u.s. >> jocelyn nungaray on monday she was found strangled to death in a creek. >> it is just the latest, in a string of violent crimes linked to illegal immigrants, police say they are overwhelmed. >> we have our own. >> and into our city and they are committed to violent acts. this is just another glaring effort -- i mean, a glaring act that have been committed on the citizens of houston by last time jocelyn nungaray's mom saw her, jocelyn snuck out of her room. but they were captured by surveillance cameras up to the last moments of jocelyn's life. the 12-year-old was murdered, dumped in a bayou, her body found in a creek. the medical examiner says the cause of death was strangulation, the suspects were picked up early thursday. >> hearing that the gentleman that were in these do not give someone bail, this is it. >> dhs sources tell fox news, jose pena ramos was caught last may, released with a notice to appear at a later date. 21-year-old franklin jose pena ramos in march, he was also picked up by border patrol, the status of his release into the u.s. is not clear. because of jocelyn's young age, houston authorities says the capital murder applies and that makes the father of two young girls. this is devastating to me and my heart goes out to the families that lost this young girl and these animals that did this deserve to rot in hell. and right now, there is blood on joe biden's hands because the executive fiat he destroyed our southern border, during president trump we had the safest southern border we have seen in modern history. we had strength on our border, it was not run by cartels, and president trump said this nine years ago that they are not going to sit and ride if we have an open border. now american children are dying. this is absolutely absurd. this is unamerican. 11,000,000 people entering our country illegally under fentanyl has entered our country and our children are dying. it is the federal government's job to keep our children's safe and we are failing them. the executive fiat joe biden destroyed our border and now you cannot blame us because congress passed hr 2 over a year ago and if we would have passed this, country after 9/11. we have a wide open border and now everyone is suffering. and i find it very interesting to see these blue states an blue governors realizing every single state is now a border state. well guess what, here in texas we have been dealing with this the last four years. we tried to close our border, greg abbott a couple months ago, tried to close our border. we got sued for it. we got sued for the state doing the job of the federal government. and so now the american people are watching this, we don't believe you anymore because four years ago we didn't have this problem. now, we do. and now that we're entering the election season a few months away from the presidential election, all of a sudden, the democrats want to get tough on crime, get tough on the border. no one believes, you want the policies of president trump that we had four years ago. november is coming. it's very important, this is a matter of national security and in a matter of national safety. americans have got to wake up, we cannot have with four more years, because border crisis that we see right now will only persist and continue to get worse if we reelect them. >> we hear the urgency in your voice, congressman. what voters are hearing from, not hearing the urgency on this issue. rachel morin's murderer, the number of times arrested and expelled, tallied up to february entered near el paso as a got away and we know what happened after that. we also have pictures of the suspect extradited up on your screen now. when you look at isis non-detained docket and the numbers swelling, going back to 2021 congressman, looking at the numbers now as i tally it up, doubling so far for 2024 year to date. this doesn't look like it's getting better. so, what are republicans -- you talked about this as an election issue. what are republicans promising they can do to improve this situation that so many are concerned about? >> it is clear our borders are our kamala harris who hadn't been to the border, has no idea what the root causes are of this immigration crisis, aren't going to do anything about it, we have to have an immediate change. we have to find these animals, we must round them up, send them back to where they came from. end of discussion. if we didn't do this after november then americans are going to continue to die. we cannot expect joe biden and kamala harris, this administration and mayorkas to do anything about this. they have sworn allegiance to destruction of this country because young people are continuing to die and they can't even mention the victims' names, why would they do anything in the last five months, in the last 3.5 years they have destroyed our southern border and we are rotting within. i am a combat veteran. i fought to keep isis out of our country. i fought for people to not come into this country illegally and destroy my fellow americans. this is not about being racist. this is not being xeno phobic. this is not about hating people that want to come to this country to find a better way of life. that is not what i am talking about. i am talking about animals that are in our mist that have to get out of here as soon as possible. again, we can't do anything about it as long as joe biden is our president. urgency in our voice and why november is so important. the solution is president trump in november. if we don't get him numbers are pretty large. however i think what stands out to me, in trump's fundraising numbers the average donation is right around 70 bucks. both say they benefited from the verdict and had great fundraising afterward. looking ahead to the debate, how important is it that the president have a good performance because of how it might impact the fundraising numbers? >> i mean, this is huge for him. and part of the reason this is huge is because when you talk about fundraising numbers, this is an area where biden has had an advantage for quite some time, right. trump has been falling behind a bit on that front and he has to use some of those funds for the legal issues as well. this has been an issue coming along. it seems to remain cured a bit. somewhat by the conviction which riled people up. the president though i think is really in a major break situation when it comes to this debate. people look at him, they see the videos, the press at large can tell you all they want that it's not happening, it's a cheap fake, they can try to get you to stop talk about it. the voters decided, sometimes 67, 70% that biden is too old to do another term. they've seen what they see. if they see that again on a debate stage, then that will solidify that view. and that view is very dangerous for biden, biden's pitch has been, i am a guy who does normalcy, i am a guy who gets you away from chaos, i am a steady hand on the wheel, even while speaking, people will have an issue with that. because by the way, your policies are also not steady hand on the wheel. people look at immigration, they look at the border, they look at the economy. they go, this doesn't look feel like what he promised. >> mary catherine thank you for joining us. matt bennett on biden facing pressure to avoid a bad debate performance, listen. >> they can't afford for that to happen to biden. there is so much scrutiny of his performance, not just his record and his policies, but his actual performance. so, they are working on that really hard and i know the president is going to take that very seriously. >> but should republicans, mary catherine about the bar being set so low he could clear it and look okay on that debate stage. >> again, people are seeing what they're seeing and they are not going to expect a like tour deforce performance out of him. this is a 90 minute debate, go back and forth. i think it poses a challenge for both candidates in different ways. they both have discipline issues, they can be unpredictable. for trump the key might be to have a temperate performance and let biden speak, the longer biden speaks, the more likely he is to trip himself up. not to give him a life line by breaking in. the mics will help, while the other is talking, don't rescue biden from himself would be my tip for trump as they go into it. >> you know, you brought up the white house pushing back on these images where you are seeing the president in an unfavorable view, not all have been zoomed in, a couple of them were independent journalist account in the case of the fundraiser video with obama leading him off the stage. a long time democratic donor said, a president should not have to be let off stage by hand or arm wrapped about him. to your point we're seeing the white house pushback strongly against anything we see portraying the president in a negative light. but is it fair to tell voters not to believe what they're seeing and does that in the end put more pressure on the president to be exactly right every single time including for 90 minutes standing next to trump? >> no, i don't think it's right -- look, part of their job is to spin it as best they can. it's okay to say it's being mischaracterized or over blown, not to apply that they are fake. you could say, we like to add context, fine, do that all day, this is a repeat of russian disinfo, a term that can be turned on americans because they say there is this grave danger to american discourse, russian disinfo or cheap fakes, they say all the things you are seeing and talking about in the videos you are distributing are bad. we are going to have social media impede you and not allow you to distribute these things and have encounter that is -- russia gate or covid, that is a bad thing for government to do. >> the stakes could not be higher. we will all be watching a courthouse in fort pierce, florida. today's arguments center around trump's legal team saying that the special council in this classified documents case was appointed unlawfully. they believe since special council jack smith's appoint was therefore it should be thrown out. however, several courts have rejected similar or near identical challenges regarding other special counsels in the past. judge cannon appointed by trump back in 2020 is face be some criticism for slow walking the case and delaying the trial since the election. the pace of the pretrial hearings is justified given the gravity of the four felony counts the former president faces. >> this judge is allowing hearings where a lot of judges rejected positions on papers. i think it's a credit to the judicial system when time is given to a case that is this important. the judge is taking time for these kind of issues and having hearings. >> reporter: now, there was some reporting by the "new york times" that two judges here in florida privately urged cannon to remove herself from this classified documents case, that former u.s. attorney coffey said it was likely friendly advice and at some point a federal here. >> good morning. >> speaking to jeff's point, the defense says that smith wasn't approved by the senate, there is precedent for this kind of argument against an independent prosecutor, typically it doesn't work out in the defendant's favor. the "new york times" is saying that the judge in this case has entertained some unusual hearings, one we are seeing today is going to have evidence in it, i am unclear what that evidence is going to be, her behavior is unusual. judge and trump's document case rejected suggestions to step aside, two federal judges privately urged eileen n cannon to decline the case when assigned to her last year according to two people on the matter. she rejected it. all these motions rather she has presided over, do you think at all that she is taking special attention to show that trump is getting a fair trial here or do you few it as "new york times" says it's unusual and tilted in his favor? >> jacqui i think it's deceptive coverage. the difference between the issue about smith's status that's been raised in this case that distinguishes it from other cases is that prior independent counsels were appointed under a independent statute. this jack smith has been appointed under a justice department regulation. what the constitution says, when you are talking about an officer of the united states carrying out these kind of duties, either the person has to be nominated by the president and confirmed by the senate, or has to occupy a position that congress has established bylaw. so, this actually is a pretty novel and important argument which is why people like former attorneys general edwin mece and michael mucass, filed briefs saying smith doesn't have adequate legal constitutional basis to proceed with this case. it's not at all a frivolous argument. i think the wrap on judge cannon is ridiculous. this is a classified information case. they are very hard to get to trial. she could have satisfied the media and said, you know, we'll have an augus august 1sttrial date everyone would have known it was ' will you sorry, she is trying to move through a massive pretrial work that has to be done so she can set a realistic trial date, she is being accused i think falsely of postponing the case because she is trying to help trump easy electoral effort. >> i want to ask you about the former president motioning now to have the judge in the new york civil fraud case recused. lawyers for former president trump have filed this motion in new york alleging that the judge engaged in prohibited communications, andy, and recuse himself. this is alina habba a legal spokesperson for trump on hannity last night. >> went on tv bragging about the fact he had spoken with the judge that was sitting on our case, judge engoran. this attorney who sued trump, sean, more than six times, has now gone up to a judge sitting on an active case and spoken to him about the case. that is not allowed. he never notified the parties. not allowed. and it gave us another reason to say, yet again, you need to step down. >> so, is it clear from your view, andy, that this judge should recuse himself? >> i really think sandra, what's happening here is that the trump team is building a stronger case on appeal for the fact that judge engoran is erratic. the court of appeals, in new york already slapped him down a number of times. it wouldn't have been the judge's fault if some lawyer came up to him and offered unsolicited advice which may be what happened here. but it's a big problem if he didn't notify the parties during the trial so that they should -- they could have done anything about it. you know, the case is already over so taking him off the case at this point wouldn't really do much. i think this is really more building the case for the court of appeals to underscore that this judge from beginning to end tended to get things wrong and handle things the wrong way. >> andy, we know you are going to hang out along. my goal was to sell 100 cars by the end of the week. as of last night we actually have 89. it's not difficult to work your deals, do your test drives, work numbers, quote payments, get all the way to the end of the sale. what happens is without having our cdk typing contracts becomes more difficult and that's where we are stumbling into it. we did have a meeting today with our sales team, we are going to have our management team here in a little bit. we have a plan how we are going to load deals into the computer by hand. the ironic thing, we are going to do electronic contracts so paper less contracts but we have to line by line load it into the computer to get it ready to do the digital thing whereas before when you had the software from cdk that would be seamless and it would just, you know, type out everything for us with all the different banks that we work with. so, -- >> this is fascinating. >> we are going to get through it. >> that's what i love about business owners and managers like yourself, you roll with the punches and you get through it and it sounds like you are getting close to your goal. congratulations on that. people who don't know, cdd provides dealerships like yours to deal with office operations like the paperwork that is electronic now to sell somebody a car. so, have you been told what caused this cyber attack and what is this happening? >> you know, we've really not had a ton of communication like that. and cdk i explained to everybody, they are doing the right thing by shutting the system down and making sure that they know what's going on. that's paramount that we have that protection. so, it is an inconvenience for us, but i think they are doing it right. you know, our tenants here at the dealership are trust, communication and transparency, i do trust cdk i think they are going to get this work out, it is a temporary inconvenience for us right now. but we're looking forward to getting back up and then hopefully there will be transparent -- they will be transparent on what happened and we'll all get back to business. >> it's a good reminder to have a contingency plan. we're so dependent on the software like this that cdk has been providing these dealerships, so many dealerships are affected by this. you told our team you are using forms that are 25 years old, which includes handwriting on all of them. so, everybody is having to sharpen the pencils. there you have it. there you have. how is morale with employees having to go back to old school? >> do you know what, i couldn't be more proud of our team. the attitudes have been great. our customers have been great. we are going to actually -- it's going to work out perfect, we are going to extend the sale next week so everybody will have time to come in, another week with the tent sale so we'll wrap it up at the end of june. everybody has been wonderful through the whole process, customers and employees. >> it's a good little emergency run through, if it happens again, have you a plan in place. we hope that cdk gets you back up and running so you can sell 11 more cars, right? you have to get that 100-goal done. >> we'll get it. >> love
