privately preparing for a critical first debate, a big question that we're running into from people is which biden will they see at thursday's cnn presidential debate, which will be simulcast here on fox? one of them shows their age and raises big questions about his fitness to serve. the other seems more alert like he did at this year's state of the union address. i'm harris faulkner and you are in "the faulkner focus." a look at some of the rules for thursday, which may make a difference depending on which version of joe biden shows up. there will be no live audience. so no distractions. and no input. other than the co-moderators. no consulting with campaign aides during commercial breaks. no props or prep notes. we know that joe biden as president has carried such notes. both candidates' microphones will be muted when it is not their turn to talk. no interjection. sometimes good questions come from each candidate. president biden is spending a week, as i said, privately preparing at camp david. the former president, donald trump has been all over the campaign trail in the last few days. no shortage of advice for both men. >> for president biden one more piece of advice, still a physical visual medium, right? he has resting old face. he needs to smile. when he smiles it goes away a little bit. when he smiles his face comes to life. they are practicing this. practice smiling. >> i think former president trump were smart he would say to the crowd are you better off now than you were four years ago and let joe biden talk. don't try to overstep. >> harris: that's the best advice, huh? he needs to smile. get joe biden to smile. i think what comes out of his mouth is pretty critical, too. north dakota governor doug burgum on the short lies for vice presidential pick says don't be fooled by the biden strategy. >> there has been a real effort on the biden team to try to lower expectations. i think we have to look. the guy running for office more than a dozen times and run for president four times and campaigning since president nixon was in office. this guy has the ability and we're anxious to see which joe biden will show up. >> harris: aishah hosni is at the white house now. >> i can tell you sources are telling fox news this morning that president biden is surrounded by at least a whopping 16 debate prepers as camp david now and stay there until he heads to atlanta for the big debate. also tell you it is common, harris, for the president to do a mock debate. one of those staffers, one of those aides will pretend or be the challenger, former president trump and the president will undergo a mock debate. now biden's team knows that the 81-year-old has to perform well for 90 minutes straight and so he will continue to prep and stay there and probably not be seen until he heads down to atlanta. in contrast, former president trump is on the campaign trail holding rallies, meeting with supporters in between all of his debate prep. he called biden a worthy debater last week but thinks all the prepping he is doing at camp david will wash away on that debate stage. listen. >> i think he will be prepared he will be fine and forget it an hour after preparing. we'll see what happens. >> all of this is happening at ronnie jackson said he will send a letter to the white house to the president requesting that he take a drug test before and after the debate. meanwhile the white house is getting some raised eyebrows about a recent promotion, tyler cheery now leads communication for biden's climate office. he is addressing controversial past tweets he made including saying the police are the quote direct evolution of slave patrols and lynch mobs in an effort to clean that up, he posted this. he says past social media posts when i was younger don't reflect my current views, period. i support this administration's agenda and will continue my communications work focused on our climate and environmental policies. not the kind of story the white house wants to see out there in the public media right before a big moment for the president. but the white house spokesman tells us they are proud to have tyler cherry on their team. all eyes now on these two contenders as we await this big debate. >> harris: i'm sure you caught it. the tweet was from 19 hours or so ago. you know people were sending out all his old tweets. so if he had hoped to get out in front of the truck that's coming toward him, he was already too late 19 hours ago. we'll see how this -- i don't know if one tweet says i didn't mean what i said. doug collins and patrick murphy. look, cleanup on aisle seven is something unfortunately that politicians have to do. even presidents have had to do it. why would you pull somebody on your team that already is a train wreak on social media in terms of cleaning up after him unless you are desperate? what does it get the democratic party and the wohite house, >> doesn't get you a lot. it is about donald trump and joe biden. it will be a debate of contrast especially today, harris, when we are two years from the disastrous dobbs decision that overturned roe v. wade. do you know 1-third of american people don't have access to reproductive predome. >> harris: you are going away from the question why they would hire this guy. a tiny sample of the flood of criticism of tyler cherry by social media users. some of them. let me guess, cheap fakes? a reference to the white house characterization of recent videos of president biden. because this is in response to that tweet that aishah hosni showed us which i pointed out came out some 19 hours ago saying don't pay attention to what the younger me posted. i don't know if that includes recent younger him or do we know it's all the same person? another, too late to back pedal. you are exposed as a horrible human being and one more, would you accept that explanation for far right posts? doug. >> the last one probably is the more applicable one. they would not accept it for anything like that. look, how much -- i think we both understand this was a bad -- optics of this are terrible. but it is also a continuation of the white house and communications department. they know what the social media posts were before they hired him and they hired him anyway. that to me is a continuation of pandering to the left on these kind of issues and they don't care until they get in trouble and then try to back out of it. not that much younger ago when you look at when the tweets were made. this is not ooh, i was in another lifetime. this was pretty recent. look, in a week in which there is monumental things going on, this is one in which the biden administration has had so much trouble with communication with basically americans to now have to deal with this on debate week, again in is self-inflicted wound here. >> harris: i just ask what they are grasping for. if it's young voters, this is insulting. young people can tell the difference between what they see and read and what is in their social media feeds and wants to separate from. he can't completely become another person. it's not how this works. it is interesting they would meier themselves down with cleanup on aisle seven when the president is getting ready for a debate. voters of president biden and the democratic party thought were locked up for them are no longer a safe bet. recent fox polling shows fewer than half of hispanic voters approve of the job joe biden is doing. opinion piece in the "los angeles times" is arguing democrats grew too reliant on a demographic newer to the country and more spanish speaking than latinos overall. it led a generation of political operatives to believe the growing latino vote would eventually turn texas and florida blue. democrats also clung to the belief that latino voters identified with the immigration experience and targeted through spanish television ads. the strategy was not backed by much evidence or effective at motivating latino voters. donald trump here with this. >> when he does a rally chanting usa. these are patriots and people that love their country. they want to turn things around. watch a joe biden rally. is anyone chanting usa, usa? >> some of the brothers we see celebrating trump in a lot of ways donald trump is i should say for a lot of people donald trump is the most crystal clear example of the american dream. he is somebody who says whatever he wants and he is only stronger because of it >> harris: imagine that. he has still got a gag order on him. some voters are seeing this president as someone who can say whatever he wants. that's part of the american dream. you heard from that young man. you can talk to many voters. we do. what the fox news polling is showing. 73% support for biden among black voters. that's a steep drop from 2020 when he won 91% of the black vote. what happened? this isn't good news for the president when it comes to young voters. 60% say they disapprove of his job performance. wow. you know, when you look at this, doug, i want to go to you first just to talk about what happened? what is the erosion point that you see in the last three plus years? >> i think what you're seeing is the difference between administration that seems to care about everything else except that base when you say that. i asked pollsters about this. when i saw the polls coming out in new york and saw the number saying demographic. issues like immigration, crime in the cities, things moved from the border to really mainstream america. they are starting to see that folks coming here doing it the wrong way illegally coming here, we see the crime with some of the murders and stuff we saw in georgia and other places look. we're americans. we did it the right way and now we're seeing it come to the doorstep and seeing it differently. >> harris: it's not clear where the voters go. it doesn't automatically mean that black and latino voters are just completely disenchanted by biden will vote for donald trump. what it could mean is they'll think about it. some of them will do the one thing that we've never want to see happen in america. they will sit. they won't even exercise their right to vote and that means biden broke something in this country. he has to fix it for everybody else. you can't leave it such that young people are outside the process because of your bad policies. >> i agree with you and doug. reality of it is the american people have been put through the wringer. the worst global pandemic. let's move on. >> harris: the high inflation has been since the pandemic. give people credit. those people who got ill and stroked and survive and now vote based on how they're experiencing a current presidency. give them some credit. >> i am giving them credit and they give president biden credit. inflation was 9% and down to 3%. >> harris: you realize he inherited 1.4 and didn't have a pandemic in the middle of that. by may 11th the president told us the pandemic was over. >> 16% unemployment rate in black america and now it is down to less than 5% is what joe biden's record is. the poll is moving forward in a positive direction. i know we can debate this but you can't debate the fact that joe biden, when they talk about the bipartisan infrastructure bill, the chips act, pack act for veterans he delivered for the american people and setting in now in economic policy and why the economy is growing. the envy of the world. it is. >> the sad part about that is patrick none of what you said hasn't done. build back better is not building or better. this has not been done. >> harris: all right. gentlemen, thank you. i will bring you back as soon as we possibly can on a different day. great debate. thank you. let's all of us together tune in to fox news democracy 24 special coverage of the cnn presidential debate simulcast. our coverage begins thursday june 27th at 8:00 p.m. eastern. as patrick murphy just said the world is watching us. the world is going to be watching those men on thursday as you can imagine. [crowd chanting] >> harris: one grassroots group is shouting out. they are very upset that liberal manhattan district attorney alvin bragg dropped charges against nearly all the people involved in a violent anti-israel jewish hate riot. remember that on the campus of columbia university? plus former president donald trump's attorneys are back in court right now and they are fighting to get classified documents charges tossed out. paul mauro on all of it. plus more in "focus" next. hey, paul. there's an old saying in the navy that the toughest job in the navy is a navy wife. and if you've made the deployments and you've been the wife at home, or you've been the spouse at home, you understand what i'm talking about. your spouse has earned the right to apply for a va home loan. the newday 100 loan allows you to borrow up to 100% of your home's value. so if you're in a situation where you need some help financially, give us a call. with so many choices on booking.com there are so many tina feys i could be. so i hired body doubles to help me out. splurgy tina loves a hotel near rodeo drive. oh tina! wild tina booked a farm stay to ride this horse. glenn close?! with millions of possibilities you can book whoever you want to be. that's my line! booking.com booking.yeah >> harris: all right, so we're looking at that picture. it's not the clearest it could be but we can sort of see inside of it here. we're taking a look inside a courtroom right now and the illegal immigrant murder suspect is appearing in court. and, you know, we've had several situations happen in the last few days so we're watching these very closely, and as we learn more on this situation, we'll bring it to you. we're following this and so we'll bring you more info in a moment. stand by. right now former president trump's attorneys are back in court on that classified documents case and they are continuing their fight to get all the charges dismissed against trump. during friday's hearing both sides agreed or argued over the legality of special counsel jack smith's appointment. they didn't agree on anything. smith is in the courtroom and talking more on that issue today. a gag order that prosecutors have requested for donald trump. this would be on top of the one he already has in the case that's already wrapped up here in new york city. sentencing is july 11th and the judge has chosen in the new york city case to keep trump under the gag order including next week's or this week's debate. in a hearing tomorrow, trump's team is expected to argue the 2022 mar-a-lago raid was illegal and all of the evidence from it should be tossed out. msnbc legal analyst with some snark for the judge, presiding over this case. watch. >> stay in your lane. yes, not only has the issue of whether the special counsel comports with the structures of constitutional law. that is settled and addressed in multiple courts. settled. we don't have to rehash that. if this were an actual issue it would be decided by the supreme court. not by a district court judge in fort pierce, florida. >> harris: paul mauro is here, retired nypd inspector and attorney. another state where special counsel jack smith and a whole host of others would like to see donald trump under a gag order. likely not going to get it at this point with this judge. but what do you think they accomplish? can they get the case tossed against the classified documents against president trump. >> it is not like an outlier case that this woman seems to believe and something occurring in fort pierce, florida makes it a lesser case is a little indication of where she is coming from. this is a serious constitutional issue related to separation of powers. realistically a special prosecutor, because that prosecutor is a superior officer of the government, constitutionally has to be appointed by the president and confirmed under advice and consent of the senate or the second way is by statute. in this case you have neither. it is a hole in our system that has to be repaired that has been kicked along. there was a law that seemed to apply and expired. don't have the color of that anymore. strangely, this case punches even above the weight of the donald trump status. this is a constitutional issue that will affect things going forward. >> harris: talk to me about those situations where they go to a person's house and start collecting evidence. how is this case different than maybe any other situation like that? >> concerning that, it is not. realistically once you get the judge to approve a search warrant you execute the search warrant and that's it. you are talking about the gag order, right? where donald trump is saying hey, they showed up, locked and loaded to come into my house. this was terrible. the f.b.i. is saying no, no, no, that's standard procedure and the government wants donald trump essentially to stop saying that. here is the deal. this is different than some of the gag order issues that were raised in new york. in new york the complaint was that he was talking about -- trump was talking about witnesses and some cases family members of the judge, etc. here he is talking about the government. there is no higher bar that you have to overcome in our system than first amendment protected speech relative to the government. that's why it is there. >> harris: otherwise you turn into russia or iran. i get it. by the way, they want to argue all the evidence in the mar-a-lago raid was illegal. part of their argument. outrage continues after alvin bragg soft on crime let 31 of the violent anti-israel rioters off the hook. those people -- you watched it live. they were storming and occupying columbia's hamilton hall in april. the school year was still going on. today activist group in jew hatred spoke out and they did so outside alvin bragg's office. columbia student from that group said this. >> d.a. bragg's decision to drop 31 of the 46 cases against these anarchists is not just a failure of the justice system. it is a betrayal of the safety and trust of all new yorkers like myself. the lack of sufficient video evidence and the protestors masked faces is not an excuse. by dropping these charges d.a. bragg sends a dangerous message that acts of aggression, anti-semitism and intimidation will be tolerated in our city. >> harris: he gets it. >> this makes my head spin. a couple of things. two, first of all, if the necessity of having perfect video was the bar for prosecuting cases like this in the past, what did we do -- currently, what did we do in the past before we had body worn cameras and video everywhere on the street and in schools and buildings? if that's now a requirement, what did we do hundreds of years before that? it doesn't hold water. secondly, the idea you drop the charges because it is a first-time offender doesn't hold water. generally if it's a first-time offender you go through with the case but they don't take a heavy hit essentially. but you don't just say your first time we'll cut the charges. the thing that they are using is what can't identify them. they were given sum onsed the seen and all got trespass summons. we got their names. the idea we don't know who they are. of course we do. they should have charged heavily. misdemeanor trespass what they should have charged would have gotten them fingerprints and photographs and you would have the whole story and arrest sheet. they didn't do that. it wreaks of a deal. >> harris: if there was ever an opportunity to tie some of those people outside the campus and went on that campus and we know they went from place to place across the country because the tents had a uniformty about them and the chants they were teaching the students, right? there were some people potentially who would have been involved at that university and others. you want a list of people to at least say are they committing similar crimes in other places? to me it is basi
