that bond he must post. the former president on truth social saying that he will post the amount set by the appellate division in the last hour. in a statement from the 5-judge panel, basically cutting down the bond that the former president must put up by more than 60%. as you know and we have been reporting, new york state attorney general letitia james had been ordered basically to potentially start enforcing that $454 million bond. that amount, set by judge arthur engoron in the real estate fraud trial. that the appellate court has cut that down to $175 million if the former president puts that up in the next ten days, and we've heard the former president through his truth social post say that he will indeed do that. there are other defeats for attorney general james in this decision also. the judge had ruled that the former president cannot do business in new york state, and trump executives are barred from doing business. the appellate court judge has also struck that down, so this morning a major victory for former president trump from the appellate court. we do expect that he will be able to post that $175 million bond. that means that attorney general james will not be able and will not move forward to try and seize any of trump's properties or any of his cash and other assets in order to try and satisfy that $454 million bond. he does not have to do that now. if he puts up that $175 million, which we do expect. it's a bit of a different story in the manhattan criminal court behind me dealing with the hush money trial, dealing with stormy daniels, mr. trump charged with 34 cans of business fraud, basically, for allegedly funneling money to the porn star through his former fixer, michael cohen. his attorneys are seeking to again delay this criminal trial once again, but it seems like the judge is not having any of that. the issue this morning has to do with the hundreds of thousands of pages, a hundred thousand or so, that the defense turned over to the state dealing with michael cohen, but the judge says only a few hundred and does not know why the defense has not been able to comb through that over the last few weeks. the judge did delay this trial until april 15th. the feeling here at court right now, harris, is that the hush money trial will likely go on on april 15th, that the judge here will not grant another delay, but we don't have that yet. we will have to see what happens. >> harris: there is so much going on. >> bottom line, a big win for the former president. >> harris: i appreciate you breaking it down. we need to hear about -- many, as well, delayed until april 15th, and we will obviously cover everything that comes out. but that big news this hour is the drop in bond, and we will get to that. you are watching "outnumbered" now. i'm here with my cohost, emily compagno and kayleigh mcenany. also joining us, rebecca heinrichs, and cohost of "the bottom line" on fox business and former wisconsin congressman, sean duffy. great to have everybody here. here's a former president, donald trump, from moments ago. >> [indistinct] >> thank you very much. judge engoron has done a terrible service to the state of new york. what he has done is terrible. businesses are fleeing. just released a statement on truth. businesses are fleeing and crime is flourishing all over the state, and what he has done is such a disservice and should never be allowed to happen again. new york state is being battered by his decision. so i greatly respect the decision of the appellate division, and i will post $175 million in cash and bonds for security or whatever is necessary, very quickly, within the ten days. i think the appellate division are acting quickly, but judge engoron is a disgrace to this country, and this should not be allowed to happen. thank you very much. >> harris: and you hurt a shattered question, we've shown a little bit of that. this was just moments after the decision. this is the fifth time in this case that he has been overturned, a record. his credibility and that of letitia james has been shattered. we will abide by the decision of the appellate division and post either a bond, equivalent securities, or cash. this also shows how ridiculous and outrageous the initial decision was at $450 million. i did nothing wrong, and new york should never be put in a position like this again." so that was truth social, and there's more now because he's posted a couple times. i won't go on too long, but judge engoron as may decision relative to the statute of limitations. this is a confrontation between a judge and those that rule above him, a very bad situation in which to place new york state and the rule of law." kayleigh? >> kayleigh: we have gone over and over and i've been beating a dead horse, that is unprecedented cases. premium is on it presumablyanalyses that ld respect, right? but with each of these cases, they continue to be overturned either in whole or in part. now you have this judgment being reduced. i agree with jonathan turley, it should be zero, nevertheless being reduced. you go down to georgia, fani willis, constant overreach. i encourage viewers to ask yourself, why do you see constant overreach? the only answer you can get to it that these are partisan left-wing actors in the form of letitia james and alvin bragg, and the list goes on. >> harris: sean, i had a different epiphany during the last hour. it's an election year for an incumbent president, so i get it, it is politics. but what are these other people being promised? you got letitia james, attorney general of new york. he would say, arguably, with some things to lose. she is out there gabbin', "going to get trumped." it's not fair in our legal and justice system to behave that way. >> sean: that's a good point, it's not fair, but letitia james is playing to her audience. you have a left-wing political base in new york city, and she won on the fact that she promised to go after donald trump. that was a polygamist. >> harris: but she's still talking x neck >> sean: she delivered on that promise and new yorkers still love it. to the point of $175 million, donald trump, that the win for him. it is still a massive amount of money. what they have done is preserved donald trump's right to appeal by lowering the bond to what he can actually meet. but they are preserving the democrat party. if letitia james was out seizing donald trump's properties, it is over for democrats. i think most americans see the war that has been waged on donald trump, whether in georgia or new york or in florida, washington, d.c. they look at this and go, to kayleigh's point, this is way too much. who does this to the lead presidential candidate? and, by the way, charges we have never seen, victims that aren't there. what the hell are you doing? >> harris: that bond doesn't absolve them from being that hungry, that they stay. it doesn't wipe them away. >> sean: no, it doesn't. but the war on trump is just clouded a little bit, it's going to go to appeal and forestall the inevitable, which again is going to be a massive payout that donald trump is going to have to make in a city that is more about politics and business. >> harris: emily, we showed a little while ago the big trump tower sign on fifth avenue. it's iconic. what does this mean now that james won't be able to rip down the letters of trump tyler? >> emily: at least for a moment i feel that there is -- i don't know, a slight reach toward faith, temporarily in the justice system, or at least it is not as tainted as this whole thing has appeared from the beginning. i would like to carry your ball further and point out how much people in power bend and sway to it they perceive as pressure from those left libs. i want to talk about the chubb ceo. according to their attorneys, chubb was potentially going to underwrite the second bond for them. they would accept liquid assets, real property. where it got, apparently come to the brokers and investors and their customers. cut to the chubb ceo writing a letter to everyone, "i'm so sorry," the typical narrative where, once again, the uproar that ensued from them just being part of, as he said, the plumbing of the criminal justice system. he said, we don't play a part. if we put up bonds, we are not rooting for the defendant. essentially money has no color, money has no side type thing. but oh, lo and behold, he too pulled out because the pressure was too great. what concerns me, as we go into the voting in november, just remember that the people in power are making these decisions because of that pressure, the war on trump. it's the people that have the power ultimately. it is us at the voting booth. please vote that way. >> harris: i said it earlier, rebeccah. people should be angry about the fact that this has been handled in such an unfair way. >> rebeccah: i keep coming back to this idea of, you've got people who are maybe not necessarily sold on donald trump, they've been flagging in their support, and you have this happen and all of a sudden you are galvanizing even the most skeptical people who maybe have voted and supported president trump previously, have gotten tired of all the drama and say, wait a second, this is about the rule of law. this is about laws being applied fairly, and the punishment fitting the crime. i do national security policy, the average american, not a lawyer. so i wanted to know how unprecedented was this money, this amount of money that he was expected to pay. bit coin fraudster sam bankman-fried's bail was $250 million. notorious ponzi schemer bernie made office was set for $10 million. and these were people who had victims and their crimes. so we know that this is because he's running for president, donald trump is running for president, and it signals, as long as you don't go after the democratic machine, you're not going to have a huge penance. >> harris: it makes me think of new york city as somewhat a barrel of crabs. he's going to make it out? they didn't want him to be the one to make it out. the democrats wanted to be the ones on top. letitia james, the attorney general, who said she wanted to get trump, her office has responded to the reduced bond. here's the quote. >> emily: "what is your collateral on the bond?" >> harris: and he turned quickly on his heels and said "cash." there were two things going on and i know our screen was a little confusing at the bottom. the first thing was that he was coming out of the courtroom because the hush money trial has been set, and jury selection begins now on april 15th. so that was the first thing that we scrolled on the bottom. those were his first comments that he was making out of the hush money trial. we will get to that first. emily? i don't know. and he said they were chanting her name at some point so maybe -- to that with "cri "criminale?" i don't know. i speak no spanish but i heard that part. that's problematic for a woman he wants to hold the redline against israel. >> it seems she's always one step behind, including addressing the southern border of which she is apparently our czar. but she continues to blame the g.o.p. for the border crisis. let's look. >> i think most americans are clearly of a broken immigration system and we need to fix it. members of the united states senate, those considered to be very conservative, when it came to a bipartisan resolution. but they are refusing to put it up for a vote. in large part because, we know, the former president would prefer to run on a problem instead of fix a problem. >> as of right now, as the executive action still on the table? could we see that? >> that does not absolve the fact that the real fix is going to be when congress acts. >> kayleigh: i think exactly what she said is mirrored in the reporting out today. i think the bite in the administration is in tough spot. both politico and axios came out with pieces that basically said biden was on the verge of taking executive action. in fact, politico went so far to say the president was announcing a string of moves and he did not. both pieces however say that the executive action is on the table. so what happened is the problem at the border, while still there, while still unprecedented, while the numbers are still high, it subsided seasonally. so they are leading these executive actions, kind of in the tank, and they are ready to deploy them in the months to come. so they have the power but they're still trying to blame it on the g.o.p. very mixed messaging, and i think the american public sees the images and says, fix this. >> emily: right, and they recognize the power. heretofore, they've been saying they've been failing. >> rebeccah: and she is the border czar. this is supposed to be her main issue is vice president that she is supposed to be addressing and she continues to shark responsibility, blame the g.o.p. when there's executive action that the said administration can take. i want to get back that puerto rico thing. i actually didn't think that kamala should be embarrassed by this. i think the democratic party should be very worried and embarrassed. these protesters, she went all the way to puerto rico and there are still pro-hamas protesters in puerto rico. she can't even get away from it. the democratic party has a serious problem with this left wing that is still giving it administration -- they are calling her a war criminal, burning the american flag in the street. >> harris: that was the word i heard. i don't speak any spanish. >> rebeccah: again, to harris' point, it's surprising her, she still shocked by it, the democratic party doesn't understand the significant problem they have trying to continue to support israel as it goes into rossa to get the remainder of this hamas stronghold. >> sean: i think this is an indictment on the media. you have a media that will allow kamala harris to try to blame the border on republicans and a bill that would never secure the border, when joe biden signed 94 executive orders to undo donald trump's border security policy, which has now given us 50 million illegals that have come into the country. in the media doesn't go, hold on a second, i know about the republicans not wanting to push this nonborder security bill, but you signed 94 executive orders, mr. president. opening up the border. they never called him out to give this message to the american people. >> harris: and you are surprised by that? [applause] my point is -- look, you are still building your politics around slicing and dicing people into these fixed categories. democrats need to get the memo that you can't win elections anymore by automatically assuming you are going to get every voter who is not these guys. the more you obsess over identity, the more you ignore the bread and butter issues that win and lose elections. >> kayleigh: rebeccah, we know it's been a strategy of the democratic party to vulcanized society into groups. i can't believe you're not segregating kidnapping. i thought we would show our viewers, here's the ebony and feather alerts to which bill maher is referring. >> rebeccah: he is right, it's not working, so it is in earning the democratic votes they want. it's also just so divisive. it is a pernicious ideology that divides everybody up into these little groups, and then presupposes that they know the way you think because of the color of your skin, because you are a woman, because you are a mom. he's exactly right. when he's right, he's really right, and when he's wrong, he's really wrong. on this point, he's completely right. i hope, maybe -- i am an optimistic person -- that we will get to the end of this identity politics. because it is especially bad, not just for the partisan purposes of it all, it's really bad for the country. >> kayleigh: it doesn't seem to be working for the left. look at latino voters. you saw trump winning, by 16 points. this was a group joe biden previously won by 23 points. 33, i should say. then he moved over to black voters and biden won by 75 points. now that margin is 43 points. so it is just not working, what they are doing. >> harris: it's offensive. we already know this president thinks that black people are monolithic, that hispanic people have many different individualities about them. he actually said that, and of course he had to walk it b back. whatever the decision is about compartmentalizing groups of people based on hair texture and skin color and first language, that sort of thing, i guess when it stops working for them, rebeccah, is when they will stop doing it. i don't know that'll stop working. we will have to see this election cycle, because this is the first time we have seen a democrat drop this type of, in the lanes they identify, making the most popular, this precipitously. so we will have to see, is that enough to get people to say you are not the guy we want anymore, we don't just want to be identified that way? >> kayleigh: and james carville is another democratic seems to be sounding the alarm bells constantly. he didn't interview with "the new york times" and he said this, that there's also a problem with men in the democratic party. "a suspicion of mine is that there are too many preachy females." i don't know if i agree with its description, but nothing less." "the message is too feminine. everything you are doing is destroying the planet. you got to eat your peas. if you listen to democratic elites, the whole talk is about how women and women of color are going to decide this election."
