24 hours. by 7:00 we'll call it turning breezy but it's saturday. the winds are going to gust. an hour by hour look at the winds coming up, but, first, a check of the roads with sue. good morning. a little bit of mist. it's not affecting anything. look at the taillights headed southbound past the north gate mall. green is good. we're seeing green everywhere except for a little blip out of the central valley which is typical for our early morning commuters. heads-up if your drive takes you up the peninsula to the civic center this morning. a funeral procession for mayor ed lee between 6:00 a.m. and 7:00 a.m. with rolling delays, rolling road closures throughout that time. we'll have more on that on abc 7 news. and speaking of the mayor, happening today honoring san francisco mayor ed lee. >> people will be able to pay their respects at city hall where the mayor's body will lie in state and the line of people is expected to be very long outside of city hall that leads to the rotunda. doors will open at 8:00 a.m. and there will be a condolence book. you can see the memorial continues to grow for mayor ed lee with tributes to the late mayor who died so suddenly tuesday morning. the memorial celebration of his life will be held sunday at 3:00 p.m. at city hall. that is open to the public as well. if you can't make it we will have live coverage right here on abc 7 news. a new murder charge in the killing of miss flo, a beloved elderly woman. cuen and brown are charged in the home invasion. douglas' neighbor willie king is being indicted for murder. initially he was only charged with being an accessory for helping plan the attack and could face 25 years to life. cuen and brown face life without parole. reacting strongly to the fcc. >> santa clara county says they will file a lawsuit. the decision clears the way for internet service companies to charge users more to see certain content. santa clara county believes this will harm local startups. other bay area tech giants including air bnb and netflix criticizing the fcc's decision. state senator weiner -- >> net neutrality is so important for a free and open internet.iener -- >> net neutrality is so important for a free and open internet. we could have a situation where it's easier to access websites that pay money and harder to access websites that don't pay money. >> wiener says his propose ed legislation will work with the aclu to craft the bill. net neutrality can be a little confusing. we have a video that helps explain it. it does it in 60 seconds. you'll find it on our website abc7news.com. recreational marijuana licenses are out and a south bay pot shop is one of the first to get one. >> matt keller is live for us in san jose. good morning, matt. >> reporter: good morning. we're here on north 10th street in san jose. this is an industrial area. buddies let us know they received their license from the cell. the state bureau says by handing out licenses now businesses will be on new year's day. they legalized marijuana in california. they posted the licensing application forms online last friday and dozens of potential businesses including buddy's has created the process. they could be approved for people looking to purchase on january 1st. >> we are going to be closed on january 1st, we're issuing licenses early with an effective date of january 1st so licensees will receive their licenses electronically, print it out, post it in their store and they will begin operating on january 1st. >> reporter: they will provide diagrams and produce documents that show how their cannabis business would operate is he site. they will collect $1 billion in taxes from pot sales and other activity within several years. >> matt, thank you. a man bitten by a sea lion hopes to be out of the hospital today. he spoke to abc 7 news reporter tiffany wilson between surgeries at sf general. >> reporter: christian spoke to us from his hospital room -- >> i'm in almost no pain. >> reporter: he thinks the sea lion trailed him as he swam to the mouth of aquatic park. >> i did feel threatened. i did have a warning. i was a quarter mile from shore. there was nothing i could do. >> reporter: the sea lion bit einfelt's upper arm. >> i was relatively calm because i wasn't dead. >> the boat saved his life. >> reporter: dr. simeon has studied sea lion attacks. she says because they're so rare it's hard to pinpoint the reason for the aggression. >> sometimes the animals can be sick or injured and may be showing behavior or protecting an area. sometimes the behavior seems moran dom. >> reporter: einfeldt doesn't blame the sea lion. >> i asked the doctor, when can i go back swimming? >> reporter: however, he's changing one thing about his routine. >> i'm now going to be swimming in waist deep water only because this is their kingdom, and so i don't think that i want to roll the dice a second time. >> reporter: live and learn. in san francisco tiffany wilson abc 7 news. this morning we have new evacuations and new video as crews continue to battle the thomas fire in southern california, and it is certainly a tough morning for everyone after cal fire engineer was killed. 32-year-old cory iverson from san diego county had been with cal fire since 2009. sources tell abc 7 news he was overcome by a so-called burnover of fire near highway 126 in ventura county. his team has been removed now from the fire lines. i also want to show you that morning's new video coming in from the city of filmore. the thomas fire now said to be the fourth largest in california history. jessica, thank you. the massive california wildfires prompting plans for an increase in controlled burning. many forests are choked with dead trees after drought and beatle infestations. state and federal agencies' goal is to thin out. experts say the work is critical in preventing fires from spreading. critics say the burns released greenhouse gases, kill wildlife and get out of control themselves. in accuweather, december is known as one of our wettest months all year long but this december has been noticeably dry. you can see that in the snowfall in the sierra. december from 2016, the image you see in the center of your screen. all that white is snowfall. compare that to this year, december, and you see a lack of that snowfall and really over the next two weeks we're not tracking much if any moisture headed to the sierra. the fire danger is increasing especially this weekend because of winds. take a look at the forecast. as we approach midnight, look at how the winds increase gusting over 20 miles per hour. our biggest day of concern is going to be on saturday. saturday morning, 7:00 in the morning, the winds area wide are gusting over 25 if not 30 miles per hour and it will continue to stay that way with the active breeze throughout the entire day on saturday. so it's for that fact. we do have that red flag warning in effect as well as that wind advisory that will go into effect. temperature wise in the 40s and 50s. you're waking up to temperatures in the 30s in our coldest spots. later on today going into the 60s. let's get a check of the roads with sue. we'll take a look outside as you make your way from golden gate fields and on into berkeley and the mcarthur maze. a solid stream of headlights but everybody is moving and behaving nicely. once you get to the toll plaza pretty light out there. so far so good. minor delays for the cash paying lanes. let's take a look at some issues out there. we have this problem overnight with the devils slide tunnels closed both directions between 10:00 p.m. and 4:00 a.m. for emergency response drills. so be aware of that. you may want to take highway 92. we have 43 b.a.r.t. trains running on schedule. a couple of delays for the ferry, the mare, mechanical issues. no ace train issues. all right, thank you so much, sue. breaking royal wedding news. we're working on an update that will probably make a lot of people happy. >> except for people getting married on the same day. >> true story. plus, what happened at a "star wars" screening that forced employees to call police. >> one man may have come one a very scary creation to scare package thieves for good. and do you see anything alike? honor mayor ed lee. the line will be here to get inside today for the viewing. the casket will be in the rotunda. people will be allowed in between 8:00 and 7:00 tonight. there will be a condolence book they can sign. the final sendoff is set for sunday, a public memorial service that will be held here at 3:00. >> we are going to honor him appropriately so this week. and lay him to rest in a way that will make him proud. >> reporter: the city has not released the names of who will speak at sunday's service. willie brown will be making remarks. they do recommend people get here early sunday. weekend. a red flag warning goes into effect tonight. >> fire departments are keeping a nervous close eye on the forecast especially in the oakland hills where fire broke out monday night. gusty winds fanned the flames. >> crews have been advised to patrol a little more in their areas. but as of right now we don't see any real threat coming up. we're on heightened awareness. >> snake road is still closed as the city waits for an engineer to assess that situation. monday's fire undermined the road. there are fears of collapse. new fire safety regulations on utilities companies politicaling into three levels of fire danger. at the hottest level stricter rules about the placement and maintenance of wires and power poles. several lawsuits blame pg&e for poorly maintained lines. several commissioners note more stringent rules would add to the company's operating costs pushing up customer bills. right now highway patrol searching for the driver who led them on a high-speed chase in the east bay. antioch police started the pursuit before it ended up on 680 through walnut creek and ended on the streets of oakland about 11:15 last night. both antioch police and chp were chasing the driver. he may have gotten away on foot. and this morning officials have not said what the original crime was. they are still searching. i'll let you know when we get an update. oakland police are investigating two shootings, one of them deadly. a man was killed around 9:00 near fleming avenue and high street. there's a $10,000 reward for information leading to an arrest. about 20 minutes earlier another man was shot and was taken to the hospital. police have not updated us on his condition. two men will go on trial for the ghost ship fire. an alameda county judge says there's enough evidence to try them. they face 36 counts of involuntary manslaughter for last december's tragedy. prosecutors say they knowingly created a deathtrap. their attorneys blame oakland city officials for failing to inspect the building. cover california is extending the deadline to apply for health insurance coverage to next friday. the state-run health care exchange is seeing a huge influx in customers since wednesday. 182,000 since the enrollment opened october 31st. in washington lawmakers right now hammering out the final details of the republican tax plan and they hope to hold votes before christmas but there is a roadblock this morning. some gop senators expressing concerns about the bill's impact on the deficit and the child tax credit. arlette saenz has details. >> reporter: president trump sounding optimistic republicans will deliver on a tax plan by christmas. >> i think we will get there in a very short period of time. it will be the greatest christmas present a lot of people have ever received. >> reporter: but on capitol hill there are signs of trouble. senator marco rubio is a no unless the bill further expands the child tax credit. senator bob corker is expected to vote no as well. he's concerned about the $1.5 trillion the plan could add to the deficit. two more gop senators are undecided. senate republicans can only afford to lose two votes. for the wealthy the plan lowers the top tax rate from 39% down to 37%. for big business, it cuts the corporate tax rate from 35% to 21%. and for middle-class americans the plan doubles the standard deduction. for those who itemize it keeps current deductions on medical expenses and student loan interest but advocates for the middle class warn it caps state and local income and property tax deductions at just $10,000. the plan also scraps a key component of obamacare. the individual mandate requiring that all americans have insurance. that could leave 13 million more uninsured over the next decade. the final details of the compromise will likely be released monday, and the senate is expected to begin voting early next week. republicans will need every yes vote they can get to pass the plan. arlette saenz, abc news, washington. it's 5:37 now. the world famous mavericks surfing competition is set to resume when conditions are right. the coastal commission has cleared the way for the contest to take place. the waiting period will run from january 3rd to february 28th. the world surf league now owns the rights to mavericks. you may remember the previous owner went bankrupt. the competition low 40s by 8:00 in the morning. the sunshine will do its job. later on this afternoon going into the mid-60s. it is a spare the air day. mid and upper 60s. a mild afternoon on the way. starting late tonight and into saturday. the winds could gust near 50 miles an hour. combined with very low humidity. that means any fires that start can easily spread under these conditions. be very vigilant. the for cannabis products and services. they will be prohibited on or inside the transit vehicles and facilities under a revised policy. supporters say pot ads might encourage under aged use. it could send a mixed message because of the drug-free work place policy. san francisco's muni imposed a similar ban last month. we've seen a lot of studies about the dangers of cell phones. california is reported seeing a mountain lion in a backyard just before 8:30. the witness says the big cat never acted aggressively and wandered back into a wooded area near st. john's cemetery. police notified the department of fish and game. san ramone police need your help catching two burglars. these two men stole thousands of dollars of wire and solar products. it happened last saturday night just after 9:15 at a solar power business in san ramone. the two men arrived in an older model tiburon. this is what the california department of public health is telling us about our phones. keep it away from your body and out of your pocket as much as possible. smart phones emit radiation and the department says research suggests that long-term heavy use may impact your health. the scientific community hasn't reached a consensus on the risk. they include keeping your cell phone away from your bed at night, reducing cell phone use when the signal is weak. removing your headset when you're not on a 24 hours. by 7:00 we'll call it turning breezy but it's saturday. the winds are going to gust. an hour by hour look at the winds coming up, but, first, a check of the roads with sue. good morning. a little bit of mist. it's not affecting anything. look at the taillights headed southbound past the north gate mall. green is good. we're seeing green everywhere except for a little blip out of the central valley which is typical for our early morning commuters. heads-up if your drive takes you up the peninsula to the civic center this morning. a funeral procession for mayor ed lee between 6:00 a.m. and 7:00 a.m. with rolling delays, rolling road closures throughout that time. we'll have more on that on abc 7 news. and speaking of the mayor, happening today honoring san francisco mayor ed lee. >> people will be able to pay their respects at city hall where the mayor's body will lie in state and the line of people is expected to be very long outside of city hall that leads to the rotunda. doors will open at 8:00 a.m. and there will be a condolence book. you can see the memorial continues to grow for mayor ed lee with tributes to the late mayor who died so suddenly tuesday morning. the memorial celebration of his life will be held sunday at 3:00 p.m. at city hall. that is open to the public as well. if you can't make it we will have live coverage right here on abc 7 news. a new murder charge in the killing of miss flo, a beloved elderly woman. cuen and brown are charged in the home invasion. douglas' neighbor willie king is being indicted for murder. initially he was only charged with being an accessory for helping plan the attack and could face 25 years to life. cuen and brown face life without parole. reacting strongly to the fcc. >> santa clara county says they will file a lawsuit. the decision clears the way for internet service companies to charge users more to see certain content. santa clara county believes this will harm local startups. other bay area tech giants including air bnb and netflix criticizing the fcc's decision. state senator weiner -- >> net neutrality is so important for a free and open internet.iener -- >> net neutrality is so important for a free and open internet. we could have a situation where it's easier to access websites that pay money and harder to access websites that don't pay money. >> wiener says his propose ed legislation will work with the aclu to craft the bill. net neutrality can be a little confusing. we have a video that helps explain it. it does it in 60 seconds. you'll find it on our website abc7news.com. recreational marijuana licenses are out and a south bay pot shop is one of the first to get one. >> matt keller is live for us in san jose. good morning, matt. >> reporter: good morning. we're here on north 10th street in san jose. this is an industrial area. buddies let us know they received their license from the cell. the state bureau says by handing out licenses now businesses will be on new year's day. they legalized marijuana in california. they posted the licensing application forms online last friday and dozens of potential businesses including buddy's has created the process. they could be approved for people looking to purchase on january 1st. >> we are going to be closed on january 1st, we're issuing licenses early with an effective date of january 1st so licensees will receive their licenses electronically, print it out, post it in their store and they will begin operating on january 1st. >> reporter: they will provide diagrams and produce documents that show how their cannabis business would operate is he site. they will collect $1 billion in taxes from pot sales and other activity within several years. >> matt, thank you. a man bitten by a sea lion hopes to be out of the hospital today. he spoke to abc 7 news reporter tiffany wilson between surgeries at sf general. >> reporter: christian spoke to us from his hospital room -- >> i'm in almost no pain. >> reporter: he thinks the sea lion trailed him as he swam to the mouth of aquatic park. >> i did feel threatened. i did have a warning. i was a quarter mile from shore. there was nothing i could do. >> reporter: the sea lion bit einfelt's upper arm. >> i was relatively calm because i wasn't dead. >> the boat saved his life. >> reporter: dr. simeon has studied sea lion attacks. she says because they're so rare it's hard to pinpoint the reason for the aggression. >> sometimes the animals can be sick or injured and may be showing behavior or protecting an area. sometimes the behavior seems moran dom. >> reporter: einfeldt doesn't blame the sea lion. >> i asked the doctor, when can i go back swimming? >> reporter: however, he's changing one thing about his routine. >> i'm now going to be swimming in waist deep water only because this is their kingdom, and so i don't think that i want to roll the dice a second time. >> reporter: live and learn. in san francisco tiffany wilson abc 7 news. this morning we have new evacuations and new video as crews continue to battle the thomas fire in southern california, and it is certainly a tough morning for everyone after cal fire engineer was killed. 32-year-old cory iverson from san diego county had been with cal fire since 2009. sources tell abc 7 news he was overcome by a so-called burnover of fire near highway 126 in ventura county. his team has been removed now from the fire lines. i also want to show you that morning's new video coming in from the city of filmore. the thomas fire now said to be the fourth largest in california history. jessica, thank you. the massive california wildfires prompting plans for an increase in controlled burning. many forests are choked with dead trees after drought and beatle infestations. state and federal agencies' goal is to thin out. experts say the work is critical in preventing fires from spreading. critics say the burns released greenhouse gases, kill wildlife and get out of control themselves. in accuweather, december is known as one of our wettest months all year long but this december has been noticeably dry. you can see that in the snowfall in the sierra. december from 2016, the image you see in the center of your screen. all that white is snowfall. compare that to this year, december, and you see a lack of that snowfall and really over the next two weeks we're not tracking much if any moisture headed to the sierra. the fire danger is increasing especially this weekend because of winds. take a look at the forecast. as we approach midnight, look at how the winds increase gusting over 20 miles per hour. our biggest day of concern is going to be on saturday. saturday morning, 7:00 in the morning, the winds area wide are gusting over 25 if not 30 miles per hour and it will continue to stay that way with the active breeze throughout the entire day on saturday. so it's for that fact. we do have that red flag warning in effect as well as that wind advisory that will go into effect. temperature wise in the 40s and 50s. you're waking up to temperatures in the 30s in our coldest spots. later on today going into the 60s. let's get a check of the roads with sue. we'll take a look outside as you make your way from golden gate fields and on into berkeley and the mcarthur maze. a solid stream of headlights but everybody is moving and behaving nicely. once you get to the toll plaza pretty light out there. so far so good. minor delays for the cash paying lanes. let's take a look at some issues out there. we have this problem overnight with the devils slide tunnels closed both directions between 10:00 p.m. and 4:00 a.m. for emergency response drills. so be aware of that. you may want to take highway 92. we have 43 b.a.r.t. trains running on schedule. a couple of delays for the ferry, the mare, mechanical issues. no ace train issues. all right, thank you so much, sue. breaking royal wedding news. we're working on an update that will probably make a lot of people happy. >> except for people getting married on the same day. >> true story. plus, what happened at a "star wars" screening that forced employees to call police. >> one man may have come one a very scary creation to scare package thieves for good. and do you see anything alike? honor mayor ed lee. the line will be here to get inside today for the viewing. the casket will be in the rotunda. people will be allowed in between 8:00 and 7:00 tonight. there will be a condolence book they can sign. the final sendoff is set for sunday, a public memorial service that will be held here at 3:00. >> we are going to honor him appropriately so this week. and lay him to rest in a way weekend. a red flag warning goes into effect tonight. >> fire departments are keeping a nervous close eye on the forecast especially in the oakland hills where fire broke out monday night. gusty winds fanned the flames. >> crews have been advised to patrol a little more in their areas. but as of right now we don't see any real threat coming up. we're on heightened awareness. >> snake road is still closed as the city waits for an engineer to assess that situation. monday's fire undermined the road. there are fears of collapse. new fire safety regulations on utilities companies politicaling into three levels of fire danger. at the hottest level stricter rules about the placement and maintenance of wires and power poles. several lawsuits blame pg&e for poorly maintained lines. several commissioners note more stringent rules would add to the company's operating costs pushing up customer bills. right now highway patrol searching for the driver who led them on a high-speed chase in the east bay. antioch police started the pursuit before it ended up on 680 through walnut creek and ended on the streets of oakland about 11:15 last night. both antioch police and chp were chasing the driver. he may have gotten away on foot. and this morning officials have not said what the original crime was. they are still searching. i'll let you know when we get an update. oakland police are investigating two shootings, one of them deadly. a man was killed around 9:00 near fleming avenue and high street. there's a $10,000 reward for information leading to an arrest. about 20 minutes earlier another man was shot and was taken to the hospital. police have not updated us on his condition. two men will go on trial for the ghost ship fire. an alameda county judge says there's enough evidence to try them. they face 36 counts of involuntary manslaughter for last december's tragedy. prosecutors say they knowingly created a deathtrap. their attorneys blame oakland city officials for failing to inspect the building. cover california is extending the deadline to apply for health insurance coverage to next friday. the state-run health care exchange is seeing a huge influx in customers since wednesday. 182,000 since the enrollment opened october 31st. in washington lawmakers right now hammering out the final details of the republican tax plan and they hope to hold votes before christmas but there is a roadblock this morning. some gop senators expressing concerns about the bill's impact on the deficit and the child tax credit. arlette saenz has details. >> reporter: president trump sounding optimistic republicans will deliver on a tax plan by christmas. >> i think we will get there in a very short period of time. it will be the greatest christmas present a lot of people have ever received. >> reporter: but on capitol hill there are signs of trouble. senator marco rubio is a no unless the bill further expands the child tax credit. senator bob corker is expected to vote no as well. he's concerned about the $1.5 trillion the plan could add to the deficit. two more gop senators are undecided. senate republicans can only afford to lose two votes. for the wealthy the plan lowers the top tax rate from 39% down to 37%. for big business, it cuts the corporate tax rate from 35% to 21%. and for middle-class americans the plan doubles the standard deduction. for those who itemize it keeps current deductions on medical expenses and student loan interest but advocates for the middle class warn it caps state and local income and property tax deductions at just
