illegal. well, technically not supposed to be here. undocumented person. i shouldn't have used illegal. undocumented. >> dana: three days and three different explanations from president biden as he bends over backwards to apologize to a migrant murder suspect for calling him an illegal. bill is off today. good morning to you i'm dana perino. >> sandra: i'm sandra smith. the man is charged with murdering nursing student laken riley. republicans pressured him to mention the case during the state of the union address. the president mispronounced lake en's name. >> dana: it didn't sit well with laken's mother. it speaks to biden's misunderstanding on the border according to the republicans. >> what the meaning of is, is. to even argue this point in the face of this 22-year-old young woman whose whole life was ahead of her, was taken allegedly by this person who crossed the border multiple times with a criminal background to argue whether it's undocumented or illegal. it's illegal, mr. president and a slap in the face that this family of laken riley. it's laken, not lincoln. >> sandra: chris clem is on deck and straight to peter doocy kicking things off at the white house this morning. hi, peter. >> good morning. 2 1/2 hour drive away from athens, georgia, where laken riley was murdered her grieving family greeted donald trump ahead of a rally there backstage. we have the photo here and a few minutes after this trump went out to the microphone and he really let it rip about president biden's apparent deference to the man accused of with their daughter's violent murder. >> they just told me prior to what i'm doing right now that joe biden went on television and apologized for calling laken's murderer an illegal. he was an illegal alien. he was an illegal immigrant, he was an illegal migrant and he shouldn't have been in our country and he never would have been under the trump policy. >> president biden initially defended his decision to call jose aybar owe, the accused murderer an illegal saying technically he is not supposed to be here. something changed and quickly and the president is now also explaining why he is filled with so much regret about calling anybody even an accused murderer an illegal. >> president biden: i'm not going to treat any of these people with disrespect. the reason our cone me is growing. we have to control the border in a more orderly flow. i don't share his view at all. >> you regret using take word. >> president biden: yes. >> biden campaign is hoping for a reset this week focused on economy. so far his handling of immigration is not part of the campaign's one minute sizzle real of the first term so far. >> sandra: thank you. >> dana: border patrol chief chris clem joins us now. listen to president biden one more time out of this msnbc interview. he rarely does interviews. this is a chance to hear what he is thinking about the helicopter behind him. watch here. >> president biden: and look, when i spoke about the difference between trump and me one of the things i talked about on the border was is the way he talks about vermin and talks about people polluting the blood. that's not what i won't do. i'm not going to treat any of these people with disrespect. >> dana: does it matter the language that leaders use from washington? >> good morning and i do want before i answer that question i want to recognize the family and friends of border patrol agent luna who died on friday as well as the national guard soldiers. these things do matter when we have to deal with consequences. that the most important piece. terminology, we can go back and forth on that. this administration started off with using the word illegal alien, month fad to undocumented migrant and now we're talking newcomers. that's fine. but at the end of the day it's upholding the rule of law and giving consequences. if we can do all that and call them whatever he wants to call them. we have to detain them and get them in front of judges and remove those that need to be removed. bottom line, when we enforce the law we can call them whatever we need to call them. that's the most important piece is doing our job and securing this border. >> sandra: speaker mike johnson had a pretty firm reaction to all this saying the president's cowering to his base showing deference to a man who deserves none. president biden should be apologizing to laken's family. what an embarrassment says the speaker. what message do you think this flip-flop on the part of the president sends to any migrant that's here illegally right now who may be considering a crime? >> well look, i agree with the speaker. this was not the time to sit there and start apologizing. he has yet to apologize to the border patrol agent on the horse patrol in del rio when he lied to the american people. for him to apologize to the murder suspect, that is ridiculous. i do think it sends a message of encouragement that you can cross illegally and be support evidence by this administration. he has profb en that time and time again and a complete disconnect from what is actually happening on the border security front and you see it in some of the reports this weekend from his progressive base. they are conflating immigration and border security to score political points but look, at the end of the day we have a border security problem and what we have witnessed in the last week or so specific to this case is exactly why we have to secure the border and we have to hold people and detain them until there is 0 uncertainty who they are and what their intent is if we can't remove them right away. >> dana: the bigger question today about worldwide threats discussed on the hill. james langford talked about the real concern and how many people have come across targeted on the terrorism watch list. listen here. >> it is our southern border right now a major threat. what we've seen is 50 people on the terror watch list in the last 4 1/2 months we've seen more than 10,000 people come across our southern border. called special interest aliens. these are individuals being trafficked in from all over the world coming at the homeland that is a major issue for us. >> dana: what's the border patrol supposed to do to try to catch these people on the terrorism watch list? >> the senator put it out very well. this will be a public hearing talking about the threats that are coming into the country and this is exactly what we have been talking about since this administration on day one last started peeling back our security measures. we know there are threats around the world happening. the intelligence officials will talk about it. we have to free the hands of border patrol agents and continue securing the border whether it will be infrastructure or technology. we need to make sure we stop the flow from the source countries. hold these source countries to include mexico accountable so our agents can do the job to mitigate threats. we still have the threats like we just talked about of these people gang members, people that have ties with criminal organizations. this is a problem. this is what america is seeing. this is what's playing out right in our backyards and it is long overdue that we secure this border. again, we have to get the agents the resources they need, not bills that say one thing but don't actually address the security portion that is so lacking in so many areas across the southwest border. >> dana: it feels overwhelming. thank you for joining us this morning and getting us started. sandra, this is how many people have come across the border that have been on the terrorist watch list just in fiscal year 2024 to state, 58. last year a total of 169. those are the people we know about. >> sandra: remember those remarkable comments from christopher wray the f.b.i. director in november just pulling that up november 15th, 2023, when he said the border gotaways are a source of great concern for the agent see. we'll have that hearing happening at 2:30 p.m. eastern time today. interesting to see what they have to say considering the situation since then has only gotten worse. >> dana: nobody to set it up better than sandra and john roberts. thanks. we'll get back to this. >> sandra: first came new york. only days after new york governor kathy hochul sent the national guard to help fight surging crime on the big apple's subway system the head of chicago's largest transit worker union is now asking for the same kind of deployment. mike tobin is live from the windy city for us. what are they planning, mike? kimmel criticized arkansas senator katie britt who delivered the gop response to president biden's state of the union saying she had the brain of a child. >> dana: alabama senator. a lot of attention on that as well. william. thank you for watching that to get up to speed this morning. >> sandra: a new twist in the trump/georgia election case. fani willis and the judge mack phene are drawing challengers in their bids for reelection. they both face the possibility of being pulled from the case before it heads to trial if they lose. let's bring in fox news legal editor, great to see you this morning. that is getting interesting. >> this has always been interesting. a couple of things to keep in mind as we wait for the judge's decision about disqualification. it is really unusual for a d.a. to be disqualified for a case by a judge. that's a fact everyone needs to remember. two, a lot of discussion about the standard of proof. that matters because unfortunately the georgia law appears to be unclear here. is it -- is it beyond a reasonable down, a very high standard. looking at that and hearing the testimony and the drama on screen i think it's more likely than not standard the judge could squeeze through a disqualification. if it is beyond a reasonable doubt it is harder. because it is so unusual and a very big deal to disqualify a d.a. these are the things the judge is thinking about making his decision. >> sandra: let's go back to a few of those moments. always interesting. this was february 15th inside that courtroom. fani willis, listen. >> you are confused. you think i'm on trial. these people are on trial for trying to steal and election in 2020. i'm not on trial no matter how hard you try to put me on trial. >> sandra: this was her former friend testifying on that same day. listen. >> first of all, romantic. i just want to make sure we don't get an argument. when i ask you personal you take that to mean romantic? >> yes. >> do you understand it that their relationship began in 2019 and continued until the last time you spoke with her? >> yes. >> sandra: the bar is high to disqualify a d.a. from a case. at this point what do you think are the chances that will happen? >> i don't know. i think it could go either way. i think that if you have a judge who is a more traditional judge and wants to adhere to standard practices they will be resistant to disqualifying a d.a. given the precedent that it would set. also keep in mind that apparently according to reports some of the dedefendants have people they would like to bring forward who say they'll also testify that this relationship began long before they gave it to the court as far as what they said when it started. that would be a problem. if they lied to the court in court and in filings. that would be a crime. it would be almost automatic grounds for disqualification because it goes to their integrity. there is that georgia lawmaker investigation going on as well. they say that they have people who want to come to them and testify under oath who say that she is lying about when the relationship began. that's something that is still happening in the background. the judge said that we can expect a decision from him over these weeks. the reports i'm reading it seems like it will come any day now. >> sandra: quick final question on this boeing situation and this string of recent incidents including the door plug incident, now you have the justice department opening a probe interviewing crews in alaska on this airline blow out. where do you see this going? buttigieg insisting flying is the safest way to travel. what do you say to people about what you have learned here, carey? >> it goes to mindset. the "wall street journal" reported it became a criminal investigation. i started thinking about they you must be suspicious that boeing is withholding information from them. don't forget boeing has been accused of that in the past. the justice department dropped that charge in a previous case but they were accused of that. in the senate investigation of this incident it was very convoluted whether they had info they could or could not find it or hadn't been prepared. if the justice department thinks there is a pattern withholding information about these accidents that's a problem for them and raise suspicion and more likely to investigate in the way they're doing. >> sandra: thank you for joining us this morning. good to see you. >> good to see you. >> things escalate on both sides. both coaching staffs coming out to try to pull their players away. >> dana: did you catch this? neither at 30. i can kind of understand that. but if you look at the next one who did a better job of handling major issues while president. trump wins on all these by a large margin. economy, inflation, crime and border. if you are biden and you think you had a good state of the union and you are trying to seize momentum, what do you do when you look at something like this? >> real change after the state of the union in the one or two polls like this conducted after ward. the polls show he did a good job with the state of union. feisty, delivered his message. most voters like neither of these candidates and they vote on the issues. they are inflation, immigration, crime, the abortion to some extent. climate change. they will vote on the issues. right now trump is winning most of those issues and why he is ahead in most of the races. >> dana: i thought president biden was trying to make sure he was solidifying the democratic base speaking directly to them. the importance of the swing voter is out there. if he wants momentum from the state of the union and if he is trying to secure and lock down his base, how do you go after the swing voter? how much time does he have in order to do that? >> he has a lot of time and a lot of money. he has proven he is not going after the swing voter. there is a clear reason why. he hasn't lost in the democratic base. we see young and hispanics and black americans and why you zoo he the divisive rhetoric we saw in the state of the union. it is also for the data you showed why he is not doing well. the 2020 election when joe biden got elected, he was elected to be sort of a caretaker for lack of a better word. people were tired of the chaos around the trump white house. they were tired of the circus and wanted the steady hand. that's not what they have gotten. they've seen crime spike up. drugs flooding across the voters. swing voters and democratic base he whats a lot of work to do. >> dana: listening to you this weekend on your podcast you talked about how you had never seen immigration top the economy. tell us more about that. >> always it's the economy stupid. poll after poll except maybe in the middle of 9/11 generally the voters in this country for decades it's always been about the economy. i've been stunned. this issue of immigration was a minor issue that came up. then a republican only issue and then as soon as those immigrants and migrants showed up in democratic cities and they said we need hundreds of millions of dollars now, this issue exploded as a national issue. it is a big negative for the biden administration now and they are not buying the story it is the republican's faults because they won't pass a bill. >> dana: 86% of americans say the president is too old to serve another term. listen to him on his own age. >> president biden: i'm not a young guy. no secret. here is the deal, i understand how to get things done for the american people. >> can we do one more take? >> president biden: i'm young, energetic and handsome. >> dana: will that work? >> no, this is the biden administration choosing to not learn from their past mistakes. this is exactly what they did in bidenomics. mark and i are campaigners and we know campaigns are about persuasion. you persuade voters by giving them new information or reinforcing something they forgot about. the hardest thing to do in a campaign is to convince voters something they believe is true is not, right? capitol hill >> good morning. supporters of this legislation say this is not about banning tiktok outright. they want to force the company behind it to divest itself of chinese ties to protect u.s. national security. just last week we saw the house energy and commerce committee move forward unanimously with the plan to move it to the house floor. thousands of people called congress demanding to keep tiktok alive. talk reining it is and congress is now close to taking action. >> it is not about speech. the authority does not penalize speech or behavior. it's about american social media. that's the issue, not speech. >> tiktok not happy about this at all saying this bill is an a ban of tiktok no matter how much the authors try to disguise it. this legislation will tram -- deprive there are more kids in this country aren't drinking soda anyway. >> i feel they all drink water. look at vitamin matter. a proliferation of beverages. what we had when we were kids. it was wild if you
