traveled further prosecution in the defense rested their cases. the first son will not take the witness stand. right now the court is about to reconvene after lunch break. we saw the family members filed back in. the president's brother james and also hunter biden's grown daughter naomi. closing arguments are set to begin in a few minutes. we will let you know as those things kind of unfold rapidly right now. the jury could get that case by the end of today or early tomorrow morning. this is "outnumbered" i am harris faulkner with emily compagno and kayleigh mcenany, host of "american dream home" on fox business. cheryl casone is with us. and "fox & friends" cohost lawrence jones is here. let's go catch up with what has been going inside that court room in wilmington, delaware. >> good afternoon. just about three or 4 minutes from now, it is the scheduled closing arguments for the prosecution and defense scheduled to begin here at the wilmington courthouse. that means that jerry could get this case later today or early tomorrow when deliberations could begin. typically when you got the closing arguments, the prosecution will go first allow client the defense. this morning, got off to a pretty slow start. much of conferring privately with a judge. the defense rested in the prosecution called a rebuttal witness. erica jensen was assigned the case last year to connect hunter's drug use to the time of that gun purchase after a sort session of questioning, the prosecution rested and here we are. two dozen family members and allies are here of hunter biden including first lady jill biden, jim biden, as uncle and hunter's wife melissa. hunter flashed him a big smile. allies at one point. overall has remained pretty serious. the jury will consider whether the prosecution proved beyond a reasonable doubt that hunter was a drug user when he bought and possessed a firearm and swore on the federal form that he was not a drug user. the defense maintains that no witness actually saw him use drugs during the period in october of 2018. if he is found guilty, he faces a maximum of five to ten years. he would be a first-time offender and a nonviolent one at that. this is his only court date in los angeles when the tax related charges trial began. we expect this trial should be coming to a conclusion soon. >> that's a good thing for hunter biden depending on how it goes. he has to get ready for what will be a much tougher trial for him in the court. thank you very much. let us know if they start to give jury instructions. i appreciate your time. this is gone by expeditiously faster than trump's trial. >> it would've been a lot faster if the federal judge didn't look over to the prosecution and say is there any precedent for this? both parties said there's no precedent. we are going to go to trial. you know, a lot of people have said that addiction problem is a real issue in the country. not everyone that has an addiction goes out and lives on a farm. the reason why this matters, your member of the crack epidemic back in the '80s. it wasn't treated as if it was an addiction at that time. they were aggressive. the chief architect of making sure people got behind bars in the crack academic was joe biden who was the author of the crime bill. when you hear liberal pundits that would go on tv and say he's being treated differently because he is a biden, i would say go talk to all the black man. some are my uncles who struggled with crack back in those days. they didn't get a sweetheart deal off very. they were locked up. they were not getting any type of treatment or anything like that. i think as we look at this and the political ramifications, this is hunter biden. also, joe biden once compassion for his son. he didn't show compassion for other people's sons then went to the criminal justice system. >> neither did his vice presidential pick. in california, she didn't have any problems with throwing people in jail or having these cases go against them as a former attorney general. >> i argue that that is even more draconian. that is in the car consequence for drug use. the consequence would be behavior while on drug use. that is labeled illegal. i appreciate your point so much. i want to take it in a different direction to make the point that other people as well do not have the luxury of having addiction soften the severity of their crimes. think about how many people made a horrible to drive drunk. and he did not been a fatality and get charged rightly so under our criminal justice system with manslaughter. you say that was a terrible decision and they didn't mean it. it resulted in a really bad consequence. then they go to prison. in north carolina, there are 300 people prosecuted for illegal possession of a firearm. part of these charges includes the fact that he was a drug user on drugs while in possession of the gun which is illegal. the point is you can't say i'm so sorry. i know you were in the throes of addiction. that's why these laws are in place. when we see people prosecuted for the same crime over and over again, they just don't have the first lady in the front row. i hope we see the same consequences. >> he used to work for the d.a.'s office, the very same one that adjudicated a case against donald trump. he said jill biden was taking notes where the jurors see her do that. we can't say when she was writing down. something that they can't do with the jury instructions in the state of new york. it is interesting how differently these cases are being handled. talk to me about the witnesses. i don't know if she's in the next -- at the time that she knew hunter biden. she testified he was doing crack every 20 minutes. >> i thought it was every 15 minutes. addiction has been a big part of the prosecution's case. i think you are correct and that the law will say whether or not you are an addict does not excuse you from abiding by this country's laws. the big question this morning's weather hunter was going to testify in his own defense. so much of the testimony was so about his behavior around the time of the gun purchase and the text messages that were happening while he made that gun purchase and tried to hide the gun purchase. the jury questionnaires, they talk about that they had friends, relatives. they were touched by addiction. at the end of the day, i think the prosecution -- i do think that the prosecution has a fairly strong case against sandra and the intimidation factor of having joe biden then the courtroom as a factor that only the jury can answer of how they feel about that. >> you called her and intimidation factor. >> i understand that you want to be there for your son. her son is facing 25 years maximum in prison. to have the first lady of the united states in front of these 12 average people has got to be intimidating. >> we talked about something that i kind of revisited today in my mind. that is, why not an anonymous jury at this point? >> we cannot anticipate israel to be warning ahead of a raid to extract or to save hostages. >> maybe reporters shouldn't try to play military strategists. >> the fundamental concept has been obliterated in this coverage. any uncomfort or discomfort or any anything is because of hamas. anyone who dies in gaza is because of hamas. anyone stuck there is because of hamas. israel has tried everything. they were the ones that were invaded by hamas. when they talk about innocent lives lost, let's talk about who exactly is holding those innocent people captive. i find defense as an american at the concept that israel somehow requires our comfort or our permission to do anything to get their people back. the last time i checked, the americans don't ask permission to get our people back. >> you have the associated press. this is really rich from them. they reported accurately last week. the health ministry as gaza health ministry which reports to hamas announces a new death toll for the war nearly every day. they go on to see as recently as march, 72% of the dead were women and children as underlying data shows the percentages well below that. we can't trust gaza health ministry. 48 hours later, they trust gaza health ministry. 274 palestinians were killed. >> this is fascinating it took them this long. you can't trust hamas' numbers. going back to the questions from the press. you notify the enemy before you go and rest to your hostages so they can kill everybody including the soldiers in special operations. it is asinine and stupid. don't expect anything less from the press. when it comes to hr hostage rescue, israel is one of the top organizations. right in front of them is the united states as well as delta force. the question should be to financial security advisor, why hasn't the president of the united states done the same thing for hostages? i don't remember. the answer is no. we know from trey yingst, our great reporting on the ground with our team there, we know that this was a refugee encampment inside of a city. some of them were high-rises. some of them were hamas families with ties to hamas. that is where they were. you are going into a civilian complex. they are using everybody as human shields. even their own people. they know the idf, the israeli defense forces going to comment and try and extract the hostages. it is the number one thing that biden has been saying. where is he today? traveled further prosecution in the defense rested their cases. the first son will not take the witness stand. right now the court is about to reconvene after lunch break. we saw the family members filed back in. the president's brother james and also hunter biden's grown daughter naomi. closing arguments are set to begin in a few minutes. we will let you know as those things kind of unfold rapidly right now. the jury could get that case by the end of today or early tomorrow morning. this is "outnumbered" i am harris faulkner with emily compagno and kayleigh mcenany, host of "american dream home" on fox business. cheryl casone is with us. and "fox & friends" cohost lawrence jones is here. let's go catch up with what has been going inside that court room in wilmington, delaware. >> good afternoon. just about three or 4 minutes from now, it is the scheduled closing arguments for the prosecution and defense scheduled to begin here at the wilmington courthouse. that means that jerry could get this case later today or early tomorrow when deliberations could begin. typically when you got the closing arguments, the prosecution will go first allow client the defense. this morning, got off to a pretty slow start. much of conferring privately with a judge. the defense rested in the prosecution called a rebuttal witness. erica jensen was assigned the case last year to connect hunter's drug use to the time of that gun purchase after a sort session of questioning, the prosecution rested and here we are. two dozen family members and allies are here of hunter biden including first lady jill biden, jim biden, as uncle and hunter's wife melissa. hunter flashed him a big smile. allies at one point. overall has remained pretty serious. the jury will consider whether the prosecution proved beyond a reasonable doubt that hunter was a drug user when he bought and possessed a firearm and swore on the federal form that he was not a drug user. the defense maintains that no witness actually saw him use drugs during the period in october of 2018. if he is found guilty, he faces a maximum of five to ten years. he would be a first-time offender and a nonviolent one at that. this is his only court date in los angeles when the tax related charges trial began. we expect this trial should be coming to a conclusion soon. >> that's a good thing for hunter biden depending on how it goes. he has to get ready for what will be a much tougher trial for him in the court. thank you very much. let us know if they start to give jury instructions. i appreciate your time. this is gone by expeditiously faster than trump's trial. >> it would've been a lot faster if the federal judge didn't look over to the prosecution and say is there any precedent for this? both parties said there's no precedent. we are going to go to trial. you know, a lot of people have said that addiction problem is a real issue in the country. not everyone that has an addiction goes out and lives on a farm. the reason why this matters, your member of the crack epidemic back in the '80s. it wasn't treated as if it was an addiction at that time. they were aggressive. the chief architect of making sure people got behind bars in the crack academic was joe biden who was the author of the crime bill. when you hear liberal pundits that would go on tv and say he's being treated differently because he is a biden, i would say go talk to all the black man. some are my uncles who struggled with crack back in those days. they didn't get a sweetheart deal off very. they were locked up. they were not getting any type of treatment or anything like that. i think as we look at this and the political ramifications, this is hunter biden. also, joe biden once compassion for his son. he didn't show compassion for other people's sons then went to the criminal justice system. >> neither did his vice presidential pick. in california, she didn't have any problems with throwing people in jail or having these cases go against them as a former attorney general. >> i argue that that is even more draconian. that is in the car consequence for drug use. the consequence would be behavior while on drug use. that is labeled illegal. i appreciate your point so much. i want to take it in a different direction to make the point that other people as well do not have the luxury of having addiction soften the severity of their crimes. think about how many people made a horrible to drive drunk. and he did not been a fatality and get charged rightly so under our criminal justice system with manslaughter. you say that was a terrible decision and they didn't mean it. it resulted in a really bad consequence. then they go to prison. in north carolina, there are 300 people prosecuted for illegal possession of a firearm. part of these charges includes the fact that he was a drug user on drugs while in possession of the gun which is illegal. the point is you can't say i'm so sorry. i know you were in the throes of addiction. that's why these laws are in place. when we see people prosecuted for the same crime over and over again, they just don't have the first lady in the front row. i hope we see the same consequences. >> he used to work for the d.a.'s office, the very same one that adjudicated a case against donald trump. he said jill biden was taking notes where the jurors see her do that. we can't say when she was writing down. something that they can't do with the jury instructions in the state of new york. it is interesting how differently these cases are being handled. talk to me about the witnesses. i don't know if she's in the next -- at the time that she knew hunter biden. she testified he was doing crack every 20 minutes. >> i thought it was every 15 minutes. addiction has been a big part of the prosecution's case. i think you are correct and that the law will say whether or not you are an addict does not excuse you from abiding by this country's laws. the big question this morning's weather hunter was going to testify in his own defense. so much of the testimony was so about his behavior around the time of the gun purchase and the text messages that were happening while he made that gun purchase and tried to hide the gun purchase. the jury questionnaires, they talk about that they had friends, relatives. they were touched by addiction. at the end of the day, i think the prosecution -- i do think that the prosecution has a fairly strong case against sandra and the intimidation factor of having joe biden then the courtroom as a factor that only the jury can answer of how they feel about that. >> you called her and intimidation factor. >> i understand that you want to be there for your son. her son is facing 25 years maximum in prison. to have the first lady of the united states in front of these 12 average people has got to be intimidating. >> we talked about something that i kind of revisited today in my mind. that is, why not an anonymous jury at this point? we don't need to know their names and all that. we know quite a bit about them. >> that is a great point that paul morrow brought up. it makes a lot of sense when you have the big political names. maybe that would have been the answer for donald trump. it is so important. this is not about addiction. it simply is not. a liberal on msnbc save the disease that hunter biden has is the same disease that i have in the same disease that almost 20% of the country has. this isn't about addiction. the left is trying to make it about that. for the sake of his family, this is about accountability. this is about whether he will face the fate that donald trump did where it was unprecedented in the case of trump. the facts of the case are strong. the fact smacks the law. he has a favorite son of delaware as noted by "the wall street journal." when accountability happened here?
