the build back better law signed into law. >> reporter: he later clarified. >> it's clear to me that we're going to have to probably break it up. i think it's clear that we would be able to get support for the $500 plus billion for energy and the environmental issues that were there. i think we can break the package up, get as much as we can now, and come back and fight for the rest later. >> reporter: the president also predicted that vladimir putin would invade ukraine. reporters pressing him on how he would respond. >> russia will be held accountable, if it invades, and it depends on what it does. it's one thing if it's a minor incursion, and then we end up having a fight about what to do and not do, et cetera. but if they actually do what they're capable of doing with the force of mass on the border, it is going to be a disaster for russia. >> reporter: that answer raising eyebrows. >> are you saying that a minor incursion by russia into ukrainian territory would not lead to the sanctions that you have threatened or are you effectively giving putin permission to make a small incursion into the country? >> i think we will if there's something that is where there's russian forces crossing the border, killing ukrainian fighters, et cetera, i think that changes everything. but it depends on what he does. >> the president there at the white house late today. mary bruce live at the white house for us tonight. and mary, president biden defending his first year in office, saying there was a lot on his plate, but pointing out he's not complaining about that, but that that was the reality. he also promised in year two that he would get out there into the country to get his message out. >> reporter: yeah, david. the president conceding they have faced some communication challenges here and so he says, going forward, he'll be spending less time here in washington, more time out in the country, speaking directly to voters. and he says when it comes to the midterms, he is going to be deeply involved, highlighting what he says are democrats accomplishments and republicans failures. and looking ahead, as he told you in your interview, the president said, yes, he is running in 2024, and yes, kamala harris will be his running mate. >> and mary bruce making news today with her questioning of the president. mary, thank you. all of this playing out with the voting rights showdown at this hour. the president again saying today, history will record how senators vote on this. and he said, if this goes down to defeat, he will put the issue to america voters, asking, are these the lawmakers you want to support, who he believes are unwilling to protect voters rights and election integrity. so, once again, we go to rachel scott live on the hill tonight. where does it stand tonight, rachel? >> reporter: well, david, voting rights legislation is expected to fail tonight for the fifth time. this will be a major blow to president biden's agenda. and it will be blocked by senator joe manchin and senator kyrsten sinema. they support this legislation, but they are opposed to changing the senate rules in order to get it passed. president biden saying tonight that he is not giving up, eyeing possible executive action on this, insisting parts of the sweeping, massive voting rights legislation could be broken up into parts. but he will need to get republicans onboard in order to get thats paed, david. >> rachel scott, thank you. and president biden also making news on russia, on vladimir putin, with thousands of troops, of course, amassing on the ukraine border. let's get to our senior foreign correspondent ian pannell in ukraine tonight. you were watching right along with us. and the president saying he believes vladimir putin will act, will make a move there in ukraine, but then dialing back when he was continued to be pressed on this issue, saying he doesn't believe putin has made up his mind and global headlines tonight about whether or not the president left any kind of window there depending on the kind of incursion we might see. >> reporter: yeah, i think there were many gasps of breath here in kiev and across european capitals when the president said that he thought that perhaps russia would cross that border. in other words, that russia would invade. he left it open as to whether it would be a my jor or minor incursion, but he nodded to significant differences between nato european allies as to how t respond. there are clear diplomatic difficulties. a president doubling down, saying, yes, vladimir putin hasn't made up his mind, also saying that there would be strong punitive sanctions imposed on the kremlin if, indeed, that is what they chose to do. worth adding that the kremlin has repeatedly denied that it plans to cross over the border. buff it puts everyone in a difficult position ahead of these tough negotiations, when the pressure is really on. secretary of state blinken is in town. he's been meeting ukrainian officials. that's going to be a difficult moment for him when he goes onto europe, but crucially, he boes to geneva on friday to meet with russian foreign minister lavrov. that will put something of extra pressure on trying to reach some kind of accommodation with the russians. david? >> and we should note that the president said, if putin makes a move, he will face sanction shuns the likes of which he has not seen before. we're tracking it all. thank you, ian, to our team there in ukraine tonight. back here at home, meanwhile, and to the pandemic now. and we have new details tonight about that plan to hand out 400 million free n95 masks in this country. from the nation's strategic supply. they'll be available at community health centers and pharmacies as soon as next week in this country. also tonight, how to get those free at-home test kits. tens of millions of families already ordering theirs. also tonight, what dr. fauci said about children under 5 and vaccines, and there's news from the cdc tonight what they're saying now if you've had covid and your level of protection now. here's abc's kayna whitworth. > reporter: tonight, the biden administration gearing up to roll out 400 million n95 masks for americans to pick up free of charge at pharmacies and community centers as early as the end of next week. each person will be able to get up to three n95s, which the cdc says provides the highest level of protection. >> the most important thing for anyone is to wear the highest quality mask that fits well and that you can tolerate. >> reporter: and dr. fauci says the government will order and send out special n95 masks for kids, as well. just a day after the launch of covidtests.gov, about 27 million americans visiting that online order form for four free at-home covid tests per household. but for weeks, those rapid tests have been in short supply. >> i saw the sign in there. it says no covid tests or they're all out. >> reporter: and pcr testing labs are racing to keep up with the omicron surge, as well. california reporting a million covid cases in the past week. we got a look inside the state's largest fully automated lab, processing up to 120,000 tests a day. >> test results that show up two, three, four days later don't have the relevance of a test result that you get in less than 24 hours. >> reporter: the country's second-largest school district in los angeles relying on that fast turnaround to stay open. twice a day samples are loaded onto a private plane and flown hereto palo alto for processing. and tonight, an update for parents waiting for a vaccine to be authorized for their children under 5. dr. fauci saying 2 to 4-year-olds may need a third vaccine for full protection. >> in a very disappointing way, the dose that was used for children 24 months to 4 years did not induce a response that was felt to be adequate. >> a lot of parents waiting for news on children under 5, so we'll continue to track that for everybody at home. kayna with us now from inside that lab. and kayna, i know the cdc out tonight with this new study confirming what many have long hoped, that if you've been infected with the virus, that it does, at the very least, help protect you in the future from infection. >> reporter: right, david. so, the study was done during the delta variant and they found that being both vaccinated and previously infected offered you the best protection against that variant. but the cdc also found that infection alone offers significant protection, but they don't know how long that lasts, so with that uncertain future, testing labs like this say they can adapt and they can ramp up if need be. david? >> all right, kayna whitworth with us from california tonight, thank you. we continue to follow that major system moving across the country tonight. wind chills plunging to 40 below zero in some places. snow, ice and severe storms really from texas all the way up into the east. accidents piling up. this is from fargo, north dakota, tonight. all of this, as i mentioned, moving east. and then, a new ice storm threatening the south for the end of the week. bottom line, there's a lot going on in the weather department. rob marciano, of course, tracking it all for us. hey, rob. >> reporter: hi, david. couple of storms coming down the pipe. the first one is not too crazy, but it comes at a really bad time. we have winter storm watches that are posted for the carolinas. that's for the second system. and severe thunderstorm watches up for parts of louisiana and winter weather advisories for baton rouge with this system. that's going to push off to the east tonight and it will turn rain across parts of the i-95 corridor to snow around 7:00 a.m. 1 to 3 inches, mostly slushy, but certainly slick. and then behind this comes that cold air, 20 to 30 degriefs below average. next system rides the southern part of the jet scream. that comes into the carolinas. snow and ice for the low country and the coastal plains there. the governor of south carolina now declaring a state of emergency. could be bad. david? >> yeah, take it very easy on those icy conditions. rob, thank you. there is breaking news tonight as we're on the air, a major new development in the investigation into the january 6th attack at the capitol. just moments ago, the supreme court now denying former president trump's attempt to block the house committee from reviewing white house documents. so, let's get right to chief washington correspondent jonathan karling, and jon, of course, this would appear to be a big blow to the former president. >> reporter: a big blow to the former president and a major victory to the january 6th committee, giving them access to documents, white house documents that would normally be under seal for years, in some cases decades. documents that donald trump fought mightily to keep secret. the committee will now have access to white house visitor logs, phone logs, communications between top aides. they have also asked for video and photo records, presumably tey will get those, as well. so, this really could give the committee new insight, significantly new insight into the actions of donald trump and his inner circle in and around january 6th. and david, another key point here, this is a major defeat for donald trump. the court, 8-1, including all three justices that he put on the supreme court, rejecting his request. >> jonathan karl with the breaking headline from washington tonight. thank you, jon. next tonight here, news of an arrest in the brutal act of random violence in los angeles. a ucla grad student stabbed to death while working alone in a fish sure store. the suspect then seen leaving by a book door on surveillance. tonight, he's now in custody and what we've now learned. here's abc's kaylee hartung. >> reporter: tonight, the suspect now in custody for the gruesome murder of ucla graduate student brianna kupfer. one of three random killings, just 72 hours apart, raising urgent concerns about the homeless crisis in america. cupper if's accused killer, shawn laval smith, who was out on bail, has a lengthy arrest record in california and the carolinas, including vandalism, trespassing, and weaponing charges. he allegedly stabbed the 24-year-old in the middle of the day at the furniture store where she was working alone, smith seen in this surveillance video just minutes after the murder. kupfer's heartbroken father in shock. >> you don't want to hear it. you want to not believe it. >> reporter: that same day, los angeles police say another homeless man, kerry bell, struck 70-year-old nurse sandra shells in the face at a bus stop. her skull fracturing as she hit the ground. >> it's sad. it's sad to hear. getting ready to retire and this is what happens. >> reporter: police found bell, who's been arrested previously in several states, sleeping a short distance from the scene of the attack. and two days later, as a speeding new york city subway car approached the platform, police say simon martial, who has a history of mental illness and criminal behavior, pushed financial manager michele go to her death. the city's new mayor under fire for rising crime in the subway, after initially suggesting the safety concerns were merely a perception. attending a massive vigil for go in times square, and now admitting he himself does not feel safe underground. >> on day one, i took the subway system. i felt unsafe. i saw homeless everywhere. >> reporter: david, as this memorial to brianna has continued to grow, police say they found the suspect just about 15 miles from here at a bus stop. and according to the lapd, over the past year, about 10% of homicides in this city have had a homeless suspect. david?
