>> julie: we'll start with off with hundreds of thousands of people illegally crossing our borders each month. the crisis causing a major political divide draining city and federal resources and worst of all, putting americans at grave risk. this is the "the faulkner focus." i'm julie banderas in for harris today. thank you for joining me. president biden's border failure on full display as the high-profile migrant crime cases pile up. the brutal assault on two nypd officers in january. the murder of georgia nursing student laken railey late last month and last week alone massachusetts authorities charged a haitian immigrant with the rape of a 15-year-old disabled girl. the white house admitting he entered the u.s. under a controversial asylum program. the attack allegedly happening in a hotel where he was staying on, you guessed it, your taxpayer dime. a guatemalan was freed after ten months in custody accused of killing a veteran florida cop who died of a heart attack after a scuffle. a judge declared the suspect incompetent for trial because he didn't speak english. after the case was tossed, he nodded and smiled on his way out of a police facility a free man. in texas, local, state and federal authorities teaming up to arrest one of columbia's most wanted man. a venezuelan gang member wanted for murder, drug trafficking and extortion. he crossed the border near eagle pass just in january. and the border crisis is also a top issue as the election approaches. >> they are counting illegal immigrants in their census. purely political. he is willing to trade the safety of american, terrorism, drugs, other crimes, he is willing to -- he being joe biden willing to trade all of that to get more democratic votes. it is not new laws that we need. you put the republicans in charge and what we'll get is we'll be able to defund the things that the democrats have been doing. the flights into the united states, the things that is enticing illegal immigrants to come here. the free food, free hotels, free money. that will come to a screeching halt if we have donald trump. >> julie: garrett tenney joins us in eagle pass, texas with the latest. what a mess. >> what's notable about the venezuelan man on columbia's most wanted list. he crossed the border a week before texas came in and took over shell be park and locked down the border here. that was in order to prevent those exact kind of people from being allowed into the country. today texas officials are waiting to find out if the supreme court is going to let them start enforcing their new law, sb4, which would allow them to arrest, charge, and potentially deport anyone they see crossing the border. in the case of that venezuelan man, rather than border patrol releasing him into the country in line with the current immigration policies, texas would be able to keep him in custody until all the proper background checks are completed. texas dps says the new law would give them another tool to deter folks from crossing the border illegally. >> we're going to make it as difficult as possible to cross unlawfully into texas. we wanant to push that activity elsewhere further west and why we're seeing it. i think our status is clear with all the barriers, consequences that we have in place, all the manpower is that don't cross into texas because if you do, then you will be arrested and prosecuted. >> law enforcement officials say the new law would help them crack down on human smuggling operations by arresting not only the drivers but also the illegal immigrants who are paying to be brought into the country like this recent high speed chase in where a cartel member was flying down the interstate with six illegal immigrants. after he was run off the road troopers could only charge the driver under current law and had to turn the illegal immigrants to border patrol where they are more easily released into the country. in the last three years texas on its own has apprehended more than half a million people. that is 500,000 people who otherwise would have become gotaways and gotten into the country. julie. >> julie: thank you so much. matt gorman, vice president of targeted victory and former senior advisor to tim scott joins me now and fred hicks founder and president of the hicks evaluation group. thank you for talking to us. this is such a growing crisis. not only weighing heavily on the local law enforcement which is already as you both know stopped as it is fighting the ride in crime on the streets committed by americans. they shouldn't have to be dealing with the burn of having to police our illegal immigration issue as well. if they don't, who will? the biden administration can't obviously. they have proven that. today texas officials are waiting on word from the u.s. supreme court. maybe they can weigh in whether it is controversy all sb4 law will be allowed to go into effect? what do you think is going to happen here? >> yeah, i think first of all this is why we're seeing immigration now rising either at or above the economy as you pointed out when it comes to top issues in november. look, i walked senator tim scott and went to yuma where there is a break in the border wall. you see how the strained services, hospitals, police as you said and budgets. also what i noticed is i was talking with a county supervisor, 20 feet before folks crossed over by the wall, you see i.d.s littered and clothes and shoes littered. they don't want i.d.s. harder to track and they also think they will get better shoes, better clothes when they come over so they ditch it. it is a crisis at every level. >> julie: the sb4 law is going to basically allow if it's taken into effect, state and local law enforcement will have the ability to arrest, charge and potentially deport anyone caught crossing the border. texas dps said it would allow them to arrest and deport the illegal immigrants like the ones we just found, we just talked about moments ago. haitian immigrant charged with raping a disabled 15-year-old girl. guatemalan migrant was seen grinning after being released from jail because a judge ordered that that person was incompetent because he did not speak english and now he has a smile on his face as he walks away free and also the venezuelan gang member arrested in san antonio last week who was on the columbia national police most wanted list for murder, drug trafficking and extortion. these are the peoplele the bide administration is inviting into our country in order to join the census and eventually vote for democrats like biden to get back into office. >> i think that's a pretty gross mischaracterization of the why it is happening. it was conducted in 2020 when donald trump was president and set the terms and conditions. the next census is not until 2030. neither joe biden or donald trump would be -- >> julie: democrats are trying to get back in on these votes. >> 2030 you have a new president whether-whoever wins this year. that's number one. number two, the biden administration and democrats recognize illegal immigration is a problem. that's why they passed the bill in the senate with bipartisan support that the house republicans then rejected because they tried to make -- trying to make this an election-ier issue. once republicans really decide to put personal lives over political points. pass the bill. that bill the administration put forth. senate republicans supported provided additional supports to the border patrol and tightened up the border as well as addressing a number of the issues here. it is disingenuous that people talk about this without taking steps forward to make things happen. >> julie: let's look at how minorities view this. the legal ones. less than eight months until the election and the left seems to have a minority voter problem. washington examner board says democrats are losing ground with the once dependable voting block pin it on things like sky high food prices, outrageous rent and mortgages and record credit card debt. the piece also points out most black voters want more spending on police not less. and most latinos prefer a secure border. now the latest numbers show the president's support collapsing, 63% support among black voters verse you 87% back in 2020. more polls show trump winning the latino vote. the former president with 46% compared to president biden's 40. and former attorney general eric holder was asked about the dismal numbers and the difference in support between biden and his former boss barack obama and, well, here is him deflecting. >> you are measuring march against november? you are comparing an extremely popular african-american running for the first time and galvanized people in all strata of life. in some ways it is not a fair compareson. we should not be too alarmed by the march polls. take them into consideration. march is a different month than october and november. well we'll see where it turns out at that point in the calendar year. julie: on behalf of the african-american community and latino community. latinos are disgusted what is going on with the border. legal immigrants here in the country do not want to see the illegals coming in and taking advantage of taxpayer dollars that those legal latinos worked so hard to get into this country and legally pay their taxes. what say you on the biden administration and democrats as a whole loosing the minorities and latinos because of this illegal immigration problem. >> right now african-american voters large swath are unhappy with various points of the administration. reality is also that when it comes time to vote, the african-american voters have company lessed around the president. we saw in south carolina high numbers. matt is from south carolina worked with senator scott there. president biden did very well there. we had the georgia primary last week and president biden received 95% of the democratic vote. president trump only received 84% of the republican support. so there are polls and what's happening at the polls and what we see where people go to vote at the polls, is that president biden is doing very well including with african-american voters. there is a long way to go and a lot of issues that still need to be addressed for sure. but one of the best things that democrats have going for us is donald trump. when he talks about there will be a bloodbath if he doesn't win in november making the threats he did ahead of january 6th is alarming to people. not just african-americans but americans people. that's not what we do. >> julie: at the big fancy dinner in washington this knitted, the president took a dig at president trump. the big news is two candidates clinched their party's nomination for president. one candidate is too old and mentally unfit to be president. the other is me running against the same guy i beat in 2020. don't tell him. he thinks he is running against barack obama. matt. >> he is talking to his base there a lot of folks in the press corps. if trump wins it will be in large part because he was able to really cut into the margins and continue the margins he had in 2020 among those minority voters. he did better among latinos than anyone else except for george bush in 2004. the best republicans did among black voters. watch african-american men as we all do. safer streets and safer communities. you want to be able to -- want to have those sorts of conversation. >> julie: when it comes to age and fitness. the president campaigning in michigan getting attention. it was painful to watch. watch. >> mr. president, do you agree with chuck schumer that netanyahu should go? >> julie: the press picking up on the president's footwear of let. hoka transport. biden's handlers are forcing him to wear a new pair of lifestyle sneakers because he trips so much. the president was diagnosed with neuropathy in his feet during his physical earlier this month. fred, the president obviously does have some issues with his balance. insulting each other on age at this point seems ridiculous. they are both not too far off from the other. it is concerning, of course, when you see an aging president unable to stand on his own two feet. >> which aging president are you talking about? donald trump is aging, donald trump has had a number of gaffes. >> julie: i'm talking about the one that trips all the time. >> president trump has stabilizers behind many of the podiums giving speeches. reality is and why i think 67% of americans didn't want this match-up. because you have two people whoever wins will be the oldest president to ever serve. two people who made a number of gaffes on the trail and stability issues. that's where the similarities end. you have one in president biden working for americans. you have another one who is working for himself and his family and donald trump. >> julie: well, it would be nice if he worked for americans by protecting americans on our borders. something that >> tell republicans to pass the bill. >> julie: he has been in the white house and hasn't done anything. that's all the time we have. matt gorman, fred hicks, appreciate you both coming on. major pushback to chuck schumer's calls for new elections in israel. >> out of line is just start of what i think. you have the senate majority leader trying to interfere in the election process and destabilize the country of our ally, israel. what the heck is going on? thank you, i'll handle it. we're at war. day 164. this is an outright push to get the muslim vote, the palestinian vote back in his camp. what they should be doing if you don't like the way i'm running it donald trump is more pro-israel. that's accurate. they can't have it both ways. admiral kirby saying we're not telling you what to do. yes, you are. you have president biden saying it's a really good speech. that means you support it. you can't have it both ways. you are calling for regime change, too. so is the whole administration. you can't have it both ways. condemn it or support it. when you don't condemn it, you support it. >> julie: how about condemning the leaders of hamas and trying to reorganize they are terrorist organization and stick to the good guys, our allies. the liberal media and many on the left are pouncing on comments by the former president trump at a rally in ohio on saturday. let's watch. >> now we're going to put a 100% tariff on every single car that comes across the line. you are not going to be able to sell those cars. if i get elected, now, if i don't get elected it will be a bloodbath for the whole -- that will be the least of it. it will be a bloodbath for the country. that's the least of it. they won't sell those cars. they are building massive factories. >> julie: he was talking about the auto industry. the legacy media are blasting out headline after headline after headline devoid of any context the, just letting the word bloodbath hang out there for interpretation. elon musk saying shame on nbc. shame on them. nbc pushing the bloodbath host. >> now you have that ridiculous attack on donald trump coming out. he was saying if you allow the chinese to dominate the e.v. industry, which is what biden's policies are promoting. you will destroy the auto industry in this country. it will be a bloodbath for the auto industry. it shows how low the media is willing to go to cover for joe biden. they know that they cannot win this election. they are going to lie about it for the next eight months and why it is so important we have real journalists and x.com and push back against this craziness. >> julie: it is crazy. the biden campaign mischaracterized trump's comments with a statement. i quote. this is who donald trump is. a loser who gets beat by over 7 million votes and then instead of appealing to a wider mainstream audience doubles down on his threats of political violence. i mean, this is crazy. nbc for them to tweet that the former president trump is vowing at a rally there would be a bloodbath if he is not reelected in november and they leave it there. it is not only deceptive, it is destructive and dangerous. >> brian: it's so obvious what he was saying. what people have to do is understand that donald trump, their offense won't be joe biden on offense. they are afraid to bring him out. nbc has confirmed that with insider sources that say that joe biden is frustrated because his people don't want to let him talk. they want trump to talk and be able to clip trump statements and say listen, america, you don't want that guy again. the problem is, it's the four years of trump against the three and a half years of biden is what's coming through. when they see that unjust clip that adds to it saying we all went to trump university. oh so did the entire world. we know the way he talks in extremes. tries to make everything vivid and talking about the economy and trying to by pass the usmca and make chinese cars in mexico, get discounts on the free trade agreement is what he is referring to. another area that's important. the people that defended trump wasn't jim jordan and lindsey graham and j.d. vance. it was mike turner, senator cassidy who came out and they were the ones and mike pence. one breath after saying i'm not going to endorse trump he said of course bloodbath was meant about the auto industry. even people that used to be that are somewhat skeptical on trump on the right who will vote for him understand what is happening here. in other words, let this whole thing play out. don't make up phrases. don't make up points of view. put it to donald trump and then make him defend it. now the first half hour of every sunday show is can you believe what donald trump said? administration cross the line by pressuring social media to remove content it simply didn't like. the white house claims it was just cracking down on disinformation about things like covid and the 2020 election. meantime republicans say they went too far. missouri senator eric schmidt explains why he filed this lawsuit when he was the state's attorney general. >> it's the most important free speech case in our lifetime because it involves some of the highest ranking government officials in our country colluding and coerceing with some of the biggest social media companies in the world to suppress millions of posts. posts related to the hunter biden laptop story, origins of covid, lab leak, efficacy of masks and much more. the scope of this is orwellian and breathtaking. >> julie: fox justice correspondent david spunt at the supreme court with the latest there. >> good to be with you. arguments began at 10:00 this morning. the justices still hearing those arguments are expected to wrap anan behind me at the united states supreme court. this case has major implications when it comes to public health policy but national security and election security going into this year's presidential elections as technology improves and more people use social media the supreme court justices continue to find themselves in the middle of these high-profile cases involving free speech and social media. the question here is did the biden administration improperly pressure or communicate with some of the largest tech firms in the country to moderate content posted by private parties. think everyday people on twitter, facebook and other sites. administration was sued for collaborating with these sites to take down disinformation relating to the covid vaccine. another big issue is he will he can shun security and fallout from the 2020 presidential election and what people posted online about the results of the race that president biden won. several states and private party suits the administration arguing their speech was being stifled and the administration was behind it. here is justice alito this morning. >> the only reason why this is taking place is because the federal government has got section 230 and antitrust in its pocket and to mix my metaphor, it has big clubs available to it and treating facebook and other platforms like they are subordinates. >> skeptical justice alito of the government's position talking about the -- the justices will wrap up today and have a decision by the end of the term, which is typically the end of june and early july, usually before july 4th. >> julie: great to see you. thank you so much. tom dupree the form assistant attorney general joins me now. let's talk about the case on hand here. it focuses on whether the several federal government entities including the white house, centers for disease control and prevention, surgeon general. f.b.i. and cybersecurity and infrastructure security agency whether they coerced or encouraged the social media sites to block and remove content from their sites which as you know and as they should know, would violate the first amendment. this is a huge case for the first amendment. >> julie, this is a big case and the question before the justices this morning is actually a fairly simple one. whether the government went too far. we heard about the government, this administration leaning heavily on the social media companies to take down content that the government didn't like. some of it concerned vaccine or health-related information. others concerned election-related information. it is different and challenging if you are a tech company and the government calls you up and says we don't like this post we're seeing on your website and we think you knowed to take it down. >> julie: the white house calls it misinformation. that's what they in fact were using as their excuse for taking the posts down. there is a big difference between misinformation, disinformation whatever you want to call it and outright truth that they don't want to hear. that's basically what surrounded a lot of these censored posts on social media especially during the pandemic. >> right. typically the way our nation has worked historically is that the people get to decide what would be disinformation. if you hear an argument made, well, you are entitled to believe it or not to believe it or entitled to kick and tires and look it for yourself. don't want the government saying that's a viewpoint you aren't allowed to hear. it would be one thing if the government called up the tech companies and said you might want to take a look at this post. we have some concerns about it. but it is another if the government does so by using coercive tactics by pressuring these companies and threatening them. that's what really raises the first amendment problem that's at the heart of this case. >> julie: we just had on the screen the "wall street journal" editorial board wrote it seems government needs remedial constitutional training, a bedrock constitutional principle holds that government can't coerce private parties to do what government cannot do on its own. the high court on monday the reaffirm this emphatically. the white house should be ashamed of itself. the white house should also be taking responsibility for this. i say when you really badly screw up in public. if it's in private with your family, cool. this is the before all americans heading into an election and i do believe and teach this to my children, when you have screwed up own it. stop the lies. we all see what they did. we all know now what they did. come out and say you're right, i shouldn't have done it. it won't happen again. that's what i tell everybody when it comes to owning your mistakes. >> excellent advice. i hope the supreme court will bring clarity to this area of the law and instruct the government how far it can go when it is communicating the tech companies. the problem won't go away any time soon and the court can perform a useful public service by making these constitutional lines extremely clear so future administrations don't try the same >> i don't know. but i do know that maine will get known as vacation spot not just for summer tourism but also for all of the transgender treatment that this bill would allow. in fact, would endorse. we would have cases of state sanctioned kidnapping under this law as written. it goes so far as to say if you are a parent in georgia and an aunt decides to bring your child to maine and you file a suit to challenge that aunt's ability to do so maine will allow the aunt to sue you, the parents in georgia, for damages trying to attempt to stop that child from receiving these transgender treatments. >> julie: it is one thing when abortion is banned in your state and you cross state lines in order to get an abortion done. typically you go with an adult. what's really disturbing here it doesn't have to be a parent to bring you over. there is no parental consent here. it doesn't have to be an adult, is that true, to take you across state laws to get a sex change or abortion?
