>> well, certainly their national leadership signed a tough mission to the israeli military and that is -- to rengd or to hamas military and terrorist organization ineffective in term of its capabilities, obviously, to change the political epghtty of hamas governing gaza. and that's completely different than the other military encourage where they're going for a number of weeks go hard and fast, kill as many as they could, destroy as much infrastructure as they could, and then get out as soon as they could. so this operation is characterized being slow, deliberate they were encircling gaza as an example of that and clearing operations inside of gaza certainly focusing on where most of that military infrastructure and leaders are, and that's in this extensive and comprehensive tunnel complex. and obviously, they will go very slowly and dealing with this because the -- the hamas terrorist can pop up at any place and they really need 360-degree situational awareness. paul, we already know that given casualties that have taken place right now, in just the first week of the war, that's twice as number of casualty days that they have experienced experience past and it gives you a concern because this war will likely go on for weeks for sure. but many months more likely -- and that is upper most in their minds is number of casualties they may sustain through this operation. >> all right so you heard the secretary of state anthony blinken in israel ask the israelis for a humanitarian pause for allowing aid to get into gaza as well as time for hostage negotiations. what do you make of that recommendation? was netanyahu right to resist it? >> yeah. i actually think he is. i mean, when you look at this operation tactically on the ground if we stopped and given where all of the troops are prepght they're not outside of gaza behind their own lines. they're in the middle of one of the most dangerous spots that i can conceptionallize in my own behind tunnel complexes all around them. that is a very -- dangerous situation and he doesn't want to stop because he knows he's going take casualty and he knows hamas will take advantage of this situation. not only to attack his troops, but to regroup, to reorganize themselves. and make -- doesn't make much sense tactically i still think that we can get people out through the southern portal. at rafa we can still get things in through that -- portal of rafa, obviously, trying to get they will all away to gaza city that will be a challenge for sure that's why the israelis told as many of those people to get out. i think about 800,000 have gotten outs and i wouldn't be surprised that the 300,000 that are still there many of the hamas leadership are holding them in place for their own protection. >> you -- obviously have experience in the laws of war. answer a question for me about the civilian casualties which would be in gaza become such a focus of critics of israel. when are civilian casualties a war crime and when are they not? >> they're not a war crime if they're distinctal to what you're attempting to do. you're attempting to conduct a military operation to kill military targets and if civilians incidental to that then that's not a war crime if you're targeting civilians, then it is a war crime. and that is, obviously, what hamas did in brutal savage attack changed focus from the past on israeli soldiers with a primary focus was on civilian and, of course, it was butchery at that. what you see in ukraine by rush russia they have in government area in kyiv complete focus of breaking the will war crime to be sure. paul: what do you make of the speech, the hezbollah leader hassan gave on friday, and do you think that the -- is he eager is he reluctant rather to open a second front and do you think that american deterrence with the carrier groups and the med are maybe making a difference? >> of course he's right. i mean, first of all these democratic senators are playing to their domestic constituents who are out running these protests and putting all of the focus on this civilians who are dying in palestinian. palestine but the fact of the matter is in gaza i should say. but the fact of the matter that the merle -- military cannot do this pause it is preposterous they're in the middle as we saw earlier when we they let news report rs into gaza yeah. they're in the middle of a very dangerous battlefield you can't just all of a sudden step back and say okay we're just going to wait here for a bit and you know other thing is that this pressure is designed to get a result had is hostages and we hear lots of complaining from the democrats about -- the humanitarian losses. but we don't hear much about the fact they're still holding some 240 hostages. >> you can make a case dan for a pause if you really thought it would yield hostages and save their lives but likely outcome is for hamas to dribble them out to two or three and get a prop propaganda game that's a leverage they have. >> absolutely and maw make a good point because we have had no evidence or indication whatsoever from the other side from hamas that they're willing to do any such thing. all of the pressure has been completely on the side of the israelis. and indeed we should try to think through this pause a little bit. presumably it means that israeli stand down let's assume for the sake of discussion they do that for two days, for three days to allow something humanitarian aid to flow through. at the end of the pause presumably israel resumes its fighting then we're back to the same situation we're in right now and, of course, they'll be more calls for another pause. how can the israelis agree to something like that? plus -- you might make the argument by israel going through gaza and opening it up, they will probably do more may do more for human tarn existence than if they paused today they open the main highway from the north down to the south. if palestinians topght leave up there they're now free to pass down through into the south. paul: kyle, the democratic pressure, though, as mary suggested from the left is building. on joe biden, and the tone markettedly that president biden has had shifted this last week where he, you know, stall -- support for israel has been stallwork no question request about it but shifted and came out for the pause do you think it is for the pressure from the democratic left? >> they're being explicit about we will stay home and not vote for you in some of the states particularly michigan, where he needs to win in 2024. if you do not call for a cease-fire, but the problem is that he has i think many members both of the democratic party and the broader electorate independent who is accept the kind of arguments that you're hearing here. which is that, maybe there would be a case for a pause if you can give over those 240 hostages including children that hamas is still holding. but you don't see any indication of that instead you have a member of hamas political bureau going on tv in lebanon saying what happened on october 7th was justified and we will do it again and again and again. paul: mary let's shift to the aid for israel which passed house this week $14 billion along with some cuts to funding for the irs. that passed the last year -- but that bill is not going anywhere on its own in the senate. president biden said he would veto it. but is there any doubt in your mind that we're going end up passing sol aid for israel here at the end of the day? >> i am not completely surprised. that's for sure. because truth to tell paul, it has a lot to do with the late 1960s and the early 1970s back then it was called the about antiwar movement anti-vietnam. guess where a lot of college presidents administrators came from the antiwar movement back in the 70s. they were there at the creation, a roll it forward a lot of them are now running these universities out of the same mindset and what was interesting about the period back then was -- by and large democratic party got on the wrong side of the american people. they were regarded as antimilitary anti-defense. it took them a good 20 years to dig out from under that and now the question is, whether they are going back into the same mode of being out of the sync with american people who by and large support israel and its right to defend itself against a terrorist group like hamas. i'm heart put to see college administrators pushing back very hard and could be more donors like those at ben penn and harvard and pull back and maybe wake them up politically, though, paul i don't quite see it happening. paul: on that note mary 24 of america leading law firms sent a letter to the law school dean said it was 24 at the start i think it was well over 80 last count law firms saying protect your jewish students hate will not be tolerated at our firms and subtle implication is if this continues we're not going hire those students. >> yeah. i think it's about time. i mean that's, you know, you look at this and you think what took them so long? is one thing and the left is saying, wow you know they're trying to control political speech. but this is not about political speech. this is about basically targeting hatred of groups which we're supposed to be against. so i'm glad to see these law firms stepping up. you know, i would go back you guys are talking about the 70s. rallying up mob is not new i want to bring up the french revolution. >> i was not alive then mary. >> neither was i but i read about it. idea of cancel culture we've seen on university campuses we've seen speakers go to yale law school, and be shouted down and run away. i mean, there's a certain narrative or certain -- i would say moral authority that young people have today that they think if they have the right idea, then anything they do in extreme manner is fine because they're right. and of course, this is the very definition of intolerance and it's -- i'm glad to see the law firms stepping up. paul: kyle, the member of congress from michigan has said that biden is supporting genocide by he used that word by supporting -- the israelis and their exercise in gaza. and threatening basically to withhold support for biden in 2024 is that a serious, political threat? and how long are they determined to go with this kind of operation? >> well look, i think the one big take away from the trip to israel was just the sense of vulnerability. it is really hard for americans to imagine that but the vulnerability there and just survival of their state is at stake. i think that to me that was the bigs take away and so -- with regard to what's happening right now, i think we have to give israel the time and the space and certainly the support equipment intel, corporation to let them destroy hamas. we need to make sure that people are viewing hamas the way we view isis the way we viewed al qaeda they deserve that designation. and i think we have to keep that in mind. but they view it as this -- the survival of the state of israel and we need to give them space to destroy this incredibly horrendous terrorist group. >> what do you make of the president and secretary of state blinken's request for a pause? is that they say they want get hostage you want get them not everybody wants to get them out. it would do you think a pause would accomplish that? and -- and can we ask that of should we ask that of netanyahu? >> i think again we have to trust israelis and give them the space right they're ones on the floor. one thing that was very powerful in meetings we met with the prime minister and met with war cabinet. they emphasized you know all of our children are in the idf. we're not doing this lightly. every one of us has a real skin in the game, and as you know, paul, when you're doing this pause, hamas is going to no doubt use this to resupply about are rearm, dig in more, and that is something that i don't think should be acceptable. they also said imagine we were there a couple of weeks ago. imagine two or three weeks after 9/11 if the world community said to the united states hey, we need a humanitarian pause for this civilians, what would the reaction in the united states have been? i thought that was a powerful argument and you saw -- netanyahu said that recently. so again, i'm not supportive of a pause right now. i think it prevents -- it could cause too much trouble as opposed to helping civilians we all want to help civilians israelis don't target civilians united states doesn't, hamas targets civilians. paul: is the administration doing enough in your view to deter these attacks we're seeing from iranian proxies on american facilityings and on -- americans who are in the middle east they've responded twice. they keep saying if they keep attacking we'll respond again. but they keep attacking. >> yeah. i worry that right now the responses have been too weak and that's only going to engender more tabes. the broader strategic issue paul is you know, and again, iran's finger prints are everywhere. people are debating whether or not they were involved on october 7th. but let's remember, there's no hamas without iran. there's no hezbollah without iran. there's no houthis without iran. they are everywhere, and if this horrendous attack on israel hopefully can do one thing in my view, it will help to break what i call the fever dream, the democrats have about always cooperating with the iranian terrorist looking for that moderate so-called moderate the appeasement policy of the biden administration has failed miserably as it relates to iran. so do they need to do more on deterrence, yes. but strategically we need to be reimposing sanctions reimposing ballistic missile regime there's so much more we can do kind of strategically to go after iran again. that they let up after the trump administration did a very good job in that regard. paul: all right let's turn to the debate in congress which is heating up as you know about aiding israel and ukraine. the house passed the through israel with the irs cuts, clearly that's not going to pass the senate. where do you stand on linking aid to ukraine with aid to israel? do you want one vote or can you separate them? >> well i don't think there's going to be a vote on the bill that passed in the house that's, obviously, up to schumer and he's already said he's not going to do that and what i've been calling for a number of weeks now -- is that we need to recognize that these challenges are all inner connected this new era of aauthoritarian aggression putin and ayatollah in iran and response needs to have four pillars, israel, taiwan, and aid critically the border. i've told jake sullivan senior people at white house border is the linchpin if you're going to continue to allow 8 million people come in, 17 members of the terrorist watch list that were, that were caught at the border just in september. it's a huge security risk. to the country it's got to have that but the border got to be policy changes, stop the flow. without border, without a serious border policy change this could be tough in the white house and chuck schumer everybody else has that message. paul: they won't get the votes you don't think -- >> we have leverage in the senate normally that's gong require 60. if the border policies are not changed we can withhold closure, and so we're very serious we've all sent that message. paul: if you get those policy changes like change in the asylum law tougher standard. do you think that there will be enough of republican votes to break a filibuster in the senate with a single bill to pass ukraine and israel aid as one? >> well, probably it's her herself, what else could explain it? we have expression in politics called big mo means big momentum, and i don't know where that goes so far to say nikki haley showing big mo at the moment but pretty big momentum. there's some momentum, and the expectation was that nobody was going to be able to compete with donald trump. but she is rising in the polls. she is turned out to be extremely articulate on the subject she talks about. that includes foreign policy, foreign policy is in the news now. and i want to raise the question here about whether donald trump at some point has to worry a little bit about reverse momentum he's not going to be on this stage. he's just not participating, the world is shaking right now. people are looking for individuals to make sense of it. and nikki haley and i would assume chris christie and ron desantis will be on that stage talking some sense about what the united states should be doing. he'll be there -- >> trump answer no words on my watch no wars again and i'll end ones we have. that's his basic -- >> if you believe. if you believe that -- manches, but haley former ambassador of the united nations gives a foreign policy credential how much do you think foreign policy is playing in her progress? >> i think it is huge and very good when she was at the u.n. and clear spoken she was very -- energetic and brave frankly saying things that, you know, a lot of other people didn't want to say. so she -- i think she gets a lot of credit for that. and you notice that people who are some big donors who are fed up with trump are starting to go her way also like ron cameron from arkansas, a poultry guy. you know she's getting money from discontented trump voters so that's also helping her momentum. paul: got a long way to go really trailing kyle, trump in any of the states that race seems frozen so far with trump at the top. so, her goal really is like desantis consolidate and get herb else out and trump one-on-one. >> she seems to be doing that up in south carolina clear number two beating desantis i think by eight points in the realclearpolitics average now number two in new hampshire over desantis by about four there, and then she's not quite number two in the average yet in iowa. but she seem to be gaining some ground the latest des moines register poll has her tied with desantis both of them at 16 and so what is notable about what is if she becomes a consensus number two, she's already leapfrog tim scott in iowa. then perhaps she can force some consolidation and gets some endorsements from people who are still in the race. but don't want to see trump win. paul: let's talk dan, about races next week big one is in virginia govan glenn youngkin has invested a enormous political capital trying to turn state senate republicans control the house but that's up too because they have redistricting so big -- shot here to really show his brand of republicanism. can, in fact, win in a swing state. >> it is going to be an interesting race when glenn youngkin won they swept most of the other states offices as well. and the expectation has always been that virginia was sort of trending purl because it was so -- >> so blue. >> glenn youngkin is interesting and not compromised on conservative principles but suggested that portion should have a 15-week limit on it rather than six and in which other states have which seems to cause republicans problems. so glenn youngkin is trying to put together an interesting coalition and if he -- secures control of that legislature, the youngkin model is going to be looked at very hard by a lot of republicans. paul: mary kentucky democrat favored for big lead in the polls but now daniel cameron protege of mitch mcconnell dead heat looks like. >> biden is helping republican -- in kentucky -- [laughter] biden is not well liked in kentucky trump beat him by a lot, and the last election. and i think that if bashir wins it will be because he's been able to distance himself from bide but it is a very clear message for, you know, 2024 about how the state will go if biden is a democratic candidate. >> very briefly kyle ohio referendum on abortion there that would put it in the constitution right to an abortion. >> right and further than roe v. wade went and a signal of whether enthusiasm on abortion issue is going to be motivating democrats to the polls in 2024. the way that it was last year, and it is special elections earlier this year. >> what do you think will happen?
