the russia investigation, despite warnings from the justice department itself. the house intelligence committee voted a long party lines to make public a classified memo that was written by republican alleging improper use of surveillance by the fbi and justice department as they look into collusion between russia and the trump administration and campaign. the committee blocked the public release of a democratic memo that refutes republican allegations opting to make the document available only to house members. democrats say republicans are politicizing the intelligence process. >> today this committee voted to put the president's personal interest, perhaps their own political interest, above the national interest. in denying themselves even ability to hear from the department and the fbi and that is i think a deeply regrettable state of affairs. it shows in my view when you have a deeply flawed person in the oval office that flaw can infect the whole of government. >> justice officials say the release of the republican memo would be extraordinarily reckless. president trump has the final say. and the white house has made it clear that he favors what they call full transparency. the fbi deputy director stepped aside and sources say, criticism is an upcoming report triggered that move. andrew mccabe left his post more than a month before his official retirement. sources tell abc news, he was going to be slammed in an inspector general report looking at senior fbi officials actions during the 2016 presidential race. mccabe faced criticism from the president and republicans over alleged political bias in the agency. cdc confirming the deadly flu season is the worst since the swine flu pandemic in 2009 with the childhood death toll rising to 37. in this all boys catholic school in chicago, at least 87 students were out sick yesterday alone. and nearly one in seven by the way. it comes as this hospital in downtown atlanta was forced to set up a mobile emergency room outside the hospital building just to handle the overflow of patients. abc's elizabeth hurr with the latest. >> reporter: from free flu shots for children in texas. to entire districts closing schools in six states. >> felt at the end what was best for the kids and school. >> reporter: the dangerous spread of the flu virus has school officials taking action and parents on alert. >> right now, a lot of people getting sick. children getting sick. >> reporter: according to the cdc, 39 states are reporting high flu activity. and still claiming lives including this 12-year-old from florida. laid to rest. among at least 37 children who died from the flu this season. >> i think this is a great opportunity to teach our children about certain symptoms. they might have a fever, temperature is high, they might feel cold. they might have fatigue. headache. body aches. >> reporter: experts say, teach your children what to look for and who to talk to. and across the country health officials say they're not just concerned about children. in minneapolis, the super bowl staff and volunteers are keeping busy sanitizing everything in sight. with organizers there anticipating more than a million fans to pack the streets this weekend. health officials say the flu can stick around until march or even april. if you haven't already, experts say your best defense is getting that flu shot. >> elizabeth, thank you. murder trial under way for a woman accused of killing her identical twin sister by intentionally driving off a cliff in hawaii. alexandria duval survived the fall. her twin sister died at the scene. witnesses say they saw the two sisters physically fighting and screaming inside the car shortly before the crash. duval pleaded not guilty to second degree murder. the sisters ran yoga studios in florida before changing their names and moving to hawaii. the pentagon reportedly reviewing rules about how members of the military use fitness trackers. the move after a popular app apparently revealed sensitive data about where u.s. forces are located around the world. here's abc's clayton sandel. >> the workout app has the the u.s. military exercising better privacy. the app, connects with wearable fitness devices, tracks users and some u.s. troops where they go, afghanistan, iraq and more. now years of data published in the online map is becoming angry that mccabe allowed comey to fly back from california after getting fired on an fbi plane allegedly calling mccabe's wife a loser. the white house has not responded to multiple requests for comments from abc news. days later on capitol hill, mccabe defending his former boss, after the white house claimed that the rank-and-file had lost confidence in comey. at the time, the white house also insisted the fbi investigation into russian meddling and any possible collusion was one of the smallest things the fbi is doing. mccabe was asked if that is true. >> sir we consider it to be a investigation but in december, after mccabe let it be known he was retiring in march. fbi deputy director andrew mccabe is racing the clock to retire with full benefits. he was just last week abc news u.s. officials released so-called putin list naming more than 200 russian politicians and leaders who flourished under putin. but that doesn't trigger any new sanctions. the pentagon is reporting a close call. officials say the u.s. plane was on a routine flight in the national airspace over the black sea when the russian jet crossed directly in front of it coming within just five feet. the navy says the incident was unprovoked. the state department is accusing russia of flagrantly violating international laws. officials in philadelphia are investigating a deadly police shooting involving a man who apparently was trying to run people down with his vehicle. one person was struck, but not seriously injured. before another driver, blocked the suspect's path. that's when an off-duty police detective approached the suspect struggled with him and fired off ten shots hitting the suspect once in the head. sheriff's deputy on patrol north of detroit hailed a hero after he pulled a driver from a burning vehicle. it happened early sunday morning. after the driver sped past the deputy, he lost control of his car and crashed. the 18-year-old driver suffered lacerations and a broken leg. a blood test of the driver is pending after deputies say they detected the odor of alcohol and marijuana. new fire dangers caused by record heat in southern california are making their way east. red flag warnings in around san diego canceled early this morning. those alerts along with high temperatures and strong winds have moved to new mexico, oklahoma, and texas panhandle. meanwhile the eastern half of the u.s. is looking at some colder snowy weather. a clipper system moving across michigan and great lakes states and northeast. as you look at the radar, a storm brewing all of the east coast.
