is there a double standard? >> what's interesting is in each video don't see the beginning of the incident, described an incredible detail about was testified and they all describe jordan entering the subway car waiting for the doors to close with a captive audience and again with unhinged rants and underscores how quickly a situation like this can devolve if you don't have someone like my client willing to step up and put himself in harm's way, come up behind jordan and bring him down and hold and subdue him until police arrived. >> is so much in here and to understand in the case of the subway shooting, that guy attacked the gentleman who got the gray away and use it against him. in the case of any, i like to say the definition of a hero is how someone asked a split moment and daniel penny protected the writers in the subway get penny is facing serious jail time and the other guy not so much. the other guy shouldn't also be exonerated for his actions. both cases perhaps heroic actions but we got to where now there is an irony of real men stepping up and doing the right thing? >> i'll never not do the right thing, the people's lives around are more important and then mine and that's what i believe, that's what i have the understanding of how to stand in the gap in front of danger for those who may not know how. what happened -- i don't like comparing them but i understand penny's lawyer might want to but the same way a split second can change one from the other so comparing isn't fair to either one. what recently happened like you said, they get in a fight and we don't see why they get into an altercation specifically and a third person comes had absent individual, she stopped him and dropped the gun and the other guy shoot them. what i love is you have elected officials in the city willing to admit you can use a gun and health the fence but they wouldn't let you carry one. it's okay for criminals out of illegal one, a great second amendment case the only clause against guns in the city but somebody is checking your back to make sure you don't have one. how effective was that? >> someone who frequently comes to visit new york, the new york post an op-ed support shooting his approval lawmakers all danger is magnified in close confines of the subject but troubled souls pose a threat yet the system until they strengthened often afterward, how is the status quo so anyone?
