because as i said at the start when you have a situation like we have today, when you have the greatest of genocide and atrocities against the people of the jewish people in israel since the holocaust and i have to sit here and sit on radio and explain what that media are doing. how they are lying in support of hamas how they are lying in support of terrorist regimes. how they are lying against israel. how they use anti-semitic guests and hosts. that is pretty sick. and now you know why this media cannot be trusted the vast majority of it. they attacked tru attack trump t the trials and they lie about so much because they have an agenda. they have an ideology. thanks to the supreme court that "new york times" decision versus 11, most of this is a protected. it was not protected at our founding when you could bring libring libelsuits and when undw heard the court decided in the early 1960s that this was free-speech it was to be protected at all costs, fine the government does not interfere but what about individuals? or groups of individuals? they cannot reply. they have no standing to do anything which is why it gets worse and worse and worse and worse and frankly, why it's an h work here at fox, and an honor to work at westwood one my radio show with this kind of evil and hate, these kinds of smears and libels which you hear on a fairly regular basis on these newspaper the cable channels the network shows, simply does not occur. i will be right back mark: welcome back america webcam of kenneth marcus former secretary of education or donald trump. he found founded is chairman oe brandeis center. civil rights lawyers he's written a book the definition of anti-semitism. kenneth marcus you see what's happening at her colleges and universities i've never seen anything like this before in my life. no one else has either. you see it pouring out into the streets. as the former assistant secretary of education for civil rights i would like your view on this. and what can be done if we have an administration and a department of education wants to do something about it. >> i have been working on this issue for over 20 years and i have to tell you that what we are seeing this year and over the past four weeks on college campuses is unlike anything that we have seen in the united states. selling anything going all the way back when hamas committed its murders, it's rape, its torturers, its atrocity it was met with extraordinary celebration on many, many college campuses not just by students who were coming out to celebrate this murder, this inhumanity. but also assaulting jewish students, forcing them to be locked in a library. threatening them with death. things we have never seen before we have campuses that can deal with the tiniest of micro aggressions real or perceived but when there are a macro aggressions they are not dealing with it. these universities are all getting federal funds the u.s. department of education for office of civil rights which i formerly led during the trump administration has an obligation that taxpayer money is not being used to subsidize this gross and anti- tenant semitism they can do more they can investigate, not the speak but the conduct and maadmixture those who are assaulting, harassing, exclusive marginalizing jewish students are treated in the same way as those who do the same for any other group. mark: what about the funding issue universities and colleges i believe they get significant federal funds whether it's grant or student loans in the sort of thing. is there anything the department of education for that matter the department of justice can do to try to force a proper behavior in the radicalized universities and colleges? quickset the whole purpose for him have an agency called ocr the agency that informally ran its sole obligation is to make sure federal funds are not used to support discriminatory behavior. it does this on a whole host of other issues that need situate with anti-semitism. now we come a, at the brandeis r filing complaints and the biden administration says it's waiting for complaints but the fact is they don't have to wait the secretary of education has full authority to conduct self-directed investigations on his own any time he turns on the television or opens a newspaper and sees what is going on. and if he turns on the tv at all or reads the newspaper then he has got to know that his education department funds are going to support these activities and it has to stop. mark: i saw a brief almost passing statement by hammett which he says they're going to start to look into this and so forth. i guess what bothers me is certainly going to start to look into this. you were at the department of education. i believe there was an executive order signed by president trump i believe you're one of the main authors of that executive order. so you saw this coming. president trump saw this coming. you began to try to do something about it before joe biden took over. what did the biden administration do with this executive order or this document or this regulation that was intended to address to some extent anti-semitism on our campuses? or some kind you mention that it's important and timely paid the biden administration claims they have not rescinded the trump executive order on commenting and tyson tis and be that they've rescinded many of president trump's other orders this else enforce it and effect but there is no indication they are really using it the way it needs to be used. they have promised the white house i as promised of the unifd agenda that it will issue regulations that will codify and extend president trump's executive order on combating anti-semitism but it has now twice delayed the regulations that has promise. currently they are self-imposed extended deadline is december of this year that is just a next month but they are not talking about it there's no mention in the recent report to congress. there is no mention of it in the national strategy on anti-semitism get it supposed to be here next month i think we should be asking where is this an prm this notice and has been promised over and over again we need to see action from the education department. >> what exactly did executive order to do that president trump signed? i don't believe any president has signed an executive order like this and combating anti-semitism is that correct? >> tones average at anything like that we saw significant policy advance under president george w. bush we saw some good action under president obama. with the president trump we saw something on a precedent about with president biden we have seen some good words but not yet real action for the executive order in combating anti-semitism signed by president trump was a game changer. it made very clear that jews, jewish students are protected under title vi of the civil rights act of 1964 that was important it had been informally understood as a guidance letter i offered in 2000 for the first of its elevated to the level of executive order. more importantly president trump directed ocr and other agencies to use an important definition the so-called pirate working definition and all applicable places. you might think a particular definition cannot do very much but it does make clear not every criticism of israel's anti-semitic. but some activity some conduct against jews relating to israel and we are seeing jews being a beaten up, followed, harass, et cetera. some is anti-semitic to provide specific standards for dealing with it. without the standards without the tool ocr is rudderless they really didn't to take the trump executive order and turn it into something more durable. a regulation that simply says what president donald trump said. >> kenneth marcus when we returned my question to you is why are they doing these things? why did they keep delaying this and where is the attorney general of the united states? i have not heard anything from him. no press conference assistant attorney for civil rights no press conference with assistant attorney for the criminal division no press conference with the deputy attorney general this soap see it attorney general i see nothing. so my question to you when we come back, why is that? why are they using them? and why are thieves and the bully pulpit? what's the absolute can do much more there is a tweet from the secretary of education that was nice. there was certainly not in continues to be much less then what we have seen from cabinet member level agencies on a much lesser issues we certainly should see more bully pulpit from the president, the secretary of education, from the attorney general. to the trump administration things are not half as bad as they are right now the department of justice convened eight nationanational summit ong anti-semitism. that was important that was very useful. i do not know why the department of justice is not doing that right now. they've done some listening towards they have put out slim letters with generalities but we are not hearing from them that moral clarity required right now for their some of this administration who understand what is going on for a think secretary cardona has some grasp of it i do not know why they cannot speak publicly, formally and for the record to express at a minimum their outrage but tapping on college campuses but more than that i would like to see some action from them i would like to see some investigation. do you know ocr the office for civil rights has sometimes as many as 19000 cases per year? i do not see why they can't initiate even at 19 dealing with the horror shows we are shooting on american c
