muskot intro. >> bret: it is new. thank you, jesse. good evening, welcome to washington. i'm bret baier. prosecutors attack what they call a pyramid of deceit in closing arguments in the trial of ftx founder sam bankman-fried. our "common ground" segment tackles the israel-hamas war. migrant children at the southern border as well. plus, donald trump jr. takes the stand at the civil fraud case against his family. ♪ >> bret: but first, breaking tonight, five american aid workers have been allowed to leave gaza through egypt. the rafah pass. hundreds of other u.s. citizens still waiting to get through. this comes as hamas official says the terror group will repeat its attacks against israel until the nation is destroyed israel is reporting the elimination of another hamas leader. israeli airstrikes pounded the area around the gaza refugee camp for a second day. and there are mounting casualties on both sides inside gaza. we have fox team coverage tonight. jennifer griffin here in washington with the search for hamas tunnels in gaza. peter doocy at the white house with what president biden is saying about americans trying to get out of gaza. but we begin with senior correspondent mike tobin in southern israel tonight. good evening, mike. >> mike: good evening, bret. israel claims to have killed another high value hamas target. the man who managed the anti-tank fire but it comes at a price. at least 16 israeli soldiers have been killed since the ground offensive expanded. [gunfire] >> mike: with ground combat intensifying inside gaza, the death toll on both sides is surging as troops push closer to gaza city and its dense neighborhood. [shouting] >> mike: following tuesday's devastating airstrike which left a massive crater in the jabalia refuse agree camp the director says hundreds were killed or injured. hamas says hostages are also among the dead. >> we see that hamas is in the current conflict as psychologic propaganda. we don't take anything whatsoever at face value. >> go, go, go. >> with hamas vowing to repeat the october 7th terror attacks on israel again and again until it's destroyed, israel's prime minister acknowledges the war will be long and difficult but the jewish state will prevail. >> i promise to all citizens of israel, we will get the job done. we will press ahead until victory. >> a small glimmer of hope for those looking to leave gaza. for the first time egyptian and palestinian officials opened the rafah crossing allowing dozens of injured palestinians and hundreds of foreign passport holders to escape into egypt. foxconn firms at least five american aide workers left today. more are expected to leave in the coming days. >> we came here hoping to live. we have a little hope to live and save our lives. >> mike: israel continues to deal with attacks from other fronts. the military says it shot down a drone and intercepted a houthi rebel yemen this has got a look at iron dome battery. the priceless. >> the interception save hundreds of people during war. the number of people hurt by rockets is very low. >> the regional fallout from the offensive into gaza ranges from diplomatic to militant. jordan has recalled its ambassador to israel iran backed hyattys in yemen claimed correspondent peter doocy has details tonight live from the breaking lawn. >> peter: we know the leader of hamas lives in qatar yet president biden is thanking qatar for these role in their talks to try free americans from a war zone. , we have all seen the devastating images from gaza. >> peter: hundreds of americans remain in gaza. >> american citizens left today as part of the first group of probably over 1,000. >> peter: the state department says hamas gets nothing for that. >> we are not making any concessions today. >> peter: vice president harris is abroad in the u.k. rallying partners behind israel's campaign. >> there should not be any intentional targeting of civilians and there should be the requirement that we meet the humanitarian need of the pima region. >> white house support for israel still strong, citing the hamas spokesman's call to repeat october 7th style attacks. >> chilling comments. we all need to pay attention to them we need to take them seriously. >> the terrorists could exploit the border crisis. >> bad individuals out there like iran and others, are watching the news and they are saying look if there is an opportunity to get inside the united states the southern border is our avenue to do that. >> peter: house republican also soon call a vote on a resolution condemning support for hamas on college campuses. liberal lobbying group j street wants democrats to vote against it arguing universities have anti-semitism handled as other prominent democrats come down against anti-israel activists. >> it's disgusting that you have people across this nation tearing these down, doing these kinds of a thing, too. i dare any of them to try to come do that here. >> peter: officials here don't just want the focus to be on combating anti-semitism. just a few minutes ago we got embargoed copy of a new effort are up by the domestic policy council, the national security council. it is the first ever white house strategy to counter islam phobia but we don't have very many specifics at all about what the strategy is, bret. >> bret: peter doocy live on the north lawn, thanks. ♪ take a look what is going on day 26. still attacks u.s. forces. we are now up to 28 attacks on u.s. forces. the latest happening here in syria at the gainerson. this was thwarted. there were two drones targeting gainerson. 28th attack in iraq and syria. you are seeing a lot of the these different attacks because there are a lot of u.s. forces and u.s. contractors throughout the middle east. 45,000 in these various places; however, most of the attacks are in iraq and syria. inside israel the attacks are continuing hamas' militant ring fire attacks. take a look at this. you see the yellow is mortar attacks coming from gaza. the red are recent rocket attacks and then as well ied explosion here. this blue is actually an effort by on-the-ground infiltration coming from gaza into the communities right outside of the wall. so that is continuing as israel pushes in. we have shown you how these israeli ground operations are getting into gaza starting up here in the northern section. they have pushed down through clearing operations and advancing into the northeastern part of gaza strip. also extending along the coast now and in the northwest palestinian militia claimed to engage israeli forces in the south southern part of gaza city. as we said at the beginning of the show, 16 israeli soldiers have been killed so far inside gaza. a number of that is expected to go up as that building to building street-to-street fighting continues make focus of that fighting is destroying the vast network of tunnels that, is what these yellow lines indicate think about this and how staggering these numbers are this is 25 miles straight address here, the length of the gaza strip. this is six miles that is a small area with 2.2, 2.3 million people crammed in here. these tunnels, they extend some 300 miles underneath the gaza strip. chief national security correspondent jennifer griffin has that story tonight. >> 300 miles of underground tunnels, home to the hamas hunter killer teams. affectionately referred to as the hamas metro. >> you can only get one person down the tunnel at a time. i really psychologically can leave soldiers to feel cause astro phobic get vert toe and lose sense of direction up, down. lose sense of time. >> retired major john spencer expert at west point in subterranean warfare. the deepest tunnel found by the idf two years ago in gaza is 23f reach of the traditional bunker buster bombs in the israeli arsenal penetrate 100 feet under ground through 20 feet of concrete. in 2021, the idf destroyed 60 miles of the tunnels in gaza. fox news correspondents have been given access to the tunnels in the past. >> down into the desert. >> israeli kevin's forces have specialized units that train to fight in the tunnels using robots and other special weapons. >> drones that bounce off walls, little remote control cars. >> dogs that can go underground to sniff bombs like booby traps. dogs that can attack under ground. >> g.p.s. and night vision do not work under ground. >> most night vision goggles actually rely on some type of ambient light, moonlight or something like that. can you use infrared and thermal but most standard night vision capability doesn't work under ground where there is zero light. >> known to fill the tunnels near its border with sea water and sewage. the israelis developed a sponge bob a large plastic bag filled with it w. two chemicals when you pull the tab and three it down the sewer interest, a hard foam forms that seals the tunnel temporarily. the biggest problem right now, bret, is that the hostages are likely being held in the tunnels as human shields. >> bret: jen, they have been planning for this for a long time. and the idf, a lot of experience dealing with this. when you look at what the pentagon is looking at and worried about, heading into this weekend what is that? >> the pentagon has trained with the idf in the past in how to attack and how to deal with these tunnels. what the pentagon is looking at tonight, they are looking very carefully at syria and iraq they are very worried after friday prayers if iran or hezbollah decide to have those iranian proxies attack u.s. bases that, they are very vulnerable and they are going to have to respond. >> bret: okay, jen, as always. thank you. cornell university student has been arrested on a federal complaint allegedly calling for the death of jewish people online and threatening to shoot up an on campus dining hall. 21-year-old engineering student patrick die allegedly threatened to stab and slit the throat of any jewish males he sees on campus and to rape and throw off a cliff jewish females and to bee head jewish babies. today attorney general merrick garland said the justice department has no tolerance for violence or threats of violence fueled by anti-semitism or islamophobia. >> bret: breaking tonight, the house is considering some personnel matters. they involve possible sen censure for two members and possible expulsion of another. chad pergram monitoring it all on capitol hill right now. good evening, chad. >> bret, good evening. the house could vote tonight to expel embattled representative george santos. his fellow new york republicans have had enough of his controversies. >> we're going to set a new precedent today that we're against lying fraudsters coming to the house of representatives. well, then i'm all for that precedent. they believe that by attempting to expel me they will garner political points, capitalize on political fundraising and receive congratulations from those who do not approve of my voting record. >> it takes a two thirds super majority or 289 to expel a member. the house has only expelled five members in history. some lawmakers ask if the house is jumping the gun. the house also considers a plan to censure a michigan democrat rashida tlaib, she supported anti-israeli rally on capitol hill. civil fraud trial charging himself, his brother with inflating the value of their business. correspondent nate foy is outside the courthouse tonight with the latest, good evening, nate. >> good evening, bret. tonight, donald trump jr. left the courthouse without saying anything to reporters but his testimony today focused on his education and his role as an executive at the trump organization. specifically his involvement in the preparation and signing of financial statements that new york attorney general letitia james contains fraudulently overvalued property. don jr. and his brother eric are co-defendants in the trial alongside their father, former president donald trump and other trump organization executives. they all deny any wrongdoing. today in court, don jr. testified he signed the company's 2017 statement of financial condition, which is just one document where the attorney general's office claims the company overvalued its assets. but don jr. claims he didn't prepare that statement himself. he also testified about his role increasing at the trump organization when his father won the presidency. the former president posted by judge arthur engoron there is no victim except me. leave my children alone, engoron. you are a disgrace to the legal profession. ivanka trump is the only older sibling not named as a defendant in the case anymore. she originally was but had an appeals court dismissed the case against her because of the statute of limitations. she will still have to testify next week pending an appeal that she filed today. don jr.'s direct examination will continue tomorrow followed by his brother eric followed by the former president himself next monday. if the schedule holds ivanka trump next wednesday. she will be the final bennet and marie salazar. thank you both for being here our first bipartisan, bicameral common ground. and you are working on the children's court act. we are going to talk about that in a second. one of the things that is pressing on capitol hill now is aid for israel. there is a debate between house and senate right now about how to deal with that. congresswoman, speaker johnson wants to move forward with a separate israel aid bill. is that where you are? >> fine. whatever help we can give to israel, we have to have done it yesterday. so if he wants to bring that bill individually, we will vote on it. we want to bring it together with ukraine, at least i will vote for it. because we know what the russians do to people. and we know what hamas does to israel. so we have got to help both. >> >> bret: so, senator schumer and others have said it's not going to work unless it's all together. >> i think senator schumer and senator mcconnell both have said that i think they both understand we need to honor our commitments here to israel and to ukraine. we shouldn't cut and run. i agree 100 percent with the congresswoman that this is the thing that vladimir putin would want most is for us to decide that we're tired of this and we're going home. >> bret: senator, you don't think that president biden is going to veto israel aid if it comes through the house. >> i don't think we should play political games here. yyou know, i was the guy the other day that held up the budget because we were passing a bill with no ukraine aid. my born was born in warsaw, poland in 1938, a polish jew. she know what is is done to people you know when he they're forgotten. the united states, above all other countries in the world, has a special responsibility here that we have to fulfill. >> bret: congresswoman, there is a split in the republican caucus on ukraine issue, on the ukraine funding issue. >> because maybe they know what the senator and myself we know i represent the city of miami. the heart of the cuban exile community. the cubans know exactly what the russians do. we send a message to vladimir putin that we're going to forget because we got tired then he says all right, the next thing i need to do is poland, and then it will be a lot bigger and going to cost us a lot more. right now ukraine is costing only 5% of the pentagon budget. not one american soldier has died if that were to change, there is going to be a lot more american troops having to intervene and a lot more money. >> this is part of what you are talking about is concern about what is happening at the border, specifically for children. this is the children's court act of 2023. a bipartisan bill. both in the senate and the house to address the backlog and removal proceedings. train judges and trauma, inform practice and ensure children are engaged in the process. utilize child appropriate procedures. expedite access to legal counsel. >> this seems like a massive problem along the border, senator. >> it's a huge problem. and i think it's an amazing thing that we have a bipartisan bill that reflects both the senate and the house, you know, for once and i think. >> bret: that is a rarity. >> we know we have kids at stake here. as i mentioned earlier my mom was separated from her parents for three years during the holocaust. these have lifetime effects on kids. and all we're saying is let's have judges that actually have experience with kids work with kids to make -- at the border to make sure that think are actually getting, you know, into the situation we need to instead of subjecting them to child trafficking or to child labor. those kinds of things. >> bret: the unaccompanied minors, congresswoman, along the southwest border, if you look at the fiscal years, 2021, 2022, now it's 137,000 in 2023. >> 250,000 children have entered the country legally in the last two years. and most of them are hispanics, which i represent like i said the city of miami, 75% of my district is hispanic. these imagine what we are doing united states is saying we are the best country on earth because we cannot erase what they had to go through crossing central america. but we can help them not continue with the trauma after they get to the border. we can -- and i commend the senator because the reality it was his idea and i'm delighted that we can work together, republicans and democrats, to show the rest of the country that we are trying to do the best with those. let me tell you something and something else i think is very important. child sex traffickers are having a feeding day. so this bill is going to make sure that we do not give back to those child sex traffickers once they have entered. because that's happening right now. there are 85,000 children who we don't know where they are. they may be in the hands of the traffickers again. >> bret: it's really amazing, terry lee hhs whistleblower back in april, the house judiciary committee. here's a piece of what she said. >> whether it's intentional or not, it could be argued that the united states government has become the middleman in a large scale multi billion dollars child trafficking operation that is run by bad actors seeking to profit off of the lives of children. >> bret: this is one much those things that you can around the edges start to address. >> just around the edges. that is place we can start. i believe we should resolve the situation for the 11 million people here that are undocumented. i believe that we should have a secure border. i was part of the gang of 8 in 2013 who wrote the last comprehensive bill that did get 68 votes in the senate, you know. and i think the country, in many ways, would be a better place if we had been able to get that through the house of representatives. because we wouldn't have left all these political questions unresolved. you know, we wouldn't have all these people in america living in the shadows, driving down wages because we haven't been able to get our act together here. maybe, if we can get one piece of business done together, it can show people other things that we can also get done. >> the problem with the border, it's national security. it's not only immigration. national security is providing the entrepreneurs and the business class, the hands they need. we have 8 million vacancies and we have those illegals here that could come out of the shadows, not necessarily be -- they don't want to be. they don't want to pass the citizenship. they just want dignity to live a dignified life in the promise land. we do have to fix immigration. otherwise, we are not the united states anymore. that's coming up. i'm sure that senator is going to help me do that. >> bret: there we go. see if we (dog bark) it's just smarter, healthier pet food. it's amazing what real food can do. >> >> bret: the federal reserve will not raise its key interest rate at this time. that news led to a rally on wall street today. the dow gained 222. the s&p 500 was up 44. the nasdaq rose 210. vice president kamala harris is calling for the global community to consider and address the full spectrum of risks posed by artificial intelligence. harris made the remarks in london after president biden signed an a.i. executive order earlier this week. it comes as political leaders, including the vice president and technology executives gather at an inaugural a.i. safety summit in britain. the meeting was organized by prime minister rishi sunak. he wants to carve out role for britain intermediary economic blocks of u.s., china, and the european union. ♪ >> bret: closing arguments have just ended in the trial of former crypto-currency executive sam bankman-fried. fox business correspondent kelley o'grady is outside the courthouse in new york with the latest. good evening, kelly. >> good evening, bret. that's right. in closing arguments today, the prosecution systematically used sam bankman-fried's own words against him. sbf hail merry decision to testify seemingly gave the government the final puzzle piece to stitch their narrative together they went count by count lighting how media would you haves, tweet proves criminal intent. the prosecution underscored the secret relationship between alameda research and ftx arguing sbf hid the connection because he knew it was wrong. six succinct times bankman-fried could have come clean instead doubled down sending fake balance sheets to lenders and spending, quote: like he won the lottery. one example came october 7th as ftx began to unravel he tweeted ftx has enough to cover all climate holdings, we don't invest climate assets. showed a chat from 3:08 that very morning proving sbf knew 8 billion in customer funds was missing. they also debunked his defense arguing the claim he was acting in good faith but had bad luck does not dismiss he knew he was doing wrong. a chilling line with the jury that stops with you today. in their closing the defense argued of the prosecution tried to turn a mass into a movie villain. this is real life. people make mistakes and the government failed to include sam's reasoning because it didn't fit their narrative. we expect the prosecution to present a brief rebuttal tomorrow morning after sam bankman's fate will lie with the jury and then, bret, we wait. >> bret: kelly, thank you. >> i wasn't running alameda. i didn't know exactly what was going on. i didn't know the size of their position. a lot of these things i learned over the last month that i learned as i was frantically digging into this on november 6th, november 7th, november 8th. and, obviously, that that's a pretty bigs in stake. >> bret: sam bankman-fried in an interview there. long before the ftx trial along the time of his arrest he took a multitude of media interviews. he appeared on podcasts and tweeted obsess sently he started his own substack. he submitted written testimony to congress. much of it reappeared in trial in the form of government exhibits. about the money still missing, victims claims are $16 billion. meantime, the assets recovered so far $7 billion. with a b. get some analysis on this from katie, a constitutional law attorney, former federal prosecutor. katie, thanks for being here. how do you see this case as we get ready to wrap it up, closing arguments finishing up today? >> i think this case is just a classic example as and i'm a criminal defense attorney, of why defendants should never make pre-trial statements. that really may not have even saved sam bankman-fried here. as you can see and as the reporter was saying all of his pre-trial statements, all of the views, all of the allegations that he made pre-trial have been thrown back in his face and had no good answers for those. so that really led him into a dangerous place for defendants on the stand. so certainly looking very bleak for him. i don't know that this is going to go well. in terms of the conviction, he may, on some of the charges have better luck than others because the prosecution does have to prove all of those specific instances and the intent that goes along with it. but it is looking very bleak for sam bankman-fried at this point. >> bret: i want to turn to the trump trial in new york that's ongoing, the civil fraud trial. "the washington post" puts it this way. transformed trump family will take center stage in new york courtroom. latest financial disclosure says the new york real estate holdings, trump power and park worst 2,387,000,000 generating income 59 million. overall trump's wealth relies less on the real estate empire for which he was once known and once on businesses turning his political popularity into dollars according to disclosure. how do you see this? some of the estimates on -- from, you know, the mar-a-lago estate being $18 million seemed way out of whack from colorado. how do you see this as this trial moves forward? >> this trial is very interesting and, obviously, the judge in that case made some pre-trial determines that these filings were fraudulent. that the valuations were fraudulent. but, clearly, to many people, there is a lot of subjectivity that goes into these things. certainly for trial purposes, i don't think that there is a very good shot at victory here. although there are some things that need to be figured out in terms of the conspiracy charges and the actual fines that might be imposed. for appellate purposes there is quite a lot to look into here. again, thee valuations are very subjective in many people's minds that are in that industry. this judge seemed to have no room whatsoever for alternate explanations for how these came to be. so for this purpose at trial, again, if the judge that's deciding the case probably not going to go very well for the trumps. but i think there is significant appellate issues at play. >> bret: in fact, there are significant appellate issues on a number of these cases. if you look at this timeline of what will happen in 2024, the legal and political timeline kind of meshing all together, it is quite something if you look at it all together. the iowa caucus, the defamation case, the classified documents case, all of these big events, election day, but the appellate process would push that, even if there are convictions, until way past election day. >> well, it absolutely would. but, on the criminal sides, we have to remember that if there is a conviction, and there is any jail time that begins immediately. even pending an appeal. so, certainly, appeals can be made and will be. those take a very long period of time in any types of cases. but there are immediate consequences that come into play. and even in the civil trial, perhaps the suspension of the business certificates or cancellation of those certificates before an appeal is ever decided and even if that does favor the trumps at that point many of the -- much the damage will have already been inflicted in some ways. >> bret: we will follow it all. it's fascinating to see both those cases. katie, thanks so much. >> thank you. >> bret: up next, the panel on democratic fish fish fissures. bob knight as died. knight was one of the most successful and controversial figures in sports for decades. he won 3 national championships at indiana university. his family says knight died at his indiana home surrounded by his family. bob knight was 83. money managers easy to thinl are pretty much the same, but at fisher investments we're clearly different. ♪w? >> yeah. what happened in israel on october 7th, that's one of the easiest, moral tests of our time, whether you can condemn that or not. and the vast majority of americans are utterly appalled by what hamas did. but the problem for democrats is that they have a very significant portion of their party that tremendously is unable to condemn. a lot in political activism core on college campuses. they are having a difficult time talking clearly about this because of the political repercussions in play in certain localities and states like michigan where they comprise a bigger part of their base. >> vince, it's hard to overlook what hamas charter says it's supposed to do but hamas leader, hamas official speaking out. take a listen. >> isra no place on our land wet remove country constitutes military, political and catastrophe to the arab and islamic nation it. must be finished. we he are not ashamed to say this with full force. we must teach israel a lesson. we will do this again and again. the flood is just a first time and there will be a second, a third, a fourth because we have the determination, receipt solve and the capabilities to fight. >> bret: we have checked that translation that, is seven days ago. seven days -- no, i'm sorry, it was 10, 15 days after the attack. saying essentially going to keep doing it. >> what does it tell you those remarks were not well-publicized?
