america's late news. fox news at night. breaking tonight, the biden administration issued a document saying there is an acute and immediate need for a border wall, we know because we broke the story on this show last night. but now the administration is walking that statement back saying there is no need for a wall. and they are only building it because they have to. matt finn is live with how the white house is trying to change the narrative. >> good evening, trace. once again president biden says he does not think border walls work. just one day after his own homeland security secretary deciding the new border wall connecticut trust. the president defended his administration's administration to wave 26 environmental and health laws to build about 20 new miles of border wall in texas. homeland security secretary mayorkas said there is an immediate need to expedite building this section of the wall. today president biden claimed he doesn't want to build the new wall, explaining he is forced to because congress previously approved the funds in 2019. >> appropriate for the border wall. i tried to get them to reappropriate, redirect that money. they didn't. they wouldn't. and in the meantime, there is nothing under the law other than they have to use for what it was appropriated, i can't stop that. >> secretary mayorkas construction of new wall is not a change in policy for this administration. which does not believe a border wall is a solution. >> from day one this administration has made clear that a border wall is not the answer. that remains our position and our position has never wavered. we have repeatedly asked congress to rescind this money but it is not done so and we are compelled to follow the law. >> over the past year i spent 40 to 50 days at the southern border, i talked to agents in person and residents down there who have told me the wall is a great asset. it does block crossings in certain areas. trace. >> trace: a lot of people have echoed that, matt, thank you. well the fox news at night common sense department doesn't normally weigh in on president bide's age but it does appear he is officially suffering from memory loss. common sense has videotape of biden, there will not be another foot of law constructed in my administration. of course, at the time it wasn't just a wall it was trump assaulting the dignity of immigrant communities. biden told the migrants to come, saying they would be allowed to stay so they came and they stayed by the millions. all the while, dhs secretary mayorkas said repeatedly the border was secure, funny because the very same dhs secretary now says, "there is presently an acute and immediate need to construct physical barriers and roads in the vicinity of the border. really kind of a clumsy way of saying we need to build trump's wall fast. so, to be clear, tuesday the border is secure. wednesday we need a wall. except president biden says we don't need a wall. that walls don't work and he is only building it because the money has already been allocated. his hand is being forced. i guess he is also being forced to wave 26 federal laws to get it done. during this election you will hear a lot more about border security or bs as common sense calls it. because migrants and bs just continue to flow. let's bring in john yu and kaitlyn roe republican candidate for congress in california, welcome to you both. john, it appears joe biden is suddenly arguing his presidential power here is somewhat limited. what do you think? >> this just shows how backwards the biden administration has the presidency. the constitution gives the president the primary duty of protecting the country, protecting our security, you would think that would include primarily protecting the border. here however he is claiming oh, congress is making me build a few miles of wall, i don't really want to do it. meanwhile the constitution makes congress the primary maker of policy domestically. he has tried to cancel student debt, tried to stop all of the evictions, he has tried to force everyone in the country get a covid vaccine. and supreme court has slapped him down repeatedly for going beyond his presidential powers domestically. >> trace: i want to bring indicate now. the border security, the bs we were talking about and common sense there. here is secretary mayorkas today. watch him. >> we had no choice, it was mandated bylaw. we requested that congress rescind the direction, it did not do so. we of course must follow the law. our policy remains as it was since may 1. we are opposed to the construction of the wall. >> trace: kate, we hate that wall but we are going to build it because we are forced to build it. >> yes. yeah, you're forced to build it because you have seen the destruction of all these left cities. so, of course when people are wanting to abandon your party and have you had enough of all the terrorists getting in and sex trafficking and drugs, maybe now it's time. but i would say to all the democrats that possibly could be watching, if you know one, tell them, we're happy to take you over here at the republican party, anyone disgruntled, disheartened democrats we'll give you amnesty at the republican. >> trace: there are a lot of disgruntled we can imagine, a lot in texas because they've been fighting this border thing for years. cnn headline, biden says border walls don't work bypassing laws to build more barriers in south texas. so, he's waving 26 laws and the thing is these are mostly environmental laws, the environmentalists are going to scream from the roof tops over this, john. your thoughts on the waving process. >> it also shows what biden could do if he actually vigorously used the powers of the presidency to the way the founders wanted, they wanted the presidency to be energetic especially protecting the country, protecting the boarder. he should be waving more laws to build more miles of borders, we have lots of empirical data he person from places line israel, where there is a wall that has worked remarkably well. i don't see any evidence why a wall wouldn't work on the southern border, too. >> trace: there is no evidence, i started my career on the southern border. they've been talking about it for 38 years, we were covering the very same problems. kate, the argument is preposterous, immigration reform is not going to slow the flow at the borderment the only thing that slows the flow is a barrier. >> 100% without that barrier you can't enforce the laws of your country. we have invited people here, fast pass into disney land, we've even said to the world come on into america. without a wall, there is no way to adjudicate any crime whatsoever. you can't build a little portion of the wall that they are talking about either. you need to build the whole wall and secure our nation. >> trace: that's the whole point is, they've been saying it's secure, we know it's not secure. when they release a document that says it is secure -- i mean it is not secure, no, no, we didn't say that. we think a wall is not going to work. your final thoughts on this john yu. >> you're exactly right. the administration itself is confused. they are letting ideology get in the face of reality. reality piques through and we saw it yesterday and today. >> trace: thank you, ready to move on from the democratic party. kevin cork with the new numbers, kevin, good evening. >> good evening, trace. two major political parties and they remain relatively unpopular with the american population. about 56% of americans view the republican unfavorably. 58% the democrats the same way. the public chooses the gop over the dems by healthy margins when they are asked about which party would provide better safeguard for the nation's prosperity and security. looking ahead for the next few years, which party would you think would do a better job of, you know, keeping the country more preposterous. number for gop 53 to 39. look ahead to the next few years, which political party do you think will do a better job of protecting the country from international terrorism and military threats. the gop by a very wide margin. then there is this. asked which political party do you think could do a better job could handle the problem you think is most important. the republican party or the democratic party. the republicans win that 44 to 36. 6 in 10 surveyed say they disapproved of the job being done by president biden. not good news for the white house, trace. >> trace: no, because it's going to be one of the top topics coming into the election will, kevin, thank you. jason chaffetz and chairman and republican strategist denise gibson. denise and jason we appreciate it. i want to put this poll back up, it's pretty telling, right? americans lose faith in the democratic party, bullet point one, 58% of americans view the democratic party unfavorably. bullet 2, 53% of americans believe the republicans will do a better job of keeping the country prosperous over democrats. and only 35% have faith that the democratic party can protect the country from international terrorism. and military threats. in an election year, jason, those are bad numbers. >> they are about as bad as they get. it's about safety and security. safety and security when you walk out your front door. safety and security over seas. and safety and security in your wallet. and, you know, president biden has been out there touting bide environmental no, ma'am i cans and it -- bidenomics, and it ain't working for anybody. they know when they go to the gas pump, when they buy groceries life is more expensive and that's because of bidenomics. >> trace: yeah, you talk about safety and security here and the economy of course is maybe the number one topic, denise, i want to put this on. the economy clearly a top issue, which party will make america more prosperous, 53% the republican party. 39% say the democratic party. 14 points in an election year, like we were talking with jason, is a huge divide. >> it's huge. and while anything can happen in the interim, i pray to god as a republican that we -- look, let's move the election to tomorrow. >> that's right. >> really listen to james carvil who told us it's about the economy, stupid. how people feel about the way they are able to live and prosperous they are. and with biden coming out and failing epically and labeling his economy as bidenomics, it feels like americans are being gas lit. >> trace: i think that's fair. removing -- we are moving now into polls, these are battleground states. this is in pennsylvania, jason chaffetz. and you can see right now the polls show that trump has a lead over biden 47-45%. it looks close. within the margin of error, you have to consider that joe biden won pennsylvania back in 2020. >> yeah, he did. and look, senator fetterman is not doing the president -- president biden any favors. that's for sure. he has been a total and complete embarrassment. there are a lot of people perhaps voted for fetterman that are scratching their heads, why do we do that? that didn't help us in pennsylvania at all. but my warning is, democrats are better at their ground game and getting out the vote than republicans are. they may be neck and neck, getting out the vote that edge goes to the democrats. >> trace: right now they seem to be a little bit behind. lastly, you know, you look at this speaker race coming up. it 'em sos like jim jordan, it seems like steve scalise are the ones getting all the talking and former president donald trump. who do you like? who do you think? >> i like steve scalise. is he a great guy. i never worked with jim jordan in washington. i think we need -- any leader who can unify our party and really help us get the agenda americans get back on track. i am not certain our former president is going to allow that to happen. he loves to create chaos >> trace: you walk into a cvs store in the nation's capital and the shelves are mostly bare but it's not because they are locking stuff away because groups of students are stealing stuff. almost every day before and after school. jackie ibanez is live in that story and how bad that crisis has gotten among young people. >> well the district attorney in washington d.c. says he does not believe arresting young people will solve soaring juvenile crime. the city mayor there, mural becauser says tonight there are far too many young and repeat offenders out there, it's the residents who say they are often the ones left paying the price. >> go to get my prescription, when i need other things i go elsewhere. there is nothing there to get. >> i'm a little upset because this is constantly happening. >> it's ridiculous, they are going from store to store to store just stealing. >> staff at one dc, cvs dozens of kids go into store before and after school as well as late at night to steal chips and drinks among other things. managers tells fox new that they lose thousands of month from teens who fearlessly grab items off the shelves, they've banned young student from their store at certain times of the day entirely. meanwhile, in philadelphia over 70 people were arrested in a looting spree last week. some as young as 14 years old. progressive district attorney says his office will investigate if some of the rioters are fundamentally law abiding people before pursuing prosecution. and right here in new york city, according to nypd data obtained by the new york post, there has been a staggering 80% jump this year in the number of juveniles arrested for robbery alone. trace, back to you. >> trace: that is a staggering number, jackie, thank you. let's bring in reformed california, radio host and author of what is killing america, jason, thank you both for coming on. jason, the cvs store that jackie was talking about is in the nation's capital, in washington state, it's happening all over the country. and the whole concept here is there are zero consumer fences for these students and these people who come in and out. >> exactly. and they know that. i mean, that's the issue here. they are actually listening. when you hear the language that they are using in the few times that they do get caught they say aren't you going to give me house arrest? i will be out in 30 days despite the fact in some of the cases it's incredibly violent crime that they are committing. they are hearing the progressives talk about no consequences. and if you are already going down that path, the legal behavior, you are just going to continue to do that and then at some point it's going to escalate to more serious crime. >> trace: yeah, that's fair. the far left da in philadelphia said that the mass looters we saw, we saw them live last week on this program, that they would be prosecuted and now karl, he is saying this, watch. >> people who have been involved in committing crimes during this unrest will be addressed individually. we'll look carefully to see whether this is a one-off situation and fundamentally law abiding people, hold them accountable one way. >> trace: these are normally very good kids. >> how can you say as a district attorney i am going to see if a looter is law abiding, by definition they are law breaking. and that's the problem here. these kids are smart enough to understand that we have politicians that want to coddle criminals and there is no consequence for doing wrong. and what is astounding in that package you just played, the residents who are affected by the stores being looted, they have to recognize that they are paying the price. who do you think is going to pay for all those lost items? the consumer does. so, everyone in society gets to pay the price for a few bad apples, our politicians seem to send a strong message, you are going to be held accountable. >> trace: we said over and over again, they a crime against society, not just cvs. i want to play this video and listen to closely if you will, we've got words on the screen, but just watch part of this. >> trace: we know the end of the story, he was killed and the new york post writes the following, the carson alleged murderer was well known to city officials despite being 18. new york city knows a young man behaving increasebly erratically and violently is not going to fix himself. but police didn't arrest him as a lever to get him into mandatory mental health treatment. you leave him out, this is what happens, jason. >> yeah, sometimes the best thing to do is put someone in prison that's the only way they are going to get help. if you refuse to do that because of aid long campo significance that views it inherently racist. this is precisely what you get. how many more stories like this do we need for folks in these cities to wake up and say enough is enough. how many people have to die. give me that number because we can ignore the stories until we get that number of dead bodies and move forward. it is getting depressing and disgusting. >> trace: tell us the number that can come over the border and killed before anything happens and we can all work together. lastly, others, the la city council motion, this is to make sure that businesses keep carrying cash, others may not be able to participate in the formal banking system or excluded from that system against their will barring the use as a cash of payment method means excluding too many people. they don't -- it was like the opened georgia thing, they don't have id's. >> to jason's point, how many more have to be killed, how many more losses have to be suffered before this crime wave to be responded to by our leaders. this law passed in los angeles, ties the hands of small businesses because the small businesses are going to credit cards and debit, they are not doing it because they want to push away business, they are doing it because of necessity, they can't have cash because that makes them a target. so, what the los angeles politicians are doing is they are once again passing another law to make it easier for criminals to attack these business he. we are still going in the strong direction so to jason's point, apparently a lot more has to happen before we hit rock bottom. >> trace: coming up, a stunning reversal in a pennsylvania school walkout and community member spoke out, the school board passed a controversial bathroom policy this week that requires students use bathrooms based on their sex at birth. >> if you can't control vaping, smoking, drugs and everything else in the bathrooms who is going to monitor that? who is going to protect those in the bathroom from those who don't belong in there? >> how did we get to this place we are all supposed to pretend the only way you know if i am a female is to give you my pronoun. >> weeks ago the school board voted against the policy that requires students use bathrooms based on their sex. a father posted online about his daughter being disturbed by someone she thought was a boy in her bathroom. so, on monday night the board voted 5 to 4 which prohibits transgender sound byte. watch. >> i believe it had to do with all the students, students voicing their opinion, that was huge the student walkout that day. i mean, that and community members coming through and talking at the board meeting, voicing their opinion. >> trace: and jenny, sometimes you have to fight and sometimes when you fight you win. >> right. absolutely. sometimes have you to walk out and stand up for what you believe in and that's what these students have done. and courage is contagious i think we are going to see more students standing up and speaking up and walking out. we are going to see similar results. unfortunately the adults should have done the right thing originally. why do the students have to lead the away. protected, young womens spaces, protected young womens opportunities when we talk about womens sports. and certainly protected the emotionally vulnerable children who are susceptible to this gender ideology. and these same school district that have these policy with bathrooms have similar policies when it comes to gender support plans and those plans and those secrets that the districts are keeping from parents that needs to so, too. >> trace: yeah, jessica, why are kids having to fight for things parents think is preposterous. 2024 election nears. the federal government believes that the threat of violence in major civil disturbances around the 2024 u.s. presidential election is so great that it has quietly created a new category of extremist it seeks to track and counter. donald trump's army of maga followers, the problem here, yeah, jessica, the problem here they are not just going after the maga -- they are going after parents, they are going after anybody they believe doesn't share their ideology. >> that's right, trace. this is a growing trend from biden's doj that he begins to define any political group he disagrees with. first it was parents calling us domestic terrorist, going after pregnancy resource centers after the historic dobbs decision. now we see that we're targeting any of these maga supporters, i'm one of them, someone that wants to put america first and put our families and our economies first and all of a sudden we are a terrorist. all of this is a trend line directly from the doj that has weaponized the governance against conservatives and every day normal average americans like you and i. this is only going to change when very a change in washington. unfortunately i think this is going to get worse as we near november election next year. >> trace: and one of the reasons parents are fighting so hard because they don't believe their kids are getting what they need in education and this kind of goes to that point. this is new york, new york city test scores roughly 50% proficient on reading, math exams. in the juno empire they write state wide test scores shows alaska school students still struggling. 200 maryland public schools, 5% or fewer students scored proficient in math. it is prevalent across the country, jenny and it is not getting better. >> right. the news that we didn't hear about new york is they had lowered the standards, they lowered the bar and still students are struggling. so, parents need to be vigilant, they need to be asking their teachers is my child on grade level when it comes to reading and math. if not why. and what are you going to do. sometimes these test scores seem too far removed from our individual child that we immediate to know how our child is doing and address learning loss and get students caught up. >> trace: is the whole truth is, she is right, you cannot continue to lower standards in hope that proficiency goes up. >> yeah, you know one of the things i think everyone learned as a country from covid is that parents have so much control and oversight over their kids' education. it's when we stand up as parents and basically take back the agency of our kids schools and say, no, we are going to have a say in what they learn, taught the abc's, we don't want them indoctrinated, in difficult, dangerous situations. when you have parents like this great story in pennsylvania, fighting it here in virginia, when have you parents stand up, on behalf of our kids you actually cause the school boards and the teachers to go back to their original intent which is to teach our kids. >> trace: i should never know the ideology of my child's teacher. it shouldn't happen. they should learn to read and write, let's move on. the united auto workers strike may see call a pay raise, the biden administration's push toward electric vehicles could put them out of a job down the road. kevin cork is back live with the latest on this, kevin. >> trace, think about it for just a second, you know all the parts and the accessories that an internal combustion engine would use. oil filters and various coolants, obviously people make them and cars that rely on them are made right here in this country. so, it's against that backdrop that striking auto workers say they need more money now and as you pointed out more job protections later. so, far the standup strike against the uaw against detroit's big three automakers appears to be working results in $3.95 billion in economic losses in just the first couple of weeks. warning the president that the green agenda being pushed by the white house including ev's, will eliminate their jobs entirely. now that may or may not be true. they are warning they have to have someone to look out for them, that could be hybrid technology but they need something, trace. >> trace: is this is not the first strike you have covered. joe biden joined the auto workers supporting their pay raise. the question you have, is he moving the needle at all in this strike? >> that's a good question. i think the short answer is not really. by the way, he said they deserve a lot more than they are getting from the big three automakers. i think the real issue here, trace, at some point the em past, less than the 40% figure. for automakers moderating again, the green vision for the future. >> trace: you talk about the green future, automakers say the green mandates. they have incentives to make more of this there is a catch 22. >> you are so right about that. people say will they ever sort of make an adjustment. i don't think that is likely, what is happening right now, you point out, trace, ev arms race among automakers all over the world. longer lasting batteries, faster charging times, that means the green future with respect to ev's and cars like them is here to stay, how quickly can if you live in texas, there is no state tax. that's quite a benefit i think to everybody who lives there. and you know, they do have property tax. i think it's on par or less than california. and but it's a great place to do business and it's a great place to invest. and texas used to have a really good film incentive program going on down here. we made great strides, george lane who shepherded me through the process. it's time to bring it back. >> trace: i want your take on this, george mead, what do you think the movie industry moving part and parcel down to texas? >> we're advocating pore policies at the legislative level to offer incentives to big film making production companies to choose texas, not new mexico, not oklahoma, not louisiana, we want to take advantage of all this out of state money to grow texas jobs and economy, that's what he and i have been working on almost six months now. >> trace: i want to put this up on the screen, then you can tell me what it is. texas cost of living versus california. the cost of living california 48%. before taxes compared to about 59 grand in texas. average residents spend 5.4 less in texas than in california. these are big differences, dennis. >> yeah. it's pretty big. texas is, you know, done a great job of taking care of its citizens, too. making things friendly for business down here. and i used to do a lot of films in texas. i probably shot nine of my 150-200 films in texas. great crews. really good environment. but it's left to the past 8, 9 years and time to bring it back. lost it to other states that do have state -- income taxes. and they've done it with tax incentive that way. >> trace: is it beneficial, george, quickly, for you to make a movie down in texas than maybe other states? >> look, not yet. the incentives aren't in place right now. it's sort of like putting the cart before the horse. you wouldn't want to spend a lot of money in texas until a sustainable program is in place for film. dennis and i are advocating to state wide elected leaders in texas to grow the film industry here and make texas the film capital of the world. >> yeah, we were able this last session to raise that from 40,000,000 to 250,000,000 which is quite a leap from what it was. we would like to grow that. you know, these incentives wouldn't be like being a government handout. we are doing this towards really private industry, taking over on its own. >> trace: let me just put this up on the screen, i know you want to put this. dennis quaid "fallen" it's a gospel album, dennis. tell us why very quickly, why a gospel album? what's the change here? >> well, it's called "fallen" a gospel album for sinners because i wanted the biggest audience possible. songs i grew up with in church and i wrote like five songs for it myself. and it's -- you know, it's that -- mirrors my life and my journey, kind of got that outlaw, good baptist boy at the same time. i hope people relate to it. >> trace: i
