We are just hours away now from a final vote on whether judge Brett Kavanaugh will become Supreme Court justice Brett Kavanaugh. It has been a brutal fight with allegations of sexual misconduct, but it appears kavanaugh has the votes although it may be the most narrow and polarized confirmation vote for a Supreme Court nominee in u. S. History. It, of course, will be a huge victory for President Trump and also for conservatives generally and with his lifetime appointment, Brett Kavanaugh is likely to push the court to the right for many years to come. So many questions this morning. Will kavanaugh take his seat on the court with a cloud over his head . Will his confirmation fire up female voters in the midterms . Well get reaction from a white house spokesman in a moment, but we start here with abc senior Congressional Correspondent mary bruce on capitol hill. Good morning, mary. Reporter good morning. The senate is now poised to confirm judge kavanaugh. This has been a nasty, ugly political fight that ultimately came down to just a handful of key swing votes. And for those senators, this decision was agonizing. This morning judge Brett Kavanaugh has the votes to be confirmed to the Supreme Court. I will vote to confirm judge kavanaugh. Republican senator susan collins, a crucial swing vote, announcing her support during a 45minute speech. The presumption of innocence and fairness do bear on my thinking, and i cannot abandon them. Reporter while protesters packed the senators office, collins argued there was not enough evidence to back up professor Christine Blasey fords allegations against kavanaugh of sexual misconduct. I do not believe that these charges can fairly prevent judge kavanaugh from serving on the court. Reporter but her fellow republican senator Lisa Murkowski of alaska came to a different conclusion. In my conscience, i could not conclude that he is the right person for the court at this time. Reporter she says there are lessons to be learned about Sexual Assault. We owe it to the victims of Sexual Assault to do more and to do better and to do it now. Reporter murkowskis no could have led to a 5050 split if the democrats united in opposition, but one lone democrat, West Virginia senator joe manchin crossed party lines announcing he is a yes. Mr. Manchin, aye. Reporter the red state democrat whos facing a tough reelection battle in a state that trump won in a landslide tried to explain his decision. Do you believe dr. Ford . I believe dr. Ford. [ crowd yelling ] i dont believe that the facts was it was. Rorter h reporter for the key swing votes, the political pressure was tremendous. Republican senator jeff flake who demanded the fbi investigate the allegations against kavanaugh says the decision was agonizing. This is a difficult decision for everybody. It really is. Reporter with kavanaugh set to serve on the court, Christine Blasey fords legal team telling us she still feels like she did the right thing. This has been a pretty brutal, ugly fight. Does she have any regrets about coming forward . I think she feels good about the fact that she came forward and did what she felt strongly was her civic duty to do. Reporter overnight her sisterinlaw speaking out concerned about the toll of this final decision. But i think that chrissy is probably feeling retraumatized by not being taken more seriously, and i know many other survivors are being retraumatized, and i think that more than ever we just have to keep speaking out. Reporter now, even though senator Lisa Murkowski is opposed, the only republican no vote here this afternoon shes expected to technically vote present, not no. Thats so her fellow republican colleague senator steve daines doesnt have to rush back to washington. He has an important obligation. He needs to walk his daughter down the aisle today. Guys, a little bit of political civility here to end this brutal fight. Definitely cant miss that. Mary, though, obviously plenty of reaction to all of this and already some speculation about who may run against senators collins and murkowski. Yeah, the fallout was swift here. On twitter we saw obamas former Communications Director asking who wants to run for senate in maine . There will be an army of supporters with you, and we saw ambassador susan rice quickly tweeting, me. And then sarah palin also chiming in with her message to a fellow alaskan saying, hey, Lisa Murkowski, i can see 2022 from my house. Well see how it all plays out. Mary bruce, thanks so much. We appreciate it. As we said, assuming kavanaugh is confirmed, it is a major victory for the president getting a second justice on the Supreme Court. Abcs White House Correspondent tara palmeri has more from the white house with how the president is responding to the swing votes swinging in his direction. Hours before the likely confirmation of judge Brett Kavanaugh to the high court, President Trump taking a victory lap with just a tweet saying, very proud of the u. S. Senate for voting yes to advance the nomination of judge Brett Kavanaugh. The president s pick potentially shifting the balance of the Supreme Court cementing a solid 54 conservative majority with the lifetime appointment. Tonight it is my honor and privilege to announce that i will nominate judge Brett Kavanaugh to the United States Supreme Court. Reporter if kavanaugh is confirmed to the swing seat vacated by the moderate Justice Anthony kennedy earlier this year, it would be the second justice President Trump has put on the Supreme Court after appointing justice neil gorsuch. Were going to appoint great justices to the United States Supreme Court who will uphold and defend the constitution of the United States. Reporter previously calling dr. Christine blasey ford who accused kavanaugh of Sexual Assault a credible witness. But certainly she was a very credible witness. Reporter then at a Campaign Rally in mississippi, the president seemingly mocking ford just days after her testimony on capitol hill. What neighborhood was it in . I dont know. Where is the house . I dont know. Upstairs, downstairs, where was it . I dont know. But i had one beer. Thats the only thing i remember. Reporter those comments garnering swift backlash from key lawmakers. To discuss something this sensitive at a political rally is just its just not right. I wish he hadnt have done it. Reporter but that backlash apparently not enough to sink the nomination. White house sources tell me the president took a handsoff approach to lobbying those key swing senators, flake, murkowski and collins, mainly due to the fact that he has a frayed relationship with those moderate republicans. Dan, thanks so much for having me on. The Washington Post is out with an article this morning quoting white house officials as saying the president s decision to go after Christine Blasey ford in that rally may have, quote, proved a key turning point toward victory for this polarizing nominee. So in hindsight do you think mocking dr. Ford while controversial was, in fact, the right move here . Well, i would say that the president wasnt mocking dr. Ford as much as stating facts. While he found the testimony sincere and heartfelt and sympathetic, nonetheless there were serious questions to be raised that he did, and they were consistent with the words of the special prosecutor in her memo, which is that dr. Ford and kavanaughs testimony for this charge didnt even meet the preponderance of evidence standard which is was it more likely than not and this is what senator collins also seized on, that she could be heartfelt but there were no corroborating witnesses, there was no Additional Information to back up her account. All the additional evidence seemed to support judge kavanaugh. Raj, i just want to challenge you a little bit about this question about the president not mocking dr. Ford. If we can, lets cue up the video of him speaking at the rally and lio it ret is. Where is the house . I dont know. Upstairs, downstairs, where was it . I dont know, but i had one beer. Thats the only thing i remember. That really does not sound to you like mocking . I know hes stating facts, but if you listen to his tone, it certainly sounds like hes making fun of a woman who came forward and disclosed some very personal and painful details of her private life. Well, dan, if you look at what he said and what prosecutor mitchells memo said, theyre pretty consistent, which is that there are serious factual im not sure youre addressing the question of his tone. Im not sure youre addressing the question of his tone, though, raj. You can disagree with his tone, but can you disagree with the substance, and i think that the key here is that what he was pointing to are facts. He was stating facts. These are the same facts that the prosecutor stated. These are some of the facts that senator collins relied on when she talked about why she was voting for judge kavanaugh. Let me ask you about something that happened last night. A sitting Supreme Court justice, elena kagan said justices that people on the court, justices on the court, need to remain, quote, above the fray. Given judge kavanaughs comments during that now infamous hearing about the attacks on him being fueled by and these are his words revenge on behalf of the clintons, do you think hes going to take his seat on the court with some sort of partisan cloud over his head, and just, for example, do you think he can be trusted to fairly adjudicate cases where one side may be coming from the left . Well, if youve seen his record as a judge for over 12 years and with over 300 opinions, he has acted like an impartial, fairminded judge throughout his career. I dont think one can hold against judge kavanaugh for being emotional in his testimony last week given what hes had to deal with, what he and his family have had to deal with, but if you look at his actual record over 12 years and he talked about this in this recent oped with the wall street journal in which he is committed to being a fair, impartial and evenhanded justice on the Supreme Court. Worth noting though a member of your own party, alaska senator murkowski, said she was going to vote no here because precisely because of his tone. But let me ask you one last final question. This has been such a bitter and divisive fight. Do you think its on the president to help unite the country now . Is he willing and capable of doing so . Sure, and i think the process has been ugly. It has been difficult, and it doesnt bode well for future Supreme Court nominees and fights, but i think we all can learn a lot more from this process. I think the president is going to talk, though, about what this pick means to the court, to his legacy, to what hes doing to try to make american jurisprudence a better better for the country. Turning now to another top story, a Chicago Police officer convicted of murder in the shooting of a teenager, officer Jason Van Dyke now facing years behind bars. The anticipation for this verdict starting with the release of that Police Dash Cam video three years ago, the jury working quickly reachingn n hosh rehicagon celebration following the verdict and the racially charged case surrounding Chicago Police officer Jason Van Dyke. The jury taking less than ten hours to reach their decision. We, the jury, find the defendant, Jason Van Dyke, guilty. Reporter van dyke showing little emotion as jurors found him guilty of Second Degree murder and 16 counts of aggravated battery, one for each shot in the 2014 killing of 17yearold Laquan Mcdonald. He going to jail. [ cheers ] reporter just outside the courtroom, jubilation as the verdict was handed down. Mcdonalds family saying justice was served. Laquan mcdonald represents all of the victims that suffered what he suffered across the country. Reporter months long e w dh cam viwas shooting the blackdown a chicago street carrying a threeinch knife. On the witness stand van dyke who was responding to a call of someone breaking into cars testified he believed mcdonald was lunging at him and refused commands to drop the knife. I was yelling at him, drop the knife. I yelled it i dont know how many times. Reporter but in the video mcdonald, who was high on pcp, appears to be walking away from van dyke when he is shot. Theres no justification for shooting Laquan Mcdonald that night. Not one shot, not the first shot, not the 16th shot. Reporter but Defense Attorneys arguing the video was, quote, essentially meaningless because it didnt capture the incident from van dykes point of view. But the jury confident in their ruling. He should have realized what the situation was and instead of escalating the situation should have at least looked at other options. We didnt come here because of race or we came here for right and wrong. Reporter van dyke could possibly face decades behind bars. Those protests remained peaceful. Eva. All right. Thank you, alex. Boyd williams taking off in his single engine navion from meridian Regional Airport in mississippi on friday. Just before 3 00 p. M. , the planes engine starts to fail. I called to turn around and tell them it was running rough and seconds later it stopped completely. Reporter boyd pulling off an Emergency Landing on highway 45 right in the middle of the afternoon commute. His plane sustaining significant damage. Trying to get into the main roadway but i think he had some difficulty, and he had to get on the shoulder and he tore his landing gear out from under the plane. Reporter boyds daughter who works at meridian aviation frantic after hearing about a pilot in distressment. I heard the tower radio saying one of our local navions and i knew my dad took off. I just said bye to him moments before. I felt sick to my stomach but just was praying he was okay. Reporter those prayers answered. Boyd escaping unarmed. A single engine airplane, youve only got one source of power, and if it does go out, you can restart the engine. So when you look at an airplane that landed on a freeway, they did that because this was a lifeordeath matter. Reporter the pilot and his family now grateful for a miracle on a mississippi highway. Im just happy to be here. Im thankful to be in one piece. Thankful nobody on the road was hurt. Thankful that both of my children came here and were sharing another day together. Reporter and he is really lucky there. Thankfully as you heard there no one on the ground was hurt. The faa is now investigating what caused the plane to go down but as for boyd, he tells us he has no plans to stop flying any time soon. Wow. So, hes going back up. The maker of a popular beverage is denying claims it uses potentially dangerous chemicals. Lacroix sparkling water fightin contains a number artificl ingredients including one that sounds particularly unappetizing. Its a widely popular bubbly beverage. Lacroix is a sparkling water known for its all natural fruity essence. The company advertises no calories, no sugar, no sodium, a drink that contains only Natural Flavors. But now the drinks parent company, National Beverage corporation, is facing a Class Action Lawsuit alleging lacroix water is manufactured using nonnatural flavorings and synthetic compounds. Some of these products are not regulated by the food and drug administration, and theres some ambiguity about how you can use the label either natural or organic. Reporter the lawsuit states that the Company Continues to mislead by using an all natural label on its drinks claiming that some of the allegedly added chemical ingredients cause kidney toxicity and tumors and are used as a cockroach insecticide. But experts say consumers shouldnt jump to conclusions about the bubbly beverage. Consumers should not be alarmed by this lawsuit. The compounds under discussion occur naturally in citrus beverages like orange juice, lime juice. Reporter the National Beverage corporation categorically denies all allegations in a statement saying, the lawsuit provides no support for its false statements about lacroixs ingredients adding that Natural Flavors in lacroix are derived from the natural essence oils from the named fruit used in each of the flavors.
