trump legal battle this hour. in florida, former president is in court as we speak and his legal team is arguing special counsel jack smith classified documents case should be thrown out entirely. meanwhile, over in georgia, we're awaiting a judge's ruling on whether or not to disqualify fulton county day fani willis from the state's election interfere case. this is "outnumbered," i'm kayleigh mcenany, here with my co-host harris faulkner and emily compagno, joining us former n.f.l. sideline reporter, michele tafoya and attorney and retired nypd inspector paul mauro. we also have this, emily, i'll get to you on audio in a moment. before that, this "wall street journal" columnist claims lawfare to take down donald trump. latest op-ed reads if democrats limited their initiative to jack smith, conservatives would have absorbed it, however degraded that benchmark, american left never knows when to stop, it is raging get-trump legal assault on every imaginable front. he noted it has backfired politically. turning to the georgia case, in particular, i will play audio. you don't often get to hear judges give radio interviews and i was fascinated to hear judge mcafee. listen what he had to say. >> i gave myself a deadline, i knew everyone wanted an answer and i'll tell you, an order like this takes time to write. there is a lot i have to go through and so i've had -- i can't emphasize this, rough draft and outline before i hear a rumor someone wanted to run for the position. the result will not change because of politics, i'm calling it best i can and law as i understand it. i feel like i'm on track having that done by deadline i put on myself. >> kayleigh: really interesting to hear what is going through his mind. >> emily: contrast that with dan heninger's point that says democrats use of lawfare on this scale makes it likely respect for the law will decline and dangerously so among much of the american public. it goes on to say essentially you guys have beaten a dead horse a million times. if you had brought one or two lawsuits or charges, maybe the american people would have bought it. you have resurrected and beaten this horse, half the country is coming to believe the legal system is being swallowed by rank political partisanship and he says, worth it? my response to the judge's clear articulation of deliberative process, it doesn't matter, main-stream left will tell you if he rules against trump, it was great. if he rules in favor of him, they will say he is political, too. we saw this during the state of the union address when president of the united states decided to shame justices who made absolutely correct decision and he used them as props and prawns during his speech and shamed them for being deliberative and thoughtful. here we have a judge saying this is why it takes two weeks, we'll see how the main-stream media responds. >> kayleigh: there is no doubt these legal cases put a tailwine behind former president trump and look to polls in arizona, up by two and in pennsylvania up by four. >> harris: part of that is because the former president, donald trump, has been able to show weaponization of what happens when your opponent has the department of justice on their side. or so seemingly. so i mean, that is part of it, other part is, when the president speaks, i watched that talk yesterday in wisconsin, i don't know he's a powerful advocate for himself right now. he had a lot of energy at state of the union address, did not have that yesterday or since when we see him speak. on this 20-place blitz right now. i think that is driving numbers, too. in the swing states. trump is able to be the same person when he's out as when he's in court. comes out, speaks, so on and so forth. we've seen a decline in the president. you don't have to be a doctor to say that. watch with your own eyes. i think that is part of this. the whole picture, it is interesting when emily pointed out, he went after left judges, after the judges he thought would go his way, the justices. it shouldn't be 9-0 with one voice and that tells you everything. part of this might have been pregained in his mind and narrative not cooking way it is supposed to, american public is smart and they are letting us know through uncommitted votes in some states, with biden in mind, he has to do something different and better make it fast and getting younger is not an option for him. >> kayleigh: no, in pennsylvania trump is up by two and arizona, trump is up by four >> these are head-to-head polls, when r.f.k. jr. is involved, numbers get tighter, in pennsylvania, for example, numbers become a tie. hispanic voters in arizona, you have biden up 49 and trump at 43. biden supposed to be running away with hispanic voters and he's not. nonwhite voters, 48 and 44, not running away. where the ball game is, you might see new coalitions, groups pulling for trump, they are both pulling in same amount in their party, 83% and 82 and 81% in the other state. as biden makes play for progressive left trump needs to make play for more establishment-minded voter to run away with the election. >> paul: i think that is true. go back to state of the union address, democratic party took a big victory lap. he was powerful and strong and compelling. put it on point here. he blew it. because the only people he convinced were those already convinced. it was a hyper partisan speech to the base, progressive base, that changed nobody's mind. it compromised him as almost certainly the candidate. realistically what happen with the state of the union, it is biden and it will not change as his poll numbers continue to go down. his state of the union was great night for the right. he won't change and now 37 and a half percent under real clear. >> harris: came down since that address. >> paul: because he alienated anybody with an open mind. if you are hispanic or black voter, you are not seeing a change to things impacting your life. go right to it, immigration. you see jesse watters does man on the street thing and girls in bikinis. >> harris: we know what is happening. >> paul: he puts a mic in their face, what is going on with migration. >> kayleigh: great point. >> paul: and they got a few drinks in them. >> kayleigh: exclamation point on the spring breakers. you see trump winning under 35 and winning 49-47. this is just a poll, maybe the spring voters have woken up. >> michele: maybe they are spreading the word to make this happen. another development was the robert hur hearing this week. it showed biden over course of many years, stuck away documents, took probably from skiffs as a senator. he took them, right? this is a pattern that he had over the course of his career, no charges. hillary clinton, same thing, no charges. donald trump, charges, going back to lawfare. you see this development in georgia, six charges being dropped against him. flaking away of that. you can try to compare and contrast, if you're saying that both men took documents and put them willingly where they weren't supposed to be and they were insecure, why is one being prosecuted and one is not? that was going on under this administration and i interviewed border patrol leader who said on camera eventually that mayorkas's team called him to find out if the pictures were real. we have it. i'll dig out that sound bite. problem was that had collided with what was going on with the administration. we'll bring these people over and show em. their prime minister had been killed. ariel henry was the current guy until 48 hours ago and he's in puerto rico last report. we have a lot of americans. he got enough of a heads up. this story has been cooking 10 days. we've watched gangs on satellite at fox news for almost two weeks, my question is why didn't this president's administration move americans, not just give them a warning, we needed to get our people out. we know what it looks like when things divolve in haiti. >> paul: remember when mayorkas came out and lied that his own people were using whips on migrants. his own people. >> harris: why are people stuck there? my question. >> emily: show that video from 2021 of over 12,000 haitian migrants crowded under the del rio bridge following the assassination of hatzerim's president. this is what harris was references and what paul referenced. haitians are not strangers to this rest. to harris's point, what has our president been doing about it? his play book is afghanistan. he left people behind. you have information for us? >> kayleigh: yes, someone from the governor's office said floridians in haiti working to provide assistance, so governor desantis is having to rescue floridians because of the biden administration mess. sending 250 national guardsmen to florida keys because of biden's mess, 271 increase in haitian migrants. governor desantis having to do biden's job like governor abbott in texas. and move to cory mills who had to orchestrate a private rescue mission of americans in an orphanage. we had to evacuate people from the haitian embassy, from belarus, from sudan, from afghanistan, from ukraine. under biden, you get embarrasses evacuated, americans abandoned and states filling the gap. we don't have a president who seems to care what is going on. >> harris: desantis sent help to israel, too. our federal government couldn't figure out how to get people out of israel at the very beginning. >> michele: he's been a forward-thinking proactive governor when they see storms coming. they react after the fact, they do not prepare. this administration has not been able to do this. this rings like the afghanistan experience, you are hearing people trapped in awful circumstances in haiti. he is not that far. how could we abandon them. one person said what they told us was be safe, it is too dangerous to come get you right now. forget biden's age. the inepitude of this administration to look ahead. jack brewer was on, he has a charity in haiti. he said you could see this coming two years ago. why weren't they on this? why didn't they take necessary preparation. we have a connection with haiti, fiscal proximity and these are gangs. it wouldn't take massive military force to settle things down in haiti to get things under control to bring some temporary stability. >> emily: part of afghanistan, part of what was unpalatable for americans is that we know, we have proof president biden ignored recommendation and advice of his cabinet members and those generals who knew exactly, i wonder here whose advice and information he has ignored? >> paul: the evidence is clear and egregious, she will be charged as an adult and likely with attempted murder. there are too many head bashes. the girl she is fighting with is limp, not offering resistance and she continues to hit her and smash her head into the ground. i think that is likely how it will go. the ag does not have the case, i think the prosecutor will have to go that way. a, what is going on in the schools? i go back to stuff we discuss when we have school shootings, which is we should consider some sort of program and i would consider that it should be nationalized and great initiative, get off-duty cops, retired cops. a lot of retired cops are lost and don't have a mission because nobody goes into it for the money. initiative, you can get older cops, they have had kids themselves, get them into schools. will it stop i -- >> harris: do you even see an adult? nobody helps that child, she is limp, out, bashing her head over and over. >> michele: and people recording it and not helping. you hear people saying expletives and oh, my gosh, i can't wash it. my daughter is 15 and trying to imagine this, not only in schools, what it takes to engender that kind of rage and strength and mindset to do this to another human being let alone someone of your own age group is mind boggling to me. what is going on at home, at school? you raise a great point. we need to bring other people in with a mission to protect kids from a lot of dangers. if law is set up to try this individual as an adult, then try her as an adult. we have gotten so loose applying the law lately and young people think they can get away with more and more. end that now. >> harris: getting away with it is one thing. having a soulless survival mode is another. when you see one child do that to another child, where is that offending child's soul. they can murder someone not even moving? >> michele: isn't that up to every individual to decide for him or herself? i love to work. i would work constantly, no, i'm kidding. work-life balance. i speak to a ceo of an american giant, based in san francisco. he was telling me, winthrop, that a lot of workers, so many of them, that is most structured part of their lives is going to work for eight hours. now you say, you only have 32 hours instead of 40, what are they going to do? i i idol idle hands. government should stay out. >> emily: he wants to be a champion of labor, he is missing whole point, the source of everyone's stress is not because they are working more. usually workers are working less now especially in gen-z and millennials, not up to standards demanded of them, we are fostering idle hands. >> kayleigh: social media, devices at the dinner table. i'm all for working smarter, giving leeway, where you can choose a good worker or hard worker for that, spending more time with family. i'm not for the way of western europe, i'm for bottom-up change. there was a company called four-day week global who did an experiment for the legislation, with companies that found workers were more productive and chose to keep the four-day work week. that is bottom-up change rather than top-down edics. >> emily: who needs to work is the senators, keep their workday long. >> harris: leave it to a democratic socialist to shame us for working harder than people in the 1940s. everything is more expensive, life is different, we are depend more on oil and things fluctuate, it hits our pocket book. we work harder now. we are some of the greatest innovators on the planet. if he wants to esquivocate this to lack of benefits in socialist society, we are not socialist. i'm not looking for someone to dumb down the work week to make up the wage gap. there is a lot still left on the table for people to do and i don't want to take anything from someone who wants to work 70 hours and set that example. maybe not healthy for everybody, maybe they come up with something we can't live without. >> paul: as you said, this is socialist nonsense, look at the 1940s. we had world war ii, who went to work during the noon 40s? >> michele: i don't know why pamela brown would lie. it is hearsay, she is saying what he said. he has not had a chance to respond. if aaron held that belief, i would be disappointed. i dealt with aaron because vivek ramaswamy was interested in getting aaron involved. i don't know if it was for vice president or anything, they wanted to be connected. aaron is influential in the world of politics. this story makes it very interesting and he will have to respond to allegations that this cnn reporter made and if true on any level, r.f.k. jr. can't use him. >> harris: paul, one thing you learn in politics, somebody thinks about choosing you from candidates i'm interviewed over the years, it teaches how important a team is and you can't go on your own. by having somebody identify you, that can be helpful, their team takes you under their wing, whether it is venturea and i lived in minnesota and his life. or aaron rodgers. they both benefit from that. >> paul: belief system rodgers has telegraphed has put him in this space. let's go to between the two of them, rodgers or venturea. i lean ventura, he has worked in politics and he has managed. it is something you need to learn and maybe rodgers ran a business i don't know about, i assume he took the normal athlete track to the top of his profession. he never managed a team or organization. venturetura, i feel is stronger option. >> harris: ventura, worked in a purple state. walter mondale lived there after he was in politics in the white house. interesting as vice president. interesting to see that choice. what do you think? >> kayleigh: let me take the alternative argument, aaron rodgers, if those statements true, disqualifies him. that aside, r.f.k. jr. is making a difference, no doubt, pulling in 9% or 10% in the poll. he makes it a jump ball, pulling equal amount of republicans and democrats, question of who he is pulling from, pulling from both. someone like aaron rodgers can he pull young people? young people seem to be up for grabs and aaron rodgers has star power and can think of viral tiktok videos. that matters. can he have a zap of energy with young with aaron rodgers? >> emily: i love the jump ball reference, love it. two tweets that are interesting regarding this prior what we are talking about that cnn reported. clay travis says so aaron rodgers must be serious contender because cnn is ripping him. something interesting, trying to wrap my head around the editorial process. one reporter is recounting a conversation in 2013 and has no notes or recordings. what outlet would let me publish that?
