the former president himself is set to testify on monday of next week followed for now by ivanka trump next wednesday. she appealed the judge's decision requiring her to testify. see if that schedule holds. >> bill: we'll see where it leads today. thank you. >> dana: house republicans are about to hold a news briefing one week after electing mike johnson as the new house speaker. right now they're ready to vote on a stand alone emergency aid package for israel and then they plan to hold a vote on a bill that pairs u.s. border security with fresh aid for ukraine. we'll monitor what they have to say and bring you the news as it happens. biden administration is under intense pressure to confront hamas one day after f.b.i. director christopher wray warned about mounting terror threats on u.s. soil. welcome to a new hour of "america's newsroom." i'm dana perino. >> bill: nice to be back with you. good morning. i'm bill hemmer. good morning at home. the justice department considering plans to file charges against terrorists thousands of miles away while the u.s. state department faces questions about known hamas supporters here in the u.s. and why they are being allowed to keep their visas instead of having them deported. the a.g. merrick garland says there is no room for hatred in america. >> today combating hate-fueled violence remains central to the justice department's mission for our democracy to function, we must all be protected in our right to live free from hate-filled violence and the threat of violence. >> dana: griff jenkins has more on foreign born visa holders who lied on their applications who entered the united states. >> this should be pretty simple and straight forward. if you openly support a terrorist organization like hamas you don't get to keep the vis yeah we gave you. state department isn't revoking visas that appears to violate their own rules. all these applicants must complete a ds160 form where the state department asks to you provide support tore terrorist organizations. as hamas is a terrorist organization they have an obligation to deport their supporters under current law. the former immigration chief under president george w. bush had this observation. >> if you are arrested at any of these for any crime whatsoever, whether it's trespassing, breaking the peace, assaulting a police officer and you are a foreigner in any capacity, student, worker, tourist, exchange, you have violated the terms of your visa and you can be deported. >> as we see the demonstrations continuing to sweep the country, some republicans are calling for a crackdown like senator marco rubio who says their presence violates the law. meanwhile the state department tells fox news that no visas are issued until all concerns raised through the screening process are fully resolved. whenever we uncover information that might suggest an individual is a potential threat the department shares that information with all appropriate u.s. government agencies. calls to crackdown on the vis yeahs is a sentiment we hear more from gop candidates on the campaign trail. that will increase. wait to see what the white house has to say about this. >> dana: you will bring it to us as it happens. thanks, griff. >> bill: out of virginia the attorney general in the state investigating a pro-palestinian nonprofit. the a.g. saying american muslims for palestine potentially used funds to aid terrorist organizations. now the group is pushing back calling the probe defamatory and dangerous. mike emanuel is on the story live in washington, too. good morning. >> good morning. virginia attorney general says he has launched an investigation to get to the truth about this nonprofit group. >> a state law that no charity is allowed to solicit funds that could be diverted toward terrorist uses. so we're investigating allegations about this organization both soliciting funds without being properly registered and allegations possibly diverting funds to known terrorist groups. >> american muslims for palestine is pushing back hard against the top attorney. instead of working to protect the people of virginia from the wave of islamophobic and anti-palestinian hate sweeping across our nation, he is contributing to the hate with tired islamophobic tropes and promises of a witch hunt straight from the mccarthy era. i asked him to respond to that critical. >> i find that laughable. i'm doing my job. i am a chief law enforcement officer to apply laws without favor or fear and exactly what we're doing here. >> he is strongly pro-israel and asked sheriffs offices across virginia to collect tactical gear to send to israel. they donated protective vests, helmets and plates. that equipment is being sent to israeli first responders and citizens. >> bill: thank you. mike emanuel in washington. see where it goes. nice to see you. >> dana: hundreds of americans stuck in gaza may be able to leave today through the rafah border crossing into egypt after it opened for the first time since hamas attacks on israel. our next guest congressman sent a letter to antony blinken two weeks ago stating my office has received outreach from several people from iowa requesting evacuation assistance for u.s. citizens who reside in my district but trapped in gaza under hamas rule. congressman joins us with an update. how many of your constituents are there and what's the latest? do you think they'll get out today? >> thank you so much. this is the challenge. we had over a dozen iowans trapped in israel, pastor goodwin and his family we were able to get out almost immediately working directly as the military guy myself have a plan to evacuate them. gaza has been an entirely different story. i have a woman in des moines, a u.s. citizen went to see ailing family members on their deathbed and got trapped in the crossfire and now after a terrorist attack by hamas on israel, has been stranded in gaza for weeks. there is only one land crossing that's into egypt. the question we have here is has the united states state department been in conversation with egypt about evacuating these people? if they have, then why haven't they informed congress? yesterday we saw the biden administration take a victory lap, if you will, on evacuating palestinians. we still have hundreds and hundreds of americans trapped in gaza with no plan for evacuation on where they are, how they are going to get out and what happens to them once they cross into the sinai peninsula in egypt to be able to get back home on american soil? >> bill: the number we have is 400 with regard to americans there. here is the president in minnesota yesterday. he talked about a group of a thousand. >> president biden: thanks to conservative american leadership we're in a situation where safe passage from wounded palestinians and foreign nationals in gaza has started. the american citizens are able to exit today as part of the first group of probably over 1,000. >> bill: a group of 1,000. we'll see how many americans are in there. what i find interesting is that the israeli government today, sir, is asking foreign countries if they could bring cruise liners to the eastern mediterranean used as hospitals to treat the wounded who come out of gaza. if you are able to get a deal on that, it could be significant. the egyptians helped the israelis seal that border. it's a hard thing to say by the egyptians don't want palestinians crossing into the sinai desert because they know it will be their responsibility and some of them could be hamas. >> bill, i think you are absolutely correct on this. no country wants to invite hamas to its territories. we saw what it did in israel and saw the barbaric behavior. what i am concerned about is that the administration not having an actual plan on what to do particularly with the american citizens who are trapped. i was involved multiple combat tours in afghanistan. we saw the withdrawal. i lost a young corporal from my district in the failed and debauched evacuation from afghanistan. we don't want this to be kabul 2.0 in gaza where americans are left behind. what we were able as private citizens to help get thousands of americans out and allies from afghanistan, this is a situation where we have two carrier strike groups in the middle east right now evacuating americans and being able to have them on a cruise ship or u.s. flagship to be able to vet who is coming out of gaza. make sure they have the medical access they need but also not allowing hamas to fly out of the country across the egyptian border or the southern border of the united states if left unvetted to come here. >> dana: both israel and ukraine are in need of funds and the new speaker mike johnson, has put forward and israel-only bill. the senate may be tempted to jam the house with a single bill but the risk is ending up with nothing, which is the worst outcome. no one will remember if the aid passes as one bill or several. is that how you see it? >> no, not at all. this is a situation where it is very clear the speaker has done a good job on this. we need to have a sole source of funding directly to israel right now to supply iron dome and help u.s. military elements resupply. we'll take that money directly from overspending that came out of the irs to fund more tax agents. we're also looking at a real responsibility here. the greatest national security threat to the united states right now isn't coming from moscow or even tehran. it is coming because of our massive national debt. we have to make sure we aren't just spending more taxpayer dollars on security without addressing the situations at home. a clean spending bill that pays for aid to israel, imperative. must come to make sure we aren't asking u.s. taxpayers to pay more. that's what a single bill does. i came to fight washington for the headaches on both sides and this is a pragmatic solution that helps our allies. >> dana: good to have you. >> bill: republican from iowa. 238 hostages what we've been told. what he is referring to if you have 400 americans carrying a passport you don't want the number to go to 638 or 639. >> dana: we talked to a father last hour waiting for his daughter and five grandchildren to come across. we have the sound if we can play it here. >> there is a list of 400 americans that they are posted today. she number 115 on the list. we're on needles and pins to see whether or not she has been able to get into and get processed out. we have not heard from her. >> dana: okay. so we will stay in touch with john. glued to fox news and we appreciate that. >> bill: can you imagine being a number on a list during this war? wow. florida house now. this is house republican speaker stefanik out of new york talking about the vote for aid to israel, which in all likelihood which will pass in the house. see what happens in the senate. she is talking on that point. we'll keep you updated and bring you headlines. part of the house republican leadership. >> why are you tearing that down? excuse me? i put that flyer up. i would like it back. why do you think this is acceptable? these people are kidnapped. >> bill: the scenes like that unfortunately anti-semitism spreading in american schools. the aclu is warning schools against shutting that down. plus this. >> dana: fighting intensifies in gaza as president biden calls for a pause. will that end up just helping hamas? >> this conflict has the potential to reshape the middle east in the same way that world
