"new york post" dubbing it an onslaught. >> jacque: there was a new york reporter who witnessed it. griff jenkins key white house. let's go to nate foye in eagle pass. >> good morning. so far at least one migrant is charged with assaulting a texas national guard soldier after a group of over 300 migrants, many single adult men from venezuela, pushed past the national guardsmen and rushed the border wall in el paso. take another look. [shouting] >> the migrant charged with assault is accused of pushing the texas national guard soldier down and trampling over him. texas governor abbott says texas dps may arrest more for criminal trespass and destruction of property. hundreds of migrants after this chaos, including women and children in total over 600 migrants here, governor abbott's office says the surge in el paso is the direct result of the unsustainable chaos president biden has unleashed on the border. it happened, jacque, has texas awaits an appeals court ruling to determine the immediate future of senate bill four to allow texas to arrest and deport migrants without turning them over to border patrol. if sb4 could have been used on the migrants in that video. congresswomans could par represents el paso and points the blame elsewhere writing texas national guard are not trained to process migrants and their presence impedes federal law enforcement. all this while illegal crossings in texas are actually down but skyrocketing in america's west. send it back to you. >> jacque: nate foye, thank you so much. >> dana: a texas reporter witnessed the whole thing. what did you see and have you talk about it. listen here. [shouting] >> dana: the video is very dramatic in the watching of it. what was it like to see it firsthand? >> that happened so fast. you had a group of 600 migrants that were all seemingly very calm for, you know, 30 minutes that we were there, maybe an hour. then all of a sudden the texas national guard began to take the separated groups, 300 single adults, 300 families and children and women on the other side. those people were going to be taken for processing, that was their priority. the single adults were taken into small groups back to mexico. they realized that was their fate and it just within a matter of seconds became absolute chaos as you showed in that clip. they took over the national guard there. they totally dominated all of their resources, which were very little. there were only a few guardsmen down there. they were running past the razor wire. they breached that. they breached the national guard physical bodily boundary they had created and then they made their way up to the wall where they were pleading to get into the country. that is what they were hoping to get. i think the promise of that and realizing they weren't going to get that because of what texas had done there was very upsetting to them. they decided to just cause chaos. >> dana: do you know if any of them make it into the interior of the united states? >> yes, many of these people did get processed by border patrol under title eight, which is what is typically used for what we know as catch and release. these are people mainly released into the country. so this sends a message to people around the world that even if you act like this, you can probably get into the country and i think they continue to push these boundaries and see what they can get away with. here they got away with some really, really scary stuff. you know, assaulting -- appeared to be assaulting some of the national guardsmen. it was totally out of control. >> dana: have you had a chance to talk to any of those national guardsmen and what they are thinking? >> i do talk to members of the texas national guard in the area. and they said they are trying to be really supportive of each other right now because they feel totally overwhelmed. just as other authorities dealing with this are. border patrol, the state dps. this is the situation they're in. when it is the federal authorities especially, they feel like the people in washington that are in charge of their agencies don't have their backs in this situation. a lot of the border patrol agents i talk to took me back to the september 2021 horse patrol unit where they were accused of whipping migrants. we know that narrative totally blew up in the media's face. it wasn't the case at all. they weren't whipping migrants and their own agency said that after an investigation. everyone was against them in that moment and that's how these people feel. >> dana: border encounter numbers in el paso sector over the past three years it really went up. it is down a little bit year-to-date for 2024, 96,000. do you think -- is that number likely to go up or down based on this legal wrangling between texas and the biden administration? >> i think we're starting to see that spring surge as the weather gets better and realize sb4 to allow state and local authorities to make arrests for illegal entry isn't going into play right now and it is still in legal limbo. they know these things. cartels are very smart. they see that they can get away with these things and get into the country. we saw just a few months ago jose ibarra came through this area and got processed and released. he wasn't a gotaway. this is one person. we have a few days ago a person who said they were a hezbollah terrorist. we confirmed they were on the terror watch list. but that didn't happen until six days after this person said they were on the watch list. it is possible they could have been released into the country as well had they not told authorities they were a terrorist. this is what we are dealing with. a lot more criminal elements coming through and a spring surge. >> dana: just tell me about the people there who live in el paso. a thriving american city. a lot of businesses down there. are they worried about the state of things right there at the border? federal judge in illinois ruling that a federal law banning illegal immigrants from owning guns. guess what? they think it's unconstitutional? william la jeunesse is live from los angeles to explain. >> this ruling totally upends existing law which says illegal immigrants cannot legally buy or own a gun. the case involves the man you are seeing here, an illegal immi immigrant. he was charged with illegal possession because of his immigration status. his lawyer fought the charge saying he needed the gun for self-defense. federal judge appointed by president obama agreed dismissing the case writing quote, the non-citizen possession statute violates the second amendment as applied to flores. >> he notes that's the reason that this individual has a firearm because of the neighborhood they live in. because of the need for self-protection, protection of home. >> the judge refers to a 2022 supreme court decision that found cities and states can limit but not deny an individual's right to own a gun. however, that ruling did not exempt felons or other prohibited buyers. under a 1968 law those here illegally or unlawfully cannot possess a gun and the federal background checks specifically ask buyers if they are a u.s. citizen or lawful resident or if they are here as an alien here illegally. if so, they can't buy the gun. experts tell us the new ruling could create a nightmare for police. the law saying one thing. federal judge something else. >> it throws a grenade of firearms enforcement. a nightmare for law enforcement to try to go after people who illegally possess firearms. >> most expect the u.s. attorney to appeal. no word from the d.o.j. on what new legal guidance it gives the a.t.f. and f.b.i. that enforce gun laws. >> dana: thank you. >> jacque: new york attorney general james might be setting her sights on several properties owned by donald trump taking her first step toward possibly seizing some of the former president's assets in westchester county as he faces a monday deadline to post a $454 million bond in the civil fraud penalty against him. joining us now is former federal prosecutor. thank you for being here. this is just wild. is there no court in your mind or any legal recourse? this is all pre-appeals, right? is there any recourse the former president has at this point in your mind? >> the president has filed and appeal to stay the proceedings or stay the forfeiture, the judgment in this case. he has made a strong case. i have dug deep into the appeal he has filed with the court and i think the court needs to respond today or at least by monday so the nation doesn't continue to hang on a thread on this issue. the appeal actually lays out that the new york statute allows for the appellate court to make exceptions in order to stay the judgment. they go through in detail essentially other cases where that's happened. they talk about the likelihood of victory in this case going through the issues at the trial court level and bring up the eighth amendment which is particularly ripe in this case. there is no precedent for any type of fine or other type of judgment of this sort. so i think the appeal is very strong and if the appellate court wants to maintain their credibility they need to come out with a ruling today. no later than midday monday. >> dana: i want to ask you about this. president trump said this morning on truth social he is very close to having the money. i think in the post he says $5 hundred million. i might be able to come up with the cash. leticia james is saying she has her eyes on trump tower on 40 wall street. this is from trump's response to the illegal bond demand. saying it would be completely illogical and the definition of an unconstitutional excessive fine and taking to require defendants to sell properties at all especially in a fire sale in order to be able to appeal the lawless supreme court judgment as it would cause harm that cannot be repaired once the defendants win as is likely on appeal. maybe the court doesn't care about this. as i understand from judge janine this is not something a private company or proverb at individual in terms of this kind of fine. maybe for a public company to raise this kind of money. will that weigh on the court's thinking at all? >> it will weigh on the court's thinking. in the appeal, the trump team actually goes through in detail other cases that are similar in nature in terms of where there was sufficient funds but perhaps held in different ways. or where the judgment itself seemed to be out of line with what the capabilities were in order to post that bond. so what leticia james is doing now is pushing the law beyond what it is meant for. it is written to allow for exceptions. he has the assets if the appellate courts were to rule in the state's favor here. but where it's not held in cash. donald trump certainly working hard for this to actually come up with the half a billion dollars in cash or the amount of cash necessary for the bond. but when you look at his real estate holdings, it shows that he isn't a threat in terms of not being able to fulfill the judgment in this case. his team has put that in the appeal. it is i think very solid and, of course, we can't forget about the eighth amendment consideration which say that you can't have fines that are excessive and the supreme court has gotten deep into that essentially ruling in the past that judgments that are in excess of multiples of this sort simply are just not constitutional. >> dana: thank bag and stole her car to get away. alexis mcadams is following this wild story for us. >> this is a horrendous situation for this person's family. grieving and this morning both squatters are on the run last spotted in pennsylvania. the duo killed the woman and took off in her car. the 52-year-old woman's body was in a closet stuffed in a duffel bag. flew from spain to new york city to prepare the apartment for a family friend. it was supposed to be vac ants for months after her mom died not too long ago. inside a man and woman who haven't been identified by police attacked her and threw her into a sheetrock wall according to reports. police say she had multiple facial fractures and broken ribs. she died from blunt force trauma to the head. >> scary when something like this happens. you always expect it to happen somewhere else and not in your neighborhood. >> police are searching for the squatters. the search has turned to pennsylvania after investigators found her car crashed in the area. the pair also reportedly were caught on surveillance video trying to go to all dees and different car dealerships trying to buy a new car to be on the run. the apartment where she was killed has no front door. you use the key to take the elevator to access the unit. police are trying to figure out how the squatters ever got inside in the first place. jacque. a california middle schooler beaten by another girl at school. days earlier a missouri teen's skull was fractured with a fight with another girl. taylor rigs joins us now. the three of us think we know there could be mean girls but this feels like a whole new level. >> a whole new level. violence is obviously very unfortunate. for me it's a symptom of a broader problem. to me a breakdown in nuclear family units. kids aren't being held accountable by parents. watching violent behavior at home. families aren't meeting to sit down at dinner together at night to talk about things. kids are being bullied at school and probably not reporting it to parents. all of this comes down to a breakdown of a nuclear family unit. we don't have in this country or feels ever more elusive. interesting when it comes to school violence i read a report in the buffalo school district. they gone away from wanting off duty police officers in 2021 to be on campus and now calling for that to come back. one solution is can you have off duty police officers come back and help monitor. what i don't understand is the video recording instead of coming in and stepping in to help some of these victims, that's a cultural younger generation, things i don't think we understand. >> jacque: another element. in the missouri case the family of the girl charged in the beating, she is claiming she was the actual victim. a daily mail headline missouri teen charged with bashing the head. an honor roll student defending herself. the gofundme account was taken down from the platform. against raising money in defense of an alleged violent crime. you watch the video. good news about all these videos is we have everything on camera, self-defense only goes so far. once the threat is eliminated it is not self-defense. you become the attacker. i think the video evidence will show everything that you need. self-defense only goes to a point. >> dana: i know fox business you talk about office culture and what's happening. we're all very interested in what's happening between the generations. gen z reported by linkedin research, one in five gen z workers say they have not talked to someone over the age of 50 in a year. they don't know -- 17% say they don't know how to approach colleagues from different generations. what's happening? >> this is wild. you have this whole group of young generation. i don't know if it was covid that took them out of the face-to-face environment or as they enter the workforce they're more nervous. i'm a huge proponent on working in an actual office part-time and not being fully remote. you have students, young workers who come in and they have anxiety. they are reporting anxiety by just picking up the phone. reporting anxiety if you are on a zoom call or zoom meeting with a boss or teacher they are asking you to turn their camera on and they say no, it gives me mental anxiety. people have an inability to engage with society. thankfully there are a lot of exceptions to the rule. we all know a lot of young people that are able to do that. the good news for that group is you can really do bare minimum and get ahead. this older generation just needs a few people to come in, go all your devices today. >> dana: fishermen looking to sink a plan by the biden administration to create more off shore wind energy. a dozen fishing groups are warning the plan to turn millions of acres into a wind farm off maine will devastate their livelihoods and marine life and would it even create that much energy? lydia hu from fox business has the story for us. >> it's interesting here is that we're told that fishermen don't usually get along with each other. but plans to use 2 million acres of land in the gulf of maine for a wind farm are uniting all of them in outage. the bureau of ocean energy management announced the plans for an off shore energy site in the gulf of maine and it is becoming 23 and 92 miles off the coast and 80% smaller than planned. they scaled back after consulting with fishing groups. the entire 2 million acres would not be used. the plan is for smaller areas inside this territory to eventually be leased. still, a group of 17 fishermen groups are alarmed and concerned about the economic and environmental impact. they said in a statement the government's plan is quote the rushed development process that the poorly informed of economic, scientific, environmental and cultural issues of paramount importance. they are concerned about lobsters, haddock and whales. one fishermen raising concerns about the eel population. he said eels are the most valuable fish in the united states and migrate through this particular area. watch. >> what happens if a seismic boat goes through a school and kills a couple of whales? or dolphins and wipe out a whole class of fish and they don't come back and don't spawn? >> the recent cancellation of off shore wind projects off new jersey and the economic viability of wind farms. the cove behind those said high interest plates and inadequate tax credits were to blame for the cancellation. public commentary on this government's plan for the gulf of maine starts monday. >> dana: thank you for the sympathize with this cause and have been following it for awhile. your organization is raising the alarm about the impacts that this president's proposals would have on the economy and also on the environment. but looking back even just a couple of years, the lobster population, shrimp population in the area has been declining. is your concern that the wind farms would contribute to that even more? >> yes, that's exactly what we're saying. the fact of the matter is we don't have enough data to have even -- we don't even know the exact cause of emf on herron stocks. if we stop these species from migrating to breed there goes sustainability of food security. even the indigenous depended on this and we're putting them at risk now for nonsense. >> jacque: it's the area in green on your screen where the wind energy area would be put in. jerry, do your fishermen often go out that far? it's pretty deep water out there. also given the warming waters in the last couple of years and you had the young lobster population dropping off by some 40% in shallower water. it was a report that came out in october. sort of expectations a lot are moving into deeper water. do you guys go out that far? >> oh yeah, we go all the way out to the georgia's banks. there are people out there right now today. we have lobstermen on the east side of that area. southern area of that wind en energy -- its pivotal for many types of fish. it is a pivotal staple due to the all occasion issues. now when we push these fellows out of these areas, you know, you will have more competing interests which will have a direct impact on the natural resources. when you control an area it's not good for any environment. when you start to restrain this, it will be a big problem. >> what kind of recourse do you have? you have been up against the last couple years environmental restrictions and effects on your industry and now potentially this as well. what will it do to the maine economy, to your business? >> oh, it will cripple us. it will cripple us. because of the allocation issues. now that we have these restrictions you'll force guys out of ecological areas that are the backbone and staple of our communities. now you are forcing guys to go into areas to compete. now everybody is catching the same stock resource. now we have market issues will have direct impacts to the economy of all wild harvesters. competing interest on areas, again it will be conflicts. it will be destruction. right now we just don't have enough data to -- like i said, we already know that the lobsters are going to have direct impact just from the emf fields. we know they will have an effect on the haddock. those are the staples of the new england economy. >> jacque: hopefully the biden administration will hear law enforcement. appears this escapee and accomplice did a lot more damage during the 36 hours on the run. they were captured in twin falls, idaho after a short pursuit with no shots fired. they were in a stolen car. the owner of that car was found dead wednesday night, night before. a second murder victim was discovered in a different county. police believe they're connected to the prison escapee
