Judge Invalidates Changes To NM Medical Cannabis Rules
Law360 (February 1, 2021, 10:25 PM EST) -- A New Mexico court has invalidated the state health department's decision to repeal and replace certain medical cannabis regulations, finding the department acted outside its statutory authority and didn't properly consult the Medical Cannabis Advisory Board before making the changes.
New Mexico First Judicial District Court Judge Bryan Biedscheid said in Thursday's order that state statute requires the New Mexico Department of Health to consult with the advisory board before putting forward new rules.
